Farmer’s market bids farewell to the season

LONG LAKE - From the height of a scaffolding airlift, Long Lake residents dropped pumpkins in what they hope will turn into an annual pumpkin drop competition. On Oct. 10 fourteen contestants gathered at the town hall with pumpkins in hand to lift them into the sky, courtesy of Wallace Contracting. Members of the Long Lake Volunteer Fire Department Cliff Ross and Jordan Wallace were charged with dropping duties. Rigging operator Greg Bruce lifted them forty feet above the ground, where they sent the pumpkins on their fall. A panel of judges including John Rayome, Rose Lily and Tammy Kitchen voted on the best pumpkin drop. Their criteria included best splatter, best noise and biggest impact. The kick-off pumpkin was filled with cherry pie filling and set the sage as it hit the pavement below and reminded spectators to find a safe and clean distance. Clean up crews cleared the area between drops. The finale pumpkin weighed over 120 pounds.

lindsay@denpubs.com NORTH CREEK - After a successful first year, the North Creek farmer ’s market has concluded as of Columbus Day. The farmer ’s market is dedicated to providing the freshest produce to the community, while recent drops in temperature encouraged them to close their doors and begin preparing for next year ’s market. “This being our first year as a market, we were not sure how long we could extend the season. Columbus Day seemed to be the best time for this area,” said market manager Barbara Thomas. The North Creek Farmer ’s Market Association, Inc. wishes to extend a sincere thanks to all who came and supported their premier market. “The market was started for the community, to supply it with fresher fruits and vegetables and as a gathering place for friends and acquaintances,” said Thomas. “We hope the community thoroughly enjoyed this first year.” The market has begun work to plan and improve next year ’s market and will be posting updates in the News Enterprise as well as on their website at www.northcreekfarmersmarket.com.

Lake Champlain Bridge officially closed DOT suggests 100-mile detour By Fred Herbst

CROWN POINT — State legislators and town supervisors are calling for the construction of a temporary pontoon bridge across Lake Champlain and a Gubernatorial emergency declaration following the Oct. 16 closure of the Crown Point Bridge. But state officials remain non-committal. The Crown Point Bridge – which allows 4,000 cars a day to travel between New York and Vermont – was closed last Friday after state Department of Transportation officials discovered inclined cracks in the supporting piers. Town supervisors and state legislators have labeled the bridge closure an emergency that threatens the local economy. Officials say hundreds face job loss if a solution is not found. For state Assemblywoman Teresa Sayward, only one course of action will salvage the economies of the surrounding communities, but the state may have other ideas in mind. “I can tell you what we think the solution is,” Sayward said. “That’s a temporary bridge.” Following a closed-door meeting with officials from numerous state agencies Monday, state Senator Betty Little said that she is currently imploring Governor David Paterson to declare Essex County in a state of emergency.

Pumpkins were purchased from Gracie Lamos of Northern Borne store for the drop. Chandler Seaman was named first place winner of the drop, followed up by second place winner Lillian Dechene. Upcoming in Long Lake is a Halloween carnival on Saturday, Oct. 31 in the school gym from 1 – 3 pm. Admission is $1 and all are invited to attend. Featured events include costume competitions and a traditional haunted house. Prizes will be awarded for the best costumes. The carnival is co-sponsored by the Long Lake Central School Student Council and the Town of Long Lake.

MINERVA - The cold and snowy days of winter are coming. The Town of Minerva is preparing by doing a major rehabilitation of its cross-country and snowshoe trails at the Minerva Winter Recreation Area at Minerva Lake. The trails have been in place since the 1990's and were originally constructed by a dedicated group of volunteers they are now receiving a much-needed facelift.

Photo festival finds young talent Indian Lake student winner By Lindsay Yandon lindsay@denpubs.com INDIAN LAKE - High school student at Indian Lake Central School, Alyssa Cuthbert was the youngest winner in the first ever Community Photo Festival at the Indian Lake Theater. Cuthbert accepted her award for best close-up on Oct. 18 and was joined by 42 other locals who submitted nature photos for review. The festival was hosted by former Indian Lake resident and professional photographer Bill Killon. The Indian Lake Theater opened its doors to over 70 community members who came to meet Killon and to celebrate the local photography talent drawn by the competition. Killon provided feedback on each photo he selected and presented examples of his own work, pointing out the joys and challenges of nature photography. He concluded the evening with a slideshow of all 173 submitted photographs.

