Many consumers mistakenly believe that credit card lawsuits are scare tactics used by debt collection companies and that they are not real. Anyone who has had a bill go to a collection agency knows that the collectors use all sorts of unsavory tactics to collect the debt. After all, their salary depends on the percentages of bad debt that they can collect. Some agencies will send out "fake summons" type of forms to fool the consumer into thinking they are sued. Many people who have had collectors after them for some time tend to dismiss these forms as just another collection tactic and do not investigate further. This is initially what I thought when I was served papers for a credit card debt lawsuit. However, being the investigative sort I went a step further and pulled up the website for my local courthouse and typed in the case number. Turns out it was a legitimate case! That's when I started to panic. Turns out that while collection agencies do threaten to sue...they actually follow through with those threats if they deem you a good collection prospect. Collectors have all sorts of models available to score you and determine whether you are "collectible." Don't think that just because it's been a few years that they still aren't monitoring your credit report. If you have assets to protect such as a house or car, you are even more enticing. You see, the deal is that by suing a debtor in a court of law they have a 90% chance of collection by default. Most people sued do not show up to defend themselves. It's a daunting process and frankly can feel quite embarressing, I know I felt that way. What you don't know is that most of time if you do defend yourself, you'll likely never see the inside of the courtroom as they will either drop the case (most third-party debt collectors don't have the paperwork to back up the case!) or you can settle out of court for a much reduced amount. The lesson is this, when served with a summons, (fake or real) be sure to verify it's authenticity with the local court and if you are indeed being sued, do your homework and fight back. The average consumer can defend themselves in this type of lawsuit and enjoy a successful end result be it a dismissal of the case or a fair settlement.
