Councilman: City did not test for soil fungus before beginning grain elevator demo By Kevin Kane • kevin@youarecurrent.com Councilman Eric Seidensticker says he has received confirmation the area on which the grain elevator sits was not inspected for a potentially-dangerous soil fungus prior to the start of demolition work. The question was raised earlier this month when Holly Anderson, the manager of nearby Club Canine Doggie Daycare & Boarding, e-mailed Mayor Jim Brainard and other city officials requesting demolition work be stopped and postponed because of what she called short notice, and the affect the work could have on the business. Eventually, members of the local media were copied on the chain of e-mails that began questioning if the demo site had been tested for histoplasmosis – a soil fungus commonly found in the state that can be harmful to humans and animals. In the series of e-mails, Brainard said, “An inspection was done about 30 days ago by an environmental consultant, and the consultant indicated there is no environmental risk.” Councilors Seidensticker and Carol Schleif were among a group of the e-mail’s recipients who asked to see the report to
verify this claim. Seidensticker later circulated a 2009 report he said was provided by Carmel Redevelopment Commission Director Les Olds that shows – as Seidensticker points out –the survey of the site completed by August Mack Environmental only looked for asbestos and asbestos-containing materials.
City and county work to avoid Crooked Stick lawsuit editorial@youarecurrent.com During and after a presentation by the Hamilton County Commissioners at the City Council meeting last Monday, much clarification on the issue was sought and given by both the city and Council, and dozens of other solutions were suggested. The root of the problem is a compound of various issues with the 1970s era construction and engineering techniques. The pipes in the Crooked Stick area are due for replacement in the next five years, due to the rapid decay of the metals used, the fact that one of the pipes has filled with silt and the drainage pipes’ points of entry to the pond, which are 4 feet underwater. None of this would pass muster by today’s
standards. The root of the political problem is a dispute regarding which option to fix the problem should be used, and whether the City of Carmel has agreed to pay for the work. After discussion of the two solutions suggested (routing the water through the Hall property and lowering the level of the pond by 4 feet), the officials decided the situation required further investigation by city and county engineers. Both parties have agreed to take a second look at the problem before pursuing litigation. At the end of the discussion, Mayor Jim Brainard offered some advice. “Don’t take legal advice from any engineers, and don’t take engineering advice from any politicians,” he said.

To this, Brainard replied, “The environmental firms, in order to get state permits, look for all environmental hazards, including histoplasmosis. Asbestos is the usual problem and is always first on their (workers’) list, but they checked for all hazards, and we are fine to proceed.” However, Seidensticker later said he personally called August Mack, and a contact with that company told him Brainard’s statement is not correct. “Their (workers’) scope of work only included asbestos and ACMs,” Seidensticker said in the e-mail. “I do not believe moving forward with this demolition project is in the best interests of the people’s health and safety. The consultant did not check ‘for all hazards’ and I don't believe we ‘are fine to proceed’ when we lack confirmation of the absence of an environmental concern the state of Indiana specifically speaks to.” Brainard said he, in the e-mails, had been relaying information told to him by staff members. According to the Indiana State Dept. of Health’s Web site, the fungus can cause an upper-respiratory illness, and people are at greater risk of being exposed to the spores during excavation and demolition.

New short-stay hospital to open in Carmel editorial@youarecurrent.com Franciscan St. Francis Health will open a new health facility this month that will offer both inpatient and outpatient services. The facility is designed to fulfill a role that various health care professionals in the area have been wanting for years, according to a Franciscan Alliance press release. St. Francis President and CEO Robert J. Brody said, “Franciscan St. Francis Health Carmel represents a new model in the delivery of health care. It exemplifies what we believe will be the health center of the future, which is likely to be smaller, less expensive to build and operate and more flexible in services provided.” The hospital will feature an inpatient unit, inpatient and outpatient surgical suites, a comprehensive imaging center, cardiac testing, physical therapy, oncology infusion therapy and other clinical services. In addition, the upper level will house independent practices and additional clinical and office space for the Franciscan St. Francis Medical Group. On April 28, from 11 a.m. to 2 p.m., an open house will be held at the hospital in the North Meridian Medical pavilion at 12188-B N. St.Vincent Carmel Hospital: A popular destination for expecting moms—and doctors too.
MonogramMaternity.com
There are a number of questions to consider when choosing where to deliver your baby. Is the hospital home to a top-notch medical staff? Is the environment comfortable and outfitted with modern amenities and state-of-the-art medical equipment? And, if something unexpected should happen during delivery, does the hospital have the specialists and facilities required to provide the proper care and support? At St.Vincent Carmel Hospital, the answer to each of the above questions is a resounding “Yes.” It’s why an increasing number of expecting mothers are choosing to have their babies at St.Vincent Carmel Hospital. And it’s also why more Ob/Gyn professionals have moved their practices to our new and improved facility. Three different Ob/Gyn groups – including Obstetrics and Gynecology of Indiana, Comprehensive OB-GYN and Women’s Health Alliance – all now practice at St.Vincent Carmel Hospital. According to Michelle Slayman, RN, BSN, clinical director of OB services at the hospital, it’s because of St.Vincent Carmel Hospital’s commitment to putting the needs of patients first. “All of the Ob/Gyns practicing here are very patient-focused,” Slayman said. “That’s why they selected us. Because our whole philosophy is to focus on and constantly improve the patient experience.” Slayman pointed to the recent renovations that have taken place at the hospital as a prime example. “We have been expanding and improving our space for the past several months,” she said. “We reached out to mothers, and asked them what they wanted in a maternity environment, and the result is what you see in our hospital today.”
The newly renovated maternity rooms at St.Vincent Carmel Hospital include rain showers, fine linens, etched glass doors and contemporary furniture. But the recent renovations address more than just comfort. The hospital is now home to new, private newborn intensive care (NICU) rooms that provide families a new level of closeness and comfort.
A Family Experience Right from the Start. (any start.)
“The private NICU rooms eliminate distraction and noise, helping protect both parents’ privacy as well as the vulnerable babies themselves,” Slayman said. The NICU rooms also include a sophisticated alarm management system so nurses can monitor babies when they aren’t in the room. More improvements are still to come, Slayman said. Construction and expansion of our labor and delivery rooms are under way as well as additional new postpartum rooms. “It’s about giving moms what they want,” she said. “And that resonates with not only moms, but families and doctors, too.”
You probably won’t need our new private NICU rooms. But if you do, know that the comfort of a private room means fewer distractions, less stress for baby and a lot more time for family. You get the highly specialized care you expect from St.Vincent...and the sweet moments you crave. It’s the best possible start for your baby — even for starts that aren’t what you expected. Find out how Monogram Maternity personalizes care, and get a look at our maternity suites and NICU rooms. Visit MonogramMaternity.com or call 317-582-7733 to find out more.

