Response - General Manager TasWater was created by legislation and Council has an obligation to be a member under the Water and Sewerage Act 2012. MR TREVOR SMITH - 7 GLEN COURT, DEVONPORT Q1
I noticed recently, at the roundabout, Stoney Rise Road and Middle Road, Devonport, road repairs are marked out to be done! This roundabout has just been completed in the last 16 months. Why will the ratepayers of Devonport, have to pay again for this work so soon after completion? Surely the Devonport Council has Australian Road Standards to abide by? Isn’t this another case of wasting Devonport ratepayer’s money?
Response - Deputy General Manager The roundabout that Mr Smith is talking about has some defects which require fixing which will be covered by the contractor at their cost, but it is also worth noting that the road actually belongs to State Growth. As the new roundabout has been handed over the extent of the defects and how far they go is the responsibility of the State Government. Q2
Could you please tell me the total cost to the Devonport ratepayers, to purchase the properties at 26,28,30 and 32 Steele Street and part of 15-19 King Street, Devonport? What costs will this add to the ratepayers huge interest bill already outstanding, on properties purchased in the CBD? What inducements did Council offer TasWater to relocate to Devonport?

Could you please tell me how old is the Devonport Entertainment Centre, compared to the Devonport Council administration buildings? Do you intend to demolish the Entertainment Centre as it is over 35 years old?
Response - Mayor In response to question 3 the Mayor responded that Council wouldn’t be demolishing the Entertainment Centre. Response - Deputy General Manager In regard to the King Street properties, Council paid $1M for those properties in question and in regard to the incentive, there wasn’t any financial incentive provided to TasWater to move into the Southern Precinct of the CBD. Responses to the above questions will be provided in writing. MR PETER STEGMANN - 118 RIVER ROAD, EAST DEVONPORT The Hotel Consultant’s report indicates that they are unable to provide any quantitative evidence of proven demand and thus their conclusions are only estimates that will require verification. As the hotel complex was part of the LIVING CITY Plan why was this report not commissioned a long time ago instead of leaving it to this late period of time after we have almost commenced the LIVING CITY project?

Page 4 of 17 Response - Deputy General Manager Council has been implementing the LIVING CITY Master Plan in a number of stages and has been focussing on Stage 1. Council are confident that it is at a stage where it can proceed and therefore the focus is on getting Stages 2 and 3 up. Stage 3 includes the hotel and obviously it is clear that getting the hotel as soon as possible is in the best interest of the City so Council is doing all it can to progress that and therefore that report was prepared which is on the agenda for tonight. The report also indicates that hotel occupancy in Devonport sits at 52%. Why should Council be involved in encouraging a new hotel to the town which will be in direct competition to existing operators?
Response - Mayor That report is on the agenda tonight for discussion. But I would put it to you Mr Stegmann that with the Cradle Mountain Way, with other events that are happening on the coast as well as growing the pie that the need will be there. There will be further debate on that issue tonight when the report is considered. Item 5.6 on page 153 of the current meeting agenda states under Community Engagement that “Council has appointed three community members to this Reference Group”. Who are these community members and do they represent residential ratepayers and/or small businesses?

Council has put an emphasis on the number of consultants it has engaged for different areas of developing Living City with HillPDA being one such example touted as a highly regarded and reputable company in its field of expertise. On that basis, at what point in time and by what process were the Aldermen consulted on the decision to ignore the recommendation to undertake a further series of business case studies and an independent review (“independent” being a review and written report undertaken by an

Page 5 of 17 appropriately qualified entity that will not benefit commercially from the Living City project proceeding) to assess likely success of the Living City concept? Q8
Assuming the Aldermen were consulted in making the decision to ignore undertaking an independent review of the Living City concept, by who and in what format was the advice/recommendation (written or otherwise) put to the Aldermen to ignore a most critical phase of the Living City risk management process?