“This show was really about the talent of people right here in Indian Lake and surrounding communities,” said Killon. “I grew up here, and I know the talent that exists here. The festival, with the easy on-line submissions and the unique format of exhibiting photographs on the large movie screen, was good encouragement to local photographers to keep shooting and keep sharing their pictures.” Photos were submitted from artists from varying ages and levels of experience. Despite her age, Cuthbert impressed Killon and spectators alike with her talent. “Alyssa’s close-up is a terrific photo,” said program designer Ben Strader. ”Her image just draws you in, and you can’t help but appreciate her talent and attention to the world around her.” The Indian Lake Theater was honored to have the opportunity to invite Killon back to Indian Lake and feature him as a reviewer. “Bill was the perfect person to help everyone learn to appreciate the techniques behind taking a great photograph,” said Strader. his week's Super-Couponing secret may surprise you because it goes against just about everything shoppers believe about saving money and shopping. Are you ready for a head-scratcher? Secret #5: Smaller-Size Items are Often a Better Value Yes, you read that right. Buying the smaller size of a product, with coupons, is often a better deal than buying a larger size of the same item. When I teach my coupon classes, this statement is almost always met with disbelief. I completely understand why, because it runs contrary to just about everything shoppers believe. To get the lowest price, we are very conditioned to buy the largest size of something - the "family size" cereals, the "value-pack" of refills or just the largest package we can find. It does seem that you'll need to buy that item less often if you buy a larger size - but you're also likely to spend much more than you need to. When we have a fairly high-value coupon, applying it to the relatively lower price of a smaller-sized item will often result in a significantly lower per-ounce cost. I know that this surprises many people. It surprised me, too, as I became a more experienced shopper. Over time, I noticed that many of the items I was able to bring home for free or for pennies were usually in smaller-sized packages than their so-called "value" or larger counterparts. Adding to the confusion, the larger packages often tout in big, bold letters that they are the better buy! A few examples will help you understand why this works. A certain brand of aluminum foil is on sale at my local store. The 70-square-foot box is $3.79 and the 20square-foot box is 99 cents. With a coupon that states "$1 off any aluminum foil," I have my choice as to which size box I'd like, the larger or the smaller. While my dollar coupon will, indeed, give me a discount on the larger box, the smaller box will be free. And I prefer free any day. The rule of thumb that it's better to buy the smaller size

For example, baby wipes are on sale By Jill Cataldo at my store this week. The plastic tub contains 77 wipes and it's on sale for $2.99. The "value-pack" of baby wipe refills contains 231 wipes and it's on sale for $5.99. My store offers a $1.50 store coupon good on any size of the wipes. I also have a $1 manufacturer coupon for the wipes. Stacking these coupons gives me $2.50 in savings on either size item. With the coupons, the plastic tub with 77 wipes will cost just 49 cents. The "value-pack" refill will cost me $3.49 using the same coupons. The "value-pack" contains three 77-count wipe packages; that works out to about $1.16 for each 77-wipe package. I'd spend more than twice as much on baby wipes if I purchased the larger, so-called "money-saving" size. An even easier example involves coupons for items that come in a trial or travel size. A $1 coupon good for any size deodorant will certainly give you a discount on a fullsize deodorant. But a 99-cent travel size will be free using the coupon. Again, any time a coupon states that it will work on any size of a product, remember that the trial and travel sizes are included. Free always makes better financial "cents" than spending more than we have to!

News Bakers Mills received it’s first snowfall one morning last week. Sheri Taylor from Indiana sang in concert in many of the area churches over the weekend. The North Creek Seventh Adventist Church held their yearly harvest dinner. Good food and good fellowship was enjoyed by many.

