T

he regional office of the Department of Health (DOH 11) assured that those who received the first dose of AstraZeneca vaccines in Davao Region are being closely monitored. The statement was issued following the DOH adoption of the recommendation of the Food and Drug Administration (FDA) to temporarily suspend the use of AstraZeneca vaccines for individuals aged below 60 years old, following recent reports of rare cases of blood clots with low platelets detected in some individuals inoculated with the vaccine. FDA Director General Rolando Enrique Domingo said that the agency is aware of the recommendation of the European Medicines Agency (EMA) to list blood clots as very rare side effects of the AstraZeneca vaccine. He said while FDA has

not seen such incidents in the country, it has recommended to temporarily suspend the use of the vaccine for persons below 60 years old as we await results of the review being done by our local experts, as well as the official guidance of the WHO. The FDA also emphasized that this temporary suspension does not mean that the vaccine is unsafe or ineffective—it just means that we are taking precautionary measures to ensure the safety of every Filipino. PEF to release PH eagle ‘Tagoyaman Fernando’ in Bukidnon on Earth Day

ix months after its rescue, the Philippine Eagle Foundation (PEF) is set to release “Tagoyaman Fernando” in Bukidnon on Earth Day, April 22. In a press statement posted on the PEF website, Dr. Jayson Ibañez, the foundation’s director of research and conservation, said the immature Philippine eagle was rescued on October 4, 2020, four days after it got entangled in a “native trap” at the Pantaron mountains in San Fernando, Bukidnon.

he Davao City Anti-Scam Unit (CASU) has warned the public anew against a couple from Sasa in Davao City for scamming. avao Light and Power Co., Inc. (Davao Light) has lighted up all 266 barangays in the company’s franchise area in all of Davao City and parts of Davao del Norte. This was bared by Rodger Velasco, Davao Light president. Velasco said that 98.87 percent of the houses in these barangays have electricity either from the grid or from a battery charging station (BCS), also provided by the company.

“ We have been consistently extending our line in the past years to serve the rural areas and will continue to spend to reach 100 percent,” he said. According to Velasco, the company has been heavily investing in rural electrification so that it can provide power even to far-flung areas. Davao Light’s franchise areas are Davao City with 182 barangays, the City of Panabo and the towns of Sto. Tomas, Carmen, Braulio E. Dujale in Davao del Norte.

The people of Panabo City and the three towns in Davao del Norte opted to be serviced by Davao Light, rather than by the Davao del Norte Electric Cooperative (DANECO) in a referendum in 1976. Velasco said that although all barangays can get connection from the grid, there are villages within some barangays that cannot. The DIF represents PDIC’s overall capacity to respond to insurance calls due to bank failures. The Confidence Index (CI) for Q1 of 2021 rose to 17.4 percent from 10.6 percent in the fourth quarter of 2020, while the CI for Q2 of 2021 went up to 42.8 percent from 37.4 percent, according to the Business Expectation Survey for Q1 with 1,512 firms as respondents nationwide. "The overall Confidence Index for Q1 and Q2 both posted increases from previous quarter

Optimism for the 2 quarters was attributed to the following: • Easing of quarantine restrictions and the reopening of businesses • Observations that people are adapting to the new normal • Increase in volume of sales and orders • Rollout of vaccines against COVID-19 • Development of new

From April 6 to 9, Cebu Pacific said it flew about 77,800 doses to six cities in the Philippines, specifically to Bacolod on April 6; to Zamboanga, Tacloban, and Cotabato on April 7; to Puerto Princesa on April 8; and to Tuguegarao on April 9. The carrier said it delivered around 53,000 doses to Zamboanga and Tuguegarao last month. Dar says lowering tariffs on pork imports ‘win-win’ for all T

he recently approved reduction on the tariff rates of imported pork is a move that will benefit all Filipinos as this will eventually lower the retail price of pork in the market, Agriculture Secretary William Dar said Friday.

On Wednesday, President Rodrigo Duterte issued the Executive Order 128, which reduced the tariff rate for imported pork within quota or minimum access volume (MAV)—whether fresh, chilled or frozen— to 5% for the first three months upon the EO’s effectivity and 10% for the fourth to 12th month. However, tariff rates for imported meat outside of the MAV has been set to 15% for the first three months upon the EO’s effectivity and 20% for the fourth to the 12th month. The existing 30% to 40% tariff rate for imported pork

will be restored after the 12th month. Dar said the reduction in pork import tariff rates aims to immediately address supply deficiencies and eventually influence market prices to go down. Likewise, the Agriculture chief said the Department of Agriculture is imposing a suggested retail price (SRP) for imported pork. Effective April 9, the following are the SRP for imported pork: Kasim - P270/kilo Liempo - P350/kilo Senators, however, expressed disappointment over the reduction in tariff rates, fearing it would pose a negative impact on the local hog industry. Dar said the DA’s repopulation program is ongoing to help revive the local industry decimated by the African swine fever (ASF) crisis.

