2012. Deputy Secretary for Public Safety, Liz Glazer, requests a review of New York’s Proba@on and ATI system.

New York has a strong proba4on and ATI system.

ü Between 2002 and 2011, the percentage of adults on proba@on who were rearrested declined 31 percent. ü New York has a robust community of ATIs, who have largely been successful in reaching and trea@ng clients with a high risk of recidivism.

Looking forward

New York state and coun@es spend $280 million each year to supervise 117,000 proba4oners.

When proba@oners fail on supervision, New York state and coun@es spend approximately $100 million on jail and prison costs. ü  More than one out of every six (17 percent) adults admiSed to prison commiSed a crime or a condi@on viola@on while under proba4on supervision.

ü  Approximately 6,100 proba@oners were resentenced to jail in 2011 because they commiSed a new crime or violated condi@ons of proba@on while under supervision.

ü  In New York City, 80 percent of proba@oners successfully completed proba@on; proba@oners in the rest of the state had a 65 percent success rate.

Looking forward

New York statutes require proba4oners to be supervised longer than many other states: ü  Felony proba@on terms are fixed at 5 years in New York. Other states typically give judges discre@on to set terms between 2-­‐5 years. ü  Misdemeanor proba@on terms are fixed at 3 years in most cases, 1 year in others. Other states set terms of 6 months to 24 months.

New York’s longer proba@on sentences @e up proba@on supervision resources on individuals long a`er they are likely to be rearrested.

2. Eliminate PSI Requirement for cases facing 1 year or less BACKGROUND

PROPOSAL Eliminate the mandate that PSIs must be conducted whenever someone is facing a jail sentence of one year or less, but ensure the court s@ll has the op@on to order a PSI when it is appropriate.

PROPOSAL Require coun@es to develop swi`, certain graduated responses to hold proba@oners more accountable and provide them the authority to address non-­‐compliance. > For certain sanc@ons (in-­‐pa@ent treatment, house arrest, curfew, 1-­‐3 day jail stay) establish an expedited process to allow proba@on and the court to respond swi`ly to noncompliance. > For other sanc@ons that are more restric@ve (GPS, incarcera@on, extension of proba@on terms, within 90 days), follow standard VOP process (i.e within 90 days).

IMPACT Strengthen proba@on and contribute to reduc@ons in reconvic@ons.

4. Reinvest and Improve ATIs/Risk Reduc5on Programs Intensive community-­‐based services are not always available for people who might otherwise be incarcerated (i.e. felony cases) or who would benefit from these services (i.e. higher risk cases).
