The regional office of the Department of Health (DOH 11) announced over the weekend that an additional Covid-19 variants has been detected in Davao City involving a 33-year old male patient from Davao City. The patient was swabbed and tested positive at Southern Philippines Medical Center (SPMC)Molecular Biology Labo-

ratory last July 5, 2021. He was discharged last July 17, 2021 and on July 19, 2021, he was then swabbed and tested negative. The patient was already tagged as recovered. Based on the announcement of DOH-Davao the case was detected from batch 29 specimens from Davao Region as reported by University of the Philippines – Philippine Genome

Center Whole Genome Sequencing (UP-PGC-WGS). To date there are already five cases of Delta variants reported in Davao City. All were tagged recovered. It can be recalled that DOH 11 reported two Delta variant cases in Davao Region last week and these were Returning Overseas Filipinos (ROFs) workers from Saudi Arabia and Zambia, Africa. On August 3, 2021, DOH-Davao reported four Delta variants detected in Davao Region: three in Davao City and one in

The group said improperly disposed of solid wastes in the city’s next source of water is an issue that needs urgent solutions. The Philippine Statistics Authority (PSA) reported that as of Aug. 8, a total of 6,012,508 have completed the Step 1 process for the Philippine Identification (PhilID) card. The online signup ensures the safety of registrants and PhilSys staff, especially with the Covid-19 threat still prevalent. Maguindanao terrorist leader arrested

leader of the terrorist Dawla Daulah Islamiyah-Maguid Group was arrested by joint elements of the military and police in Maguindanao on Wednesday (August 11). Col. Alaric Avelino Delos Santos, spokesman of the Western Mindanao Command (WestMinCom), identified the suspect as Kalid Andalani Kalaing, alias Kumander Kalid. Delos Santos said Kalaing was arrested by elements of the Philippine Army’s 1st Mechanized Infantry Battalion, Shariff Aguak Municipal Police Station, and 2nd Provincial Mobile Force Company during a

checkpoint operation at Lining Patrol Base in Barangay Labu Labu, Shariff Aguak, Maguindanao at about 2:30 p.m. Wednesday. Kalaing was heading from Cotabato to Isulan, Sultan Kudarat onboard a white Toyota pick-up when he was arrested. He was arrested by a strength of a warrant of arrest for carnapping with homicide issued on June 13, 2019, by Presiding Judge Lorenzo Balo of the Regional Trial Court Branch 19-Isulan. Arrival of more anti-Covid-19 vaccines boosts inoculation drive

he arrival of more anti-Covid-19 vaccines in Davao City is expected to boost the vaccination drive of the city government of Davao. Davao City Covid-19 Task Force spokesperson Dr. Michelle Schlosser said that more than 24,900 doses of Moderna vaccines arrived this week for Davao City. Schlosser also said that Pfizer-BioNTech vaccines have also arrived and as of the moment the city is waiting for the regional office of the Department of Health (DOH 11) to determine the number of allocations for the city. She added that the city is also waiting for the supply of the Sinovac vaccines, which recently arrived in the Philippines. Schlosser said more

Dabawenyos are expected to be vaccinated with the arrival of the vaccines. She said these vaccines will help the city in achieving herd immunity. en. Manny Pacquiao could be expelled from ruling party PDP-Laban following supposed complaints on loyalty and violation of their constitution, a party official said on Friday. The PDP-Laban faction led by Energy Secretary Alfonso Cusi said they would give Pacquiao’s camp 10 to 15 days to explain why they should not be expelled from the party, Secretary-General Melvin Matibag said. Matibag said their National Executive Council met Friday and passed a resolution asking Pacquiao’s camp to answer a complaint for disloyalty and violation of the party’s by laws and

