TK Mashaba The Bela-Bela community has been growing increasingly incensed by repeated police raids on a local gathering place, as part of a recent police crackdown on illegal alcohol use. Much of the indignation was fuelled by confusion, as the community members were not aware of the reasons for the repeated busts. Maks Chisanyama, a popular gathering place for township residents, was raided on Saturday, 15 October, and again on Saturday, 22 October. The BEAT reported on the 15 October raid in a previous issue. Police vehicles arrived at Maks at around 20:00 on Saturday, 22 October, reversing their vehicles up to the exits. Eyewitnesses claim that there were at least six vehicles and many police officers, some of whom were not local. Colonel Lindi Marx of the Bela-Bela Police confirmed that 110 officers took part in the operation, and that assistance was requested from stations in Gauteng. The surprised patrons were amazed to see police emptying the bottles of alcohol they had brought to enjoy at the Chisanyama. The venue does not have a liquor license and does not sell alcohol. Instead, patrons are allowed to bring their own drinks to be enjoyed with the meals served at the Chisanyama. The police eventually left with a number of the restaurant’s patrons. Local DJ Mpho Kinstan says that he does not understand why he was detained. “They asked me to leave and while I was telling them that I’m the sound engineer,

they forced me into their vehicle. They did not charge me when we arrived at the police station.” The BEAT reached out to Bela-Bela police to clarify the situation. In an interview, Colonel Marx explained that contrary to popular belief, the practice of allowing customers to bring their own alcohol to a restaurant that is open to the public as Chisanyama is, is in violation of Section 154 (1) (d) of the National Liquor Act no. 27 of 1989. This Act renders it illegal to consume alcohol “in any road, street, lane, or thoroughfare, or on vacant land adjacent thereto, in an urban area or other area subdivided into erven or plots with streets bounded by such erven or plots.” According to Section 154 (1) (c) of the same Act, it is also an offense to be drunk in “any place of entertainment, café, eatinghouse or race-course or any other premises or place to which the public has or is granted access”. Because Maks Chisanyama is being run as a business, it is considered to be a public place in terms of the Liquor Act. Except in cases where the owner has a liquor license, consuming liquor in a public place, regardless of the source of the alcohol, is against the law. Colonel Marx explained the reason behind the crackdown as an attempt to curb crime in the area. Of the 60 assault cases received in September, she said that 55 were alcoholrelated. Contact crimes such as assault and rape have also been on the upswing in the township lately, to the point where the crime figures for September were among the worst that the town had seen in years.

Amid fears that the crime rate would only continue to skyrocket if nothing was done, the decision was made to crack down harshly on illegal alcohol use at Bela-Bela. Part of the reason why Chisanyama was raided, she said, was that the restaurant’s patrons would often spill over onto the busy thoroughfare into the township, creating a dangerous situation for passing traffic and making the area almost impossible to effectively police. Colonel Marx also said that the owner of Maks Chisanyama had been warned that patrons were not allowed to bring their own alcohol to the premises, and had not complied. While none of the patrons who were detained on 22 October were charged, Colonel Marx said that they were warned against public drinking and released on the understanding that if they were detained again they would be arrested. Colonel Marx promised that the raids and the crackdown would continue until the situation was under control. The owner of the Chisanyama refused to comment, but did say that he was consulting with his legal representatives. * It has come to The BEAT team’s attention that last week’s article regarding the police raids in the township (Local journo caught in police sweep, Page 2, 21 October) may have given the impression that the individuals picked up by the police, among whom were municipal employees Thabo Moselane and Tebogo Maheso, and The BEAT reporter TK Mashaba, had knowingly broken the law. While they, and the other patrons who were detained on the night in question, were in violation of the Liquor Act, they were not aware that Maks Chisanyama is regarded as a public space in terms of the Liquor Act

