Preserve Equity, Build for the Future Using a 1031 Tax Exchange By Patrick McCarran ~ Real Estate Broker Leaving California or is it time to reinvest in a different property or state? Due to the recent upswing in homes values we have realized a significant growth in equity. Many owners think that they may be stuck in their current investment property? Whether you bought it as an investment or it was an owner occupied that went past you 3 year deferment period you have options. Maybe you would prefer an investment in a different city, region or even another state? Possibly you would like to combine many properties into few or few into many? The answer is a 1031 Tax Exchanges otherwise known as a Starker Exchange. This process allows real estate owners to defer taxes on capital gains resulting from the sale of investment real estate, often a sizable sum since combined Federal and State taxes can run as high as 38 percent. In general terms to roll their profit into another property and defer the tax and preserve equity and cash flow. To accomplish this, sellers need to engage a Qualified 1031 Intermediary to document the sale as an exchange and to receive
the funds from the sale. I cannot stress the importance of a THIRD party for the exchange. This does NOT mean a title or escrow company. By definition you cannot have any direct control over the funds, which is not just in your pocket but anywhere within your reach
There Are other options for example you can opt for a Reverse Exchange where you buy the replacement property first then sell the current property. An Improvement Exchange, allows you to build investment properties from the ground up or improve existing properties.
Central to a 1031 Exchange is the interpretation of like-kind property. While the common assumption is that like-kind implies land for land or a condominium for a condominium swap, the definition of like kind has become far less literal. Today it defines like kind as meaning that both the replacement and the original property must be used as an investment. So land, condominiums, single-family homes and motels can all be exchanged for one another as long as they are used in the exchanger’s business or held as an investment.

1031 Exchanges do have specific IRS requirements and a set timeframe for performing. This is why it is very important that you contact an experience agent such as myself and engage the Intermediary BEFORE you close and ideally before you place the property for sale.

Wow, over 20 years ago I became a member of Women’s Council; how time flys! It was the start of a journey that would take me from 2005 Network President, to California State President in 2016, currently serving on the Past Presidents Advisory. Along the way, because I was a Women’s Council member, I got involved with the Board and was on several committees, Education to Strategic Planning, before being elected to the Presidency of the Delta Association in 2012, eventually holding several California Association of REALTORS® positions, I believe in giving back to the industry that has been so good to me. When I initially began my career, I had no idea that we REALTORS®are such a force in the national economy and can make such a difference. I started with a small independent firm in San Jose who worked with REO properties. Over several cycles, I and my team sold over 1000 properties, and a few more over time,all over the Bay Area. The knowledge I gained over time, has contributed to my business success as well personal and professional life, and that path began with Women’s Council. 31 Days Can Make A Tremendous Change Or not…..it depends on how one sees it! Last month I stated that it looks that the lid has begun to lift off the real estate market. Believe it or not, things are opening up! A number of notable things have come to light and homebuyers and home sellers are reaping the rewards! We are seeing an increasing number of home available for sale. Across East County and the entire Bay Area, there are an increased number of homes that have gone on market since last month. Since last month, mortgage interest rates have increased, partially due to the increased number of home buyers in search of mortgages but more so the increase in the base indices used to calculate the rates by over a quarter of a percent. The number of active homebuyers searching for homes has also increased due to the better availability of homes and the premise of higher interest rates in the near future which typically spurs an increased activity in buyer interest, hoping now to cash in on the current lower interest rates. So what does this mean? As we have been saying (just as many others saying the same thing), waiting for the first of the year to purchase or sell a home will decrease the total satisfaction of both the buyer and the seller. The wait of 2 or three months to enter to market causes an increase in costs, delays any plans the family may have, and add to the difficulty and timeliness of completing the transaction once one comes to an agreement.

This will not last forever and rate will go down, most likely if everyone gets another $1,400 check from the federal government. There is already a surplus in dollars in the economy and with more injection into it, we will almost certainly experience a price inflation. At this point, rates are low and will be historically through at least the first half of the year. After sorting through this, I will make it simple. To delay either a purchase or a sale in this will result in both a financial loss and a satisfaction loss as well. Increased availability (more listings on market) will only make a difference if the demand for them is satisfied. At this point, our inventory of unsold homes has not changed significantly and as a result, prices have gone up. This trend will continue until such time as the demand slackens.