constitution by the alleged conversion of regional party People’s Champ Movement (PCM) into a national one. The PCM is a regional political party in the Philippines, particularly in the provinces of General Santos and Sarangani. Such conversion, he said, happened even if the senator was still leading the PDP-Laban. Pacquiao was ousted as the party president on July 17 following a widening rift between his faction and Cusi’s. The August 12 quake reminds us to be wary of the safety consciousness including the inspection of buildings and critical structures in the city. MY HUSBAND’S GIRLFRIEND This case involves a Filipino wife who is working in the U.S. and whose husband is a U.S. citizen (“USC”) living in the Philippines. The wife has learned that her husband is having an extramarital affair and wants him deported from the Philippines. Given the very limited facts, the bedrock issue here is whether the act of the USC husband in having an extramarital affair in the Philippines is by and of itself an act which the wife can use to have her husband deported. Deportation is the act by which a non-Philippine citizen (“NPC”) is removed from Philippine territory. The Bureau of Immigration (“BI”) must determine if any of the grounds provided by law, particularly, Sec. 37(a) of C.A. 613, exists to authorize the deportation of the NPC following the procedure under the BI Omnibus Rules of Pro-

cedure of 2015. Since the only fact that we have is that the husband is having an affair, two possible legal grounds might apply to have him deported, namely: (1) he was convicted of a crime the sentence of which requires both his imprisonment and deportation after service of sentence; or, (2) he was convicted in the Philippines and sentenced to a term of one year or more for a crime involving moral turpitude. The existence of the first ground is easy enough to determine and needs no further discussion. For the second ground to apply, the crime must involve moral turpitude, i.e., the act is “intrinsically immoral, regardless of whether it is punishable by law or not.” Zari v. Flores, 94 SCRA 317, 323. Concubinage is a crime that involves moral turpitude.

See Teves v. Comelec, G.R. No. 180363, April 28, 2009, concurring opinion of J. Briones, FN 39. It is committed by “any husband who shall keep a mistress in the conjugal dwelling, or, shall have sexual intercourse, under scandalous circumstances, with a woman who is not his wife, or shall cohabit with her in any other place.” Art. 334 of the Revised Penal Code (“RPC”). Having an extramarital affair is punishable if it amounts to psychological violence under section 3(c) of R.A. 9262 (“acts or omissions causing or likely to cause mental or emotional suffering of the victim such as but not limited to intimidation, harassment, stalking, damage to property, public ridicule or humiliation, repeated verbal abuse and mental infidelity”). If having an extramarital affair is seen by the courts as “intrinsically immoral, regardless of

whether it is punishable or not,” then an R.A. 9262 violation will be considered as a crime involving moral turpitude. In conclusion, if the extramarital affair of the husband leads to a conviction for: (a) a crime that imposes a sentence of imprisonment and deportation; or, (b) a crime involving moral turpitude, such as concubinage under the RPC or possibly psychological violence under R.A. 9262, then the wife can file the necessary complaint with the BI to initiate deportation proceedings against her USC husband. The practicality of having the USC husband deported under the limited facts of this case is another matter that should be considered. The entire process will involve separate proceedings by different agencies conducted one after the other:

he must first be charged and convicted by a court of law in a criminal case, and after he has served his sentence, he must then be found deportable by the BI in deportation proceedings. Clearly, this will take several years. Therefore, it will be best for the wife to first consult with a lawyer to consider more expedient and probably better alternatives for the vindication of her rights. It may be culturally ethnic that Filipinos can’t seem to solidly unite as one against a common enemy. Even during the early days of the Spanish colonization, history writes of anecdotes of in-fighting among tribal kingdoms and leaders, instead of pooling their armies together to defeat a foreign invasion. And so, it goes on and on. Calls to unite the political opposition against the incumbent administration in time for the 2022 presidential balloting have fallen on deaf ears. Presidential aspirants - among them Sen. Ping Lacson and VP Leni Robredo have failed to find a common

ground simply because each may have been nurturing a selfish attitude devoid of sincerity and viable alternatives. Some pretenders impose themselves to be considered presidential timbers, whether the electorate believes it or not. Rookie mayor Francisco Domagoso of Manila aka “Isko Moreno,” is parading himself as a ‘Messiah” of sorts, has activated a media promotions plan to create a positive image in both the mainstream media and the SocMed platforms. Sen. Manny Pacquiao, though unhappily saddled by intramurals in the PDP Laban where he has been unceremoniously ousted, clings on the coattails of former Senate President Koko Pimentel who now appears to be his mentor for his presidential ambitions. Not to be outdone, exSen. Antonio Trillanes has declared himself prepared