A prominent member of the provincial legislature said that he could not comment on his case or the charges levelled against him. The official was arrested on Tuesday, 11 October on charges of rape and bribery. The suspect, a highly-placed member of the ANC, told The BEAT on Tuesday, 25 October that he could not comment on the matter regarding his case because it is a matter for the courts, and referred the media to representatives from ANC branches. It is alleged that he raped a 23-year-old woman at The Park Hotel at Mokopane on 5 April this year, but there was not enough evidence at that point in time to make an arrest. Police’s provincial spokesperson Lieutenant-Colonel Moatshe Ngoepe said that the arrest was made after new evidence came to light. The ANC in Limpopo announced following the suspect’s arrest that they remain resolute in the fight against any form of abuse including sexual abuse and rape. The party’s Provincial Secretary Nocks Seabi told the media that the ANC noted the arrest and re-affirmed its confidence on the judicial system. He added that the ANC encourages a speedy resolution on the matter in the interest of justice. The ANC hold the principle of innocence until proven otherwise and will receive a report from the Regional Executive Committee (REC) on the way forward in line with the ANC Conference resolution. During his appearance before the Mokopane Magistrate’s Court on Friday, 14 October, a group of ANC supporters gathered outside the courts with posters showing their support for the suspect. One of the supporters’ poster read: ‘He is not a rapist, but a leader’, while another read: “Stop abusing leaders”. The suspect was granted R1 000 bail and was instructed to reappear before the Mokopane Regional Court on Monday, 7 November when he will plead his case. A representative of his family told the media after the suspect’s court appearance that he believes the rape accusations against him is nothing but a political ploy and that they will fight tooth and nail as it is a miscarriage of justice. He was recorded giving his outlook on court proceedings.

protection against him. The protesters demanded that Ngobeni remain behind bars until his trial is concluded. ANC Chief Whip Councillor Spando Maluleka was among the protesters, many of whom were women. She said that justice must prevail. “We don’t need the kind of people who abuse women and children in our community,” she said. “We want to see justice done.” Ngobeni, a former soccer player for local team Fast VI FC and

formerly a goalkeeper for Total Surrender, appeared briefly in court. His case was postponed to Tuesday, 1 November. DA Councillor David Senosha and a number of DA members also attended the hearing. “We are supporting the community as their leaders,” Senosha said. “We meet as the leaders from different political parties to tell the community that the justice system will make the decision. There is no need for the community to take revenge.”

Court on Monday, 24 October. The suspects were arrested on Thursday, 20 October, after they were allegedly found in possession of two unlicensed firearms. According to Lieutenant-Colonel Abel Phetla of the Bela-Bela Police, the suspects were stopped and searched by the local traffic officers during their normal roadblock operation on the day in question. Phetla said that the traffic officer who stopped the suspects found a crowbar and cable ties in the boot while searching and asked his colleague to alert the police immediately, while he stalled them by checking everything regarding the car. On arrival, the police also searched and detained the suspects, charging them with possession of unlicensed firearms and ammunition. The police confirmed that one of the firearms had seven bullets, while the other had five.

Phetla further said that the firearms were confiscated and sent for ballistic tests to check if they could be linked to any crimes. He added that the suspects are expected to appear again in court for formal bail application. In a separate case, three suspects were remanded in custody when they appeared in court on charges of burglary relating to businesses. The suspects were arrested on Friday, 21 October following a tipoff. The police said that a team of detectives followed up on the tip and tracked down the suspects, who have allegedly been robbing tuckshops belonging to foreign nationals. The suspects were found in possession of the alleged stolen groceries when they were arrested and all the items were confiscated and given back to the rightful owners. The suspects were denied bail and will also be appearing again shortly.

Alleged burglar found with massive stash Justin Steyn A resident in Bela-Bela received a rude awakening as she was the latest victim of an attempted burglary. Amanda Ferreira, who resides in Swanepoel Street, said that she was woken up by the loud barking of her dogs in the early hours of Thursday 20 October. “I woke up and shouted at my dogs for barking constantly, little did I know that there was a man who tried to steal from our house,” she said. Ferreira said that she did not realize the seriousness of the situation until a housemate, Shaun Dearall, informed her that a man was attempting to climb over their wall with a compressor that belonged to them. “Shaun went to investigate the constant barking of our dogs and he found a man was attempting to steal

one of our compressors. The compressor was being balanced on the wall as the man attempted to climb over it. Shaun managed to fight off the man and recovered the compressor. I contacted the BBCS and Galven Security to assist in apprehending the man,” Ferreira said. Bela-Bela Crime Support (BBCS) founder , Elri Arlow, said that members of the BBCS and Galven chased after the man as he fled on foot. “We gave chase to the man immediately after receiving the call. He fled on foot and we chased him from McCord Street. He initially managed to evade capture but was finally caught and arrested in Park Street where he was hiding in an empty house,” Arlow said. Lieutenant-Colonel Abel Phetla of the Bela-Bela police said that the man was identified as Seun Maluleke.

