he Bureau of Fire Protection 11 (BFP 11) and the Police Regional Office (PRO 11) were asked to provide nursing and medical staff to augment the personnel of the Southern Philippines Medical Center (SPMC), which is currently overwhelmed with Covid-19 active cases.

The City Council recently approved under Suspended Rules a Resolution requesting the BFP 11 and

PNP PRO 11 to provide nursing and medical staff to augment the personnel needs of SPMC and private

hospitals in Davao City to respond to the ongoing COVID-19 surge in the city. This after an official of SPMC appealed to the City Council to help the hospital from severe staffing issues. It can be recalled that Dr. Ricardo Audan, head of SPMC, has appealed to the City Council to help the hospital with the problem on staffing. Audan asked the City Councilors for staff augmentation from the

ockdown is already lifted at the Police Regional Office XI. Police Major Eudisan Goltiano, spokesperson of the PRO XI confirmed this information, as no one among the police assigned at the camp is COVID-19 positive. However, she said that more COVID-19 cases were noted in the provinces like 28 cases as of June 17, and 162 active cases as of June 18.

Goltiano said that a total 695 cases of COVID-19 have been noted in the whole police force of Davao Region since the start of the pandemic last year. “Most of the police afflicted with COVID-19 was asymptomatic,” she said. Goltiano revealed that a total of three policemen died because of this virus. She said that civilians who have transactions

Of the 16 wards or “purok” in Barangay Pasian, nine had diarrhea cases, he said. Gentugaya said it was Wednesday morning when residents began experiencing diarrhea. Some of them however waited until afternoon to go to the health center, as they were initially afraid to seek medical attention since diarrhea is a symptom of COVID-19, he added.

Face shield policy still in effect

earing of face shields remains a must when riding a public conveyance and entering establishments with a large number of people in Davao City. Police Colonel Kirby John Kraft, director of the Davao City Police Office bared that the police do not have a written policy lifting the use of face shields. He said proper wearing of face shields is still a must in public conveyances and in establishments that have many people. Kraft said with the increase of COVID-19 cases, the MECQ in the city has been extended from June 20

to June 30. “It still needs discipline and understanding from the people,” he said. A total of 17 members of the Davao City Police Office have been afflicted with COVID-19 virus. Kraft said the 17 members come from various units of the DCPO. “No specific office has the contamination. “They got the virus from their housemates, landlord and while working,” he said. BSP-Davao acting director Jane Ann Gonzales said BSP-Davao is now welcoming gold traders with zero tax rate after experiencing a lull in gold trading due to the imposition of two percent excise tax and five percent

withholding tax in 2007 to BSP. She said with the imposition of the said taxes, the delivery of gold to BSPDavao was almost zero from 2011 to 2019. She added that this is the reason why BSP welcomed RA 11256 or the Gold Law, which is an act to strengthen the country’s Gross International Reserves (GIR), amending for the purpose Sections 32 and 151 of the National Internal Revenue Code.

Acting director Jane Anne Gonzales said BSP-Davao is now buying gold with zero tax rate. She said gold traders stopped selling to BSP and went to the black market instead when the government imposed 2 percent excise tax and 5 percent with withholding tax. Selling of gold to BSP went down to almost zero from 2011 to 2019 during the Benigno S. Aquino III administration.

In those halicyon days of gold strike in Davao and Caraga regions, BSP-Davao would buy an average of P 40 million worth of gold everyday. This quotidian routine occurred even in those weeks when the government suspended gold mining in these areas.

BSP-Davao is urging miners and traders in Davao and adjacent regions in Mindanao to sell their gold to BSP-Davao and not to worry about taxes.

Is there a penalty of IMPRISONMENT or FINE only in cases of RECKLESS IMPRUDENCE RESULTING TO DAMAGE TO PROPERTY (VEHICULAR ACCIDENT)? Juan

Dear Juan,

The specific law applicable on this question is Article 365 paragraph 3 of the Revised Penal Code, to wit: When the execution of the act covered by this article shall have only resulted in damage to the property of another, the offender shall be punished by a fine ranging from an amount equal to the value of said damages to three times such value, nevertheless, the fine shall in no case be less than five thousand pesos (P 5,000.00). One’s first impression upon

reading the above provision is to think that the penalty for the said violation is FINE only. But in reality, there are provisions of the Revised Penal Code, which come into play which are Article 39, Article 9, Article 25, Article 26 and Article 78. Article 39 refers to SUBSIDIARY PENALTY in case the CONVICT has NO PROPERTY TO MEET THE FINE, paragraph 2 thereof states, “When the principal penalty imposed be only a fine, the subsidiary imprisonment shall not exceed six months, if the culprit shall have been prosecuted for a grave or less grave felony, and shall not exceed fifteen days if for a light felony.” In determining whether the felony is grave, less grave, or light, we turn our attention to Article 9 which states that Grave felonies are those to which the law attaches the capital punishment (death) or penalties which in any of their periods are afflictive, (reclusion

perpetua, reclusion temporal, perpetual or temporary absolute disqualification, perpetual or temporary special disqualification, prision mayor) in accordance with Article 25. Less grave felonies are those which the law punishes with penalties which in their maximum period are correctional (prision correccional, arresto mayor, suspension, destierro) in accordance with abovementioned article. Light felonies are those infractions of law or the commission of which the penalty of arresto menor or a fine not exceeding forty thousand pesos (P 40,000.00) or both is provided. Lastly, to determine if the fine is afflictive, correccional, or a light penalty, we refer to Article 26 of the same Code, which states that, “ A fine, whether imposed as a single or as an alternative penalty, shall be considered an afflictive penalty, if it exceeds One Million two hundred thousand

