THE NOEL & HARRIETTE LEVINE COLLECTION
Doyle is honored to auction the Noel and Harriette Levine Collection. This remarkable collection comprises important English furniture and decorations from the Levine’s elegant apartment on Park Avenue and their country house in Bedford, New York. Jewelry from the Collection offers a dazzling array of creations by such prestigious makers as Van Cleef & Arpels, David Webb and Cartier. Generous patrons of the arts, Noel and Harriette Levine were longtime donors to the Metropolitan Museum of Art and the Museum of Modern Art (MoMA) in New York, both of which have galleries named in their honor. They donated their extensive and renowned collection of Photographs to the Israel Museum in Jerusalem, whose Photography Department bears their name. Mr. Levine served as Board Member and Trustee to a number of cultural and arts organizations, including serving as Chairman of the National Trustees of the National Symphony Orchestra in Washington, DC. Mrs. Levine was active in the Foundation for Art and Preservation in Embassies. This non-profit, non-partisan organization is dedicated to enhancing the United States’ image abroad through contributions of American art to our embassies around the world. The Levine Collection was assembled by a consummate connoisseur. Mrs. Levine was a stylish and sophisticated interior designer, who possessed a discerning eye for quality and had unerring judgement in her choice of the best, whether it be furnishings or jewelry. Furniture and Decorations from the Noel and Harriette Levine Collection will be offered as a single-owner sale on January 17. Jewelry from the Collection will be offered in the sales of Fine Jewelry on February 21 and Important Jewelry on April 24.

45 Pair of Anglo-Dutch Polychrome-Painted Dummy Boards First quarter of the 18th century Each figure depicted with a spaniel; bearing accession nos. 1947-561, 2; bearing a partial printed label...COREA ST. SALE/...18TH & 19TH FEBRUARY/...PLYMOUTH. Height 39 inches (99.0 cm). Dummy boards, whose origins were in the Low Countries, were popular in England in the 17th and 18th centuries. They are often thought to have been used as fire-screens, but the heat from a fire would have damaged both the wood and the paint. Rather, these trompe l’oeil figures were fanciful objects meant to deceive. C. Graham, Dummy Boards and Chimney Boards, Aylesbury, 1988, p. 3, writes ‘Arnold Houbraken, in 1719, describes how the artist Cornelius Bisschop painted cut-out wooden templates which could be placed in a corner or doorway in the hope of deceiving the unwary. One gentleman, for instance, placed a wooden maidservant at the door of his salon and the assembled company were much entertained by a guest who tried to tip her.’ The boards were either hooked to the wall or put at a short distance from a wall, creating a shadow when light was cast on them; see also Macquoid and Edwards, The Dictionary of English Furniture, London, 1983, rev. ed., vol II, pp. 229-232, figs. 1-11, for a further discussion. Grendey, of Aylesbury House, St. John’s Square, Clerkenwell, appears to have been one of the most prolific chair makers and cabinet makers working in London during the reign of George II. He was one of the few makers of the period who regularly attached printed trade labels to his furniture, which in the absence of documented provenance, allows a firm attribution to be made on both stylistic and construction grounds to his workshop. The present pair is similar to two suites of seat furniture which retain Grendey’s label. The first of these included an armchair and side chair, the second, from Gunton Park, Norfolk, included four side chairs and a settee; see Christopher Gilbert, A Pictorial Dictionary of Marked London Furniture 1700-1840, p. 243, figs. 437 and 438. The legs of all these examples are of a similar profile with scrolled toes, the upper part extending into the frame of the seat. The examples illustrated by Gilbert are carved with acanthus leaves above the toes and, although the knees of those illustrated and the present example all differ in their detail, their design and execution display the same hand. Stair & Co., New York Purchased from the above Without further documentation or provenance, the present china cabinet is not able to be attributed to Thomas Chippendale, although there are features present that are characteristic of this most celebrated of all 18th century English furniture makers. His seminal book of designs, The Gentleman and Cabinet- Maker’s Director, 1754, the first of three editions published, influenced design not only in the British Isles and its colonies but on the Continent as well.
