Editor's Article Buying land should not be such a hustle, especially when you go through the required legal processes. It is important to note that it is only through the right legal procedures that your right as a purchaser will be safeguarded. It is important for one to use a reputable lawyer or firm of advocates to act for him/ her in the sale transaction. The lawyer will also assist you in obtaining the requisite completion of documents. Here are 5 pitfalls to avoid when purchasing a piece of land 1. Never rush into buying any piece of land It is important to carry out a due diligence on the authenticity of the house or property you want to purchase. It is safer to buy from a legitimate real estate company that is registered by the relevant bodies and has a track record than from a source that is unknown. In this digital era, property search has been made easier with just a click of a button. Find reputable real estate portals that list registered real estate companies to buy land from them. These real estate portals have sieved off unscrupulous people who purport to be Realtors thus making your property search as stress free as possible. 2. Never buy without negotiating first Negotiate, Negotiate, Negotiate. Why do I say this? Even if you have the entire amount of the price offered, properties are always inflated and therefore it's good to put your negotiation skills to the test to get the best deal of any land you want to buy. 3. Never make any oral agreement. When an agreement involves land ensure that all the agreements are in writing. Oral land transactions cannot be enforced by law courts. The most basic of the document that you need is a purchase receipt. You should ensure that you read any fine print on the receipt and take note of the words used. For instance, if you fully paid for the purchase of the land and you find written on the receipt that you leased it no explanation from the seller should suffice until he or she changes the words to reflect that the land had been sold to you. Land can be purchased from an individual, a community, a private or a public corporation. When the land is purchased from a community rather than an individual, the precautions you need to take during and after payment are slightly different. In this instance, a sale of community land must be with the consent of the head of the family. The receipts and agreements that you will have must be signed by the head of the family and any other recognized signatory or signatories of the family. 4. Never deposit finances to the seller's account without signing n offer letter Offer letters are mainly processed by lawyers or Realtors representing the buyer and the seller. Offer letters protect either party just in-case one decides to change his/ her mind. Incase either of the parties terminates the agreement, there is a fine that is paid by the party that terminates the agreement first. 5. Never buy a piece of land without inspecting it first You may be buying the land for your own use or to lease it. Whatever the reason for buying the land, it is important to conduct an inspection on the land. Verify the exact position of the beacons and find out from the neighbors or the community about the land e.g. if it floods during the rainy season. The inspection should be carried out by a registered and reputable land surveyor.

10 Questions with Mr. James Muigai Muigai Commercial Agencies Ltd was founded in 1976 by the late Mr. Samuel Kahiga Muigai in Nakuru town ini ally as a general insurance brokerage firm. Meet James Muigai, the director in charge of the Technical wing at Muigai Commercial Agencies. Here is what he tells Gloria Ngure about the real estate sector. 1. Do you think the real estate sector is a never ending sector and why? You can never say a certain sector of the economy is ending, you can only term it as sustainable or not. And YES!! Real estate is certainly a sustainable sector of the economy as it forms part of the basic needs. You can have a look at the best prac ces in land management to yield highest and best use of the landed property. 2. What percentage of growth does the company experience every year? A company always grows when the product grows in both diversity and use but as you know land does not expand in size, it is just put to the highest and best use to yield growth. We have experienced constant growth throughout the years as more and more people develop landed products. The percentage, however, is never constant as various mes call for various percep ons about real estate investment e.g. during elec ons, we experience very slow and low property sales as opposed to when the country is stable enough and has offered good economic climate for investments. Some mes during the same elec oneering period, the rate of uptake of rental property is high depending on the migra on pa erns associated with elec ons. 3. Where will the company growth be directed to in the coming years? The company definitely aspires to grow in terms of development of proper es in various areas of the country and in the greater East Africa/ The African con nent in general. We should be offering gated communi es, integrated concepts as well as luxurious proper es targe ng both the middle and high end segments of the society. 4. There are many Real Estate companies coming up in Kenya every day. How can one know the legi macy of Real Estate Company? The prac ce of real estate is very diverse in itself and various companies offer various products. A real estate development company is involved in construc on of developed units on land whereas a real estate company is involved in the selling aspect of the developed product. Both are governed by different laws of Kenya. For real estate agents, we have Cap 533 of the law of Kenya which governs the prac ce of agency, whereas we have ins tu ons like the Ins tu on of Surveyors of Kenya (ISK) by which members prac cing more advanced real estate management prac ces are registered and governed. Land managers and valuers form such membership. Our directors are both registered under the Estate Agents act CAP 533 and ISK for be er and enhanced delivery of services. 5. Are you involved in any sponsorships or community Rela ons ac vi es? We do sponsor individual students through our sister company, Carol Academy, as well as support the needy children of various children's homes in the country including St. Ann Mother & Child Home, Newlife Children's Home among others. 6. What are the challenges of running a Real Estate company? Challenges of running a real estate company are diverse and are encountered at different stages in the delivery of services. From when a client approaches us to sell a property on their behalf, you may find that the product is not legi mate, or is grabbed, or is under dispute. Secondly, the records in the various land registries may not be updated, hence hindrance in the true iden ty of the owners. Thirdly, in real estate management, when a client has approached us with an already complete product for us to fetch tenants and start collec ng rental incomes, you may find that the house is not what is required in a certain market hence crea ng a lot of voids/ loss of rent. These are just a few, and as I said, they are many and varied depending on the area of opera on. 7. What is your advice to people who want to get into Real Estate Business? My advice to young and old people alike who want to get into the profession is that they must first aspire to understand the profession. I usually tell people that selling real estate is not the same as selling a bag of potatoes or onions which is an absolute sale. It involves a lot of processes which have to be followed. So it is a good profession but one which you have to be careful when selling. Research of the product and a er sale service is very crucial. 8. A typical day for you? My day starts at 6:00 am with a morning jog, then the office by 7:30 am where we hold a brief staff mee ng before opening the doors at 8:30 am to customers. Official hours never end as I strive to meet clients a er hours. 9. Favorite Quote? My favorite quote used to be said by my late father every other day we would be together. He used to say, “War is war comrade” meaning you either fight or die. 10. Advice to young people? I always tell the young ones that I mentor that a dream is never too big if you have proper planning and discipline. “Failure to plan is planning to fail”. Never ever give up no ma er your age, background, color, or what you did in the past. You wake up to start a new day which is the beginning of something new.