The police in Thabazimbi outside Bela-Bela are looking for two armed suspects who attacked and robbed the John Craig clothing shop at the Thaba Mall on Thursday 20 October. Provincial police spokesperson Lieutenant-Colonel Moatshe Ngoepe said that two men arrived at the store and one of them drew a handgun. They tied up all of the staff and two customers with shoelaces at gunpoint. The captives were then forced into one of the shop’s store rooms.

The criminals went on to take one of the staff and ordered him to open the store’s safe. “The men instructed one of the staff members to open the safe and took different kinds of cellphones, one pair of All Star branded sneakers and push-in shoes, waist belts and an undisclosed amount of money,” Ngoepe said. He added that no shots were fired and none of the victims were injured. “The suspects are still unknown to us and police investigations are still continuing,” Ngoepe said. The Thaba Mall could not be reached for comment.

Farm attackers sentenced to 18 years

Photo supplied Justin Steyn Three men who were involved in a farm attack in January this year have been sentenced to 18 years imprisonment. According to Ben Engelbrecht of the Heritage Protection Group (HPG), the attack happened on Sunday 10 January when Kululeko Freedom Shongwe (38), Albert Matwasa (47), and Mooiman Jabulani Mahlanu (32) waited for Nico Muller at his garage and

detained him using a pistol. Both Nico and his wife, Annetjie Muller, were bound inside their house and the men took off with Nico’s pistol and an undisclosed amount of money. Local farmers and police commenced a search for the men as soon as the incident was reported. “The local farmers and police arrived at the scene and started searching the area. Two helicopters and a small airplane was used to aid in the search,” Engelbrecht said that the men were found hiding underneath a bush in the afternoon by one of the helicopters. “We moved in on the men and after a firefight between us and them, the men were caught and apprehended,” On Wednesday 19 October, the men were sentenced to 20 years imprisonment which was suspended for 18 years. Shongwe Matwasa and Mahlanu were all found guilty of possession of an illegal firearm and armed robbery.

Phetla said that Maluleke was apparently using the empty house to store goods he had allegedly stolen in the neighbourhood. Phetla added that the stolen goods included clothing, valuables and household goods.

Maluleke appeared before the Bela-Bela Magistrates Court on Monday 24 October where his case was postponed to Monday 31 October. According Arlow, this is not

the first time Maluleke has been arrested for burglary. He was allegedly shot in the left leg by police officers while attempting to escape from a crime scene in March last year.

Justin Steyn The National Head of the Directorate for Priority Crime Investigation Lieutenant General Mthandazo Ntlemeza has welcomed the Thohoyandou High Court’s double life-sentencing of Zwanga Mbonani Mashawana (23). Mashawana was found guilty of being involved in the murder of Constable Malesela Stanley Mokonyane (43) and the rape of an 18-year-old woman in 2015. His co-accused Norman Mundalamo (29) was sentenced to life imprisonment for the same rape plus 15 years for robbery under aggravated circumstances. The third suspect who cannot be named was acquitted of all charges after he turned state witness. On Thursday, 20 October Mashawana was found guilty for the murder of Constable Mokonyana from the Modimolle Public Order Policing Unit (POP) in February last year.

At the time, Mokanyane was deployed at Giyani during the demarcations protests and was off duty when he met his untimely death. He was allegedly attacked and stabbed by three suspects in Thohoyandou. The three allegedly ran away with his cellular phone and money. Three days after the incident, the three suspects were arrested by the Hawks and subsequent investigations found that they were connected to a brutal rape case and other robbery cases in Thohoyandou. Lieutenant-Colonel Moatshe Ngoepe of the provincial police said that the rape victim was stabbed, assaulted, and gang raped before she was robbed of all her belongings in January 2015. She survived the attack. “The Hawks management applaud the SAPS and the Limpopo Hawks team for their dedication throughout the investigation which resulted in the apprehension and successful prosecution of these criminals. We also extend our applause to

the National Prosecuting Authority for these harsh sentences, which we believe will send a strong warning message to would-be police killers that crime does not pay,” Ngoepe said. Ntlemeza meanwhile stressed that the sentencing clearly demonstrates that the HAWKS will not tolerate such vile criminal acts and remains committed to ensuring that all South Africans feel and are safe. “The fact that Constable Mokonyane lost his life while off duty serves as a harsh reminder of the kind of dangers all our members are faced with, on a daily basis. Each year we gather to commemorate and remember fallen heroes such as Constable Mokonyane. Such officers remain committed in protecting and fight against crime. For this reason, any person who kills a police officer deserves a hefty punishment. Gender-based violence also deprives women and children of the opportunity to become productive citizens of the country,” Ntlemeza said.

