RENT CONTROL FOR EVERYONE! Scheduled for a vote this November is a proposition that imposed rent control on all rental properties in the great state of California. Voters will be asked to decide how much a landlord may actually charge to rent property to tenants. This is being done to stem the increasing cost of living in the state, with the first action to keep rents under control. Will it actually make a difference, the answer is a resounding ‘Yes’, but not in the way that many think it will.

Rental property will become less available

This is the biggest impact that this new law will have as landlords now are under the limits of the rent they may charge and not levy the market rate of rents according to demand. Under this law, many landlords will sell their properties to Buyer that will most likely a) live in it, or b) buy it and charge a new and higher rent. The total impact is that there will be fewer units available for rent and they will cost more, not less, to rent.

There will be less new construction of rentable property.

Today, there are not enough units available for the demand which continues to grow. With a limited profit margin, developers will build where the opportunity for a free market rent can be achieved. The state is very short on rental properties today; it will get worse.

Maintenance on existing units will be hard to come by

Landlords today on the whole, keep their properties in as good a condition as it possible. With less profit out of the rent, maintenance may slack off due to the cost of it. This example can be seen today in any rent controlled city. To do it statewide would mean less maintenance and poorer living conditions for the tenants.

Property value for rental property will decline

The impact is fairly obvious to those who understand the economics of rental income. The limits on income will also reduce value to these units. As they are sold off at lower values, the properties will also produce lower property taxes. The lower incomes generated by the property taxes will then reduce services provided by the governing bodies that receive property tax funding.

It may be unconstitutional

To disallow the owner of any property the full and free usage of his estate is a possible violation of the 5th and 14th Amendments. There is case law that supports the premise that a government law or regulation that makes property uneconomic is in violation of the constitution.

Is there a solution?

Actually, there is. Government is the largest barrier to real estate development. Planning and building fees continue to rise, zoning and restriction on usage is another barrier to build rental property in California. A rational response to rising rents and affordable housing aims are to remove the governmental barriers to development and allow more housing to be constructed.
