Home Instead Lend A Hand On ‘Dignity Action Day’ Relaxing hand massages, delicious home-made cupcakes, coffee and a good natter were all enjoyed by the residents at Sunnyfield Lodge, the extra care housing facility in the centre of Ripon, during a pamper morning to mark Dignity Action Day on 25th February.

The event was organised by Home Instead Senior Care in Harrogate, who have pledged their continuing support for the national ‘Dignity in Care’ campaign, headed by Dignity Ambassador Sir Michael Parkinson, to promote treating people with dignity as a basic human right. This year’s theme for the day was ‘giving someone the gift of time’ and Home Instead Caregivers were on hand to share stories, and their time, with all the residents. The team were joined by Nicole Inggall, a professional mobile beauty therapist from ‘Gorgeous on the go’, who was kept busy giving hand massages and beauty advice.

Article 2 of 3

Starting A Business tax CONSIDERATIONS

In the second of three articles, Lydia Ebdon, a Chartered Accountant and Chartered Tax Adviser, explains the tax considerations for a new business. In her first article, Lydia covered the options of trading as a sole trader, partnership or through a limited company and in the next article she will cover paying your first employees.

INTRODUCTION This article describes the records that all businesses must keep for tax purposes, and the expenses that can be deducted in arriving at taxable profit. It outlines a business’s obligation to register for VAT. It explains how profits are taxed through income tax work for sole traders and partnerships and through corporation tax for companies. Finally, it explains the penalties that apply if things go wrong, and how to keep in the clear. RECORD KEEPING It is important to keep a record of business assets, liabilities, income and expenses separate to any personal records, so that you can track the progress of your business, prepare accounts and ensure that you pay the correct amount of tax. Records must be retained for six years following the tax year. Although the main consideration when starting a business is usually the amount of trading profit, sole traders, partnerships and companies are also liable to tax on capital gains, investment, property and miscellaneous income. For companies, all of these items are included in the corporation tax computation and for sole traders and partners they’re included in the selfassessment tax return. Some details of the tax computations differ depending on the legal form of the business. Confusion often arises over expenses that may be deducted for tax purposes, especially because tax and accounting rules can differ. The overriding tax rule is that expenses may only be deducted if they are incurred wholly and exclusively for the purpose of the trade. Expenses that are generally not tax deductible from any business profits include: • private expenses paid by the business (when paid by a company, these must be recorded as owing from the director concerned); • reimbursed business motoring expenses in excess of scale rates (currently 40p per mile or 25p >10,000 miles) ; • costs of working from home, other than the incremental cost of extra heating, cleaning, etc; • business gifts and client entertaining; • capital expenditure; and • depreciation – instead, capital allowances are deducted for tax. Most business costs are deductible including salaries and

10

Ripon & Masham infocus

benefits that are reasonable in relation to the work done, pension contributions and employer’s NICs. VAT Whether you are operating as a sole trader, partnership or limited company, you will need to register for VAT once your taxable turnover reaches £70,000. You may register at a lower level if you wish, for example, to enhance your credibility or to reclaim input VAT if you make zero-rated supplies. HMRC operates several schemes that aim to simplify administration for small businesses. INCOME TAX – SOLE TRADERS, PARTNERS, EMPLOYEES AND SHAREHOLDERS Sole traders and partners need to pay income tax on their share of business profits made each year. Sole traders must register as self employed with HMRC and must submit a selfassessment tax return by 31 January each year. Partners must file individual self-assessment tax returns and a nominated partner must file a partnership tax return showing each partner’s share of the profits or losses. Partners are jointly liable for filing the partnership tax return and for any penalties, surcharges or interest. Employees including directors need to pay income tax on earnings and benefits received from their employer (such as the use of a company car). For most employees, their employer deducts tax through PAYE, and there is no more for the employee to do. Other income over specific levels, including dividend income, must be declared and tax paid through the HMRC self-assessment process. Income tax is payable under self-assessment by 31 January following the tax year (i.e. for the 2010/11 tax year to 5 April 2011, tax is payable by 31 January 2012). HMRC will ask for payments on account unless most tax has been deducted at source. Each payment on account is equal to one half of the previous year’s tax liability excluding tax deducted at source, and the payments are due on 31 January in the tax year and 31 July following. The balancing amount is due by 31 January following the tax year. Any income tax overpaid can be reclaimed in the self-assessment tax return. Taxpayers can apply for a reduction in their payments on account if their income falls. CORPORATION TAX Companies must register as dormant with HMRC before they trade and must register for corporation tax within three months of beginning to trade. All companies and some unincorporated entities pay corporation tax (CT) on their income and gains. As noted above, there are some differences between expenses that can be deducted under accounting and under tax rules. Corporation tax is assessed for an accounting period and is generally due, together with the corporation tax self-assessment return, nine months and one day after the relevant accounting period. The rate of CT applies for a financial year, i.e. from 1 April each year. The 2010 / 2011 rates are 21% / 20% for companies with annual profits of less than £300,000, 28% / 27% for companies with profits of more than £1.5m, and a marginal rate for levels in between.