The most persuasive supporting evidence of a possible Chippendale connection is the quality of the cabinet’s craftsmanship, carving and use of the finest wood, so typical of his workshop. A curious anomaly is the herringingbone stringing, which does not seem to have been previously noted in firmly attributed examples of his work but could possibly have been a compromise in design, adding an additional visual feature where once there might have been more carving. The present china cabinet was probably made for a bedroom, used both for the display of porcelain and clothing, as the lower section is fitted with a brushing slide for clothing storage in the drawers below. It is a good example of the transition from rococo to neoclassical decoration: the shape of the cresting, with its paper-scrolled terminials and opposing C-scrolls, relates to designs for cornices and beds, op. cit., 1762, 3rd ed., and the glazing bars, which relate directly to his design for a ‘China Case’, 1754, pl. CVI. Although the cartouches retain a certain rococo aspect, i.e., the cabochon or ‘peanut’-carved center within C-scrolls, there is more of a symmetry and restraint to them than examples of the previous decade. Each of the drawers is lined with marbled papers, often found in Chippendale’s provenanced pieces, such as the bottoms of the slides of the clothes-press at Dumfries House; see Christie’s, London, Dumfries House A Chippendale Commission, July 12, 2007, lot 100, illus. p. 279. Simon McCormack, Curator at Nostell Priory, is researching marbled papers and feels that the present drawers’ paper ‘is of the more contemporary cyclopean/oyster format (which became prevalent after circa 1760) rather than the comb pattern of [Nostell’s], which is really more late 17th and early 18th century’. The drawers sides are constructed of oak and the bottoms of deal, which due to shrinkage, one can see where the deal bottoms meet the drawer fronts. The handles are a more elaborate version of Chippendale’s favorite neoclassical gilt-brass loop-handle ‘wrought brass’ pattern; see C. Gilbert, The Life and Work of Thomas Chippendale, 1978, vol. I, col. illus. 16, of two drawers from Nostell Priory. From a constructional viewpoint, there are several Chippendale-related features. These include the red wash that is found to the unseen parts of the cabinet, including the top behind the cornice, the backboards of both sections and the underside. One is able to see minor traces of the red wash to the inside of the case of the lower section along the joins of the frame and panel construction. Furthermore, the feet blocks are laminated and also covered with red wash; see Rufus Bird, ‘Who was the ‘Dumfries House Cabinet-Maker’ “, Christie’s, op. cit., vol. Provenance: Stair & Co., New York These finely carved giltwood four-light appliques are inspired by 18th century French designs for trophies, especially those of the architect Jean Charles Delafosse (1734-1789). At the age of thirteen, Delafosse was apprenticed to the carver Jean-Baptiste Poulet, later working as an architect and designer and rising to the position of professor of drawing at the Académie de Saint-Luc in 1771. This is the same year that he published the second edition of his Nouvelle Iconologie Historique ou Attributs Hièroglyphiques, (first published in 1768), a book that contained engraved architectural and ornamental designs using emblematic representations of the virtues, vices, the four continents, military forces, arts and sciences, laws and countries, all presented for use on furniture and decoration. Pictures frames, candelabra, urns, tables, ceilings and chimneypieces are designed in the latest neoclassical Louis XVI style. 54 DOYLE • JANUARY 17, 2018 • NEW YORK
In England, the Prince of Wales, later George IV, his architect, Henry Holland, and his circle of francophile friends were influential in promoting French neoclassical taste. Holland became involved with the reworking of Carlton House in 1783 when it was presented to the Prince when he came of age. Holland spent the next two decades working there as architect and designer. In 1785, Horace Walpole described Carlton House in a letter to the Countess of Upper Ossory: ‘We went to see the Prince’s new Palace in Pall Mall; and were charmed. It will be the most perfect in Europe. There is an August simplicity that astonished me. You cannot call it magnificent; it is the taste and propriety that strike. Every ornament is at a proper distance, and not one too large, but all delicate and new, with more freedom and variety than Greek ornaments; and though probably borrowed from the Hotel de Condé and other new Palaces, not one that is not rather classic than French. . . I forgot to tell you how admirably all the carving, stucco and ornaments are executed.’; see Dorothy Stroud, Henry Holland, 1966, p. 67.