COMMUNITY Philanthropy Habitat for Humanity constructs first duplex project Commentary by Jeff Worrell The folks at Habitat For Humanity have really outdone themselves this time: Habitat is knocking it out of the park two families at a time. In what turns out to be a unique first-time event for Indiana is a reality due to tremendous generosity, dedicated volunteers and good stewardship of resources. On April 11, Habitat broke ground and began construction of the first duplex construction project in Indiana. A brand new residence with a left and a right side address, plus garage, will provide shelter for two families. Once settled inside their new safe, decent and affordable home, the families can learn to live, love and grow, just like their fellow homeowner neighbors. Salin Bank donated the land in an established, well-kept Carmel neighborhood. Because the homes in the area tend to primarily be duplexes, organizers decided a duplex should fill the empty lot. Rhett Cecil, CEO of Habitat for Humanity of Hamilton County, says, “We are known for single-family, modest one-story homes. But in this neighborhood where the land was, our normal model would not work. So, we adapted our plans to fit the personality of the neighborhood.” As you may know, to become eligible for a Habitat Home, sweat must be contributed in order to earn equity in the house. Thus, sweat
equity from every partner family is a must, and although ground has just been broken, both partner families are almost totally invested. Richard Carriger of Carmel United Methodist Church enjoys working alongside the partner families from the planning process through construction. He said, “I get a huge payback from the families. It is very rewarding.” Carriger serves as head of mission work for Carmel United Methodist. His church, along with St. Mark's United Methodist Church and other Methodist Hamilton County congregations, have taken responsibility for one side of the duplex. Northview Church stepped forward and is accountable for the other side. Together, the church community will see to it $130,000 is raised, hammers pound, saws cut and tape measures measure. It will take more than 600 volunteers working during the next 12 to 13 weeks until finally, on the last day, two sets of keys will go to two families to unlock a new chapter in their lives. I promise to keep you updated on the progress of this magnificent project during the next few months. If you would like to get involved, contact Cecil at 896-9423, ext. 1. Kimmel to host Joshua’s Ride June 24 editorial@youarecurrent.com When Keith Kimmel and his wife went to the doctor’s office for a sonogram at 19 1/2 weeks, they “had no idea (they) would be blessed with a ‘Riley Child.’” At the time, they were informed their unborn son’s abdomen hadn’t closed. Although it did close while still in the womb, he had a very large bladder, so they were introduced to Dr. Mark Cain, for whom they are very thankful. Their son, Joshua Kimmel, was born at 6 p.m. on a day when Cain had been in surgery from 6 a.m. until 8:45 p.m. when he met with the Kimmels. “He helped calm us down, reassured us Joshua would be OK and told us to just focus on loving our son,” Kimmel said.
Since then, Kimmel has hosted two events on the Monon Trail in the Carmel Cyclery parking lot called Joshua’s Ride, and has raised more than $13,000 for the pediatric urology department at Riley, which is made up of the only five pediatric urologists in the state. Joshua’s Ride isn’t a usual charity ride, though. Rather than focusing on local athletes to complete a race of some sort, it’s billed as a “family day on the Monon.” In the parking lot, there will be a bounce house, a fire truck for kids to poke around in, a reptile show run by “Steak Head Ed,” a retired middle school teacher, live music and a silent auction for the adults. People are encouraged to walk or ride the trail during the event; a short course is set up for smaller children. The event is on June 24.
Student publishes findings on use for cat odor editorial@youarecurrent.com Matthew May, a recent Indiana University graduate and Carmel resident, just had a paper accepted for publication by the university. His study found the chemicals released in cats’ scent rubbings elicits a defensive response in rats. The rats in the experiment were reluctant to travel toward food that was near the
scent, even when hungry. While these scent rubbings are used by cats to communicate territory and ownership to each other, this study shows prey species will “eavesdrop” on the scent markings to identify areas predators frequent. May is working on isolating the compound that elicits the response in rats in order to develop an environmentally-friendly rat repellent.