Profit can be retained after corporation tax within the company and used as capital for investment or to pay dividends at a later date. Dividends are taxable on receipt in the hands of the shareholder under self-assessment. They are taxed at lower rates than other forms of income such as interest, to recognise that they are paid from profits that have already been taxed. Basic rate taxpayers pay no extra tax on dividend income, and higher/additional rate taxpayers pay an effective rate (in 2010/11) of 25/36% on the net amount received. Special provisions apply to close companies and close investment holding companies. Close companies are, broadly, those controlled by the directors, or by five or fewer shareholders. Close investment holding companies are close companies that hold investments. The key provisions are that close companies must pay corporation tax on loans to participators (broadly, shareholders) and cannot deduct the cost of benefits provided to some participators. Close investment holding companies must pay corporation tax at the full rate, even if they meet the size criteria for the small companies rate. This reduces the tax benefit of investments being held through a company. NEW HMRC PENALTY REGIME HMRC recently introduced a new system whereby a taxpayer’s behaviour affects the scale of a penalty. Penalties escalate if errors are careless, deliberate or concealed, and there is a further charge if HMRC prompts disclosure rather than it being volunteered. The maximum penalty for an error is 100% of the tax underpaid, so big errors can be very costly. But the good news is that taxpayers who take reasonable care will not be penalised. HMRC say that taking reasonable care may involve seeking professional advice or appointing an agent to help with tax affairs, although this can’t absolve responsibility – taxpayers must still act within their own competence. Where you give your agent all relevant information, act on their professional advice and check their work to the best of your ability, you will have taken reasonable care. Your agent should be able to demonstrate to you that they have taken reasonable care on your behalf. SUMMARY The tax implications of starting a business are significant and may seem daunting. But its important to get it right as errors can be costly and can become a major distraction from your business. Business owners should get familiar with the rules on HMRC’s website or seek professional advice if they need more help. .................................................................................................. No responsibility can be taken for any loss arising from action taken or refrained from on the basis of this article. Details correct at time of writing. Local Business Wins National Award Local Agricultural Merchant Green Farm Health Ltd, from Thirsk, has won the prestigious “Store of the Year” award sponsored by Pharmaceutical giant Pfizer. The competition is open to all independent merchants in the UK and rewards the winner who, in the opinion of the judges, offers the very best in customer service, product choice and value for money. The judges agreed Green Farm Health should be proud of what they have achieved and recognised that the passionate, dedicated and customer focused team work extremely hard, which has quite rightly resulted in the business’s growth. Green Farm Health Directors, Chris Jeffery and Kate Williamson were presented with their award at a glittering ceremony in London last week. The judges were impressed with their shop design and layout which offers customers a pleasurable experience in store and also with the high quality of service given to all customers.

Dr Susie Boardman from Yorkshire,

riding high at Twycross Zoo Top vet Dr Susie Boardman, who grew up in Yorkshire and is now the only female director of a Top Five British zoo, Twycross in Leicestershire, began learning her trade as a teenager at the Thirsk veterinary practice of best-selling author James Heriot (real name James White.) Susie, 48, whose father Edward Jackson’s family had farmed in the Vale of York for decades, worked at the practice from the age of 12 and was even taught to stitch up animals’ wounds by James White’s son Jim and the real life “Siegfried”, Donald Sinclair. Susie’s mother Kate Jackson even appears in some of James Heriot’s books as “Mrs Westby and her four unruly children”. Since then, Susie has more than fulfilled the promise of her early years, and after leaving Thirsk Comprehensive School where she excelled in science, she gained distinctions as a student at Glasgow Veterinary School. She went on to work at London Zoo and founded a conservation charity before taking over as CEO at Twycross 6 years ago. One major task she now faces is promoting Twycross Zoo, the World Primate Centre, which has changed radically since it opened in 1963 to huge crowds, desperate to see the animals, particularly the hand-reared chimps whose famous tea parties featured in the PG Tips commercials.