Travels Gene and Pam Mulligan were in Jamestown, NY (not Ohio, my mistake). They visited Ray and Lori Nebner as well as Ron and Phyllis Golden. They also went fish feeding and saw a fish that weighed 25 pounds and was 25 inches long in Linesville, Pa. They had a great visit. Keitan Millington enjoyed a fishing trip with several friends. It was a good outing and all had a great time.

September 2009 weather was very pleasant, with drier than normal conditions and slightly cooler than normal temperatures, giving us a very nice introduction to Fall. The average high was 68.2 degrees and the average low was 46.2 degrees, giving us an average temperature of 57.2 degrees - 1.2 degrees below normal. The highest temperature, 78 degrees, was recorded on Sept. 6 and the lowest temperature, 34 degrees, was recorded on Sept. 20 and 21. There were scattered frosts around the area on these dates, although not here in Riparius, as the river does have a moderating effect on our temperatures, giving us a slightly longer growing season. There were 238 degree days bringing the seasonal total to 325.5 Rainfall for the month was 2.04 inches, 1.51 inches less than normal. This was the third driest Sept. on record and it followed the third wettest Aug. on record. The driest Sept. was in 1998, when only 1.77 inches fell, and the wettest September was in 1983, when 6.45 inches were measured. Our seasonal total is now 33.49 inches, 2.15 inches above the normal of 31.34 inches. There were only 9 days of measurable rainfall, most of which were at the end of the month. The greatest amount, 0.73 inches fell on Sept. 28. The river rose to its highest level, 4.50 feet, on Sept. 29 and its lowest level, 2.61 feet, on the Sept. 17.

I’ve heard that Halloween is second only to Christmas in the amount of decorations sold to consumers. It is not unusual to pass a house with tomb stones in the yard, a large spider on the front door, and a string of pumpkins circling the porch railing. Halloween is a fun day for kids (and adults) who like to dress up. Costumes are sometimes planned weeks in advance. We look forward to the day when, for a few hours, we can become someone completely out of character: a princess, a witch, a super hero, etc. Performing on stage, in a play or musical is another opportunity that has the same effect. We will always remember those special times when we left our routine lives behind, donned a costume, put on grease paint and acted out a part. Shakespeare said, “All the world’s a stage, and all men and women merely players. They have their exits and their entrances, and one man in his time plays many parts”. He went on to enumerate seven stages of life between birth and senescence and death. His message was a grim one: that we really have no choice in the matter. I believe that most of the time we live our lives, from day to day, and there’s nothing very memorable about those days. But it is the times when we go outside of our everyday existence to dress up and act out a part, even a Halloween character, that are the days from which memories are made. HAPPY HALLOWEEN!

We knew Ernie for over 25 years as a member of the Backwoods Ski Club at Gore. One day, one of our friends (George "Lonesome George" Turton), who was a cabinet maker at Montgomery Ward in Menands showed up with a bunch of wooden hand lettered pins he had made and presented each of us with one of them. The pin bore the legendary title, "Backwoods Ski Club". From then, the "Backwoods Ski Club" had a tangible identity. The Club remained loyal to "Old Gore" until the 1964-65 ski season, when a new manager was hired by the Gore Mountain Ski Lift Corporation, which operated the Ski Bowl. The new manager demonstrated by his words and actions that the Backwoods Ski Club would find a more hospitable reception at the recently opened state ski center. We thereupon, moved our activities to "Big Gore" where we have been for the last 31 years. After all these years, The Backwoods Ski Club has evolved into a group of friends at Gore Mountain who ski together, enjoy lunch together, and party together. Ernie Johnson

he Backwoods Ski Club is not a "club" in the usual sense. No officers, no meetings, or any other bureaucratic trappings that characterize what is commonly known as a club. It is nothing more than a group of friends who ski together a Gore Mountain, enjoy lunch together and sometimes party together. There was no starting date for the club, it just happened sometime in the mid 1950’s at the North Creek Ski Bowl, now known as "Old Gore". The probable beginnings can be traced to Ridings Restaurant, Farrell’s Hotel and the American Tavern in North Creek, all of which were popular après ski watering holes at the time and attracted both skiers and local people. Familiar faces, over the weeks and years often created friendships. One of these familiar faces (Ralph