and ready to be the standard bearer for 1Sambayan, a new political group led by convenor ex-SC justice Antonio Carpio. Though all of the above personalities are seeking to battle the administration candidate in the 2022 presidential derby, they are unable to find (or refuse to acknowledge) a unifying solution that will send only one of them as the common candidate of the entire political opposition. If this is so, why the heck should they be wasting their time looking to coalesce with the other? Why don’t they just thrush themselves upon the populace and see what develops in the succeeding months and then those at the far end of the surveys surrender and submit humbly by supporting the candidate with the best chance of winning and beating the administration candidate on a one-on-one? To date, Lacson and Robredo are at the tailend of

the survey rankings. But both continue to harp and plead. The reality is that, despite Mayor Inday Sara’s intentio to run as an independent, she remains at the top of survey rankings. This actual political condition will be hard to beat as she has not even yet taken the first step of the political campaign trail to speak before the voting public. Domagoso and Paquiao appear to be unnerved and uncowed by this glittering reality though. If it is possible, they could form an alliance - Isko-Manny or Manny-Isko - depending on the terms of the trade. Is there enough time for the political enemies of the Duterte government to find and agree on a common cause so that they could put up a strong candidate capable of pulling the rug from under? They could if they get rid of their “Me First” selfish, egoistic mindset.

AND THAT IS A BIG IF. The political opposition nor any one of these pretenders have nothing to show that each is capable of leading the country out of the hump. In the first place, had this pandemic not entered the picture, the continued economic resurgence would have immensely improved the socio-economic lives of the people. Majority of Filipinos from all walks of life acknowledge that the incumbent Duterte administration has achieved so much more compared to the previous regimes combined in the areas of peace and order, infrastructure, trade and commerce, foreign relations, public health care, education, labor and employment, etc. I dare say that uniting the political opposition in our country remains just a childish dream - if not a myth. ORDINANCE NO. 0528-21 Series of 2021 AN ORDINANCE PROHIBITING THE SELLING OR ENTRY OF IMPORTED OR LOCAL PORK AND ITS BY-PRODUCTS FROM AFRICAN SWINE FEVER (ASF) AFFECTED AREAS WITHIN THE TERRITORIAL JURISDICTION OF DAVAO CITY PROVIDING PENALTIES THEREFOR AND FOR OTHER PURPOSES Be it ordained by the Sangguniang Panlungsod of Davao City in session assembled, that: CHAPTER ONE GENERAL PROVISION SECTION 1. TITLE – This Ordinance shall be known as “AN ORDINANCE PROHIBITING THE SELLING OR ENTRY OF IMPORTED OR LOCAL PORK AND ITS BY-PRODUCTS FROM AFRICAN SWINE FEVER (ASF) AFFECTED AREAS WITHIN THE TERRITORIAL JURISDICTION OF DAVAO CITY PROVIDING PENALTIES THEREFOR AND FOR OTHER PURPOSES”. SECTION 2. DECLARATION OF POLICY – It is the duty of the State as well as the Local Government Unit to protect and promote animal health and welfare and secure the development of animal industry in the attainment of greater safeguard and food security and safety for the City’s animal and human population, improved public health and environment and enhancement of global competitiveness. SECTION 3. COVERAGE – This Ordinance shall apply to all persons, One Person Corporations (OPCs), partnerships, ventures, corporations, cooperatives and associations engaged in raising, buying, trading, transporting domestic and imported animals and selling for personal and commercial use. SECTION 4. DEFINITION OF TERMS a. African Swine Fever (ASF) - is a highly contagious hemorrhagic viral disease of domestic and wild pigs, which is responsible for serious economic and production losses. b. ASF affected areas – defined as areas within or outside the territorial jurisdiction of the Republic of the Philippines declared by the proper Government bodies as having tested positive for ASF virus using the recommended laboratory test. c. Biosecurity – refers to measures aimed at preventing the introduction and/or spread of harmful organisms (e.g. viruses, bacteria, etc.) to animals and plants in order to minimize the risk of transmission of infectious diseases. d. Boar semen - Boar semen is a suspension of sperm cells and secretions from the boar reproductive tract, including the accessory glands. The fluid portion of this suspension is known as seminal plasma and it helps to carry and protect the sperm cells. In boars, the semen also contains large quantities of gel. e. Carcass – the carcass of an animal, including part of the carcass and the meat, bones, hide, skin, hoofs, horns, wool, offal and other parts of an animal. f. Cold storage facility - an installation intended for the cooling, freezing, and cold storage of perishable food products and other perishables.