‘Rock's’ Military Record
H. J. "Rock" Effron in his office at Key Bank, Overlook , surrounded by children's art and personal photos.
Army veteran H.J. ‘Rock’ Effron fights for camaraderie at KeyBank, within community By Darla Kinney Scoles • editorial@youarecurrent.com Do an online search for the word “patriot” and the definition provided will be “a person who loves, supports and defends his or her nation and its interests with devotion; one who thinks not of himself but of his people, and is willing to put him or herself on the line for those ideals and to better society.” Ask the friends and clients of KeyBank, Overlook's office relationship manager to point out a patriot, and they’ll most likely point right to H.J. “Rock” Effron. In his position as relationship manager there – and as a lifetime member of the Carmel American Legion – Effron has made many fast friends and done much to help the Carmel community. A peek inside his cubicle reveals his dedication to the younger customers who enter the branch, as the walls are lined with coloring-book art, autographed and dedicated to a man who took the time to give some financial advice to pint-sized investors. “I love doing this,” shared the 60-something-year-old Effron, who helps open new accounts and works with businesses in procuring loans and lines of credit. “I deal with a myriad of people all the time, from all walks of life, and it’s great. I still have the first drawing I received and photos from that family during the years. I like marketing to the young kids. Every one of them gets a star.” One of Effron’s adult customers thinks Effron is a star. 10 | April 17, 2012
“I am fortunate to be among those who are greeted by KeyBank, Overlook's Mr. Customer Service – ‘Rock’ Effron," stated Dr. Jan Battenberg. “For five years, I have continued to drive a little farther from home than need be to do my banking with ‘Rock’ and the Overlook competent and friendly staff. An acquaintance of Effron said Effron represents the patriotism the nation needs from its citizens. Himself an Army veteran, Effron is involved in the Carmel American Legion Post 155, where he fittingly serves as finance officer – raising monies through events such as golf outings and Texas Hold‘em tournaments – all to benefit the Lafayette Soldiers and Sailors Home, scholarships for children of deployed servicemen and women, homeless veterans and children in need during Christmas.

Effron, married 22 years to wife Carole, has also served in his homeowner’s association, the Chamber of Commerce and as a Career Day mentor to high school students. “My biggest push right now is to get the younger vets to join the Legion, to let us help them. A lot of us are disabled vets and have helpful information for those coming home now,” said Effron of another effort dear to his heart. “We invite any and all vets to come see us. We can offer a lot of support, especially in acclamation and benefits. We take care of those who took care of us.” Effron, who loves riding his motorcycle almost as much helping others, has a soft spot for the underdog that drives most of his community efforts. “I believe in fighting for the rights of others,” shared Effron. “I hate to see people being taken advantage of. I can’t put up with that and cannot stand people being used. I get up every day and try to help one more person. If I do that every day, I’m doing well.” An acquaintance of Effron believes Effron's service to the nation hasn't stopped, even after his time in the Army. With Effron's passion, he inspires others to join in the mission to help make life better for others. “Family, God, nation. That’s all there is,” said Effron. “It doesn’t get any better than that.” www.currentincarmel.com

Editorial And now, a few words from the ‘traffic ‘copter’
Chilling effects It is our position freedom of speech is not only a right, but a privilege. The general public has access to the widest array and farthest-reaching communications tools the world has ever known. It seems lately the First Amendment is getting quite a workout. Recent events such as a Marine being discharged for using his Facebook page to de-face the President, a high school student being suspended for tweeting profanities allegedly with school property and Arizona recently passing a law making “annoying” and “offensive” online speech illegal, has made many wonder if our right to free speech is in jeopardy. Are these events truly examples of the chilling effects of expressing one’s opinion via social media, or are they a chillingly realistic window to behavior in a modern day society? James Madison authored the First Amendment with the intent of granting power through liberty, a privilege thought to be a necessity for the safety and happiness of the people. John Milton argued an individual is capable of using reason and distinguishing right from wrong, good from bad. If they had a crystal ball, would our forefathers have written amendments for linguistics and manners into the Bill of Rights?

Image builders Commentary by Terry Anker With the advent of digital cameras, the world of memory preserving has changed immensely. Time was that we all made judicious use of the expensive and often temperamental film employed to record our important vistas and milestones. Now, we can shoot thousands of shots. Virtually unrestricted by incremental cost, once we invest in the camera, the photos are free. My computer and telephone are filled with scores of images; and, my screensaver takes me on a halcyon journey with the progression of each photo from my collection. Yet in spite of all the advantages, I miss the tactile nature of developed prints. Even while most general retailers can produce the pictures for pennies each, we routinely fail to have them made. Add it to the list of good intentions – we plan to print and share, but are daunted by the effort required to review 100 pictures to find just the right one. Is it a basic tenant of human nature to col-
lect – even hoard – all manner and sort of object or experience, and yet never commit the time to fully enjoy them? Perhaps it is simply the urge to accumulate that stimulates us. Whatever the root our desire to build a personal stash of our favorite things can, in itself, become an addiction. But even if we manage to control the urge to overstuff our homes and our lives, we still have to find time to enjoy those things we have collected. As a boy, I was amazed by people who had all the toys and times I thought I needed in my life. Yet, they would let them sit unused and unenjoyed. Like many things with the passage of time, I have come to realize it is more complicated than once thought. Terry Anker is an associate editor of Current Publishing, LLC. As the U.S. 31 Freeway Project now is under way with quite a fervor, we urge motorists from Boone and Hamilton counties to exercise extreme patience – if not a little ingenuity – in dealing what many already are calling “the three-year mess.” The finished product, we believe, will be worth the wait and certain hassles. Further, it isn’t a mess; it’s progress taking shape. We have opined in this space before on the positive aspects this project will deliver. To get to the good, we must find a way to sanely endure the “ugly,” and that means finding ways around snarled traffic, keeping your cool and allowing plenty of extra time during peak commute hours. A customary 10-minute drive last week took us more than 25 minutes. Patience! It will be worth it in the end. “Coping skills” may be found at us31hamiltoncounty.in.gov. Current will provide updates in the paper, on its Web site and on Facebook and Twitter. We pledge to help you all we can. ••• Saturday brings the second running of the Carmel Marathon, of which Current is a sponsor. Participants, including those from here, Indiana, most of the nation and nations abroad, are bringing not only their talents and determination, but also their wallets. Hotel rooms have been booked for months, and the local economies should enjoy a bump-up on the bottom line. That’s the good news. The “other” news is the event will cause traffic disruptions for a short while, so anyone in, or passing through Carmel is urged patience while the races play out. Basketball: A first political priority Editor, I am so pleased to see how busy Sen. Mike Delph (R-Carmel) has been by introducing a bill in the General Assembly and conducting statewide hearings on a single-class basketball tournament. One would think participation in
the endless quest to move Indiana even further to the right on such issues as abortion, creationism, gay marriage and immigration would take up all of his time. Attaboy, Mike! Jim Donahue, 46032
Kindergarten: Does one size fit all? Editor, Research shows the quality of a program is more important than the number of hours spent in kindergarten. If you have had doubts about squeezing your square peg of a child into the round hole of all-day kindergarten, or if you have confidence your child will be ready for first grade without a full-day kindergarten, consider the alternatives available. State law doesn't even
require kindergarten, let alone require children to attend an all-day program. There are quality part-time alternatives, so be sure to consider what's best for your child. Driving down to New Orleans Laughs by Danielle Wilson When my Louisville Cardinals made it to the Final Four in New Orleans, I joked with my husband about going down for the game. The following evening, after Kentucky earned its own ticket, the joke turned into something real. University of Louisville versus University of Kentucky? With the winner going to the national championship? That’s a no brainer. So I emailed my dad and sister, both Louisville alums, and discovered I could have a hotel room floor and a driving partner if I wanted. I WANTED. I quickly called Doo, in Alabama on business, to inform him of my plans. He whined at being excluded (even though he’s an Indiana University fan) and spread the guilt on thick enough to smother any simple plan of getting to the game. Luckily, I am the Queen of Logistics Miracles and quickly set to work to devise a way for us both to go. Despite single-parenting, working full time and driving to/attending an inordinate amount of practices and concerts, within three days, I’d located a sitter (a longlost cousin who happened to have nothing going on that weekend), organized a place to stay (a different cousin’s boyfriend’s parents’ house) and painted “Final Four, Baby!” and “Cardi Gras Bound” all over the minivan. Thursday night found me heading south to collect one
sister from the Mega-Bus stop in downtown Indy, one from the Ville and an engaged couple whom I’d never met but had promised to pay for gas. The next 38 hours were a whirlwind of emotion and activity. When you take the Battle of the Bluegrass to Bourbon Street, things get crazy quickly. My sisters jammed with an old guy for 30 minutes before they realized it was Jimmy Buffett. A Kentucky-clad Doo talked Bobby Knight into taking a photo with him. And, I fell victim to hormones and fatigue resulting in an all-out brawl with Doo in the valet lot of the Cardinals' hotel that ended with me crying myself to sleep and Doo drinking all night with our Katrina-survivor host. I also had a hurricane shutter fall on me, met an Irish-mafia vampire and almost missed tip-off awaiting the arrival of my ticket-toting inebriated sister who’d lost track of time in the French Quarter. Louisville lost, and the 14-hour drive home was so not fun. (Damn you, construction!) But I crossed off a bucket list item, and for me, that made the madness worth it. Peace out.

