PURPOSE The purpose of this report is to enable Council’s Planning Authority Committee to make a decision regarding applications for dispensation (DISP2014.05) and a planning permit (PA2014.0166) for 90-102 Stony Rise Road. It is proposed to alter the requirements of the Devonport Interim Planning Scheme 2013 (Planning Scheme) to enable the construction of a showroom 6m from the Stony Rise Road frontage rather than 15m as currently required as an Acceptable Solution in the Devonport Regional Homemakers Centre Specific Area Plan (SAP). Should the decision be made to exhibit the dispensation, approval is also sought for a showroom and the consolidation of lots along Stony Rise Road to provide a uniform frontage.

SITE DESCRIPTION The subject site is located on the northern side of Stony Rise Road, immediately east of the Friend Street intersection and south of the site of the proposed Bunnings showroom. The site consists of four titles (Figure 1 shows an aerial view of the site). The largest lot, CT167737/19, has an area of 1.341ha and an irregular frontage of approximately 174m due to strips required for perceived road widening strips during prior subdivision proposals. The issue deemed most important, landscape screening, remains so. Internal traffic circulation and security fencing are not desirable adjacent to the street frontage and therefore reducing the setback will ensure that only landscaping is possible within this area. The planning permit for the proposed Bunnings has also confirmed the internal traffic circulation and additional room in the setback area is not required any longer. One concern in reducing the setback is the impact of a future building on the streetscape. The zone allows for a building height of 12m however such a building would impact negatively on existing dwellings on the southern side of Stony Rise Road. In order to ensure that any future impact is minimal it is suggested that the clause be amended to require the Stony Rise Road carriageway receive at least 5 hours sunlight on 21 June each year. This will ensure that the dwellings to the south are not overshadowed and will also reduce the visual impact of any future building. While a planning application is being made in conjunction with the application for dispensation it is felt that this requirement may be necessary should the proposed development not go ahead and be replaced with a non compatible building form at a later time. Special or Significant Features of the Subject Land There are no special or significant features of the subject land. Threatened Species There are no threatened species involved. Consistency with intent of zone The proposal is consistent with the intent of both the zone and the specific area plan (SAP) which is to provide for large floor area retailing and service industries (Commercial zone) and for integrated bulky goods showrooms and trade supplies, including associated food outlets, car parking, signage and landscaping (Devonport Regional Homemaker Centre SAP). Statutory Requirements Before deciding to exhibit a dispensation Council must be satisfied that the application: (a)
would not conflict with a common provision in the interim Planning Scheme that applies to the area of land; and
(b)
would further the objectives set out in Schedule 1; and
(c)
would be in accordance with all State policies; and
(d)
would be in accordance with the regional land use strategy for the regional area in which the land is situated; and
(e)
is consistent with the safety requirements set out in the standards prescribed under the Gas Pipelines Act 2000; and
(f)
as far as practicable, will not conflict with a use, or development, in respect of land next to the land to which the application relates, that is a use or development permissible under the relevant interim Planning Scheme.
The proposed dispensation is in keeping with the abovementioned criteria. A detailed examination of the statutory requirements can be found in Appendix 1 as provided in the applicant’s submission (refer pages 9-12 of the Planning Development Services report).

The Depa artment off State Gro owth did not feel th he need to t comme ent in rega ard to the e proposed subdivisio on, therefore it is felt that there e is no reason to refu use the pro oposal. In n addition, an arrang gement ha as been m made for th he portion n of land d directly south of the e proposed access to o be made e road to e enable all proposed p pedestrian n infrastruc cture to be e located w within the road reserrve. Figure e 8 below shows the e approxim mate locattion of the e portion off land in question q circled c in rred and th he portion to be co onsolidated d with the e remainde er of the lott outlined in purple.

On site stormwater detention (OSD) must be provided by the developer to reduce the outflow of stormwater from the site to what it would have been for a site coverage of 50% permeability. The OSD must be designed to account for the 1 in 10 year event and 1 in 100 year event with provision for an overland flow path. Design and calculations of the OSD must be submitted for consideration prior to the lodgement of a building application.

No covenants are to be placed on the schedule of easements that are inconsistent with the provisions of the Devonport Interim Planning Scheme 2013.