b. Allowing entry, transportation, distribution, storing, receiving for sale and selling of locally-sourced pork, its by-products, carcasses and boar semen originating from ASF affected areas within the territorial jurisdiction of Davao City without the necessary permits and clearances from the appropriate agencies of the Government; c. Display of pork, its by-products, carcasses and boar semen through an exhibition sale in any place, open market or private yard sale or the sale of carcasses and boar semen in any of the said places originating from ASF affected areas without the necessary permits and clearances from the appropriate agencies of the Government. d. Sale of seized or confiscated pork, its by-products, carcasses and boar semen originating from areas declared as ASF-affected by the Government agencies. e. Refrigeration of unsold or excess order pork, its by-products, carcasses in cold storage facilities after the same had been withdrawn from the said facilities for sale, manufacture or display. f. It shall be unlawful for any person, firm or corporation to resist, harass, intimidate, assault, impede or interfere with any inspector during the performance of his duties as prescribed under this Ordinance. g. It shall be unlawful for any authorized persons employed by the Government or persons employed by the local government unit for the purpose of meat inspection work, to engage directly or indirectly in the business of buying, selling and trading or otherwise negotiating purchases or sales of meat and meat products for his own account or as an employee of another person, firm or corporation. h. Performing any other acts prohibited under this Ordinance. SECTION 10. PENALTIES – Any person who violates the provisions in the preceding section or any prohibitive provisions of this Ordinance shall be penalized as follows: a. First offense – Fine of ₱ 3,000; b. Second offense – Fine of ₱ 4,000; c. Third offense – Fine of ₱ 5,000, revocation or cancellation of business permit and seizure or impounding of vehicle used for transportation and operation. In addition, an imprisonment of not less than six (6) months shall be imposed. SECTION 11. CEASE AND DESIST ORDER – The City Mayor is authorized to issue after proper notice and hearing which shall be summary in nature except in instances when the continued operation causes imminent danger to public health, a ”Cease and Desist Order” to any person, firm, or corporation engaged in the business of selling, receiving or officering for sale, transporting, freezing, distributing, storing any pork and its by-products, boar semen, carcasses or parts or products, found to be in violation of any of the provisions of this Ordinance should the continued operation of said entity pose risk to public health and endanger the animal population. SECTION 12. CONFISCATION / FORFEITURE – Any pork, its by-products, boar semen and carcasses found to have been sold, transported, distributed, delivered, received or offered for sale and stored, not in accordance with any provisions of this Ordinance shall be confiscated and disposed of as provided in the Implementing Rules and Regulations at the expense of the person, firm or corporation found to be in violation thereof. SECTION 13. DISPOSAL OF CONFISCATED ITEMS – All confiscated or seized items shall be immediately disposed in accordance with RA 9003 or the “Ecological Solid Waste Management Act of 2000” and PD 856 or the “Sanitation Code of the Philippines” or other pertinent laws, regulations and issuances of the Republic of the Philippines. The confiscated items shall be disposed of in a landfill area or in any area defined by the local government unit as appropriate area for disposal or by any other means as determined by the Office of the City Veterinarian.

h. Good Animal Husbandry Practices (GAHP) – it is a set of principles of good practices and minimum requirements for the commercial/ backyard rearing/ farming of animals for food use.

SECTION 14. IMPLEMENTATION – The City Veterinarian’s Office, National Meat Inspection Services, Department of Agriculture, DA - Bureau of Animal Industry, Department of Trade and Industry , Food and Drug Administration, Bureau of Customs, the Philippine National Police and other concerned agencies are hereby directed to coordinate and strictly enforce the quarantine control protocol and food safety measures within the territorial jurisdiction of Davao City. The City Veterinarian’s Office shall be given confiscatory powers to enforce this Ordinance.

i. OIE – Office International des Epizooties or the World Organization for Animal Health. It is an international organization responsible for improving animal health worldwide.