Much of the decoration at Carlton House was based on French neoclassical sources and was furnished with French furniture, ormolu-mounted porcelain and clocks. Thomas Sheraton included ‘A View of the Prince of Wales’s Chinese Drawing Room’ and another of ‘A View of the South End of the Prince of Wales’s Chinese Drawing Room’ in his Appendix to the Cabinet-Maker and Upholsterer’s Drawing Book, 1793, pls. 31-32. In plate 31, a pier table by the French maker Adam Weisweiler, maître-ébéniste (1778-1820) is shown between two windows. This is but one of many examples of French furniture bought by the Prince of Wales that survives in the Royal Collection. Eagle-headed terminals of armrests are found on numerous suites of furniture in the second quarter of the 18th century, including the suite of armchairs and a settee designed in the manner of William Kent and supplied to Sir Robert Walpole for the Marble Parlour at Houghton Hall, Norfolk; cf. a pair of armchairs, sold, Christie’s, London, Works of Art from Houghton, December 8, 1994, lot 130. A suite of six chairs and a settee, circa 1730-1740, is attributed to Giles Grendey at the Lady Lever Art Gallery, Port Sunlight, Merseyside. The settee, with almost identical armrest terminals to the present armchair, is illustrated, Lucy Wood, The Upholstered Furniture of the Lady Lever Art Gallery, 2008, vol. I, p. 246, iv 20G. It is interesting to note that Wood, ibid., cites and illustrates the Houghton armchair, p. 262, fig.171, stating that the suite made for the Marble Parlour [was] ‘possibly made by Grendey’. A seemingly identical settee to the present example attributed to Grendey was sold, Sotheby’s,London, Benacre Hall, Suffolk, May 9, 10 and 11, 2000, lot 261,and a later example, circa 1755, lot 284. The same eagle-headed terminals are seen on a George II needlework-upholstered walnut settee sold, Christie’s, New York. CHINESE POLYCHROME PAINTED COROMANDEL 301 Chinese Polychrome Painted and Parcel Gilt Coromandel Black Lacquer Cabinet on a Continental Giltwood Stand The cabinet, late 17th century; the stand, circa 1700 The rectangular cabinet with two doors decorated allover with landscapes and birds amidst blossoming foliage, opening to a fitted interior of doors and drawers, centered at the bottom by a removable cabinet with doors opening to shelves, drawers and two concealed drawers at the back, the sides with handles, raised on a foliate carved stand centered by a bust in relief flanked by winged figures continuing to leaf carved square tapering legs. Height 66 1/2 inches 1.68 m), width 39 inches (99.0), depth 23 1/4 inches (59 cm). Provenance: Christie’s, New York, October 26, 1985, lot 125 The name Coromandel is taken from an area on the east coast of India between the Godavari River and Nagapattinam that during the late 17th and the 18th centuries was occupied by a number of European trading posts. This form of cut and colored lacquer was actually the product of an area in South China called Wenzhou (Zhejiang province) where it was called kuan cai (literally ‘incised colors’). It was much sought after by Dutch and French traders, and also the English, being known to them as bantam work or cutt-work. The actual technique appears to date from the 16th century, its application being described in a book called Xui Shi Lu, or Notes on the Lacquer Industry and Lacquerware dating from the 16th century Written by Huang Chen, a well-known lacquer artist (1557-1572), it was adapted in 1625 by Yang Ming. Its main use was for screens, large screens of twelve panels being recorded as early as the Northern Song dynasty (960-1126), and remaining as major pieces of household furniture through the 19th century. They were commonly decorated with terrace and riverside scenes, fantastic mythological beasts and birds amidst exotic flowers and trees. Very rarely did these scenes contain European figures; the less elaborately decorated reverse-sides being inscribed with poems of dedication. The present Coromadel lacquer cabinet is of Chinese manufacture: the secondary wood is a softwood and some of the drawer bottoms have Chinese characters indicating their location in the cabinet. In China, these cabinets would have stood on the floor or on a small stand; see Adam Bowett, ‘Lacquer, Japanning and other finishes’, English Furniture 1660-1714, 2002, pp. 144-169. Highly desirable and extremely expensive in Europe, lacquer cabinets, once shipped from Asia, were often raised on higher stands, often gilded or silvered, made to emphasize their rarity and importance.

