It's with great relief that Dennis Omanoff was found to have been improperly sued by CHEYTAC USA, LLC. Judge Cecilia M. Altonaga ruled that the case belonged in Arbitration per the Operating Agreement and since there was simply no way that Dennis Omanoff could infringe against something that he already owned the patent for the Patent Infringement claim was dropped during the Safe Harbor period. This lawsuit emerged following inaccurate reports that Dennis Omanoff infringed a patent for armor piercing rounds, produced the rounds, and attended The Special Operations Forces Industry Conference in an attempt to find customers for his product. The Court ruled that CHEYTAC USA, LLC had improperly sued Dennis Omanoff and had filed those three motions in a case that should have been in arbitration due to the fact that the issues being presented to the court were easily resolvable and under the arbitration clause of the operating agreement. Thankfully, Dennis Omanoff was able to demonstrate that he owned the disputed patent which cast the entire court proceedings into the realms of pointlessness. After all, it's impossible to infringe something that you own. The patent infringement allegations were withdrawn following the revelation that Dennis Omanoff was, in fact, not guilty of any form of patent infringement. Dennis Omanoff testified that none of the disputed products were produced, let alone sold. He also informed the court that it was impossible for him to attend the SOFIC in an attempt to market his product as he was over 1,000 miles away when the conference was taking place. It was ruled by Judge Altonga that CHEYTAC USA, LLC was in breach of the agreed arbitration provisions by their initial filing of a complaint and the three motions. The counsel to defense demanded sanctions on the plaintiff as it was the general consensus that the entire case against Dennis Omanoff was pointless. The judge agreed and deemed it to be a fruitless exercise that was a total waste of everybody's time and money. Judge Altonga initially awarded Dennis Omanoff and his defense team a total of $85,000 in fees as a result of the court case and the unjust, inaccurate complaints that were filed against him. Cheytac issued a press release thanking Mr. Omanoff and other resolutions were sealed.