CHAPTER FIVE MISCELLANEOUS AND FINAL PROVISIONS

j. Pork – the meat of pig that is used for food, either whole carcass, fabricated or in the form of retail or choice cuts, whether fresh, processed, cooked, refrigerated or frozen.

SECTION 15. DURATION OF EFFECTIVITY – This Ordinance shall be effective until the lifting of the ban by the Local Chief Executive or by legislative action with the recommendation of the City Veterinarian’s Office or by higher authorities, the Department of Agriculture or when the ASF disease has been completely eradicated.

k. Pork by-products – are fresh, frozen, processed or cooked products derived and/or processed from pork, whether cooked or uncooked, that includes alpha (pork fat), bacon, sausages, chorizo, tocino, hotdogs, corned pork, ham and the like. It also includes marinated or ready-to-cook pork meat, canned pork, and pork-based sauces intended for human consumption.

SECTION 16. SEPARABILITY CLAUSE – If, for any reason, a provision of this Ordinance is declared invalid or unconstitutional, all other provisions hereof not affected shall continue to be in full force and effect.

g. Exhibition sale – a public display of goods for sale, exchange, barter or trade, whether for profit or not.

l. Sale or distribution - any form of sale, conveyance or transfer of ownership of meat or its by-products. It may include sale or generous transfer of pork and/or its by-products from the owner, broker, store owner, stall owner, mall, or its agents or representatives to the recipient or third party. This also includes selling by means of internet or through online-selling. m. Swill feeding - is the traditional name for the feeding of food scraps to pigs. n. Unsold or excess order – the difference between the quantity of pork and its by-products withdrawn from the cold storage facility over the quantity displayed, sold, used for processing and manufactured outside the cold storage facility by the owner, vendor, seller, manufacturer or supplier. CHAPTER TWO INSPECTION OF IMPORTED MEAT AND/OR MEAT AND BY-PRODUCTS COMING FROM OUTSIDE DAVAO CITY SECTION 5. EXAMINATION AND LABORATORY ANALYSIS – The City Veterinarian’s Office (CVO) shall conduct examination and, when necessary, laboratory analysis of imported and local pork and its by-products brought from outside Davao City after the products are approved for release by the National Veterinary Quarantine Service at the ports or place of entry. SECTION 6. CONFISCATION OF MEAT AND MEAT PRODUCTS – The inspectors shall seize, recall, confiscate, condemn or dispose by destruction or re-export at the expense of the importer, any imported carcass, pork and its by-products that has been prepared, sold, transported or otherwise distributed or offered or received for distribution in commerce, and found to be in violation of the prohibited acts under this Ordinance during inspection and laboratory analysis.

SECTION 17. REPEALING CLAUSE – All Ordinances, resolutions, memoranda, orders and similar issuances, or part or parts thereof, which are inconsistent with any of the provisions of this Ordinance are hereby repealed, modified, or amended accordingly. SECTION 18. EFFECTIVITY – This Ordinance shall take effect immediately after posting and publication in a newspaper of general circulation in the City of Davao. DBP, DA partner to boost cash aid disbursement

he state-owned Development Bank of the Philippines (DBP) has signed a memorandum of agreement (MOA) with the Department of Agriculture (DA) to facilitate the disbursement of financial assistance to the agriculture sector. DBP president and chief executive officer Emmanuel Herbosa said under the agreement, the bank would provide the disbursement channels to implement the DA’s initiatives on direct cash or loan interest rate subsidy and other forms of assistance to qualified agro-fishery enterprises, agriculture cooperatives, farmers, fisherfolk, and other agricultural workers. “(The) DBP and DA will continue to work on an expanded alliance to promote the growth potential of agribusinesses towards gainful economic growth for local communities,” Herbosa said in a statement Friday. Under the MOA, beneficiaries of various DA programs may receive their funding assistance via direct credit to their DBP accounts and/or other banks’ accounts/electronic money issuers (EMI) and other Bangko Sentral ng

