LAKE PLACID — A Lake Placid man who won his battle against the state Department of Environmental Conservation over motorized access to the Old Mountain Road is asking that the department’s commissioner recuse himself from administrative proceedings and strike several petitions asking him to reconsider the decision.

Jim McCulley and his attorney, Matthew Norfolk of Lake Placid, filed a motion Tuesday seeking to have DEC Commissioner Pete Grannis removed from all future hearings regarding the May decision in McCulley’s favor.

According to a statement issued by Norfolk, Grannis failed to disclose ex parte communication with DEC staff counsel, the Adirondack Park Agency and the Adirondack Council. The motion specifically names Alison Crocker of the DEC, APA Chairman Curt Stiles and Adirondack Council Executive Director Brian Houseal.

McCulley said Commissioner Grannis had an obligation to disclose the letters received by DEC that sought reconsideration of the decision.

“The reason for that is because the APA and the Adirondack Council have both filed for third-party status in my case,” he said. “We’ve found that they have been sending letters to Mr. Grannis that they have not disclosed to me or my attorney and it really is showing an underlying taint of the commissioner ’s position as the judge because these letters are giving him legal advice, legal opinion, which, quite frankly, in these administrative hearings are not allowed.”

In May, Grannis dismissed a ticket issued to McCulley for operating his pick-up truck on the Old Mountain Road, which runs between North Elba and Keene.

McCulley drove on the trail with his snowmobile in 2003 and his pickup truck in 2005 so he could get ticketed and force the issue into court.

State law prohibits the operation of motor vehicles on Forest Preserve land, but there are two exceptions to that rule: Motor vehicles can be used on a road that falls under the jurisdiction of a town highway department and where a legal right of way exists for public use.

Although DEC staff had argued the Old Mountain Road had been formally abandoned by the towns, Grannis found that wasn’t the case. He also said the road “is a legal right of way for public use.”

In dismissing the complaint against McCulley, Grannis took the recommendation of Administrative Law Judge James McClymonds, who presided over a three day hearing in the case in November 2007.

Since the May decision, numerous groups have come forward requesting Grannis revisit his decision.

Stiles wrote Grannis on June 3, stating that the decision failed to take into account “the legal effect of the Adirondack Park State Land Master Plan.”

“As a result, it reaches the wrong conclusion and provides a precedent that could lead to years of unnecessary litigation and conflict over long-closed motor vehicle roads,” the letter reads.

The letter also calls for the formal abandonment of Old Mountain Road pursuant to Highway Law 212. Stiles also offers “any resources we can bring to bear to assist in this outcome.”

The United Way of Clinton and Essex Counties Inc. officially marked the beginning of their 2009-10 fundraising efforts with their annual fundraising campaign kick-off breakfast at American Legion Post 1619 Sept. 10. The event included the announcement this year ’s campaign team will again seek to raise $700,000 to benefit the 33 partner agencies of the local United Way. John C. Bernardi, the nonprofit organization’s executive director, announced “pacesetters” — businesses and individuals who begin early fundraising efforts — have so far raised $151,426.62, bringing the campaign to 21.6 percent of its overall goal.

Bernardi credited the success of the campaign’s start to the “good cross-section” of those in the community who continue to lend a hand to the United Way. “We’re well-represented and it’s just a tremendous asset, I think, to be so strongly supported by such a wide range of groups and individuals,” said Bernardi.

“We’re truly blessed in this region in many ways. Mainly because people get involved and they’re compassionate and they’re caring towards their friends and their neighbors. It really shows.”

Catholic Diocese commissions 65 as pastoral ministers

Those were the words of the Rev. Terry LaValley, presider and Diocesan administrator at the beginning of his homily, as the Catholic Diocese of Ogdensburg commissioned 65 parishioners as pastoral ministers in a Eucharistic Celebration Mass held at St. Mary’s Cathedral Sept. 12.

Formation for Ministry courses were held the last two years at two regional sites: St. Phillip Neri Church in Westport and Church of the Visitation in Norfolk.

Candidates attended courses in eightweek segments, once per week. The required courses included the Old Testament, New Testament, Church, Spirituality, Christology, the Sacraments, Moral Theology and Social Justice.

“There is an academic component and pastoral training through workshops for mentoring and spiritual formation,” said Heidi Macko, who directs the program.