Outsmarting the smartphone Laughs by Mike Redmond I just got a new smartphone. It does everything – manages my e-mail, keeps my calendar, gives me driving directions, downloads books, sends messages, does my taxes, walks the dog and cooks breakfast. So why am I not deliriously happy? Is it because I’ve been up late the last three nights trying to figure out how to perform this phone’s simplest tasks, such as finding the button that turns it on? Is it because it is a touch-screen phone, which kind of gives me the willies because I can’t stand fingerprints on shiny surfaces? Yes and yes. But there’s more. It appears the phone may be smarter than its owner. There may be no limit to what it can do, but the same cannot be said of the owner. Now, lest you get the wrong impression, I am no Luddite, no Flintstone. I embrace the changes brought by modern technology. I love my computer and my cable TV and my cell phone. Well, maybe not so much on that last one. Part of that is because I am a guy, and guys are easily distracted by shiny things that make noise. This explains cars, stereos and shotguns. But there’s more. I have doomed myself to a lifetime of frustration. The quickening pace of technological

advancement also accelerates the pace of obsolescence. As soon as you buy the newest, fastest, most powerful thingamajig, an even newer, faster, more powerful one becomes available. That’s the problem with trying to keep up with technology: You can’t. You start to ponder this stuff and inevitably, the questions begin: Do I need 1,000 channels of TV? Do I need to be available to the world 24/7? Do I need a computer to do what I used to do with a typewriter or, before that, a pen and paper? But about this new phone: It really is a marvel. Not that long ago, it would have required a Univac machine the size of your living room to do all the stuff that now can be done with a gizmo that fits in your hand. In time, I’m sure I’ll learn to use my phone properly, to exploit its full technological value. I’m sure it will be wonderful. And I’m just as sure as soon as I do, someone will come up with something faster and more powerful. But that’s a problem for another day. Right now, I’d just like to know how to get the silly thing to make a phone call. Mike Redmond is an author, journalist, humorist and speaker. Write him at mike@ mikeredmondonline.com or P.O. Walk in my shoes! Laughs by Dick Wolfsie Mary Ellen and I live in a subdivision of homes built around a small lake. It is exactly a one-mile stroll to circle the neighborhood. But what should be a pleasant and invigorating jaunt each evening turns into a humiliating 20 minutes for me. Not for Mary Ellen. That’s because it takes her only 15 minutes to complete the trip. I’ve always been a very slow walker. The day we got married and headed down the aisle, I ended up having to break into a full gallop so we’d reach the minister at the same time. If Mary Ellen were an understanding wife – and not simply an Olympic fast-walking athlete – she would have the courtesy to double-back every few minutes and loop around me. This would prevent the entire neighborhood from hearing a senior citizen yelling “Wait up!” The big reason I was originally attracted to my wife was her long, slender gams. But this is how short-sighted and impulsive men can be. I wish someone had said to me, “Sure, she has gorgeous legs, but 30 years from now, you’ll be a quarter mile behind her by the time you get out of your cul-de-sac.” I’m so unhurried in my pace even my 11-year-old arthritic, overweight dog has to turn around every 20 seconds to see

where I am when we walk in the woods. I’m a little tired of that “Are you coming, or not?” look on his face. But at least Toby is checking to make sure I haven’t had a coronary. I wish Mary Ellen would be as concerned. Sometimes, just to feel loved and wanted, I’ll hide behind a tree to see if Mary Ellen will notice I’m no longer anywhere in sight. But in a residential area, men hiding behind trees are frowned upon. I tried to explain this once to the police officer who was summoned by the neighborhood crime watch. You know you’re in trouble when the officer keeps writing down the word “lurking.” Because of the beautiful spring weather, the indignity has begun earlier than usual this year. Mary Ellen is in her fitness mode and she refuses to slow down her gait to accommodate me. She suggested we head in opposite directions around the circle, claiming no matter what pace I walk, we will still pass each other at exactly the same time. Huh? Someone needs to explain that to me. I’m a little slow.