Pilipinas-supervised financial institutions through electronic fund transfer channels, such as PhilPASS, and DBP-accredited payout outlets. Herbosa said the DBP would also work closely with the Rural Bankers Association of the Philippines and various EMIs for the efficient implementation of this project. The DA, he said, would also be introducing an “interventions monitoring card” that would serve as an identification card to access government assistance for farmers enrolled in the farmer’s registry, starting with the second round of the rice farmers’ financial assistance worth PHP5,000 each, which would be disbursed in the last quarter of the year. “(The) DBP shares the mission of the DA in promoting the socio-economic well-being of all Filipinos, especially those in the agricultural sector,” Herbosa said. “We are committed to provide faster, more reliable and more secure disbursement channels to facilitate the delivery of much-needed financial interventions from the national government.” (PR)

he Bureau of Internal Revenue (BIR) has filed 84 complaints before the Department of Justice (DOJ) against suspected tax evaders involving PHP3.15 billion in estimated tax liabilities in the first half of 2021.

According to a report to Finance Secretary Carlos Dominguez III, the BIR is also pursuing 17 cases before the Court of Tax Appeals (CTA) as of end-June to collect an estimated PHP1.54 billion in total tax liabilities under its Run After Tax Evaders (RATE) program. BIR Deputy Commis-

sioner Arnel Guballa said in his report during a recent Department of Finance (DOF) executive committee (Execom) meeting that as part of the Bureau’s Oplan Kandado, it has padlocked 274 commercial establishments in the first half of 2021 for various tax code violations, which resulted to

Guballa said that last July 1, as earlier reported in the media, the BIR seized thousands of Relx and Snowplus++ heated tobacco and vape products being sold in several establishments, branches and kiosks around Manila, particularly in several major shopping malls after it found out that these items were untaxed. He said the BIR confiscated from a warehouse inside the Technology Resource Center (TRC) compound in Pampanga a total of 27,132

Another warehouse at the Global Aseana Business Park in San Simon, Pampanga yielded 2.06 million pieces of fake internal revenue stamps, two cigarette-making and packing machines, and raw materials and chemicals. “The estimated total excise tax leakage from both warehouses is PHP1.56 billion,” Guballa said. nflation may remain elevated in the short term before settling within the government target of 2 to 4 percent, Bangko Sentral ng Pilipinas Governor Benjamin Diokno said Friday.

Inflation in 2021 could average 4.1 percent, higher than the previous forecast of 4 percent, the BSP said. Higher global crude oil and non-oil commodity prices contributed to the higher inflation forecast, Diokno told reporters in a virtual briefing. Dubai crude oil prices could remain elevated due

to the recovery in global economic activity as well as a possible uptick in global commodity prices due to the strong demand and supply chain bottlenecks, he said. But the upward risks are transitory, Diokno said. “Oil prices could remain elevated in the coming months, but could be

lower in 2022,” he said. Next year, inflation could settle at 3.1 percent on average, according to the BSP estimate. However, recent data showed that wet markets around Metro Manila have seen spikes in prices of highland vegetables such as carrots and Baguio pechay. The BSP said it would be ready to take action if needed and that it “supports direct supply-side measures to address the main source of supply constraints and bottlenecks.”

Diokno earlier said non-monetary measures helped ease supply-side woes such as the tariff reduction in pork meat imports as the African Swine Fever (ASF) caused a shortage in supply earlier this year. The BSP earlier said it would keep its policy stance “accommodative” to support economic recovery. Is the Sports Incentives Law fair to Para athletes?

came across a very scholarly article written by sports lawyer Mickey Ingles and published on SPIN.PH.

Not only is it timely. It is very relevant. Coming at the heels of the smashing performances of our athletes in the Tokyo Olympiad, we couldn’t help but feel thunderstruck at the fate that has befallen gold medalist Hidilyn Diaz who stands to receive a whopping P50 million incentives in cash and in kind from the government and private sector, as well as silver medalists Nesthy Petecio and Carlo Paalam and bronze medalist Eumir Marcial. To say it’s mind-blowing is an understatement. I would raise my son to be an Olympian if this is the fate that awaits our future generation of athletes. Then we thought, there’s another bunch of athletes. Not as muscle-bound, cocky or physically-equipped at the Fab Four of Tokyo. Some of them have no leg, no arm, blind, deaf, or have underdeveloped extremities like our very own Ernie Gawilan. Ernie and his fellow Paralympic athletes are next up in Tokyo. Like Diaz and Co., they also have a chance to win medals and reap incentives. The only difference is that, their medals may not be worth as much as Diaz and Co. Why? Because that’s what the law says.

