Title: Amul federation Board Room Battle in Supreme Court Summary: The Special Leave Petition against the order dated 10.01.2014 of the Gujarat High Court dismissing the Letters Patent Appeal seeking stay of implementation of Board Resolution was heard by the Hon’ble Supreme Court today. Body: The Special Leave Petition against the order dated 10.01.2014 of the Gujarat High Court dismissing the Letters Patent Appeal seeking stay of implementation of Board Resolution was heard by the Hon’ble Supreme Court today. The Hon’ble Court observed and recorded that submission of the Counsel for the Federation that the resolution stands implemented, the Hon’ble Court in the circumstances issued notice in the Special Leave Petition directed maintaining of status quo as of date; in other words no new Chairman can be elected/appointed as that is the position on date. The Counsel for Petitioner submitted that the implementation of the resolution by the Managing Director is without any lawful authority. The Court observed that if the Court is subsequently at hearing agrees to the aforesaid the Court can reinstate the Petitioner as Chairman. The Hon’ble Court further observed that as the decision of the High Court was not available hence the matter be called after two weeks. In the meantime the Division Bench of Gujarat High Court can continue hearing in the reference matter. The order of proceedings today is not available and the above is based upon oral observations and the order passed by the Hon’ble Court, subject to copy of final order.