DIVORCE – WHAT TO EXPECT: PROPERTY DIVISION
In Indiana, courts divide a divorcing parties’ property in a manner which is deemed to be fair and reasonable. Indiana law follows the “one-pot” theory for the division of marital property, which presumes all marital property is put into one pot and that a fifty-fifty (50/50) division of all marital assets and liabilities is presumed to be fair and reasonable. However, there are various factors Courts consider in determining whether or not a deviation from the equal division is warranted, including: the contribution of each spouse to the acquisition of property; the economic circumstances of each spouse at the time of the disposition of the property; the conduct of the parties during the marriage as related to disposition or dissipation of their property; and the earning ability of the parties. Thus, while an equal division is presumed, one party can request more than fifty percent of the marital estate. What is Marital Property? It is important for parties to understand what is considered marital property as many people believe certain assets or accounts remain separate from the estate. This is often incorrect. Absent a prenuptial agreement, excluding certain property from becoming part of the marital estate, Indiana law presumes that all assets and debt brought into or acquired during the marriage is marital property and is subject to division by the Court. That being said, one may argue that certain property or liabilities should be allotted to one party in the division of the estate. An example of a liability remaining with one party would be a student loan.

Such a determination is very contextual and seeking legal advice is recommended to determine if such a request is supported by the facts of a given case. Each case is unique and the decision to exclude property is left to the discretion of the Court. Naturally, there are certain issues which arise more often than others and therefore, more Court decisions regarding the treatment of such property in dividing the estate. This gives parties guidance on what may be expected after a hearing on the given issue. Further, it is important to note that any property which is acquired after the date of the filing of the Petition for Dissolution of Marriage may be considered property which is separate from the marital estate. The division of each marital estate requires the work of the parties and counsel to reach an agreement which works best for the family. Parties are well advised to seek the advice from financial planners to determine a division which will have the fewest tax consequences or negative implications on the estate. Wellness Helpful tips to protect skin outside HEALTH
Commentary by Dr. Melanie Kingsley
As we head outdoors to enjoy the warm spring weather, now is the perfect time to review the best ways to protect your skin from sun damage. It’s important to wear a sunscreen with a sun protection factor of 30 or more when exposed to the sun for an extended period. Sunscreens with zinc oxide or titanium dioxide provide the best protection and should be applied to your entire body before going outside. It’s best to reapply sunscreen every two hours or sooner if you begin developing sunburn, and remember: Do everything you can to prevent your skin from burning. Sunburn causes DNA damage to skin cells, which can lead to skin cancer, as well as wrinkles and other damaging effects. In addition to good sunscreen, there are hats, beachwear and protective clothing that have ultraviolet protection; look for “ultraviolet protection factor” on the label. Even if you are only exposed to the sun for a limited time, you should use a daily sunscreen. We are exposed to harmful UV rays while driving a car, sitting by a window or walking from the car to our destination. Routine exposure to harmful UV rays can lead to skin cancer and photoaging (wrinkles and brown spots). This is especially true for tanning beds. With proms and other seasonal special events right around the corner, teenagers and others are strongly discouraged from using tanning beds, which

If you are already showing signs of photoaging, using a daily sunscreen, as well as topical antiaging products that include retinoids and vitamin C, will help prevent and reverse signs of sun damage. Laser treatments may also be considered to help reduce fine lines and brown spots. The Fraxel Dual laser was recently approved by the U.S. Food and Drug Administration for the treatment and prevention of precancerous lesions called actinic keratosis. Eyelid surgery to fix 'sad eyes' Commentary by Dr. Barry Eppley Q: I have tired and sad-looking eyes. The outer part of my eyes has always been turned down since I was young and I have never liked it. Can excess skin be removed and remaining skin lifted up and under the eye? Can the outer corners of the eyes be lifted for “sad eyes” at the same time? A: Traditional lower blepharoplasty or eyelid tuck techniques can remove fat that causes bags, and tightens loose skin under the eyes. The position of the corner of the eye is controlled by a tendon that attaches it to the inside of the bony
socket of the eye. This tendinous position can be changed to raise the corner of the eye, known as a canthopexy procedure, making it either level to the inside of the eye or higher if one desires more of an almond-shape to the eye. This can be done at the same time as a lower blepharoplasty (or an upper blepharoplasty) through the same incision. Dr. Eppley is an Indianapolis board-certified plastic surgeon. Move the needle: Automatic leadership Commentary by CJ McClanahan You’ve just completed another 65-hour week and had the realization something’s got to change. No amount of money is worth all this stress, exhaustion and time away from family. It’s time to bring on some additional help. However, unless you understand how to lead, you may have just signed up for more work and frustration. Keep in mind leading an individual is completely different than managing employees. Anybody can send out an e-mail with a list of tasks and follow up to make certain they were complete. Anyone can manage – few people know how to lead. First, a great leader starts by understanding the “why.” Understanding the “why” simply means you need to take time to figure out what your employees hope to get out of their careers. In other words, you need to know what a perfect career looks like for each of your direct reports. How much would they (employees) like to make? What would their title be? What skills would they be developing? Before you start, it’s important to note I have asked thousands of employees these questions and almost no one has any idea what they want their career to look like in the future. You’ll need to help them stretch their horizons a little bit and get them dreaming. Next, be prepared for some of your staff to have a vi-