At some point prior to the February 2016 public meeting, Council became aware of a $50M shortfall in the funding of its $70.5M Living City Stage 1 project (assume $20M from increased delivery costs for the construction phase and $30M shortfall in State and Federal grants identified in the former funding model) and accordingly at what point in time and in what format was this presented to the Mayor and Aldermen?
Q10 Further to Q3 and in arriving at the decision to simply allocate an additional $11M from cash reserves plus add $39M to the already approximate $20M of costs and borrowings for Living City to date, what due diligence processes were undertaken with the Mayor and Aldermen to assess the obviously massive change in the project’s financial risk profile prior to release of the new funding model in February 2016? Response - Deputy General Manager The majority of those questions Council has answered already to the best of its ability, there is not a lot further to add, but there are a couple of points. With regard to the appointment of a Quantity Surveyor, we can advise that it is Lifecycle Cost Management, Stuart Solman. Cost of fitout is being negotiated with the tenants, and will largely be the tenants’ responsibility. Members of the community group are Jodi Wilkinson, Andrew Billing and Tim Hess on the Reference Group. So far as HillPDA, Council has been comfortable with their advice and that has been provided in writing before to Mr Gardam. The same with the inference around the funding shortfall, this is not something Council agrees on, therefore there is nothing further to add on that question. In regards to the others we don’t have any other comment. Further responses will be provided in writing. MR BOB VELLACOTT - 11 COCKER PLACE, DEVONPORT In fairness to you Mayor and as we all know you will be standing for the Senate, when questions are being asked in regards to certain aspects of your position as Mayor and I think it is only fair that the facts be given tonight in that regard. My question is will you whilst on leave of absence to campaign for the Senate be accepting your Aldermen and Mayoral allowance without guilt? Response - Mayor That question was answered in writing and recorded in the agenda at the last meeting. There was a two page letter I provided to Mr Smith which was published in the agenda last month which outlined that allowances are paid in arrears. It outlined that in the past seven years I have taken five weeks of personal leave and that it is my intention to take a leave of absence for four weeks, during which time I will receive my allowance, which is paid in arrears. Also will you be handing over to the Deputy Mayor your Mayoral mobile phone and the vehicle? What is the situation there? Response - Mayor The vehicle will be handed over to the Council which the Deputy Mayor will be able to utilise. Page 6 of 17 except that it is a plan and there is a set cost to Council for that plan, each month and any over cost is payable by the Mayor. I note a report in the Advocate 26 July 2011 that concerns were expressed if the Spirits of Tasmania were lengthened they would be impossible and/or impracticable to berth in the Mersey River. I understand that the existing ships are 194.3 metres in length and the maximum length for ships to use the turning basin is 205 metres in length over all. Q1. According to Council the economic promises of the entire Living City are entirely dependent on the Stage 1 catalyst phase and the need to attract significantly increased visitor numbers from the Spirit of Tasmania ships for it to succeed and given the recent announcement (Advocate 21 May 2016) that the existing Spirits will be replaced in 2023 by ships that will carry more passengers and freight: what written guarantees did Council obtain from the Infrastructure Minister that Devonport will remain as the home port for the TT Line prior to incurring some $59 million in borrowings for the Living City Stage 1 plan? Response - Mayor It has been stated on numerous occasions by the State Government that Devonport will be the home of the Spirit of Tasmania, categorically by the State Government, publically recorded in the newspapers and other media. If no guarantee has been given will Council seek a guarantee from the relevant Minister that will ensure that Devonport remains the home port in Tasmania for the ships?

Mr Mayor as I have walked between Oldaker Street and Steele Street I’ve counted fourteen empty shops, not including all the empty spaces for offices upstairs. With that in mind can you tell me if the Council has received a guarantee, not an expression of interest, but a signed guarantee by a major retailer as an anchor, so that we can guarantee we have an anchor tenant that will go into any of the new areas of the Living City complex?
Response - Deputy General Manager No, Council doesn’t have a written guarantee agreement with a major tenant, we certainly have interest and certainly have economic studies showing the demand is there, but the answer is no, there is no guarantee as yet. Q2
Seeing the owners of all those properties in Devonport, what will the Council, seeing as they have received rates and taxes from those properties over many, many years to keep this Council and this City going? What assistance will you give to those people who have lost their tenants and their shops are now standing empty?
Response - Deputy General Manager Whether landlords have tenants or not, is not Council’s responsibility. What can be said if you go back to the principles of the Living City Master Plan that Council is taking actions that will consolidate retail in the CBD and that is with a view of protecting existing retail in the CBD and preventing further fragmentation. 3.3

Annual Luncheon for 50+ Year Ratepayers That the report of the Media and Communication Officer regarding a ratepayer luncheon be received and noted and that Council: 1.
Agree to host a luncheon for eligible Devonport ratepayers as part of Council’s Seniors Week 2016 program.

Allocate $3,500 in the 2016/2017 budget towards the event and its promotion.
