Michigan’s No-Fault reform continues to have real time devastating implications for motorcyclists. When a motorcyclist is involved in an accident with a motor vehicle, the motorcyclist is bound by the medical
expense cap that the motorist chose for himself/
herself on his/her own auto policy! For example, if a motorcyclist incurs $350,000 in medical expenses, but the involved motorist only chose a $250,000 cap on his/her auto policy, the motorcyclist’s no-fault claim for medical expenses is likewise capped at $250,000.
As an attorney representing injured motorcyclists, I drafted House Bill 4809 that would allow injured motorcyclists to instead seek payment of their no-fault benefits from their own auto insurance, hence get the benefit of their own choice of medical benefit cap.