sion for their careers that doesn’t include you and your company. That’s perfectly normal. They were going to leave anyway – everybody does. Why not get the most out of them while they’re here? Second, once you know where your employees want to go, it’s important you set some clear expectations to help them get there. Most leaders think an annual review and sporadic staff meetings qualify as setting clear expectations. Not true. Employees are like teenagers: They do a lot of head bobbing (up and down) to our instructions, but rarely give us their full attention. As a result, you need to set and reset expectations all the time. I recommend you start weekly at a minimum. When your staff doesn’t meet expectations, you have to hold them accountable. Because holding people accountable is often uncomfortable, many leaders permit the failure to meet expectations convincing themselves “They probably won’t make this mistake again.” Don’t let that be you. Avoiding these conversations doesn’t fix the problem; it just makes it worse. As with most things in life, the solution is simple. All you need to do is execute. Commentary by John Mikesell
While most of our articles are about dogs, I think it is important at this time of year to remind everyone this is “kitten season,” a time when millions of kittens are brought to animal shelters or left to fend for themselves on the street. It’s a compelling reminder of the significant reproductive potential of pet cats, as well as neighborhood stray and feral cats. Spaying and neutering, however, can help keep cat populations in check. Not only does it prevent litters of kittens, it improves cats’ health, according to Alley Cat Allies, a national advocacy organization based in Bethesda, Md. That’s why Alley Cat Allies, along with the American Society for the Prevention of Cruelty to Animals (New York) and other organizations, advocate trap-neuter- return programs for feral cats. The name is self-explanatory: Feral cats are humanely
“Doggy dementia” – Clinically known as canine cognitive dysfunction, mental deterioration is a sad but real part of being a dog owner. Things like sticking to a strict schedule and managing your pet’s anxiety by keeping it in familiar surroundings can mitigate the disease’s effect.pets.yahoo.com
trapped, neutered or spayed, vaccinated and then returned to their outdoor homes. “Through trap-neuter-return, we are able to stabilize the population and decrease the number of cats entering shelters,” said Becky Robinson, president of Alley Cat Allies. “The cats that remain no longer undergo the stresses of mating and pregnancy.” A number of organizations across the nation support TNR programs. In New York, for example, the ASPCA rents humane traps to people who have taken a related certification workshop. And numerous clinics offer free or low cost spaying and neutering service for feral felines. Given that cats as young as 4 months can become pregnant, it is important to neuter even young animals. Remember, if your cat is an outdoor cat, be sure to have it spayed or neutered. John Mikesell, owner of Izzy’s Place, A Dog Bakery, in Carmel, can be reached at john.mikesell@att.net.

Caring for pet, nature – Pets and the environment are two hot-button topics for a lot of people. But what happens when the two meet? How do you care for a pet while also caring for Mother Nature? Things like recyclable litter and buying supplies locally for less shipping can accomplish both. - pawnation.com Getting a puppy? – If you’re considering adding a baby canine to your family, consider your babies first – waiting until your children are mature enough to help care for the dog can be a great asset and bonding experience. - goodhousekeeping.com Pet insurance? – Purchasing insurance for your pet can be a smart move in the right situation. "Pet insurance can make state-of-the-art medical treatment and/or traumatic emergency care possible for many pet owners who might otherwise not be able to afford it," says veterinarian Karen Halligan. goodhousekeeping.com

Secrets of the pyramids Commentary by Don Knebel The Great Pyramid of Giza remains the most massive structure ever built. Its base covers 13 acres and it was the tallest thing made by man for almost 4,000 years, when it was eclipsed by the spire of Lincoln Cathedral. By any standard, the Great Pyramid is extraordinary. And yet, so monumental and almost otherworldly does the Great Pyramid loom in the common imagination that many visitors to Giza come away vaguely disappointed. It is a little like standing at the edge of the Grand Canyon and not being amazed that it could have been created by flowing water because, after all, there it is. But there are legitimate surprises for people who visit the Giza plateau to see the Great Pyramid and the smaller ones nearby. For example, photographs of strategicallyplaced visitors approaching the Giza pyramids on camels help maintain the illusion the pyramids are far out in the desert. They are not. Giza is right next door to Cairo, a sprawling city of 17 million people. Another common misconception, fostered by late-night movies, is the pyramids were built by thousands of slaves led by bare-chested Egyptians wielding whips. The pyramids were almost certainly built by paid workers, perhaps including farmers during the off season.
Compounding Pharmacy We bill insurance on all compounds. Great cash prices for regular medications.
People visiting Egypt are surprised to learn the art of building pyramids was at its pinnacle near the beginning and went downhill from there. The largest and most complex of the true pyramids, the Great Pyramid of Khufu completed in about 2560 B.C., was also one of the first. The 100 or so pyramids of subsequent pharaohs were less impressive. The pyramid of King Teti, who died in about 2300 B.C., is little more than a pile of rubble. As witnessed many times in history, continued progress of civilization is never guaranteed. Don Knebel works for Barnes & Thornburg LLP. You may contact him at editorial@youarecurrent.com