“Our goal is to bring them into a deeper relationship with Christ and then to go out and minister to others. They’ll serve in a wide variety of capacities within their parishes.”

The newly-commissioned ministers will assist their pastors in all phases of parish life. A minimum commitment of two years service is required, although most are already considered very active in their parishes and many will look to continue their formation training even further.

Third suspect arrested for break-ins

By Chris Morris denpubs@denpubs.com SARANAC LAKE — An investigation into reported vehicle break-ins on Franklin Avenue last Wednesday morning has resulted in the arrest of a third suspect.

According to Saranac Lake Village Police Chief Bruce Nason, his officers arrested 19year-old Justin K. Kelton of Lake Placid on Sept. 13 at 10 p.m.

Following last week’s arrests, Saranac Lake Police launched an investigation with assistance from the Lake Placid Village Police and Ray Brook-based State Police.

The investigation revealed that Kelton, along with co-defendants 19-year-old Riaval B. LaVair and 20-year-old George W. Setzer III, allegedly went through numerous vehicles in both Saranac Lake and Lake Placid, stealing several items in the process.

Last week, Nason said dispatch received a complaint of three persons entering unsecured vehicles parked on Franklin Avenue.

Police arrived at the scene in time to interfere with the criminal action.

Kelton was arrested Sunday night and charged with one count each of petit larceny and sixth-degree conspiracy. He was processed and released on an appearance ticket to appear in Saranac Lake Village Court at a later date.

Lavair was charged with criminal possession of stolen property and sixth-degree conspiracy. Setzer faces charges of sixth-degree conspiracy, attempted larceny and unlawful possession of marijuana.

Lavair and Setzer were arraigned in court last week.

Nason says the trio may be responsible for numerous thefts that were reported in both Saranac Lake and Lake Placid. Items stolen reportedly include car stereos, iPods, GPS systems, satellite radios, computers, car chargers, money and various other unspecified items.

Anyone with information related to these crimes is asked to contact police in Saranac Lake, Lake Placid or State Police in Ray Brook.

Essex County leaders respond to APRAP

By Matt Bosley matt@denpubs.com ELIZABETHTOWN — Essex County officials lauded a recently completed report that shows some troubling statistics for communities in the Adirondacks.

Jim Martin from Landscape Architecture and Engineering gave a presentation to the Essex County Economic Development Committee at their Sept. 14 meeting summarizing the Adirondack Park Regional Assessment Project, which outlines the economic and demographic challenges facing the region.

Using data from local governments and state agencies, researchers compiled charts and color-coded maps showing trends all too familiar to the Adirondack Park: a stagnant, aging population and stifled opportunities for growth.

Martin said that while communities around the edge of the park have shown increases in population, the core communities of the Adirondacks have been steadily losing people.

“The median age is increasing at an exceptionally fast rate,” he said, noting the Adirondacks are rivaled only by the west coast of Florida for the oldest residents.

The rising age of people in the park is felt most heavily in the schools, Martin said. The number of K-12 students has fallen 31 percent since 1970.

Meanwhile, the number of teachers has risen 43 percent, putting extra stress on communities to produce more revenue through property tax.

Adirondack schools are losing students at a rate of 354 every 18 months, said Martin,

the equivalent of one average school district in the Adirondacks.

Martin also pointed to land use as another major issue in the Adirondacks. With more than 40 percent of the park owned by the state, another 20 percent under conservation easement, and another 15 percent already in use, only 15 percent of the land in the Adirondacks is available for development. forty percent of residential parcels are owned by residents with addresses outside the Blue Line.

Unemployment in the region rises to 30 percent during the winter months, said Martin, and even during the summer it is still higher than in the rest of the state.

“This assessment review is incredible,” said Robert Dedrick, supervisor of Ticonderoga and chair of the committee. “If we can't use a lot of this data, we should be ashamed of ourselves.”

Dedrick said one of the most startling statistics in the report is that less than one half of one percent of the land is used for commercial or indus-

trial purposes.

“Those are the drivers of the local economy,” said Martin, noting actively utilized commercial and industrial land requires 30 cents worth of services for every dollar they generate while residential land requires $1.30. “Having a balance between the two is crucial.”

Other supervisors praised the assessment project, saying it points out valuable information that should be brought to the forefront.

“The one number that is really astounding is that 30 percent of the population is in a government job,” said Moriah Supervisor Thomas Scozzafava. “How do we get the state legislature to sit down and look at this report and see that the Adirondack Park is different than the rest of the state?”