308 George I Gilt-Gesso and Giltwood Pier Mirror Circa 1720, in the manner of John Belchier The beveled two-part mirror plate with star-cut upper section within a molded frame with flowerhead and foliate-carved reserves and surmounted by a cresting centered by a plume with three acanthus terminals flanked by eagles’ head above scrolling foliage and pea shoot vines, the serpentine apron with a central shell and two brass candle arms. The present mirror is of a form described as a ‘sconce’ in the 18th century, which differed from that of a candle branch because of its decorative backpiece, often made of lacquered brass, silvered brass, and carved and gilded wood; see Adam Bowett, Early Georgian Furniture 1715-1740, Woodbridge, 2009, pp. 277-283. Mirrored glass sconces began to be produced in the early 18th century and are found at Boughton House and Drayton Hall, Bowett, ibid., pp. 278-9. Their popularity was probably due to the 1720s fashion for using them instead of candle stands between windows. Thence by descent at Wimpole until the house, together with much of its contents including the present chairs were sold in 1894 by the 5th Earl of Hardwicke to Thomas, 2nd Lord Robartes, and 6th Baron Clifden. Thence at Wimpole Hall until removed by the 6th Viscount or his son, Francis Gerald, 7th Viscount, to Lanhydrock, Bodmin, Cornwall, circa 1930. Six chairs from the original suite, together with a settee,were sold by the 7th Viscount Clifden, K.C.V.O, Lanhydrock,Cornwall, Christie’s, London, December 10, 1953. The present chairs were purchased by Mr. and Mrs. Martin Gersh from Messrs. Frank Partridge Inc., New York, 1961, and are presumably a pair from this suite. The pair was sold in their sale, Sotheby’s, New York, October 18, 2006, lot 65.
Wimpole Hall was originally designed and built between 1640 and 1670 by Sir Thomas Chicheley, a friend of the architect Sir Christopher Wren. It was subsequently sold to the City merchant Sir John Cutler. His son-in-law, Charles Robartes, 2nd Earl of Radnor enlarged it and in 1710 Wimpole was acquired by the Duke of Newcastle who then passed it to his son-in-law Edward Harley, later 2nd Earl of Oxford. Wimpole was then acquired by Philip Yorke, Ist Earl of Hardwicke (1690-1764), who commissioned the architect Henry Flitcroft to reface the central block, which had survived from the Chicheley period, and to make various internal alterations including the creation of the long gallery in the west wing. Some sixty feet long, the room was created by Flitcroft in 1742 out of three small ‘cabinets’ which was subsequently altered again, retaining two screens of columns probably dating from alterations for the 4th Earl in the 1840s.

Presumably, the present chairs, together with eight other chairs and two pairs of sofas, were commissioned by the Earl of Hardwicke at the time of Flitcroft’s alterations to furnish this new gallery, their exceptional scale being suitable for a room of this size. Unfortunately, there do not appear to be any surviving accounts relating to the maker of the suite, although their quality and design indicate a London maker of some distinction. Unusually carved in walnut of fine grain and seeming to retain an old and untouched surface, their design exemplifies the prevalent taste of the period, with their finely modeled lion-paw feet, scrolled acanthus leaves, stylized foliate shells and C-scrolls ornamenting the strongly conceived frame.
Another almost identical set of six armchairs without provenance is recorded as being on the London art market in the early 1930s, differing only in the carving of the terminals to the arms. 327 327 Pair of George II Japanned Walnut Caned Side Chairs Circa 1730 Each top rail with gilded shell, the splat of one decorated with pavilions, the other with flowers and foliage, the uprights decorated with figures and unusual geometric reserves on a turquoise ground, the shaped seat rails centered by masks, raised on cabriole legs joined by shaped and turned stretchers and ending in pointed pad feet. These chairs were almost certainly made in London for export to Spain. The material and construction of the chairs are identical to other surviving examples of London-made japanned furniture for the export market, with particularly brilliant colors to the decoration. They differ from other chairs of this type in being decorated directly onto the walnut ground with the natural wood serving as a background. The quality and character of the japanning is comparable to the work of Giles Grendey and John Belchier for the export market. Matthias Lock (b. circa 1710-d.1765), Castle Street, Long Acre, London was not only a wood carver of exceptional talent but was the first Englishman to publish designs in the fully developed Rococo style. The son of Matthias Lock, a joiner in the parish of St. Paul’s, Shadwell, he is recorded as being apprenticed to not only his father but also to Richard Goldsaddle, a carver, in the parish of St. Martin in the Fields. An accomplished draughtsman and talented