The global community affirms that the Philippines is now truly open for business under new management: our unprecedented growth has garnered the optimism of multinationals and financing institutions, and has led prominent credit rating agencies to recognize the country as among Asia’s emerging tigers. The Filipinos’ resolute commitment to integrity and accountabiliy has borne fruit and continues to fuel our rise as a nation. We are grateful to staunch partners such as the ECCP for supporting our endeavors and espousing honest and responsible corporate governance. Your expanding list of signatories for the Integrity Project represents the revitalization of the bedrock principles upon which our country was found: justice, fairness, and inclusiveness. Delegation of the European Union to the Philippines The EU is one of the major trade, investment and business partners of the Philippines. The signature of the EU-Philippines Partnership and Cooperation agreement in 2012 was an important milestone to put the bilateral relations on a new and comprehensive basis. While 2012 was a challenging year for the EU and the global economy as a whole, efforts of reform processes are underway to strengthen the international banking system, fiscal stability and economic governance, some key pre-requisites for re-establishing trust and confidence among businesses and investors. Experience shows that structural and legal reform processes are positive in creating a push for new investment and for production opportunities, and there is in particular considerable potential in the Philippines. The EU welcomes the commitment of President Aquino and his administration to fight corruption and increase transparency in public affairs. Achieving clean, transparent governance with a sound legal system and effective courts; with efficient procedures that make it easy to set up businesses and with reliable standards and regulations that reflect best international practice, will win over potential investors, because they will create a positive business and investor-friendly climate. In today’s globalised, competitive market place, the countries that attract most investments and businesses are those that have excelled in creating a trade, investment and business-friendly environment. There is a strong sense in the Philippines among business people and politicians alike that the country needs to catch up with its ASEAN neighbours. I am convinced that there are ample opportunities for increasing the attractiveness of the Philippines, with its vast natural resources and well-educated and trained people. Creating a modern framework for competition is one way of opening up for increased business and I am happy to say that the EU - through our trade-related technical assistance programme – will provide support for this effort This brings me to my final observation: After more than a year in the country, let me say that the EU’s bilateral trade, business and investment relations with the Philippines are strong but clearly remain below their potential. There is significant scope for further improvements and through continued efforts, collaboration with ECCP, dialogue with government, I and my colleagues in the EU-Delegation will make every effort to help further expanding and developing bilateral trade and investment.

EUROPEAN CHAMBER OF COMMERCE OF THE PHILIPPINES The year 2012 has been a challenging year for the EU; 2012 has been an exciting year for the Philippines, with the growing reform momentum in the Philippines attracting worldwide attention in the international press and among foreign governments. Philippines – EU relations moved into level, given visits of the French prime minister with a business delegation to the Philippines and visits of high Philippine government officials to Europe. 2013 is going to be another exciting year to continue with the reforms, build on the worldwide attention and implement infrastructure projects to provide the foundation for continued economic, inclusive growth. We also hope to a see decision makers in the government and private sector to take the ASEAN economic integration seriously and prepare for it. In this context, we trust that business leaders will encourage the Philippine government to decisively move forward in starting Free Trade Agreement (FTA) negotiations and be ready when the region integrates economically in 2015. ECCP priorities for 2013 can be summarized as follows: 1.
Infrastructure - 2013 is the year to show results by contracting a record number of PPPs, capping the international container capacity of Manila, opening NAIA IPT-3 and finding a settlement with the original investors, continuing to increase spending on national roads, irrigation, and flood control, starting the long-delayed CNS/ATM project, and buying a new DVOR for the Manila airport, and addressing severe air safety concerns, and approving the MRT-7 project and the LRT-1 extension to Cavite, etc.

Legislation and FINL - A complete review of the Foreign Investment Negative List (FINL) should be made before mid-2013 resulting in a legislative reform agenda for the 16th Congress, hopefully including economic provisions of the Constitution.