latest arrivals, a pair of stunning snow leopards, Irma and Suou in their huge rocky enclosure. They’ve got real ‘Wow!’ factor and even come up to the window to paw at our visitors. They’re a critically-endangered species with under 7000 left in the wild, so we aim to raise awareness of their plight, and now they’ve settled in, they’re showing a lot of interest in each other, so we’re hoping to hear the patter of tiny paws. This is a 24-hour-a-day job; I live, eat, breathe and sleep the zoo and it’s hugely rewarding. We have Britain’s only group of bonobos, endangered apes from the Congo and I’ve just been along Uda Walawe our Sri Lankan themed walkway which gives visitors a bird’s eye view of the elephant paddock and our ‘superstar’ 18-month-old baby elephant, Ganesh-Vijay, the youngest mem-

rative, paintings to ceramics, sculpture to photography, but the common thread will be their capacity to engage visitors with the natural world in an emotional, visceral way. The Gallery forms part of the Zoo’s new art strategy which aims to engage visitors with the natural world through a more creative medium. Art will be incorporated across the Zoo park and in complementary education and research projects, to make Twycross Zoo the most exciting new art venue in the region. Some of the works and exhibitions may focus directly on the themes underlying all the Zoo’s work: passion for conservation, for sustainability and of course for the animals themselves, their habitats and their welfare. Other artworks will have a more general, abstract link with nature, but all will be thought-provoking and distinguished examples of their particular genres.

Twycross has grown from a comparatively small collection to become one of Britain’s major zoos with 500,000 visitors each year. Working towards advancements in animal welfare, conservation and education, it is an organisation dedicated to make a significant difference to the region and cares for some of the world’s rarest animals. 2010 saw two major new additions to the Zoo, Himalaya, the free-to-enter visitor centre and the Uda Walawe elephant walkway. “Himalaya is a fantastic experience” enthused Susie. “You can eat Nepalese curry or another of our delicious freshly-prepared meals, and watch two of our

20

Ripon & Masham infocus

ber of our herd of Indian and Burmese elephants. Apart from providing the unforgettable experience of seeing such amazing animals at close quarters, one of my major aims is to make sure that Twycross Zoo is a great value day out.” This summer, Twycross will launch a ground-breaking new contemporary art gallery to showcase a variety of works and genres, which reflect the Zoo’s own values and its aspirations for the future. The Gallery is designed to provoke curiosity and engage emotions through the introduction of contemporary art and will feature an exciting selection of high-quality pieces in a range of styles, from abstract to figu-

Exhibitions will feature some of Britain’s top contemporary artists, designers, jewellers, printmakers and photographers and provide a platform for numerous rising stars of the art world. The Twycross Gallery is a major feature of the transformation which the Zoo is currently undergoing and central to its innovative strategy for the future: its pursuit of excellence in all aspects of its work and its awareness of the multi-faceted natural world and the inter-dependence of every element. But if you’re looking for a reason to visit between now and the summer when Twycross Gallery is due to open, then the baby orang-utan, the two baby bonobos plus Ganesh-Vijay and the snow leopards should work a treat.

A winning connection Fibre optic broadband is now available at Sycamore Business Park at Copt Hewick, Ripon. This makes it the first rural business park in North Yorkshire to get a live high speed broadband connection. High-tech and main stream companies can now be based in an idyllic, rural location without compromising connectivity. As well as a faster internet connection, businesses at Sycamore Business Park can now take advantage of a number of additional features available with Fibre optic broadband including VoIP telephones (Voice over Internet Protocol) which have the clarity of a traditional landline but at a much reduced cost. It is reported that some tenants are already switching to cloud computing to reduce their need for multiple software licenses and many are now working on the move thanks to remote access to their data and secure offsite backup facilities. Colin Stamp, owner of Sycamore Business Park said: “I hope all the businesses at Sycamore embrace this new technology. I have been amazed at how much a fibre optic broadband connection can improve the efficiency, and therefore the cost effectiveness, of a business whatever its size or type.” Sycamore Business Park’s fibre optic broadband connection has been installed as a result of its winning application to NYnet’s Smart Park’s project. NYnet is a public and private sector commercial venture led by North Yorkshire County Council. For more information about fibre optic broadband at Sycamore Business Park contact Colin Stamp on 01661 853952 or visit: www.sycamorebusinesspark.co.uk