Accused escapes court cells Justin Steyn The Police in Lephalale have launched a manhunt for a suspect who escaped from custody. According to the Provincial police spokesman, Lieutenant-Colonel Moatshe Ngoepe it is alleged that Jimmy Motlogelwa (21) escaped from the local court cells. The circumstances of his escape are still being investigated. He was arrested for burglary and sexual assault. Anyone with information about his whereabouts may contact the nearest Police Station or the Crime.

Photos supplied Justin Steyn Sannah Lebudi. a resident of Leseding, a suburb outside of BelaBela, says she will be forever grateful for the help she has received from Change for Bela-Bela and the Democratic Alliance (DA). The roof of Lebudi’s four-bedroom house was blown off by strong winds on Friday 7 October, leaving her and her seven other family members in a rather worrisome situation. “I was very worried as we are eight people living in the house, which includes two small children. I immediately contacted the municipality and spoke to the mayor, who said that he would help me.”

Despite the alleged promise for help, Lebudi said that the Bela-Bela mayor Jeremiah Ngobeni never came to her aid. Tinus Ras, a DA ward councilor, was informed about the situation and decided to seek assistance from Change for Bela-Bela, a community orientated non-profit program. “We were approached by Tinus Ras, one of our contributors, about the desperate situation that Sannah Lebudi is experiencing. Her whole roof got blown away by the strong winds that shook BelaBela recently, three of her big windows also broke. She explained to us that she is unemployed, like so many others in our community, and does not

have funds to replace the tin of her roof,” the organization’s founder, NJ van Heerden said. Van Heerden said that he immediately contacted his contributors and they assisted in repairing the roof and windows. The repairs took over two weeks to complete, during which Lebudi said she and her family sought refuge at her neighbour’s house. “I am so thankful for the help I have received and I am deeply disappointed in the local government for their failure to help me. I will be changing my vote to the DA come the next election,” Lebudi said. Ngobeni could not be reached for comment.

Head guide wins national award Lizzy Bapela After a lengthy process of nominations, interviews and provincial awards, head guide at Thabazimbi’s Marakele National Park Sidney Fhumulani Mikosi has scooped a national award. He was crowned the best guide in South Africa at the Lilizela Awards. Minister for Tourism Derrick Hanekom presented the awards at the Sandton Convention Centre on Sunday, 16 October. Mikosi has been with Marakele since 2009 and was representing the Limpopo Province at the awards. Since he joined the park, he has received 13 awards including SANParks CEO Awards amongst others. Every year this energetic man sets very high targets for himself and works very hard to attain them. This is evident in the positive feedback that he receives from clients after they have been on a game drive with him, some have called him the “jungle encyclopaedia” while some just say “he is simply the best”. “Dedication, professionalism, research, creativity and of course passion for my job make it easier for me to do my job. This is just the beginning, when I collect an award, I always say it is for SANParks because this is the organisation that has given me the opportunity to do what I love doing best. Modimolle mayor Marlene van Staden has asked The BEAT to publish letters from her to the community and the readers of The BEAT. This is the Mayor’s Letter for October 2016. Since taking control of the municipality in August and in line with our commitment to freedom, fairness and opportunity, we have set about identifying and prioritizing the many problems facing our municipality, problems the ANC created. One of these is the horrendous state of many parks, sports fields and public spaces. We will be setting up a program to turn what have just become dumping sites back into clean and safe public spaces for the use of all our residents. A big thank you to all those who assisted with the recent repainting of road markings as we set about making our roads safer by ensuring that markings are visible. We look forward to more community action as we set about cleaning up more areas in our towns. We have also started a prepaid meter audit to deal with the often random and incorrect billing as well as those who are stealing electricity. Conventional electricity users will be able to convert to pre-paid meters and buy electricity online or in many shops in the area. Regarding the RDP housing crisis in Mookgophong which saw those entitled to homes lose out to home grabbers, we have appealed to the province to intervene and sort out the mess they made. We have written to the MEC and will continue to push for a resolution to this situation. It is important to remember that while certain competencies including Health, the Police Service and Education fall under National or Provincial government, we are committed to ensuring that these levels of government

