THE BEAUTY OF NEGOTIATION

As most of you have heard, the commission structure of the Seller and the Buyer is changing, probably in mid-July. To clarify, the commission paid to the agent, both the seller’s agent and the buyer’s agent, upon the completion of the transaction has generally been paid for by the seller’s agent based on an agreed split, most of the time on a 50/50 basis. A lawsuit decision that is now still awaiting court approval.

While there was no hard and fast rule on the amount of the commission that the agents earn in the sale of a property, the listing agreement had a clause that specified the actual amount. This clause was always negotiable and specified how much of the sales commission would be and when completed who (generally the seller) paid the commission to the seller’s broker and the buyer’s broker as well. As for the ruling, all of this is about to change. Commission amounts will be negotiated outside of the listing agreement and dealt with as a separate agreement.

This is where the beauty of negotiation shows itself. The seller’s agent will work with the seller to determine the amount that the seller’s broker will receive. What is left out is how much the Buyer’s broker will be paid in the transaction as well and in addition, who will pay it. The buyer will have to work with their agent to negotiate who will pay the commission. The buyer’s agent and the seller’s agent will have to work together to determine an agreement.

There are many ways this could work out. Here are a few that everyone needs to consider. There are probably hundreds of other results possible. There are a few things that need to be considered. The principals must assume that the agents know what they are doing and, almost as important, they are unlikely to work for free. I would also posit that

the principals also want to complete the transaction as a buyer or a seller and are reasonable enough to get help to determine the best terms of the contract.

Scenario 1 – the seller lists the property for sale and agrees to pay both the buyer and seller brokers a nominal commission. This more or less is how it happens today if the buyer’s agent agrees to the terms

Scenario 2 – the seller agrees to pay the seller’s agent for the work that is done. The buyer’s agent is paid by the buyer. Again, this could be done and is dependent on the buyer’s agent accepting what the buyer is willing to pay

Scenario 3 – neither the seller or the buyer can come to terms and as a result the transaction fails. This should not be a result that anyone wants but certainly is possible

Scenario 4 – after a long-term drawn-out negotiation, both parties agree on who pay how much and other terms. Good agents can reduce any potential acrimony and come to an amenable agreement

UNDERSTANDING HOME INSPECTIONS

Purchasing your home is one of the biggest thrills of your life, but it can also quickly become overwhelming. Whether you are buying a new or a resale home it is important that you look underneath the staging, perfect floorplan, or location and see what may be hiding that could impact your dream home and pocketbook.

Enter the home inspector. A home inspector performs a basic physical inspection of the structure and systems of your prospective home. This means that while you may love the beauty of the living room’s wood floors, your inspector can tell if the floor will truly last.

The home inspection is an objective visual examination of the physical structure and systems of a home, from roof to foundation. The inspection will determine not only the present condition of the home, but also help foresee any immediate or future necessary additional costs that may go unnoticed by the untrained eye.

Home inspections start at around $500 depending generally on the size of the home. I believe it’s money well spent.

A standard home inspector’s report will cover the basic condition of the home’s heating system; central air conditioning system (temperature permitting); interior plumbing and electrical systems; visual of the roof, visual of the attic and insulation; walls, ceilings, floors, windows and doors; the foundation, basement and structural components.

I have always viewed a home inspection much like a visit to the doctor for a physical from a general practitioner, if there are any problems or concerns you are referred to a specialist such as a cardiologist. A home inspection works in a similar manner, if there is a concern about the foundation you are recommended to a structural engineer, plumbing to a plumber etc.

The inspection will show the positive and negative aspects of a home, as well as the maintenance that will be necessary to keep it in good shape. After an inspection you should have a much clearer understanding of the value and needs of the property.

I think it is important to note that even if a house needs repairs, it shouldn’t always be the cause for getting out of a

sale. No house is perfect and as long as you know ahead of time what needs to be done and are comfortable with the cost and possibly the ramifications, knowing about an issue before closing gives you the peace of mind before you close or often make an offer. The home inspection can give you a great starter list of what needs to be done to really make moving in that much easier. Don’t be shy about asking questions and getting a clear understanding.

I would like to note that home inspectors are not licensed or certified by the State so do your research to make sure your inspector is qualified. I recommend that they are members of an association with certification criteria and a standard of practice such as ASHI.