designer, this is manifested by Lock’s first publication A new Drawing Book of Ornaments, Shields, Compartments, Masks & c., which was followed in 1744 by designs for Six Sconces and in 1746 by designs for Six Tables, and an undated Book of Ornaments, drawn & engrav’d by M. Lock, principally adapted for carvers, but generally used for various decorations in the present taste. In 1752 he published in collaboration with H. Copland A New Book of Ornaments, which is described by M. H. Hecksher (Beard & Gilbert, op.cit.), as ‘the most ambitious book of Rococo ornament prior to Chippendale’s Director’. PAIR OF GEORGE III CUT-GLASS & GILT-METAL SEVEN-LIGHT WALL LIGHTS 338 Pair of George III Cut-Glass and Gilt-Metal Seven-Light Wall Lights of Important and Impressive Size In the manner of Parker and Perry, late 18th century/early 19th century Each suspended from an oval hook in the form of a sunflower on a trefoil shackle, with pear drop-hung swagged canopy above an urn-form stem and a receiver bowl with scrolling plain fluted arms with Vandyck-bordered drip pans and nozzles, similarly hung with swags and drops, and ending in a acorn-form finial; the receiver bowls with numbers, the arms and nozzles with either numbers or letters. Height 56 inches (1.42 m), width 28 1/2 inches (72.3 cm), depth 13 inches (33 cm). Provenance: Jeremy, Ltd., London The present wall lights are of an unusually large size and are a rare survival. William Parker was a glass manufacturer with premises at 69 Fleet Street, ‘two doors below Water End Lane’, from 1763, supplying three chandeliers for the Tea Room of the Assembly Room at Bath in 1771. One of the receiver bowls of these three chandeliers is inscribed Parker Fleet Street London, enabling firm attributions of similar pieces to him. From 1772-84 the firm was known as William Parker and Company and from 1785-97 as William Parker and Son. In 1798, his son Samuel took over the business and traded as Parker and Perry, glass manufacturers, from 1803-18. Probably one of the most notable design features of Parker’s oeuvre was the introduction of vase-shaped stem pieces, revolutionary in chandelier design, where spherical stem pieces were heretofore almost universally found. In 1782, Parker supplied a pair of chandeliers to the Duke of Devonshire at Chatsworth with his innovative vase-shaped stem now spirally cut. Additionally, Parker added ormolu bands to the vase and receiver bowl, described in the records of a chandelier supplied to William Beckford in 1791 as ‘ormolu furniture’. These bands were cast and chased with a guilloche, as on the receivers of the present pair, or possibly a Vitruvian scroll. Other characteristics include the cutting of the plain fluted candlearms, the designs of the Vandyck-bordered drip-pans, nozzles and canopies, the pear-shaped drop and ‘the hollow-blown finial of almost acorn shape’; see Martin Mortimer, The English Glass Chandelier, 2000, p. 87, pl. 35, for one of the Tea Room chandeliers at the Assembly Room with a finial that is very similar to those of the present pair. Parker also introduced a technical modification to the candle arm, as seen in the chandeliers at Chatsworth: detachable candle nozzles with brass mounts which were able to be changed if damaged. Each brass mount of the nozzles and arms of present wall lights is either numbered or lettered, corresponding with the receiver bowl housing. Additionally, each is fitted with an interior metal guard or saveall, providing protection from a candle burning down to its base and splitting the glass. Provenance: Sotheby’s, New York, December 13, 1986, lot 264 John Linnell (1729-1796), a cabinet-maker upholsterer and carver was the son of the cabinet-maker William Linnell (b. circa 1703-d.1763), joining his father’s firm in the late 1740s. He studied at St. Martin’s Lane Academy, which had been founded by William Hogarth in 1735, becoming closely acquainted with Rococo design through his contacts with an international group of fellow students. It is obvious that his talent for design which is apparent through his many surviving drawings was a large factor in the rapid expansion of the family firm in the early 1750s. In 1754 new and larger workshops, together with a dwelling house, were opened at 28 Berkeley Square, and at his father’s death in 1763 he inherited a firm employing almost fifty people. The firm had an extensive clientele including William Drake at Shardeloes, the 1st Duke of Northumberland at Syon Park and Alnwick Castle, the 2nd Earl of Shelburne at Lansdowne House and the 5th Duke of Argyll at Inverary Castle. It is apparent that Linnell and the architect Robert Adam had a number of mutual clients and at times must have worked closely together. The present tables, with their geometrical trellis parquetry tops of French transitional breakfront form, suggests a maker familiar with the work of Simon Oeben, the Parisian master ébéniste. Christopher Furlohg and his brother-in-law Georg Haupt, young Swedish cabinet makers newly arrived in London in the late 1760s, had both worked for Oeben in Paris and were introduced to John Linnell by the architect Sir William Chambers. Chambers was born in Sweden to Scottish parents and was helpful in making introductions for Swedes arriving in London. The two Swedes would have been in the vanguard of contemporary French design and, as such, been