Technology My e-mail account is sending spam! LIFESTYLE
Technology by Ken Colburn
I have had people tell me they have been receiving spam e-mail from me. I have changed the password for my account and the spam is still being sent from my account. Do you have any ideas as far as what might be causing this? - Andrew The two most likely possibilities are your email account has been compromised or you are simply the victim of the age-old “spoofing” tactic that’s been around since the early e-mail days. If you are able to change your password, that confirms your account hasn’t been taken over, but it doesn’t mean it wasn’t compromised at some point in the past. When you get locked out of your own account, you’ll know someone is engaging in some nefarious activities with your account. If you’re hearing from a large number of people about the same spam message, your computer might have been compromised at some point, or you could still be infected with a silent malware program. The first thing to do is change your e-mail password from a completely different computer just in case your computer is infected, or the malware tracking program will know what your new password is as well. The second thing to do is have your computer scanned by a security program that isn’t already installed on your computer, as it could also be

compromised. If scammers can trick you or anyone that uses your computer (like children) into clicking on malicious links or inadvertently installing a program that allows them to overtake your computer, your security program will be the first thing they go after. Another way they can gain access to your email account is if you access your account from another computer that has been compromised, or has a tracking program running silently in the background, which is why it’s never a good idea to access your e-mail from a public terminal. To properly check your computer, you really need to get “a second opinion” from a completely different program that could not have been compromised in an attack. Microsoft Safety Scanner can be used as an ondemand scanner if you suspect you are infected. In our service centers, we take an additional step by booting to a special CD/DVD or flash drive, so any potential malware can’t activate from an infected hard drive. If the problem is bad enough, you may want to consider getting a new e-mail address and notifying your friends so they can block your old address.

Spirituality The saltiness of a dogged Christian Don’t Be a Drag! LIFESTYLE
Commentary by Bob Walters
“You are the salt of the earth …” Matthew 5:13. “Salt of the earth.” I always thought that expression meant “common” in a good sort of way; it was a compliment to one’s overall usefulness and humility to be called a “salt-of-the-earth” type of person. Turns out, it is a compliment, but not in the secular (non-God) way I had imagined. Like so many Biblical words and phrases, “salt” has more than one meaning. In this verse of the Sermon on the Mount – Chapters 5, 6 and 7 in the Bible’s Gospel of Matthew – Jesus tells his disciples that, just as salt is an indispensable necessity of life, they, too, are indispensable to the real life – the eternal life – of humanity’s New Covenant with God. What salt does for food, the disciples were enjoined to do for the Kingdom of God. “Salt” is a preservative that prevents spoilage – it “saves” food. As a seasoning, salt enlivens the taste of food. It would be the disciples’ role going forward to share their life in Jesus with the whole world, to be the salt of Jesus’ ministry. Jesus isn’t the salt; Jesus is the life. It’s we Christians who are to be the indispensable salt for the Kingdom of God; to preserve and enliven the truth of Christ for the world around us. Salt also covers over the taste of tainted food – think “my sinful life.” And, salt is a cleaning
WHAT IS DEBT SETTLEMENT? Debt Settlement is when you pay off debt at a reduced amount, often at 50% or less. WHO IS THE BEST CANDIDATE FOR DEBT SETTLEMENT? A small business or individual with $30,000 or more of unsecured debt, who has a 401K plan, an inheritance, or a lump sum distribution; as approximately half of debt amount must be set aside in escrow to settle debt when agreement is reached with the creditor. WHY DO I NEED AN ATTORNEY? WHY CAN’T I DO IT MYSELF? Most of the time creditors will not negotiate with individuals, or debt settlement companies. They will ask an attorney for a “power of attorney”. An attorney locks in the terms, so that the creditor cannot change them and try to collect more interest or fees later. An attorney can also protect you in the event of a lawsuit occurring while negotiations are ongoing. WHAT ARE THE RISKS? There is a risk of a lawsuit occurring before the debt is settled, which is usually avoided by using a LOCAL attorney. Also one’s credit score could decline while negotiations are taking place.
component – think “the cleansing power of Jesus’ blood.” I truly never understood the importance of salt in world history until an article showed up in my e-mail a couple of years ago noting most early wars were fought and wealth was won over salt. Whether it was access, ownership or trade routes, salt drove commerce because it was both a multipurpose substance and the only way anyone had of preserving food. As for discipleship salt, I recently finished reading “Bonhoeffer: Pastor, Prophet, Martyr, Spy,” Eric Metaxas’ superb 2011 biography of German theologian Dietrich Bonhoeffer, who was executed late in World War II by a defeated and bitter Adolf Hitler. Now, I’m reading Bonhoeffer’s 1937 theological classic, “The Cost of Discipleship,” which goes into some detail regarding the Sermon on the Mount, salt and much else. Bonhoeffer, who lived a full, determined and exemplary – if shortened – Christian life to the very end was the salt Jesus Christ called his disciples to be. If you are curious what that looks like, these books are for you. Bob Walters (www. commonchristianity.blogspot. com, rlwcom@aol.com) quotes Bonhoeffer, “… disciples are salt … whether they like it or not.”

HOW LONG DOES IT TAKE TO SETTLE ALL THE DEBT? Most of the time a creditor will not begin negotiating until debt is 6 months past due. Around Town
I’m a Carmel runner: Siegmund Haider Presented by the Carmel Marathon Championship Weekend I’m running the Carmel: Half Marathon Number of years as a Carmel resident: Three. I am an Austrian citizen and I immigrated in March 2009. Goal for the 2012 Carmel Marathon Championship Weekend: I hope to finish the Carmel Half Marathon in a little less than 2 hours. My personal best is 2:02:53 (2010). Why I started running: I was overweight (185 pounds) had a heart attack in November 2004. Running became the best cardio training. Now, at age 63 and 140 pounds, I am in better health than I was 10 years ago. Favorite place to run in Carmel: Monon Greenway. I run with: I join the trainings group on Saturdays, but most times I am my own because I am slower than other runners. I adjust my running tempo with my base heart rate. When I’m not running: I enjoy other fitness training at the Monon Center, reading, cooking,
wine tasting, traveling, being a member of the Indianapolis Scientech Club, theater, concerts (classic, folk), meetings or parties and having discussions with friends. One word to describe what running means to me: Freedom. How running/exercise has changed my life: I am in much better shape than years before. Race day lucky charm: None. I do not believe in bad luck. Advice for new runners: Take your time and don’t increase your mileage too fast. Get advice about running techniques (at Runners Forum, for example). Good running shoes are also important, the right clothing and don’t get dehydrated. Why I decided to run a race: If you have signed up for a race, you train and run more than (you do) without Haider a goal. Since I am now a citizen of Carmel, I wanted to do my first marathon in this town. I finished! And I did another marathon last year, two 5 Ks and one 5-mile (run). I trained and ran more than 1,000 miles last year.

