ADVERTISING GUIDELINES Rate Schedule Changes: The Bulletin may revise its advertising rate schedule, and should advertising rate schedule changes occur, you will be given a 30 day written notice. You may, without penalty, cancel by written notification your advertising contract with The Bulletin any time prior to the date the new rules become effective upon prior written notice to The Bulletin. Standards: The Bulletin may, in its sole discretion, edit, classify or reject, at any time, any advertising copy. Errors or Omissions: Read your ad the first day and let us know if there are errors. We will adjust your billing charge based on the space occupied by the incorrect copy in the event that we have failed to correct errors clearly marked by the customer on the returned proof. This adjustment will be made on the first insertion only, so please check your ad carefully. Billing discrepancies must be brought to the attention of The Bulletin within 60 days for credit adjustments. Indemnification: Advertiser agrees to indemnify, defend and hold harmless The Bulletin from all claims (whether valid or invalid), suits, judgments, proceedings, losses, damages, costs and expenses, of any nature whatsoever (including reasonable attorneys’ fees) for which The Bulletin or any of its affiliates may become liable by reason of The Bulletin’s publication of Advertiser’s advertising.
with the collection of amounts payable, including court costs and attorney fees. If your ad is cancelled due to your failure to timely pay, The Bulletin may rebill you for the outstanding balance due at the open or earned contract rate, whichever is applicable. If you use an advertising agency (“Agency”), Advertiser and Agency are jointly and severally liable for compliance with the advertising agreement terms, including payment for all advertising. If, at the end of your contract period you have exceeded or fallen short of the revenue or linage (inches) agreed upon, we will adjust your bill to represent the appropriate contract level based on the actual number of inches run in that time period, and rebate or bill you accordingly. Rebates will be granted at a level no more than 1 linage increment above the original contract. We accept payment by Visa, MasterCard and American Express. Credit is extended at the discretion of The Bulletin. Cancellations: The closing time for in-paper ad cancellations is 2 working days prior to the scheduled publication date for black-and-white material, and 2 working days prior to the scheduled publication date for color material. Should you wish to cancel your ad simply notify your Bulletin account executive prior to the advertising deadline for the day your ad is scheduled to run.
Brokered Advertising: The Bulletin does not accept brokered advertising. To place an ad, contact your account executive or The Bulletin at (860) 887-9211.
Tearsheets: The Bulletin will supply electronic tearsheets upon request. There will be a charge for hard-copy tearsheets. A $15 charge is required for affidavits and certificates of publication.
Contract Billing: The Bulletin bills in 12 periods as indicated in The Bulletin billing calendar. Payment is due 15 days from date of invoice. In the event of late payment, we reserve the right to reject ad copy and/or immediately cancel your advertising contract. You agree to indemnify The Bulletin for all expenses incurred in connection
Transfer: If you sell your business or your business closes you must notify us to cancel your advertising contract with The Bulletin. We will negotiate a new contract with the new owner, as contracts are not transferable. Advertising contracts may not be assigned or transferred by Advertiser or its Agency, if any.
Positioning: The Bulletin has full latitude with respect to ad placement, however we make every effort to accommodate your positioning requests. You may guarantee the position of your ad for an additional cost of 25%. Force Majeure: Each party’s obligations under the advertising agreement are conditional on strikes, fires, acts of God or the public enemy, war, or any cause not subject to the control of such party. Taxes: If any federal, state or local taxes are imposed on the printing of advertising material or the sale of advertising space, such taxes shall be assumed and paid by you. Credit Check: The effectiveness of advertising contracts is subject to a satisfactory credit check on Advertiser and/or Agency. No Sequential Liability: The Advertiser’s contract renders void any statements concerning liability which appear on correspondence from Advertiser or its Agency, and is irrevocable without the written consent of The Bulletin’s Credit Department. It is further agreed that The Bulletin does not accept advertising orders or space reservations claiming sequential liability. Incorrect Rates in Order Forms: When orders are forwarded by Advertiser or its Agency which contain incorrect rates or conditions, the advertising called for will be inserted and charged at the correct rate in force governing such advertising as provided for in The Bulletin’s rate schedule, and in accordance with the conditions contained in Advertiser’s contract.