important sources of inspiration for Linnell and the newly-fashionable French taste in London. Haupt returned to Stockholm in 1769 when he was appointed cabinet maker to the King of Sweden but it appears that Furlohg stayed at bit longer with Linnell. He established premises with his brother-in-law, Johann Christian Linning at 24 Tottenham Court Road by 1772. It is probable that Furlohg continued to supply Linnell with the parquetry panels for which he was so celebrated. A commode with related trellis parquetry panels made by Christopher Furlohg circa 1772 is illustrated by Lucy Wood, The Lady Lever Art Gallery Catalogue of Commodes, 1994, p. 106-114, i-ii. Wood illustrates two other examples with trellis parquetry, a group of three commodes now in The Metropolitan Museum of Art ibid., pp. 110-112, figs 104-106 and figs. 108-109, as well as fig. 110, the pair to the Lady Lever commode. The trellis parquetry enclosing flowerheads is similar to those of a pair of pier tables made by John Linnell for the 5th Duke of Argyll at Inveraray Castle, Argyll, Scotland, circa 1780; see Hayward, H. and Kirkham, P., vol. I, pp. 126-128, figs. 307-208. Another pair with similar parquetry at Heveningham Hall, Suffolk, is illustrated by Hayward, H. and Kirkham, P., op. cit., vol. II, p. 162, figs. 309-310. The fluted tapering legs headed by egg-and-dart-carved collars to the tops of the legs of the present tables are similar to those on a George III mahogany table, circa 1760, now located at the Victoria and Albert Museum, London, acc. no. W.31-1979. This table was designed by James ‘Athenian’ Stuart (1713-1788) for the bedchamber of Georgiana, Countess Spencer at Spencer House. Stuart was responsible for the original design of Spencer House, one of the first houses in London to incorporate authentic Greek architectural details. They are first recorded in a Western collection in 1777, when a group bought at auction by the Danish Asiatisk Kompagni subsequently entered the Danish Royal Collections. In the event of error or dispute between bidders, or in the event of doubt on our part as to the validity of any bid, whether during or after the sale, the auctioneer has final discretion to determine the successful bidder, to continue the bidding, to cancel the sale, or to reoffer and resell the lot in dispute. If any dispute arises after the sale, the Doyle New York sale record shall be conclusive.
7. PURCHASER’S RESPONSIBILITY Title passes upon the fall of the auctioneer’s hammer to the highest acknowledged bidder, subject to the conditions of sale set forth herein. 2. COVERAGE UNDER THE GUARANTEE Subject to the exclusions set forth below in paragraphs 5 and 6, Doyle New York warrants the authorship (as that term is defined above) of each lot in this catalogue for a period of five years from the date of the sale of the lot. The guarantee is made only to the original purchaser of record at the auction, and only the registered bidder for the lot at the auction will be considered as the original purchaser. The buyer must give written notice of claim within five years from the date of the auction. Doyle New York may require, at its option, to have the purchaser obtain at the purchaser’s expense the opinion of two recognized experts (approved by Doyle New York) in the field relating to the item in question, before Doyle New York determines whether to rescind a sale under the above warranty. 3. NON-ASSIGNABILITY The benefits of this warranty are not assignable and shall be applicable only to the original purchaser of record (i.e., the registered bidder) and not to any subsequent owners (including, without limitation, donees, heirs, successors, beneficiaries or assigns) who have, or may acquire, an interest in any purchased property. The original buyer must have remained the owner of the lot without disposing of any interest in it to any third party.
4. SOLE REMEDY The purchaser agrees that in the case of a breach of warranty under these Terms of Guarantee, he shall have no remedy other than rescission of the sale and the refund of the original purchase price paid. The original purchase price paid is defined as the amount of the successful bid price, plus the buyer’s premium. No rescission and refund will be made unless the item is returned to Doyle New York at 175 East 87th Street, New York, NY 10128, in the same condition as at the time of sale. The remedy of rescission and refund is exclusive and the purchaser waives any other remedy which may be otherwise available in law or equity. Doyle New York shall not be liable for any special, consequential or incidental damages incurred or claimed including, without limitation, loss of profits or for interest.