Business costs. should be kept in check to increase investment, both domestic and foreign. This means a focus on lower electricity costs through effective ‘open access’ and energy efficiency investments, more efficient transports, small or no increases in minimum wages. There is a great opportunity to attract relocating manufacturing investors from China and elsewhere who can create millions of new jobs and make inclusive growth more than a slogan. Also tourism investment must grow by around 1.5 million new visitors a year to reach the 10 million target in 2016, provided the required infrastructure is created.

Maintain the pressure on government to ‘level the playing field’. Our agenda has four areas to be covered: a. No corruption – we have made progress in the last two years but much more needs to be done; ECCP is driving the Integrity Initiative jointly with the Makati Business Club; b. Competition legislation – having the Office of Competition under the Dept. of Justice is a good step forward but legislation will be needed in the 16th Congress, including an independent Competition Office; c. Remove fees and taxes that burden foreign investors / operators – good progress has been made by addressing the CIQ issue, passing legislation to remove Common Carriers Tax and Gross Philippine Billings (the cargo issue still needs to be addressed in the 16th Congress), and passing the Excise Tax Reform Act (we still have to see whether the hybrid system for distilled spirits is fairly and effectively implemented); d. Opening the economic provisions of the Constitution and remove the limitations for foreigners – the debate has to be resumed after the May elections.
As ECCP enters its 35th year of existence we continue seeing challenges as opportunities and enter 2013 with a healthy level of optimism.

The Business Environment Countries - where bribery and embezzlement are effectively contained allocate capital more efficiently, grow faster, preserve the environment, attract investors, avoid inequality in income and wealth, enhance trust in politics and foster happiness among its citizens. Around the world, citizens are crying out against corruption. New leaders like President Aquino have prioritized the fight against corruption. Before the Aquino Administration is reaching its halfway mark, the change in the Philippines is visible and recognized internationally. The Philippine business environment has improved substantially in 2012 after the Aquino Administration launched a serious campaign against graft and corruption in 2010. The Philippines moved up another 10 notches in the Global Competitiveness Report from 75 in 2011 to 65 out of 144 countries this year (in 2010 the Philippines ranked 85), while corruption, inefficient government bureaucracy, and inadequate infrastructure still remain the top three problematic factors for doing business in the country. The Philippine economy expanded 5.9% in the 2nd quarter of the year, weaker than the revised 6.3% recorded in the first three months; there is no doubt that the country will finish strong in 2012 and belong to the high economic performers this year. At the European front, the lingering economic crisis is making the Philippine and ASEAN markets important destinations for investments and trade. European enterprises are looking at international markets to compensate for the current unfavorable economic conditions in many parts of Europe. The European Parliament and Commission are providing support mechanisms to help SMEs find new opportunities overseas. In this regard, European Business
Organizations (EBOs) have been requested to assist European SMEs in identifying business opportunities outside the EU and in entering these new markets, particularly, in the ASEAN region. The European Union launched a Call for Proposals in Sept. 2012 to provide “Support to European Business in South East Asian Markets� or SEBSEAM with a grant component of 3.5 million euro for the Philippine component. This Call has been issued in 4 ASEAN countries, namely, Indonesia, Malaysia, Philippines and Vietnam. In 2012, ECCP intensified its campaign to promote business integrity. The Chamber is working closely with Makati Business Club and other business organizations to come up with an industry accepted integrity standards and tools to ensure that ethical business practices are promoted and control measures embedded in all companies and organizations. Meanwhile 1,600 CEOs have signed the Integrity Pledge together with 32 government CEOs, mostly Cabinet-level. After two years in driving the Integrity Initiative we are seeing progress but also clearly recognizing that so much more needs to be done to achieve culture change, to level the playing field and get the message across that clean business is good business. On the business side, ECCP continued to work towards opening new markets for European SMEs as well as improving the competitiveness of Philippine exporters to enhance their collaboration potentials with enterprises in Europe and in emerging markets in Asia and South America. We also developed new programs and advocacies as well as platforms to promote and support the expansion of existing and new industries that will bring more business opportunities for both European and Philippine enterprises. Our membership committees on energy/energy efficiency, agri-biz and IT/BPO/KPO/e-creative services are delivering encouraging results.