Lawyer Ma. Karina Trayvilla, director of the Bureau of Workers with Special Concerns (BWSC) of the Department of Labor and Employment (DOLE), said the possible beneficiaries of the Tulong Panghanapbuhay sa Ating Disadvantaged/Displaced Workers (TUPAD) Program has been increased to 14,000. “As to the numbers of beneficiaries, Secretary Silvestre Bello III initially said it is 12,000 for 30 days work. But it increased on Wednesday with an additional 2,000,” she said in a Laging Handa briefing. Trayvilla, meanwhile, said some of the workers might be employed for a longer period based on the request of some local government units. “The requirement of LGUs is 90 days. With the budget for 14,000 workers, we will stretch it to

90 days, so we will be able to accommodate roughly 5,000 to have a longer duration of work,” she said. Trayvilla added that they are hoping to start the hiring next week. “For our contact tracers, hopefully, we will start hiring next week after finalizing the details among the DILG (Department of Local and Interior and Local Government) and MMDA (Metro Manila Development Authority (MMDA),” she said. As for the salary of contact tracers, she said it will be based on the minimum wage rate of the area where the workers will be employed. “The salary that will be provided by the DOLE will be based on regional wage rate in NCR (National Capital Region) and also to the bubble area which is Region 4-A (Calabarzon). In NCR, the minimum wage is PHP537 per day at one month that’s PHP16,110.00,” she added. Trayvilla said interested applicants can submit their applications to the Public Employment Service Office (PESO) of the LGUs where they reside. (PNA)

he Social Security System (SSS) has recorded P6.23 billion in disbursements for disability benefits in 2020. The amount covers payouts to 118,755 beneficiaries, according to the pension fund. The disbursements, however, were lower by 12.6% compared to 2019. SSS president and chief executive officer Aurora Ignacio attributed the decrease to the limited mobility of members and pensioners since March 2020, when the government implemented strict community quarantine throughout the country. “We facilitated the use of the dropbox system to minimize face-to-face transactions to curb the spread of the COVID-19 virus. Our top priority is the health and safety of our transacting members and our employees,” Ignacio said. “We have pushed for the digitalization of all our services amid the pandemic. However, we are already working on disability and death benefits to be includ-

ed in the pipeline soon for the safety and convenience of our members,” she added. Online services The SSS said there are now around 25 online services available on the My.SSS portal. In addition to online applications for Calamity Loan, Pension Loan, Retirement Benefit (subject to qualifying conditions for online filing), Unemployment Benefit, and Funeral Claim, members may also submit their requests for Member Data Change for simple corrections, while employers can submit Sickness Benefit Reimbursement Applications of their employees through the portal. It added that members and employers can also get a Real-Time Processing of Loans Payment Reference Number (RTPL-PRN), which will be mandatorily implemented on May 1, 2021; Benefit Re-disbursement Module, and improved Disbursement Account Enrollment Module (DAEM). Moreover, the SSS said it enhanced its online SS

Number Application facility and provided members with access to the Remittance Transfer Company/ Cash Payout Outlet (RTC/ CPO) Reference Number Inquiry. “They can also access other virtual services, including viewing contribution and loan records; and inquiring on the status of their benefit claims and eligibility for benefit programs, among others,” the pension fund said. “In addition to the My.SSS portal, this information may also be accessed using the SSS Mobile App and Text-SSS,” it added. SSS members can also view their membership information, list of PRN payments, addresses of SSS branches; file for Salary Loans; submit Maternity Notifications (for self-employed, voluntary, and overseas Filipino worker members); generate PRNs for contributions; and update their contact information through the My.SSS Portal and SSS Mobile App. “By using the My.SSS Portal, members can set an

appointment with an SSS branch, send a request for SSS records, enroll in the Personal Equity and Savings Option (PESO) Fund or Flexi-fund, use a simulated retirement calculator, and view details of their Unified Multi-Purpose Identification (UMID) Card or SSS ID, as well as change their account password. With the SSS Mobile App, they can also pay contributions using PayMaya and the Bank of the Philippine Islands (BPI),” it said. “For employers, they may also view employees’ contribution and loan records, the status of payments, and benefit reimbursement claims and update their contact information,” it added. Employers may also update their contact information, facilitate submission of Employment Reports (R1A), Loan Collection Lists (ML2), Contribution Collection Lists (R3), sickness notifications, maternity notifications, and generate PRN, as well as certify the loans or claims of their employees.