"Chubber" Montello), a regular skier a "Old Gore" - where it all started, began bringing a charcoal grill, hamburgers, hot dogs, relishes, etc. and set it all up near the end of the Hudson Trail at the bottom of the mountain. Many others brought their wine, beer, etc., to share and often ended up as an "Adirondack Luau !". Still no identity, just a bunch of friends. The ski school at "Old Gore" was one of the first in the east whose instructors passed the rigorous US Eastern Ski Association (USEASE) instructor certification tests. These instructors were among the best. Back in the 50’s we had buses, too, which did not please the regular customers. Buses meant long lift lines, and they brought their own "bootleg" instructors. One day, one of our friends started skiing down the Ridge Trail and she had to stop because one of the bus instructors had the trail blocked with his students. He was teaching them to snowplow, which should have been done on the lower slopes. One of his students had previously taken a lesson from the local ski school and informed him that his instructions were not the same as what she had been taught locally. In a contemptuous tone, he stated, "Don’t pay any attention to them, they're a bunch of back-

although New York DOT is responsible for its maintenance. “It’s important to remember safety is our highest concern,” John Zicconi, Vermont Department of Transportation spokesman, said. “We realize the inconvenience this poses to many people, but we can’t risk lives for the sake of convenience.” The bridge, built in 1929, has been the site of repair work since mid-summer. Plans are being made to replace the bridge in 2013. Hoffman explained that low water allowed crews making repairs on the bridge to inspect concrete piers Oct. 16. They immediately alerted DOT officials of deteriorating conditions. A signed detour now diverts motorists on U. S. Route 4 through Whitehall and on Vermont Routes 22A and 17, a distance of about 100 miles. Motorist can also use ferries in Ticonderoga and Essex, N.Y., although they have limited capacity and charge a fee. Supervisors Dale French of Crown Point, Tom Scozzafava of Moriah and Bob Dedrick of Ticonderoga were all at the bridge Oct. 16 along with state Sen. Betty Little. All expressed disappointment the NYS DOT had allowed the bridge to reach this point. “I’ve been saying it’s unsafe for three years,” French said. “No on would listen. Now we have an emergency.” Essex County has declared a state of emergency and the county board has asked the state to do the same. It’s hoped the declarations will make federal emergency funds available for bridge repairs. “A lot of people have built their lives around this bridge,” Scozzafava said. “They live here because they have access to work, stores and health care across the bridge. Now, they don’t.” Dedrick said the bridge closing will have a serious economic impact. He noted many people use the bridge to reach work and others to shop. “People don’t realize the financial impact this will have,” Dedrick said. “Wal-Mart, Lowe’s, International Paper — every business will be affected.” Little promised quick action by the state.

But getting that designation has proven tricky. “They are looking at what the impact is. They don’t need an emergency declaration to repair the current bridge,” Little said. “They are waiting to see the impact and we have seen that. A woman who needed chemo waited three hours for the ferry.” On Monday morning, the Essex County Board of Supervisors unanimously endorsed a resolution urging the governors of both states to declare the bridge closing an emergency. Supervisors repeatedly hammered the state for years of inaction as the bridge deteriorated, while continually reiterating the importance the bridge plays in the lives of local residents. According to Essex County Transportation Coordinator Nancy Dougal, between 1,000 and 1,500 Essex County residents are employed in Vermont and cross the bridge daily. At present, local residents who must cross for work or access to one of the Burlington area hospitals must use one of the two ferries. And since the bridge closure, waiting for hours to get on a ferry has become common. Officials said that an emergency declaration would clear much of the red-tape surrounding historic preservation issues at or near the site. In a bizarre twist, the Crown Point Bridge was officially declared a state Historic Site Monday. According to State Emergency Management Office Director John Gibb, the focus is on fixing the old bridge and an emergency declaration wouldn’t expedite that process at all. “The governor is prepared to declare a state disaster emergency is that’s going to be needed to speed things along,” Gibb said. “But right now, as for the state DOT, that doesn’t quicken the work they are doing right now.” Officials noted that an emergency declaration would instead significantly reduce the red tape surrounding the construction of a new bridge and the state is not yet committed

I will push for an answer.” Gov. David Paterson released a statement also calling for quick action. “This emergency closure was necessary for the safety of those who use the bridge, and the action could not be delayed,” he said. “I want to assure North Country residents that we are working as quickly as possible to re-open the bridge, as it is a critical passageway to and from Vermont. “However, we will not in any way jeopardize the safety of those who use the bridge,” Paterson said, “and the structural problems must be resolved to ensure that safety.”