Martin said Assemblywoman Teresa Sayward had organized a delegation of 25 state legislators to view his presentation in May. “I think that's an encouraging start,” Martin said, noting that the challenge will come in getting representatives to fo-

cus on a region with only 130,000 people.

Essex Supervisor Ron Jackson said the state should focus on maintaining a “critical mass” of people in the region.

“Are you going to want to be up on the mountain if there's nobody to come get you if you have a heart attack?” he asked. “It benefits the state to have people up here.”

Carol Calabrese, co-director of the Essex County Industrial Development Agency, said enough has been done to ensure environmental conservation within the park, and that government should now shift its focus.

“In my opinion, we need that same commitment at the state and federal levels to preserve the socio-economic sustainability of the Adirondack Park,” she said.

hey don’t drive, they don’t have a job and they don’t have a cell phone. They sometimes cannot tie their own shoes or zip up their own coat. Many are missing teeth and more than a few seem to have a difficult time sitting still. If you guessed that they are kindergarteners, you would be right.

By Scot Hurlburt soon will experience their first day of school. They have initiated the fall ritual of school shopping which often includes a brand new backpack. Their new shoes may still not fit just right as they have not had enough time to stretch out yet. Many have stood with a parent or parents for the first time waiting for the big, yellow school bus. As they catch a last glance of mom out the school bus window, they wonder why mom is smiling and waving while she wipes away a tear. The bus is noisy, they bounce on the seat and they cannot see over the top of the seats nor do their feet touch the floor. They sit at the front of the bus and near the bus driver. It just feels safer. The older kids sit near the back and seem like giants as they walk by.

While school is exciting and interesting to them, it can also be a little scary sometimes. They don’t mind standing close to each other. Having a buddy and holding each other ’s hand is OK. They like doing everything in groups and don’t mind sharing their stuff. They don’t hide their enthusiasm and are almost always smiling or laughing. They seem to know that they are beautiful, wonderful and perfect just as they are right now in this moment.

Some are a little home sick the first couple of days but luckily, kindergarten teachers are imbued with a caring magic that makes you feel good inside. They help you find your seat and your cubby so that you can put your stuff away. They help you with lunch and your snack. Sometimes they get down on one knee so they can look you in the eye to let you know that everything is alright. They show us how helping each other and looking out for each other is really the best way to help ourselves and our classmates. They always make sure that everyone is included and everyone gets a turn. They also make sure that everyone is always safe.

I can clearly remember my daughter ’s first day of school and the mixed feelings that my wife and I acknowledged as our daughter reached this milestone. During her first year of school she shared with me much of what I have just shared with you. Mrs. Higgins was her teacher and she was a fantastic teacher in every way that is important.

As a teacher she taught many important things upon which an entire education was built, As a person, she taught lessons that were even more important. I guess it is true that everything you need to know you learn in kindergarten.

Good luck, class of 2022 and thank you to all the Mrs. Higgins out there that will welcome you to your first day of school. Remember, all kids count.

RAY BROOK — After years of controversy and lawsuits, the effort to reclassify roughly 12,500 acres surrounding and below the waters of Lows Lake has come to an end.

In a six-to-four vote, the Adirondack Park Agency Board of Commissioners approved the reclassification Friday of the recently acquired state land — and for the first time in agency history, classified nearly 2,000 acres of lake-bed as wilderness.

Some Adirondackers believe the decision represents an unwarranted expansion of the APA’s jurisdiction and a further erosion of landowner rights.

Most of the terrestrial property will also now fall under the wilderness designation, while numerous non-conforming structures like bridges and access roads are now considered primitive.

While agency staff claims the move — although unprecedented — is an appropriate expansion of zoning regulation, detractors have called it dangerous and they worry about the future of private ownership of land on lake shores throughout the park.

Commissioner Lani Ulrich — who chairs the agency Regulatory Programs

Committee — expressed some doubt about the push to classify a man-made lake bed as wilderness while questioning agency Counsel John Banta. ”Can we classify this as wilderness waters event although it’s created by a man-made damn?” Ulrich asked Banta.

“We can do this, it’s not in conflict?”

Lows Lake exists because of two 100year old dams and is encircled by numerous roads and private easements.

But Commissioner Jim Townsend countered stating that the move is not as precedent-setting as some believe.