(DLPC or Davao Light), easily Mindanao’s biggest power utility company, has electrified all 266 barangays in its franchise area composed of Davao City and some parts of Davao del Norte such as Panabo City and the municipalities of Sto. DISHONORED CHECKS CONSTITUTE BOTH ESTAFA AND VIOLATION OF B.P NO. 22 Dear IBP Davao, Good morning. I have a question regarding checks. I hope you can help me. I know someone who issued a check last February 2021 and issued post-dated checks under the same checking account for September 2021. I tried to deposit the check last February 2021 but it was dishonored due to a “Closed Account” so most likely the check will be dishonored on September as well. He stopped replying to calls, texts, and private messaged. I also learned that there are many others who are trying to get him to pay his debt towards them. What are my remedies for this, Atty? -Aurora

Dear Aurora, In the Philippines, you have two remedies the moment any issued check is dishonored or more commonly known as when the check “bounced” back from the bank. First is under Article 315 paragraph 2 (d) of the Revised Penal Code which punishes for the crime of Estafa. Second is under a Special Law, Batas Pambansa Blg. 22 (B.P. No. 22), or the “Bouncing Checks Law”. Under Article 315 paragraph 2(d) of the Revised Penal Code, a person may be held liable for Estafa by postdating a check in payment of an obligation when he had no funds in the bank or his funds were not sufficient to cover the amount of the check.

Further, the same paragraph provides that his failure to deposit the amount necessary to cover his check within three (3) days from the receipt of notice from the bank and/or holder of the check that it has been dishonored shall be prima facie evidence of deceit constituting fraud. Thus, it is the fraudulent intent that is punished here. Under B.P. No. 22, on the other hand, a person is punished for the act of issuing a check to apply to account or for value, knowing that at the time of issuance of the check, he does not have sufficient funds or credit with the bank for payment of the check upon presentment and such check is subsequently dishonored by the bank for

the insufficiency of funds or credit. Thus, it is the mere act of issuing an unfunded check that is punished here. In your case, considering that the check had already been dishonored and your debtor has stopped answering your calls, your debtor can already be considered prima facie in deceit and may be held liable for the crime of Estafa. Likewise, his act in issuing the check knowing fully that he did not have sufficient funds and the check’s subsequent dishonor makes him liable for violation of B.P. No. 22 as well. In our jurisdiction, you can file for both a case of Estafa and B.P. No. 22 at the same time since although it may be rooted from an iden-

tical set of facts, under the law, they present different causes of action which are considered “separate, distinct, and independent” from each other. Thus, both cases can proceed to their final adjudication in both the criminal and civil aspects, only subject to the prohibition on double recover (Rimando vs. Spouses Aldaba, G.R. More pointedly, I am referring to the South China Sea where China is presently moving in a hegemonic manner, imposing its military shadow over islands and reefs that belong to our economic territorial zone. Why? Because nothing we do will result positively in our favor. Not even the presence of the US Seventh Fleet nearby is deterring the once sleeping dragon from trying to extend its claws into these small reefs and claim them. In this situation, I cannot help but be amused by the teasing and media clowning of retired Associate Justice

Antonio Carpio who is underestimating the efforts of Pres. Rodrigo Duterte in resolving the WPS conflict. Carpio invokes the arbitral victory of the Philippines in the UN court where China did not participate. Aside from ignoring its summons, it also did not recognize its authority. But Carpio has not stopped nudging Duterte till now. Methinks he is on a subtle political run because the mainstream media have been carrying his statements extensively. Even when his position has become presumptuous, Carpio has now been leading a movement (1Sambayanan) to call on and coalesce anti-Duterte groups hoping to support only one candidate who has the best prospects to defeat the incumbent and his endorsed candidate for the 2022 presidency. So - anyway - does Carpio honestly think we can intimidate China and force it to withdraw from the WPS where it has built military in-