Gibb said that all state agencies are attempting to find the best solution to the bridge closure, but that rushing into an action like building a temporary floating bridge requires significant analysis. “I am not a temporary bridge expert, but I can tell you that our structures people at DOT are looking at the viability and the alternatives associated with temporary bridges,” Gibb said. Sayward noted that using either of the ferries would result in a cost of between $230 and $500 a month. And their claims aren’t without merit. Cindy Bodette is a Crown Point restaurant owner. She said she has seen her business drop over 40 percent since the bridge closed and that’s not even the worst of it as her daughter and son-in-law work in Vermont and rely on the bridge to get and from work each day. “She waited for an hour and a half for that ferry and that is not acceptable,” she said. “She only makes $13 an hour anyway, she can’t afford the ferry and her husband does shift work in Vermont and he doesn’t get out until midnight. The ferry doesn’t run at midnight.” Gibb indicated that it would likely take several months before a permanent or temporary solution is reached. Until then the businesses and residents who rely on the Crown Point Bridge for work or medical appointments will have to grin and bare it.

States consider ban on the use of deer urine in lures feeding ban - and a containment area was created in Oneida and Madison counties. Since that time, two cases of CWD have been identified in the wild deer herd in the containment area, but biologists are optimistic because the disease has not yet spread statewide. In the meantime, wildlife officials in neighboring states are keeping a wary eye on CWD, knowing it can have potentially devastating impacts to deer numbers. Last week, biologists of the Pennsylvania Game Commission urged state officials to consider a ban on deer urine and products that use it in an effort to keep CWD out of the state. Walt Cottrell, the Wildlife Veterinarian for the Pennsylvania Game Commission, said Saskatchewan has already banned urine lures and nine states are considering it — including Vermont and New Hampshire. While Cottrell said he could not give the likelihood that the disease will spread by the use of the lures, he said a ban would be better than doing nothing. “CWD is forever,” he said. “If you get it, you're going to have it forever.” Pennsylvania Game Commissioner Tom Boop asked if there was a way that the marketers of deer urine could somehow certify a product as being CWD-free. But Cottrell said it

is currently not possible because there is no live-animal test for the disease and it can take up to 18 months for a deer to show signs of being sick. “It seems, at the least, that we should put out a news release making hunters aware of the potential,” for urine to spread CWD, Boop said. “I'm just thinking a lot of people have never even thought about this.” DEC Spokesman David Winchell said

state officials have discussed a ban on deer urine in New York but said there is no proposal currently on the table to implement a ban.

stopped by Adirondack Outfitters in Lewis today to stock up on a couple essentials for the Oct. 17 muzzlestuffer opener and Steve Koop mentioned some states, including Vermont, are considering banning the use of deer urine in hunting lures. We both found this hard to believe. The hunting lure industry is a multi-milliondollar business and the use of urine as a masking scent and an attractant for bucks is extremely popular. But I did a little research and it turns out that a ban may indeed become reality. That’s because biologists are concerned the commercially-available urine, which comes from captive deer held in pens, could spread chronic wasting disease, or CWD. CWD is an always fatal disease of the nervous system which has been identified in deer in 15 states — including New York — and two Canadian provinces. The disease is spread from one deer to another through saliva and other bodily fluids, along with food that has grown in CWD-contaminated soil. The proteins that carry CWD are excreted in both feces and urine, and once they reach the soil, become 700 times more infectious. First identified in Colorado in 1967, CWD has been found in Colorado, Illinois, Kansas, Nebraska, New Mexico, New York, South Dakota, Montana, Oklahoma, Minnesota, Utah, Wisconsin, West Virginia, Wyoming and the Canadian provinces of Alberta and Saskatchewan. CWD was first identified in New York in 2005 in the captive deer herd in central New York. After that, several regulations were put in place to help control its spread, included a