EXCLUSIONS This warranty does not apply to: i. authorship of any paintings, drawings or sculpture created prior to 1870, unless the lot is determined to be a counterfeit which has a value at the date of the claim for rescission which is materially less than the purchase price paid for the lot; or ii. any catalogue description where it was specifically mentioned that there is a conflict of specialist opinion on the authorship of a lot; or iii. authorship which on the date of sale was in accordance with the then generally accepted opinion of scholars and specialists, despite the subsequent discovery of new information, whether historical or physical, concerning the artist or craftsman, his students, school, workshop or followers; or iv. the identification of periods or dates of execution which may be proven inaccurate by means of scientific processes not generally accepted for use until after publication of the catalogue, or which were unreasonably expensive or impractical to use at the time of publication of the catalogue. The term counterfeit is defined as a modern fake or forgery, made less than fifty years ago, and made with the intent to deceive. The authenticity of signatures, monograms, initials or other similar indications of authorship is expressly excluded as a controlling factor in determining whether a work is a counterfeit under the meaning of this Terms of Warranty.

INFORMATION ON SALES AND USE TAX RELATED TO PURCHASES AT AUCTION To better assist our clients, we have prepared the following information on Sales and Use Tax related to property purchased at auction.
WHY DOYLE NEW YORK COLLECTS SALES TAX Virtually all State Sales Tax Laws require a corporation to register with the State’s Tax Authorities and collect and remit sales tax if the corporation maintains a presence within the state, such as offices. In the states that impose sales tax, Tax Laws require an auction house, with a presence in the state, to register as a sales tax collector, and remit sales taxcollected to the state. New York sales tax is charged on the hammer price, buyer’s premium and any other applicable charges on any property picked up or delivered in New York, regardless of the state or country in which the purchaser resides or does business.
WHERE DOYLE NEW YORK COLLECTS SALES TAX Doyle New York is currently registered to collect sales tax in the following states: New York and the District of Columbia. For any property collected or received by the purchaser in New York City, such property is subject to sales tax at the existing New York State and City rate of 8.875%.
WHERE DOYLE NEW YORK IS NOT REQUIRED TO COLLECT SALES TAX Doyle New York is not required to collect sales tax on property delivered to states other than those listed above. If the property is delivered to a state where Doyle New York is not required to collect sales tax, it is the responsibility of the purchaser to self-assess any sales or use tax and remit it to taxing authorities in that state. Doyle New York is not required to collect sales tax for property delivered to the purchaser outside of the United States.
RESTORATION AND OTHER SERVICES Regardless of where the property is subsequently transported, if any framing or restoration services are performed in New York, it is considered to be a delivery of the property to the purchaser in New York, and Doyle New York will be required to collect the 8.875% New York sales tax.
CERTAIN EXEMPTIONS Most states that impose sales taxes allow for specified exemptions to the tax. For example, a registered re-seller such as a registered art dealer may purchase without incurring a tax liability, and Doyle New York is not required to collect sales tax from such re-seller. The art dealer, when re-selling the property, may be required to charge sales tax to its client, or the client may be required to self-assess sales or use tax upon acquiring the property. If a not-for-profit or charitable organization is selling property through Doyle New York, it may be sold as a tax exempted purchase. The not-for-profit seller must be registered with the New York Department of Taxation and Finance as an exempt organization and the property must be picked up or delivered in New York. However, a compensating use tax is due from the buyer if any such lot is shipped to any of the states where Doyle New York maintains offices. It is the buyer’s responsibility to ascertain and pay all taxes due. Buyers claiming exemption from sales tax must have the appropriate documentation on file with Doyle New York prior to the release of the property.
LOCAL TAX ADVISORS As sales tax laws vary from state to state, Doyle New York recommends that clients with questions regarding the application of sales or use taxes to property purchased at auction seek tax advice form their local tax advisors.
