The Devyani Khobragade incident refers to the controversy surrounding the arrest and detention of Indian consular employee Devyani Khobragade in New York, New York. She was charged on 11 December 2013, of committing visa fraud and providing false statements in order to gain entry to the United States for a woman of Indian nationality, for the potential employment as a domestic worker for Khobragade in New York, NY. She was arrested the next day by U.S. Department of State Police and the United States Marshal Service, leading to a major diplomatic standoff between India and the United States. Devyani Khobragade is an IFS officer functioning as Deputy Consul General in the Consulate General of India in New York. Khobragade hired Sangeeta Richard, an Indian national, in November 2012 as a nanny and domestic servant . Khobragade alleged that Sangeeta Richard and her husband Philip Richard approached her for a job as they needed money for their children’s education. As per their agreement, it was decided Richard would go to New York with Khobragade to take care of her household work for a monthly salary of Rs. 30,000. Richard went to New York in November 23, 2012 and began working for Khobragade . In March 2013, problems started between Khobragade and Richard when the latter allegedly started pressuring her employer to allow her to work outside on her off days. Khobragade turned down Richard’s requests citing the fact that it was illegal according to her visa status and also since she had an official passport. ARREST
Based on the charges filed by by a Special Agent with the United States Department of State, Diplomatic Security Service, theUnited States Magistrate Judge Debra Freeman issued an arrest warrant against Khobragade. Khobragade was arrested in New York on December 12, 2013 by United States Marshals after dropping her daughter at school, after which, she was handcuffed, strip searched, DNA swabbed and, according to Indian media sources, subjected to a cavity search. However, on December 18, 2013 Nikki Credic-Barrett, a spokeswoman for the U.S. Marshals service, stated that Khobragade was strip searched but not subjected to a cavity search. Per agency regulations a strip search can include a "visual inspection" of body cavities. Credic-Barrett also stated that anyone taken to holding cells of the New York federal courthouse is automatically subjected to a strip search if they are placed among other prisoners. Khobragade was detained for six hours and released on a $250,000 bond after pleading not guilty and surrendering her passport. Click here to read more
VISA FRAUD CHARGES
Khobragade was arrested on December 11, 2013. The charges allege that she committed Visa Fraud willfully and under penalty of perjury under Title 28, United States Code, Section 1746. It further alleges that Khobragade submitted an employment contract to the U.S. Department of State, in support of a visa application filed by Khobragade for another individual, which she knew to contain materially false and fraudulent statements.

On December 18, 2013, John Kerry expressed regret over the arrest and strip-search of the Indian diplomat Devyani Khobragade and empathised as a father of two daughters at similar age as Khobragade.

In India, much of criticism of the actions of the US authorities centered on the fact that Khobragade was handcuffed in public, especially that she was subject to a strip search, and that she was made to share a cell with "drug addicts".