Willa McKinley scored two goals and Delaney Sears netted another off an assist from Kelsey Carroll for Westport. Oh, this is a football column? OK, so Big Blue had a big let down. I blame the defensive play-calling. Where were all the blitzes? And it would have been nice if the defensive backs actually knocked some balls down or made some tackles. Still, it was only one game, and I’m sure The New York Football Giants will bounce back nicely this week at home against Arizona. Sure, it was a little depressing, but my how I perked up when I saw Philly lose to Oakland and the Deadskins drop another game to a crappy team. And as much as I like the Jets, I couldn’t help but be happy for my buddy Dan Jr. to see his Bills actually win a game. He was so excited he was e-mailing me happy-face Emoticons! Very cute. Joe Sherwood and architect Art Vandelay led the way this week with 11-3 records, while Sue Ringler ’s solid 10-5 was enough to move her back into a tie for first with Matt Aldous. Some good games on tap for Week 7: Minnesota at Pittsburgh, Atlanta at Dallas, and Chicago at Cincinnati all should be fun to watch. I’ve got to take the Steelers at home and look for the Bengals to bounce back, but see the Cowgirls falling to the Falcons after their cozy bye week. This Local Law shall be titled “A Local Law Providing for a Storage Fee and Collection Thereof for Non-Exempt Vehicles, Vessels, Trailers, and/or Heavy Equipment Stored at the Warren County Sheriff’s Office Impound Storage Area”. SECTION 2. AUTHORITY. The authority for this Local Law is Municipal Home Rule Law §10(1)(i). In addition, authority also exists under Municipal Home Rule Law §10(1)(ii)(a)(9-a) and (14). SECTION 3. PURPOSE AND INTENT. The purpose of this Local Law is to: (1) impose a reasonable fee for storage of vehicles, vessels, trailers, and/or heavy equipment in the Sheriff’s Office impound storage area; and (2) provide a mechanism for the collection of that fee. There are costs associated with the maintenance of such a storage area, such as the capital costs for fencing, administrative costs and labor costs for maintaining the area and handling of the vehicles, vessels, trailers, and/or heavy equipment. Private garages which tow and store vehicles typically charge a storage fee and it seems reasonable for a municipal corporation to do the same for the service being rendered to particular persons and businesses. SECTION 4. EFFECT OF LOCAL LAWS ON ACTS OF THE STATE LEGISLATURE. In addition to providing for a storage fee, this Local Law provides for a lien and collection thereof. New York State Lien Law §184 provides, under certain instances, a lien for a person who tows and stores a motor vehicle, motor boat or aircraft at the request of a law enforcement officer. It is the intent of this Local Law to essentially follow New York State Lien Law §184 and provide for a similar garageman’s lien for the benefit of the Sheriff’s Office, only the Sheriff’s Office does not tow but just stores motor vehicles, vessels, trailers, and/or heavy equipment in the instances covered by this Local Law. To the extent that New York State Lien Law §184 does not provide a lien for a person who simply stores a vehicle, vessel, trailer, and/or heavy equipment, or for a Sheriff’s Office that stores a vehicle, vessel, trailer, and/or heavy equipment, then this Law shall be interpreted as covering that particular instance. Otherwise, it is the intent to follow the procedures outlined in New York State Lien Law §184 with regard to the establishment of a lien and enforcement of the same in the instances provided for under this Local Law. SECTION 5.