“The precedent set here is narrow and specific to this location,” Townsend said.

Local officials have blasted the move for months, arguing that is nothing short of the agency expanding its own authority.

But APA Counsel John Banta said that the State Land Master Plan “invites discussion” about the classification of lake beds.

The Lows Lake issue got especially ugly after a lawsuit was filed by the Adirondack Mountain Club against the APA and the state Department of Environmental Conservation stating that the agency was required to reclassify the land and ban motorized activities in accordance with the SLMP. Due to the suit, the agency preempted the reclassification by disallowing

float-plane access to the popular bass fishing destination as of January 1, 2012.

Several canoeists had claimed that the presence of the float planes was ruining their wilderness experience.

The two remaining floatplane operators in the park —Helms Aero Service and Payne’s Floatplanes — have reported that flights to Lows Lake account for around 35 percent of their annual revenue.

But for Adirondack Mountain Club Executive Director Neil Woodworth, the reclassification is essential in preserving one of the finest canoe corridors in the country.

“APA’s action is a vital step in protecting the wild character of these canoe routes, which offer rare opportunities in the Adirondacks for quiet canoeing and kayaking,” Woodworth said. “This is the proper follow-up to the agency’s decision to phase out float-plane use on the lake by the end of 2011.”

According to APA spokesman Keith McKeever, the agency is currently in negotiations with all of the stakeholders in an attempt to find an alternate location for floatplane access.

The move to reclassify the land will take effect immediately, pending the signature of Gov. David Paterson.

In one class, someone spoke up and felt they should get four bottles for free, because the shampoo is already on sale BOGO at the store, and the coupon states “Buy One Shampoo, Get One Free.” But it doesn’t work that way (and the store cashier will take issue with that incorrect viewpoint, too!)

Truly, the BOGO wording on the coupon is irrelevant when you are using the coupon during a sale in which those items are already BOGO at the store. What we as shoppers are looking at is the actual value of the coupon.

Because the coupon has a value of $4.99, it’s just like handing the store that same amount in cash.

I’ve touched on this in previous columns, and it’s important to mention it again. Think of your coupons as cash, because they are! They represent money to you and to your store. And when you start thinking of them as cash, it helps you visualize why you can “buy” items that will ultimately be free with a coupon.

Diocese now 60 years old, the church is faced with a dwindling number to serve 105 parishes and more than 100,000 Catholics in the North Country. The 14-year-old formation program has seen more than 800 individuals go through the course to provide assistance to their parish families.

“I’ve been a little worried about it,” admitted Bernardi. “And, it went from bleak to promising to bleak to promising to delightful, thankfully.”

In the days leading up to the campaign kick-off breakfast, Bernardi learned Wyeth would indeed make a corporate donation of $32,521, and the employees of both the Rouses Point and Chazy facilities will again conduct employee fundraising campaigns.

Though there was no novelty check presentation from Wyeth as in years passed, company representative Tammy Lashway was in attendance for the breakfast, standing as Bernardi recognized Wyeth for the contribution.

Lashway later said the donation was part of Wyeth’s continued commitment to the North Country.

“I think it’s very important,” she said of the donation. “We need to support our community.”

Champlain National Bank also surprised Bernardi and the fundraising team this year, again nearly doubling their amount raised.

The bank’s employees raised $2,000 in the 2006-07 campaign year, doubling that amount the following year and doubling that amount the year after.

Given the state of the national economic climate and that Champlain National Bank had a recent reduction in its number of employees, Bernardi said he didn’t expect the business to be able to raise as much as in previous years. But, they did.

“We just figured they were maxed out. I mean, you can’t double it every year. It’s not realistic,” said Bernardi.

Gail Bridge, human resources director for Champlain National Bank, said bank president Jon Cooper challenged his employees to do just that, and they came close.

“We showed him what his team can do. We raised $15,000,” said Bridge.

More big news came from Nine Platt Hospitality Group, which raised $10,121, which was the largest amount from the local business in the past seven years.

“I believe that we will exceed the goal,” said Basiliere, who is serving the campaign team for her 11th year. “I believe for those people who are employed, who have a campaign within their organization or within their business, that they will give because of the economy, not in spite of it.”

Though pacesetters are an important part of getting the campaign moving, said Bernardi, every donation is just as important as the last, he noted.

“Every penny is important,” said Bernardi, “whether it comes in today or whether it comes in in December.”