are held accountable if the system is failing. I really want to commend all the residents who are participating in Ward committees. This is a crucial level of government and an effective way for communities to make their voices heard. I encourage others to join the process and be part of the change. The public participation process to find a name for our new municipality is going ahead full steam. We look forward to seeing what you, the residents, have come up with. Remember to submit all ideas to your councillors. While we applaud residents for being water wise, the crisis is far from over and we ask that our residents continue to be part of the solution. I have visited a number of schools to wish our matriculants well in the coming exams but would also like to use this opportunity to thank the parents and teachers for their role in getting our matrics to this important juncture of their lives. Regarding the IDP Meetings that are taking place until Tuesday, 8 November, I really want to encourage residents to join us during these fact-finding meetings, bringing their input to make their wards a better place. We still have many challenges ahead of us and we remain committed to stopping corruption, improving service delivery and assisting with opportunities for all. The examinations commence in the midst of student protests for free education. Deputy Minister in the Presidency Buti Manamela sent his well wishes to all South African Matriculants, encouraging them not be negatively affected by the protests but to focus on passing. He said that the government acknowledges that some students may have concerns about their future in higher education due to funding challenges, but they encourage them to work hard in their exams and not be deterred by other things. “The National Development Plan recognizes education, training and innovation as key elements in eliminating poverty and reducing equality. Therefore learners should take every opportunity to access education and training with vigour. In considering options for further education and training, learners should consider studying at Technical and Vocational Education and Training (TVET) colleges. These colleges offer courses for practical skills development including technical skills that are needed for our economic growth. Let us make education fashionable!” said the Deputy Minister. The DA also wished all 110 000 Limpopo matriculants the best of luck, saying that the exams are a stepping stone towards securing a better future and the fulfilment of each learner’s dreams to build a better country. The party said that the class of 2016 must be mindful of the fact that last years’ matric class dropped from 72.9 % in 2014 to 65.9% in 2015 resulting in a 7% decline in the pass rate. “We would like to urge all learners to study hard and aim higher to get a pass rate that allows them a platform for tertiary studies. There must be a special encouragement to students taking crucial subjects such as maths, sciences, accounting and economics because our country needs them in the future. We would also like to applaud the efforts of principals, teachers and parents who have provided support, guidance and encouragement leading up to this important milestone,” said the DA Provincial Spokesperson on Education Jacques Smalle. Photo supplied TK Mashaba Limpopo’s Benny’s Sports Academy and Development returned to South Africa after a successful 2016 Danone Nations Cup World Final where they finished in 14th place overall with 32 countries competing. This has been rated as South Africa’s best finish since 2009 where they won the tournament. Benny’s managed to finish second in their Group after beating South Korea 1-0, Italy, the first all-girls team to compete in the finals, 3-0 but losing to Indonesia 1-0. According to Intune Communications & Entertainment correspondent Nombuso Kunene, the second round was tough with Benny facing Brazil in their first top 16 game. “After losing 1-0 they were fighting for position 9-16, they then faced a strong Tunisian team that were far bigger and stronger than the Limpopo boys.” She said. After an early goal the South Africans fought back hard but failed to get the ball past a very agile goalkeeper leaving the boys fighting for position 13-16. The penultimate match of the tournament saw the South Africans running onto the field next to Uruguay, arguably the tallest boys in the 2016 world finals,” she added. Mogale Stadium in Modimolle on Wednesday, 19 October saw the team dealing a fresh blow in a 2-1 defeat to the fellow strugglers Polokwane Academy FC. The team visited Polokwane Academy FC in their hometown, Polokwane on Monday, 24 October for a rematch and they lost again, this time with a dismal 0-1 score. Speaking to The BEAT, the team’s spokesperson John Mabusha said that the boys are content with what they are doing, the problem is that they lose concentration at times. He added that the boys play good football, but that the problem is just to finish the game at a high note and scoring goals. Mabusha further said that the margin is very good and they are not losing hope. He added that they have a turn-around strategy and are enforcing new tactics with the coach and the striking force. He continued to say that the team management pleads with supporters to be patient as the light at the end of the tunnel is about to shine. They also ask the supporters to keep rallying their support behind the boys against all odds!