stallations and structures? Does Carpio want us to go to war, hoping if we fire the first shot, America would come ASAP to our rescue and bamboozle the Chinese People’s Liberation Army from pursuing its dirty designs? Carpio cannot put the wool over our eyes. The truth is that, the Chinese need not even send ground troops (in case war is declared between the Philippines and China) to engage us. China has missiles already kept in the reefs and islands it has occupied in the WPS. Just a press of the button, and boom, the country will be on fire. Would America want a war against China, knowing that Americans in the mainland will also be endangered as Chinese nuclear missiles and ICBMs are already programmed to be fired just in case. Carpio thinks like he is the modern superman who can solve the country’s headaches. The truth is that NO ONE among those professing to be

fit for the presidency can. Our problems are not only economic, political, social, etc. Many (and much) of our groanings are spiritual in nature. Even the great Solomon will fail. We are in the crossroads of our lives where politics and the politicians today are the cause and sources of all the maladies our country is suffering from now. Carpio does not have the moral ascendancy nor the political acumen and leadership needed to get our country out of the rut. He appears to possess these but only in the way he appears to be. Filipinos - the electorate in particular - have the sovereign mandate to choose the way to go. If the country goes left, the Filipinos have only to choose the communist way of life and install JoMa Sison and his CPP-NPA to the top echelons of government. (The Americans drove Trump out of office and they have chosen the directions leading to the left. That is

their lookout.) Watch out that we do not fall prey to “emerging new faces” in the political limelight. Just as we nearly fell to the importunings of a candidate employing his dad’s showbiz appeal and popularity, we have to be extra careful because other pretenders to the throne are also going around to woo the endorsement of ignorant Filipino voters in the countryside. Carpio has the temerity to label a would-be presidential candidate as “incompetent” because this guy had extremely become popular because of his fists. But Carpio does not realize that he is himself “incompetent” because he is only a legal eagle trying to lead this country politically. And this guy is not even yet a (dirtied) politician. EW ORLEANS — Zion Williamson scored 14 of his 37 points in the fourth quarter and the New Orleans Pelicans held on to beat the Philadelphia 76ers, 10194, on Friday night (Saturday, Manila time). Williamson scored the first six points of the fourth quarter and eight of the Pelicans' first 10, extending an eight-point lead to 8671. or a sports nerd like me who’s been on this beat since 1974, the absence of some live domestic sports games to watch has been really agonizing. During the 70s, despite the popularity of basketball (MICAA was then the top attraction until the PBA made its (in)glorious entry in 1975 to steal the thunder from under) there was baseball and softball (both men’s and women’s) that contended for the sports fans’ attention. Believe it or not, during championship series in both baseball and softball, the baseball stadium at the RMSC (Rizal Memorial Sports Complex) is filled to the rafters, literally. At that time, the men’s and women’s softball squads, dubbed Blu Boys and Blu Girls, were always title contenders and formerly held the Asian crown respectively in their divisions at one time or another. As much as legendary heroes were media hyped in the dribble and drive sport, there

were also a number of home run belters and outstanding pitchers who carved their niche in the diamond arenas. I’m kinda reminiscing of the decades past (gee, pardon me again) and I’m telling you I don’t like what is going on. I’d like to think our sports officials know how to beat the Wuhan virus without letting fear overwhelm them. At this point, only professional boxing appears to be bold enough to hold title fights because they have begun to see that the transmission of CoVid 19 can be avoided by observing the enforced health protocols. Filipinos are involved in championship matches very frequently now. Just recently, MP Promotions through the efforts of Nonoy Neri, held a title match in GenSan. Two Filipinos - Nonito Donaire and Michel Dasmarinas are reportedly scheduled to meet their counterparts in two separate title matches this coming May and June. Donaire will square it out against Frenchman Nordine Ouballi for the WBA bantam-

weight crown in May while Dasmarinas is looking to take away the IBF bantamweight title from Inoue, the Japanese who defeated Donaire previously before the CoVid attacks came. Oubaali is 34 years old, a two-time Olympian and owns a 17-0 with 12 KOs against Nonito’s 40-6 and 26 KOs. Dasmarinas, 28, is the IBF number one contender with a 30-2-1 win loss draw record and 20KOs. Inoue, is 27, with an immaculate 20-0 win loss mark and 17 KOs. He is Japan’s living hero. The Filipino challenger is however taller by two inches at 5’7” and is deemed like the smaller version of Thomas Hearns with his long, spindly arms. While my heart goes to both Nonito and Michael, I can’t figure out whether their hands will be raised after the bell. Look at their foes’ fight records. Boy, don’t these speak volumes? Anyway, I’m happy that local boxing is still up and about and that no untoward incidents or transmissions of viral infections have been reported.