(P 1,200,000.00); a correctional penalty if it does not exceed One Million two hundred thousand (1,200,000.00) but is not less than Forty thousand pesos (P 40,000.00); and a light penalty, if it be less than Forty thousand pesos (P 40,000.00).” Therefore, to answer the question above, YES, IMPRISONMENT MAY BE INCLUDED AS A SUBSIDIARY PENALTY in a case of reckless imprudence resulting to damage to property, when the offender does not have the means to pay the damages and its duration shall be determined by the gravity of the felony committed which in turn shall be determined by the gravity of the fine or penalty which is likewise determined by the amount charged as a penalty. He cannot choose to serve subsidiary imprisonment in lieu of the fine if he has property enough to pay the fine. There should be an EXPRESS PROVISION IN THE DE-

CISION ordering the convict to suffer subsidiary imprisonment in case of insolvency, because a penalty of fine or the subsidiary imprisonment in case of non-payment is considered a principal penalty under Article 25 and also because Article 78 of the code provides that, “ No penalty shall be executed except by virtue of a final judgment.” Should the convict’s finances improve, he is not relieved from paying the fine despite his subsidiary imprisonment. PROTECTING PHILIPPINE RISE Originally, it was called Benham Rise. Presumably, it was named after Admiral Andrew Ellicot Kennedy Benham (18321905), an American navy officer who served with both the South Atlantic and West Gulf Blockading Squadrons during the American Civil War. Although it is near the country (approximately 250 kilometers east of the northern coastline of Dinapigue, Isabela), the 13-million-hectare underwater plateau was not included in the territory of the Philippines. It wasn’t until on April 8, 2009 that the government lodged a partial territorial waters claim with the United Nations Commission on the Limits of the Continental Shelf. A bill filed by then-Senator Miriam Defensor-Santiago was enacted by the Congress and became Republic Act No. 9522, or the Archipelagic Baselines Law, which became the basis of the claim. In 2008, the Philippines filed its claim for Benham Rise in compliance with the requirements of the United Nations Convention on

the Law of the Seas. “The UN officially approved the claim in April 2012, the first claim of the Philippines approved by an international body since the colonial era,” Wikipedia says. Today, it is called Philippine Rise. On why it was changed, Wikipedia reports: “After Chinese survey ships were spotted in the region in 2017, President Rodrigo R. Duterte suggested that the plateau be renamed to emphasize the Philippines’ sovereignty over the area. Soon after, the Department of Foreign Affairs announced plans to come up with a new name. In May 2017, the Philippine government officially adopted the name ‘Philippine Rise’ for the feature and designated the areas as a ‘protected food supply exclusive zone’ and prohibited mining and oil exploration in the Philippine Plateau.” To enhance the protection and sustain the near pristine condition of the Philippine Rise, a $4-million project is being designed by the Department of Environment and Natural Resources (DENR) and Conservation Inter-

national (CI). The proposed five-year project, titled Philippine Rise Integrated Conservation for Enduring Legacies through Ecosystem Support Services (PRICELESS) will be financed under the 7th Replenishment Cycle of the Global Environment Facility (GEF-7). It will be executed by the DENR in partnership with non-government organizations, namely, Conservation International and Rare Philippines. GEF-7 will provide a $4 million grant, with an expected co-financing from the government, conservation partners, and other key stakeholders in the Philippine Rise Region. According to the press statement, GEF-7 PRICELESS aims to address the need to ramp up and build capacity to protect and manage the waters, reefs, and natural resources in the Philippine Rise Marine Resource Reserve (PRMRR). The PRMRR is composed of the Benham Bank and its surrounding waters, being the first National Integrated Protected Ar-

eas System Marine Protected Area (NIPAS MPA) in the country’s Exclusive Economic Zone (EEZ). A “natural submarine prolongation” of the Luzon island is how the area has been called. It is described as “3,000 meters to 3,500 meters below sea level, except for the Benham Bank, which is 48 meters to 70 meters below sea level.” The Benham Bank – the shallowest point of the Philippine Rise – exhibits a rich marine biodiversity. Its reefscapes contain ecologically-fragile corals, exotic algae, varied sponges and Halimedia, which sustain a variety of fish. The PRMRR was declared as an Ecologically and Biologically Significant Area (EBSA) by the Convention on Biological Diversity (CBD) back in 2016, granting the area the international recognition it deserves. The CBD website states: “In terms of associated fish fauna, the area contains 60 bony fish species and three cartilaginous species. Despite the depth, the majority (13 families) of the reef fishes are commercially important food fish:

snappers (maya-maya), emperors (bisugo), groupers (lapu-lapu), trevallies (talakitok), and surgeonfishes (labahita). The area also exhibits a high diversity of butterfly fishes with 9 species per unit area of reef.” However, it is through the issuance of Presidential Proclamation No. 489 in 2018 that PRMMR is being managed and operated. The DENR has initiated that the PRMRR be declared a full-fledged NIPAS Marine Protected Area. In Benham Rise Region in the Philippines: Protecting its Role in Providing Ecosystem Services, fisheries expert Dr. Jose Ingles argued that biodiversity conservation and the protection of Philippine Rise be initiated as these are “critical to the country and the future of oceanic tuna stocks regionally.” Philippine Rise is a haven for the Pacific bluefin tuna (Thunnus orientalis) and the big eye tuna (Thunnus obesus) both classified as “vulnerable” by the International Union for Conservation of Nature Red List of Threatened Species.

hilippine monetary officials hiked the Bangko Sentral ng Pilipinas’ (BSP) balance of payment (BOP) projection for 2021 on expectations of quicker global economic recovery but cut the 2022 forecast on expectations of higher imports growth. From a USD6.2 billion 2021 BOP surplus projection last March, the policy-making Monetary Board (MB) hiked this to USD7.1 billion but the 2022 figure was cut from USD3.8 billion surplus to USD2.7 billion. “The latest BOP assessment for 2021 reflects sustained optimism, fueled by expectations of improved global and domestic economic landscape, moving into the second half of this year; the better-than-expected global economic outlook for the year driven by upward revision in the prospects for advanced economies, our trading partners,” BSP Department of Economic Research (DER) managing director Zeno Ronald Abenoja said in a virtual briefing on Friday. This, as monetary officials expect better growth outturn in the second half of this year, which bodes well for trading prospects.

The MB hiked the central bank’s exports goods growth forecast for this year from 8 percent last March to 10 percent. Abenoja said measures by the government to stimulate economic recovery such as strengthened vaccination program rollout and fiscal stimulus along with the inputs of the private sector are plusses seen to boost market confidence, which in turn, are seen to result to more economic activities. LGU-private sector links up to vax Davao City’s tourism employees T he City Government of Davao and private tourism stakeholders has partnered to vaccinate the workforce of various tourism, tourism-related establishments in Davao City. ‘“As of now we are targeting 5,000 vaccinees from the tourism sector,” said Cherry Faye B. Al-ag, president-elect of the Davao Tourism Association (DATA) a private sector group which represents the various stakeholders of the region’s tourism industry. Al-ag said the vaccination of the tourism workers was born from the city government’s efforts to seek the help of private sector to fasttrack the vaccination. She said various companies in the sector has joined hands to make the vaccination program into a reality. For one, Waterfront Hotel Davao has agreed to shoul-

der the logistical needs of the vaccination, which includes the provision of the venue for the vaccination site. “This morning, our vaccination site has been approved which is the Waterfront Hotel. a cost of PHP3.3 trillion to be completed in 2023 and beyond, while there are 28 big-ticket projects amounting to PHP1.1 trillion in the pipeline. “Not only they will be giving a legacy of completed projects by the time President Duterte ends (his term) in 2022, but they will also be leaving behind a legacy of

projects, big-ticket projects that are ready to go,” Dizon said. The administration’s “Build, Build, Build” program has also completed 212 airport projects, 446 seaport projects, 10,376 flood mitigation structures, 26,494 kilometers of road, and 5,555 bridges throughout the country, he added.

he Department of Public Works and Highways (DPWH) has provided over 6 million jobs to Filipinos through the government’s ‘Build, Build, Build’ (BBB) projects in the last four years. “While these projects are being conducted, (these) generate jobs. From 2016 to 2020, we have created 6.5 million jobs,” DPWH Secretary Mark Villar said in a press briefing on the progress update of the BBB program in Makati City on Friday. He added that the jobs offered are for engineers, construction workers, among others. Villar said for this year, they are looking to provide employment opportunities to over one million workers. “Our target for 2021 is 1.6 million jobs,“ he added. Under the BBB program, the government is set to construct roads, bridges, airports, railways among others, with a total budget of PHP8 trillion. Meanwhile, Villar assured that the remaining civil works are being fasttracked to open the new and modernized Estrel-

la-Pantaleon Bridge by next month. “We are here on-site to show you that all substructure and superstructure of the Estrella-Pantaleon Bridge have been constructed and we are confident that we will be able to finish remaining works on the approach road and ancillary/miscellaneous works by July 2021,” he said. ilas Pilipinas moved to within a win from completing a sweep of the Group A play in the FIBA Asia Cup Qualifiers after drubbing Indonesia, 76-51, at the Angeles University Foundation Sports and Cultural Center on Friday night. Similar to Gilas’ nail-biting win against South Korea on Wednesday night, Gilas needed a strong second half to pull away from Indonesia.