Sunscreen Facial sunscreen is vitally important. With all the different brands and SPF levels, selecting a good sunscreen can be confusing. A good sun care product should have a combination of both sun block and sunscreen, giving you the best protection for your skin. Choosing the right balance will depend on the amount of time you will be out in the sun. As you may know, the number factor on SPFs is related to the amount of time you plan to be in the sun. Salon 01 carries Sun Grand products by Jack Black, perfect for a guy’s sunscreen needs, as well as Jan Marini’s Antioxidant Daily Face Protectant, a great sun care product for men or Women, that will help you enjoy the sunny days without worrying about skin damage.

Do it yourself … with an interior designer Commentary by Vicky Earley Think back to your first do-it-yourself decorating project. Do you recall the practical experience you gained from your successes and your mistakes? Now, picture what it would be like if you had completed thousands of such projects during a span of many years, totally immersed in design for 50 to 60 hours per week. That is the wisdom a professional would bring to your project. I would say the primary reason clients call a professional is to avoid costly mistakes. There are so many details involved in a successful project; it is easy to miss the small stuff that makes a huge difference. I recently hung up the phone from a conversation with a young lady who purchased family room furniture based on nothing other than a selection at a furniture store during a weekend sale. It has been delivered, and the scale is all wrong – a detail she never considered while buying her “deal” furniture. The room looks all out of proportion, the furniture is nonreturnable and she is sick. Although mistakes like this can sometimes be mitigated, a call at this point in time is usually too late to bring the project to the point of fabulous. Her 40-percent-off purchase just set her decorating budget back thousands. There is a huge misconception floating
around that using an interior designer will add cost to a project. This homeowner’s one experience dispels that! A good designer should always be willing to work within the client’s budget and ultimately be able to provide a much more impressive result for the money through a combination of savvy sourcing and skillful design. The best designers will work with what you already have, or be able to start from scratch. Every project is different. Unless the designer selected is totally devoid of talent, the benefits will far outweigh the cost. Just the avoidance of the one mistake can be worth the entire consultation fee! Parts of a project that have to be redone due to error are costly. The elimination of sleepless nights due to uncertainty is worth every cent of consultation billing. Working with a decorator opens up sources generally closed to the public. Also, designers have a resource list of talented labor they can readily tap into, as well as the ability to negotiate on behalf of a client.

The accidental gardener Commentary by Holly Lindzy
I don’t know why it’s taken me so long to figure it out, but I’m not afraid to say so … I’ve decided good gardening happens by accident. It stinks when you look at other people’s gardens in admiration and think you’d love to have that, but it looks like a chore! Nobody wants to voluntarily create more chores for oneself … think of the lawn alone. But it won’t hang over your head if don’t put so much pressure on yourself. It doesn’t have to be that picture out of magazine. Let it happen naturally. Here’s how gardening happens by accident: Verbally admiring a plant at a friend’s house will get you sent home with a piece of it. It’s bad luck to say “Thank you,” so just accept it, with a smile. Ask the name of it, Google it when you get home, keep the weeds away from it and fertilize … you just might get to enjoy something pretty. And have a great story. Pass it on! Part of my realization comes to me from
watching the formality of garden instruction on TV. Even though they (people on TV) totally speak my language, “cultivar” and “dormancy” … they looked so uptight and stuffy talking about it; it would never inspire me to go walk about the garden center carefree. It’s intimidating … ya know? And the infomercials and garden centers don’t make it any easier. Those people bombard you with gimmicks and make you cram your shed with useless items. My grandma gardened with a spoon and a pair of scissors. I pretty much follow suit with a soil knife and a pair of snips. It makes me think people take life too seriously, even gardening, with their gardening bibles and what not. I learned gardening from my aunt. It was the time of my life. And I’ll pass it on … hoping you do, too. Holly Lindzy is an Indiana-accredited horticulturalist and advanced master gardener residing in Noblesville. E-mail your gardening woes (or wisdom) to hollylindzy@gmail.com.
Take care of your lawn – Doing things such as removing thatch with a rake, aeration, using extra fertilization where roots compete with grass and watering for a long enough period of time are somewhat common lawn care techniques, but often are overlooked by homeowners. - almanac.com

Creative design for new screened-in porch Landscaping by Larry Greene Original backyard setting: This home located in the Bayhill neighborhood in Carmel was built in the mid-90s. The existing backyard area was nicely landscaped and also included a simple wood deck. The family always wanted to add a screened porch, but due to the existing windows and the roof profiles, it had never been able to figure out how or where to tie a porch into the existing home. Design challenges: The project designer presented the homeowner with various options to connect the porch to the home. The homeowner wanted to maintain the windows in the master bathroom on the second floor, and also wanted to avoid placing the porch in front of the family room windows. The creative final solution was to create a new hip roof and move the porch out about 8 feet from the house, and add a connecting roof. This allowed the nice open cathedral ceiling the owners wanted while maintaining the natural light from the existing home windows. Exterior and interior details: The porch

was finished with new HardiePanel exterior siding and cedar trim on the knee walls. To add architectural detail, the corner support posts were finished with new decorative stone column bases. Finally, a new pergola was added above the existing deck including 4-by-4 cedar posts and decorative columns with stone bases to match the porch. The porch includes new fiberglass screens and two new screen doors. The porch ceiling includes a painted beadboard ceiling with cedar-wrapped beams. The porch flooring is cedar decking boards covered with semitransparent oil-based stain. Final results: The homeowners added new landscaping and stone pathways to complement the new porch. The new porch gives the family a place to sit, relax and enjoy the beauty of the backyard setting.