IMPOSITION OF STORAGE FEE AND LIEN FOR STORAGE OF VEHICLES, VESSELS, TRAILERS, AND/ OR HEAVY EQUIPMENT AT THE WARREN COUNTY SHERIFF’S IMPOUND STORAGE AREA; PAYMENT PROCEDURE; EXEMPTIONS. A. Storage Fee Imposed. On and after December 1, 2009 and except as provided herein, there shall be imposed and there shall be paid a storage fee of Twenty-Five Dollars ($25) for each twentyfour (24) hour period or any part thereof that a vehicle, vessel, trailer, and/or heavy equipment is situated at and stored at the Warren County Sheriff’s impound area due to: (1) an accident; (2) lack of a legally qualified operator; (3) abandonment, other than those motor vehicles stored by reason of being stolen or abandoned, pursuant to New York State Lien Law §184(3); (4) being seized contemporaneously with an arrest; and (5) seizure by reason of the action of a creditor and/or courts, in furtherance of a creditor or lienholder’s right in the vehicle, vessel, trailer, and/or heavy equipment. B. Computation of Storage Fee. For purposes of computing the charges imposed, the twenty-four (24) hour period shall commence at 12:01 a.m. C. Lien. Any charges imposed by authority of this title shall constitute a lien upon the vehicle, vessel, trailer, and/or heavy equipment. For purposes of enforcing the lien, New York State Lien Law §184 and Article 9 shall apply, except that it shall not be necessary for the Warren County Sheriff to have towed the vehicle, vessel, trailer, and/or heavy equipment, but merely stored the vehicle, vessel, trailer, and/or heavy equipment at the request of a law enforcement officer. It shall also not be necessary for the Warren County Sheriff’s Office to be registered as a motor vehicle repair shop. D. Payment of Storage Fee. The fee shall be payable to the Warren County Sheriff by the owner, operator or anyone else claiming title to the vehicle, vessel, trailer, and/or heavy equipment before regaining possession of the vehicle, vessel, trailer, and/or heavy equipment. The person paying the fee shall present: (1) an original certificate of a registration and title to the vehicle, vessel, trailer, and/or heavy equipment or such other bona fide proof of ownership, as the Warren County Sheriff shall require; (2) personal identification; and (3) payment of the total storage fees due on the vehicle, vessel, trailer, and/or heavy equipment. E. Definition of “Vehicle”, “Vessel”, “Trailer”, and/or “Heavy Equipment” to Which Fee Shall Apply. “Vehicle”, as that term is used herein, shall include a

visors; (3) a position, explanation or argument as to why the fee is not due or not correct; (4) an address to which all communications from the County should be sent; and (5) signed by the person seeking to retrieve the vehicle, vessel, trailer, and/or heavy equipment from the Warren County Sheriff’s impound storage area. Failure to include the required information in a review request shall cause the review request to be considered incomplete, and the County may elect not to act upon the same for failure to follow the required procedures. Upon receipt of a complete written review request, the Clerk of the Warren County Board of Supervisors shall notify the Chairman or Deputy Chairman of the Committee of the Warren County Board of Supervisors with oversight of Sheriff’s operation, who shall, in turn, call for a meeting of the Committee to review the submitted written request. The meeting shall be held within five (5) business days of the time the Clerk of the Board of Supervisors receives the request. The person making the request shall be notified in writing of the meeting and may attend, and shall be allowed to make any presentation or present evidence as to the reason(s) why the fee is not due or the amount is not correct. Following such review, the Committee shall make a decision with two (2) business days and either provide a copy of the same to the person requesting the same, if in attendance, or mail the same, by certified mail return receipt requested. B. Judicial Review. Any final determination by the Committee of the Warren County Board of Supervisors with oversight of the Warren County Sheriff’s operations shall constitute a final determination of the County and shall be reviewable for error, illegality or unconstitutionality or for any other reason whatsoever by a proceeding under Article 78 of the Civil Practice Law and Rules if application therefore is made to the Supreme Court within thirty (30) days after the giving of notice of such final determination. SECTION 8. DISPOSITION OF STORAGE FEES. All fees received as a result of this Local Law shall be paid by the Warren County Sheriff to the Warren County Treasurer once a month. The Warren County Treasurer shall deposit the same in the General Fund of the County. The Warren County Sheriff shall show the anticipated revenues as part of the budget submitted by the Warren County Sheriff each year. SECTION 9. SEPARABILITY. I f any provision of this Local Law or the application thereof to any person or circumstance shall be