If the property is delivered into any of the states in which Doyle New York is registered, Doyle New York is required by law to collect and remit the appropriate sales tax in effect in the state where the property is delivered. Property collected from Doyle New York premises by common carriers on behalf of the purchaser for delivery to the purchaser at his address outside of New York is not subject to New York Sales Tax. If it is delivered by the common carrier to any of the states where Doyle New York is required to collect sales tax, applicable tax will be added to the purchase price.

BIDDING AT AUCTION Auctions are open to the public without any admission fee or obligation to bid. Pre-auction viewings are open to the public free of charge. Information and appointments to view property in your home or in the gallery can be arranged through our Scheduling Department, an appropriate Specialist Department, or a Doyle New York Regional Representative. Once your property has been evaluated, Doyle New York representatives can then help you determine how to proceed with the auction process. They will provide information regarding sellers’ commission rates and other charges, auction timetable, shipping and any other further services you may require. SUBMITTING PHOTOGRAPHS We welcome photographs of property to evaluate for possible auction if the property is not portable, or if you are not able to visit our galleries. If you have a large collection, a representative selection of photographs is acceptable. Please bring in the photographs or email photos of your objects to the Scheduling Department. You may also mail photographs to the Scheduling Department, or call them at 212-427-4141, ext. 260, to discuss your property and perhaps arrange an appointment with a specialist. Please be sure to include the dimensions, artist’s signature or maker’s mark, medium, physical condition, and any other relevant information. Our specialists will provide a free preliminary auction estimate subject to a final estimate upon first hand inspection.

REGIONAL APPRAISAL DAYS Doyle New York’s Regional Representatives host free appraisal days on a regular basis throughout Connecticut, the metropolitan Washington, DC area, as well as in other areas throughout the United States. These popular events provide ease and convenience for collectors outside of New York who wish to sell their property at Doyle. At these events, we accept property for upcoming auctions in our New York salesrooms through both consignment and outright purchase.
SELLING YOUR PROPERTY CONSIGNING TO AUCTION In consigning property to auction, the seller retains ownership until the successful sale of the item at auction. When property is consigned to Doyle for auction, we devote the expertise of our specialists and professional staff to achieving outstanding prices at auction. THE CONSIGNMENT CONTRACT When you consign property to Doyle New York you will receive two copies of our Consignment Agreement, the legal document delineating the terms of sale. One copy should be initialed, signed and returned; the other kept for your records. Once the property is received in our gallery, you will be sent a Contract Schedule listing the property, the planned sale dates, the estimated price ranges, and the reserves will be listed, along with the agreed upon seller’s commission and other related fees. RESERVE PRICE Before an item is offered at auction, the consignor and Doyle New York may agree on a reserve price, a confidential minimum selling price. Unless a specific reserve is arranged, a discretionary reserve is fixed at fifty percent of the low estimate. If the consignor designates a reserve on a lot, and it remains unsold, there will be a buy-in fee charged on the reserve price. OUTRIGHT SALE TO DOYLE Outright purchase of property by Doyle allows the seller the advantage and convenience of immediate payment. Many sellers prefer this method of sale rather than consigning their property to auction and awaiting payment after the successful sale of the items. AFTER THE AUCTION RESULTS OF SALE You may track realized prices of your consigned property in real time and view all sales results online at Doyle.com. A preliminary settlement statement itemizing the hammer prices, commissions and fees is mailed to the consignor after the auction. You may also call us at 212-427-2730 for prices realized.
PAYMENT TO CONSIGNORS Payment to consignors is mailed five weeks after the date of the sale, together with a final settlement statement. The amount of payment is the hammer price of each lot successfully sold, less the commission and any other fees.

Doyle New York offers a full range of expert appraisal services, specializing in providing timely formal appraisals for estate tax and probate purposes. Our expert team of specialists and our professional staff bring years of experience to each appraisal. Full color digital photographs may be included in the appraisal in order to make each object easily identifiable. Depending on the location, we are happy to provide, at no charge, a preliminary walk-through examination to determine approximate costs and special needs. Appraisal fees are based on the scope of the property with travel expenses additional. Doyle New York will prepare a customized proposal tailored to the specific property under consideration for auction, including a commission and fee structure developed to maximize returns to consignors. We may also make an outright purchase offer on individual items or entire estates. As part of our focus on comprehensive estate liquidation, we offer our unique “Broomclean Service” – our own trucks and crew will transport the fine property to Doyle, remove remaining items, and leave the premises “broomclean.”