Atty. Ingles, a leading sports lawyer working in the law firm of Ingles Laurel Calderon and the author of the country’s first and only book on sports law, “Laws for Sports and the Sporty”, explained it profoundly. And so let’s take a closer look at the operative law that provides for incentives to athletes winning medals in the Olympics and other competitions -- Republic Act 10699 or the National Athletes and Coaches Benefits and Incentives Act. The law has been put on the spotlight because of the windfall it promised Olympic medalists Hidilyn Diaz, Nesthy Petecio, Carlo Paalam, and Eumir Marcial. What makes it interesting is that RA 10699 also grants cash incentives to our athletes who will come home with medals in the upcoming Paralympics. Under RA 10699, the cash incentives for Olympians and Paralympians are as follows: Gold Olympics (Summer/Winter): P10 million Paralympics: P5 million Silver Olympics (Summer/Winter): P5 million Paralympics: P2.5 million Bronze Olympics (Summer/Winter): P2 million

Paralympics: P1 million Now, did you see the disparity? Did you notice something unequal here. Like we always say “nasaan ang hustisya (where’s the justice)?” Sadly, our Paralympians are entitled to only half of what their Olympian counterparts get. So, if the Dabawenyo Gawilan wins gold in the 2020 Paralympics, he is only entitled to P5,000,000 — half of what Hidilyn Diaz was entitled to when she brought home our first gold in Tokyo 2020. A bit unfair, isn’t it? Is this classification legal? Ingles explains the doctrine on “equal protection under law.” “Section 1 of the 1987’s Constitution’s Bill of Rights states that no person shall “be denied the equal protection of laws.” More popularly known as the equal protection clause, it guarantees that the law should treat each person the same manner as the next. In a nutshell, the law should treat everyone equally. This, however, does not mean that the law can’t make classifications and distinctions between people. The equal protection clause allows reasonable classifications as long as these classifications comply with the following requisites, which we’ll list down below in legal terms: 1. The classification must rest on substantial distinction; 2. It must be germane to the purpose of the law;

3. It must not be limited to existing conditions only; and 4. It must apply equally to all members of the same class. So, how does RA 10699’s treatment of our Paralympians stack up to the equal protection clause? Well, it hits a snag when it comes to the first and second requisites. Let’s talk about prequisite number one first. Is there a substantial distinction between Olympians and Paralympians? At the outset, the distinction is clear: disability. It’s important to know the basis of the distinction because it’ll determine what test we should use. If the distinction is based on a suspect class (like race, national origin, or religion) or impinges on a fundamental right (like free speech), then we use what lawyers call the strict scrutiny test. If it doesn’t, then we use the more permissive rational basis test. Here, we’ll have to use the rational basis test, as disability is neither a suspect classification, nor is receiving less cash incentives an infringement of a fundamental right. Under the rational basis test, as long as the classification is rationally related to achieving some legitimate state interest, then it’s valid. How does RA 10699 advance state interest? Well, it

does so by promoting excellence in sports, since it looks after the welfare of coaches and athletes, and provides incentives and benefits to athletes who succeed in international competitions. Which now leads us to prequisite number two. Is the distinction based on disability germane to the purpose of the law to promote sports excellence? To put it in simpler terms: Is giving less cash incentives to Paralympians rationally related to improving sports in the country? It doesn’t seem that way. Paralympians endure the same rigorous training, participate in the same level of competition, and bring the same honor to the country the same manner that Olympians do.” I would like to say, to be honest, I feel bad for Gawilan and Co. As explained by Ingles, distinguishing between Olympians and Paralympians for the purpose of cash incentives doesn’t further the government interest. It’s doing the reverse. It only galvanizes the discrimination against athletes with disabilities. It’s like saying, “Sorry, you are a lesser athlete, so you get less.” But a gold is a gold. A medal is a medal no matter who won it. It’s time our lawmakers pay this law a visit.