vehicle, as defined by Vehicle & Traffic Law §159, and aircraft, as defined by General Business Law §240. “Vessel”, as that term is used herein, shall be that defined by Navigational Law §2. “Trailer”, as that term is used herein, shall consist of hauling trailers, boat trailers or other types of trailers that could be towed on the highway by a vehicle. “Heavy Equipment”, as that term is used herein, shall consist of equipment with a motor or engine and capable of being ridden, including, but not limited to tractors, bulldozers, backhoes, front-end loaders, and other similar hauling equipment. F. Exemption from Storage Fee Charges. Storage fees shall not be assessed: (1) under those circumstances where the vehicle, vessel, trailer, and/or heavy equipment is seized as a result of a search warrant issued pursuant to CPL §690.10 or other similar circumstances where the vehicle, vessel, trailer, and/or heavy equipment is lawfully seized for purposes of the District Attorney and/or the Sheriff’s Office or other police agency having and keeping temporary custody of the same; (2) for County-owned vehicles, vessels, trailers, and/or heavy equipment; (3) for abandoned motor vehicles, as described in New York State Lien Law §184(3); and (4) light power equipment, including, but not limited to lawn mowers, power tools, and/or machinery that can not be ridden by the operator. SECTION 6. TRANSITIONAL PROVISION. There shall not be a storage fee imposed upon any vehicle, vessel, trailer, and/or heavy equipment which was stored in the Sheriff’s impound storage area before December 1, 2009 or for which storage commenced before December 1, 2009 and ended thereafter. SECTION 7. DISPUTES AND JUDICIAL REVIEW. A. Administrative Review and Right to be Heard. Any person desiring to dispute, challenge or bring a court action with regard to payment of the storage fee or amount imposed hereunder must request a review by a Committee of the Warren County Board of Supervisors with oversight of County Sheriff’s operations not later than ten (10) business days following the time the fee is paid. This review may be requested whether or not the storage fee is paid at the time the review is requested. The Burghers have tallied very few loses on their home field and Johnsburg was the lone team to beat them there this year. “We really came together and played our game,” said Blackhurst. "And it's better," Samantha Burns added, "because they’re not just some team we beat, they are a good team.” Despite a tough season last year, the Jaguars are no stranger to championships. They were tied for the league title in 2006 and made their way to the sectional finals for the first time ever in 2007. Johnsburg has yet to be seeded for sectionals and are taking it one game at a time in post season play, before the Class C quarterfinals begin on Sept. 27. “We are going to have to communicate really well and work as a team,” Welz said of their plan for upcoming competition. The rest of the seniors joined her with confidence that their season’s success will carry over. “This could be our girls’ year,” said Toney.

This year ’s squad is the first team in Johnsburg’s history to go undefeated since their premier in the league in the late seventies. Coach Jill Toney attributes the season’s success to the girls who began this quest when they started playing the sport in fourth grade her seniors. They include Kelly Blackhurst, Emily Burns, Samantha Burns, Keri Cleveland, Margaret Welz, Kelsey Williford and Brittney Allard. “These young ladies have worked so hard for so long and I hope they finally get the titles that they deserve,” said Toney. Beating Warrensburg and sweeping the Adirondack League was a long time coming for Johnsburg’s seniors and their victories were extra sweet. After suffering some tough loses last year, the Jaguar season came to an early end. “We were motivated from last year ’s loses to give all we had,” said senior Keri Cleveland. JOHNSBURG - “A lot of people doubted that we would make it this far,” said senior field hockey player Margaret Welz. Johnsburg was not favored to win the Adirondack League over Warrensburg this year, but they took the league title without a single loss and boasted a 12-1 overall record. League play ended on Sept. 14 as the Jaguars faced the Burgers at home and were able to ring their victory bell after a 1-0 score. Kelly Blackhurst netted the goal that pushed Johnsburg to a win off an assist from fellow senior Kelsey Williford’s corner pass. The Jaguars outshot the Burghers 6-2, outcornered them 16-2 and dominated most of the field. Black-
