Recent Changes Threaten To Squeeze Out The Little Gal Talking about building code will put most people to sleep, but recently proposed changes to cannabis grow building codes in Washington state can’t be ignored. While very few are watching, interests seeking to make it harder to succeed in our booming industry are quietly at work. The Washington State Building Code Council (SBCC), seeks to add growing of more than 15 cannabis plants, and cannabis processing to a more stringent building code that changes the game for commercial growers. If passed, it will be more costly and more time consuming to comply with the state law.

HERE’S WHAT IT MEANS FOR YOU Cannabis grows will be reclassified to group F-1 building code - joining other industries like aircraft manufacturing, electric generation plants, paper-mills, appliance manufacturing, soap and detergents and the list goes on. The council seeks to also add cannabis growing and processing to this list. If something sounds wrong to you, you are not alone. Cannabis is a plant. It grows under the same conditions as any other fruit or vegetable - in a green house, under the sun, or in a building with artificial lights. Lavender, mint, and tomatoes are not classified under the same F-1 building code for Moderate Hazard Factory Industrial facilities these agricultural products are in the Group U, a set of building codes with far less strict building requirements. So, why is the SBCC planning to treat cannabis differently than other agricultural products? In the proposal letter it states,“The proposal specifies an occupancy classification for marijuana growing and processing facilities for consistency through out the state. Group F-1 was chosen over Group U because marijuana growing and processing involves more complex ventilation, electrical, and plumbing equipment than a typical green house. Processing involves hazardous material, which is not typical of Group U.” All growers are not created equal. Growers like Crystal Oliver of Washington’s Finest Cannabis clip, dry, and can their products. The problem with the regulations are that the risk they to manage lie principally with one process, extraction. The SBCC changes refer specifically to solvent-based cannabis oil extraction. Certain risks do pertain, but it should be noted that many other low risk methods for extraction also exist. “A call for consistency prevails over common sense,”


says managing member of Canna Herb Farms Crystal Oliver of Washington’s Finest Cannabis. She explains,“This proposal leans heavily in favor of industrial warehouse operations in cities like Seattle, and basically devastates the small family farmer.” Many others are rallying with Crystal to oppose this code and request amendments. “Consider instead adding marijuana extraction equipment to this list, or consider adding lavender, mint, hay, wheat, apples, pears, cherries, grapes, and all other types of plants and agriculture to this list to ensure consistent application of code throughout the state.” In addition, the proposal letter also states that there “will not be a financial impact” to enact this code. Let me repeat. They said, “There will not be a financial impact.” Local growers such as Washington’s Finest Cannabis, Kush Comfort Farms, TopShelf 420, Green Source, and many others who have testified to the council in Olympia over the last several months would most definitely say otherwise. “If proposal 15-035 is adopted, it is absolute certainty that many of those businesses will fail, resulting in the financial ruin of many families and hardworking people who have invested their all,” states Canna Herb Farms.

Washington growers are not under false illusions. This could be a devastating blow to rural growers. If the F-1 code passes it will mean all greenhouses will have to comply with sprinkler, fire wall, and ventilation requirements that hazardous manufacturing facilities comply with. “I believe that small farmers in rural Washington should be given the opportunity to participate in this new industry and earn a living off of their land. It’s not very often that a new industry with jobs and strong revenue come to Spokane or any place in rural America, please don’t take this away from us. Many of us have invested our life savings into our businesses and we are just now beginning to realize a profit and future market stabilization. We’ve worked as hard as any other farmer to grow our crops, and we don’t believe we should be treated differently than any other farmer or plant cultivator.” Crystal Oliver pleads to the council. Now is the time to help shift legislation and move Washington away from regulation that will hunt our growing industry. We are at the forefront of a new archetype to set the standard for America’s newest industry.
