he city government of Davao can now start vaccinating 12 to 17 years old. Mayor Sara Duterte-Carpio announced through her Facebook Page that the city government has been given recently a notice by the national government that the city can start giving vaccination for 12 to 17 years old on October 15, 2021.

“We are just waiting for the guidelines of Department of Health (DOH). If they say there

is a need for pre-registration, we will do it,” the mayor posted. It can be recalled

that the city government waited for the final guidelines on the children’s anti-Covid vaccination from the DOH. “Gahulat ta sa DOH, kung ang DOH moingon nga i—preregister ang vaccinees then we will do that,” said Dr. Michelle Schlosser, spokesperson of Davao City Covid-19 Task Force. Schlosser also noted

ormer rebels who are indigenous people (IP) youths from communities in the area of responsibility (AOR) of 60th Infantry Battalion, recently shared their experiences and struggles in the hands of the communist terrorist group (CTG), New People’s Army (NPA). They also exposed the deceptive tactics of the NPAs in recruiting IPs. In the press conference on October 07 at 60th IB headquarters, dubbed as “Deceit, Abuse, and Death: The Naked Truth of the CPP-NPA’s Five Decade Propaganda”, former youth rebels rescued by the government tell their story on how they were deceived by the NPAs. In his briefing, 60th Infantry Battalion (IB) commander, Lt Col Ronaldo Sarmiento, narrated the painful experiences of the rescued IP youths

he Davao City government has resumed the free Reverse transcription PCR (RT-PCR) swab test for the second-generation (F2) and third-generation (F3) contacts of a Covid-19 positive. The RT-PCR test for the F2 and F3 close contacts of the Covid-19 was suspended in August after the Southern Philippines Medical Center (SPMC) machine extraction machine to run swab specimens bogged down and limited testing kits. Davao City Covid-19 Task Force Spokesperson Dr. Michelle Schlosser during the Bida Bakunado program over the Davao City Disaster Radio on Friday said that the Magsaysay Swabtesting Center has started second generation (F2) and third-generation (F3) close contacts for RT-PCR swabbing on October 5, 2021. “Gibalik ang swabbing sa Magsaysay for F2 and F3, this week Tuesday. So ang maximum capac-

ity daily sa Magsaysay is 150-250 per day (We have resumed the swabbing in Magsaysay for F2 and F3, starting this Tuesday this week. Schlosser, however, pointed out that even there was a temporary suspension of swab testing for the second, third generation contacts, the contact tracing for the said individuals did not stop. “We continued to inform them to conduct self-monitoring for COVID-19 symptoms,” Schlosser said, adding that those who exhibit symptoms or Influenza-Like-Illnesses are immediately recommended for swabbing.’ CIO

he city government of Davao assured that there is no wastage of anti-Covid vaccines in Davao City with contingency plans laid out to prevent such incidents. Davao City Covid-19 spokesperson Dr. Michelle Schlosser said that the city has not recorded spoiled vaccines since the start of its inoculation drive in March this year. “As much as possible, we do not allow it. EDITORIAL Squeeze game There’s a popular Netflix series movie entitled “Squid Game” which features competitors in green and workers in pinkish red. For whatever coincidence its has in current political affairs in the country, is just like that, a coincidence. What appears to be non-coincidence is how the political game in the country has transformed into a drama-filled game. But yes, this latest twists and turns in our political landscape as we approach the 2022 elections is as baffling as it can get. To some though, the ‘squeeze’ games are reminiscent of the 2016 version of the electoral exercise with the drama and plot almost depicting each other. We say almost because the anticipated climax has yet to happen most likely on or before the final day of substitution of candidates. The buildup of anticipation for Mayor Sara Duterte-Carpio fizzled out on Friday afternoon with the presidential daughter not filing her Certificate of Candidacy for President. Instead, the biggest surprise was Dabawenyo Senator Ronald “Bato” dela Rosa turning up for his CoC representing the ruling Partido Demokratiko Pilipino-Lakas ng Bayan (PDP-Laban). Senator Dela Rosa’s filing, although a surprise, wasn’t taken seriously though. Many have anticipated he is merely a decoy in the mold of a Martin Dino in 2016.

The Commission on Elections (Comelec) accepted the certificate of candidacy (COC) for president of then-Davao City Mayor Rodrigo Duterte amid issues on the legality of his substitution move. Back then, the poll body ruled to accept Duterte’s COC in a 6-1 vote entirely without prejudice to the disqualification case filed by broadcaster Ruben Castor against Duterte, or any other case against him. The Comelec accepted Duterte’s COC from an administrative point of view and as a ministerial process. The rest was history.

Whilst Senator Dela Rosa dismissed talks he is merely a decoy, he disclosed that the decision was made a while back but was kept under wraps. Still, PDP-Laban’s squeeze game points to Mayor Sara taking over by substitution.

Since your problem is about Facebook posts that may be considered libelous, then you have to go to Court. The law applicable to your predicament is the crime of cyber libel, as defined under Section 4(c) (4) of the Cybercrime Prevention Act of 2012; Libel. — The unlawful or prohibited acts of libel as defined in Article 355 of the Revised Penal Code, as amended, committed through a computer system or any other similar means which may be devised in the future. In reference to Article 355 of the Revised Penal Code, as amended, a libel committed by means of writing, printing, lithography, engraving, radio, phonograph, painting, theatrical exhibition, cinematographic exhibition, or any similar means are punishable acts. Primarily, Article 353 of the Revised Penal Code. A libel is a public and malicious imputation of

a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause the dishonor, discredit, or contempt of a natural or juridical person, or to blacken the memory of one who is dead. There are five elements to be considered in your case. a.) defamatory statement, b) presence of malice, c.) publication, d.) identifiability e.) use of computer system. It appears that the post at Facebook describing you as a ““whore, pukpuk, puta”‘ are defamatory words as it ascribes to you the commission of a crime of prostitution under Article 202 of the Revised Penal Code. Your boyfriend who is a teacher and is described as “tanga, bobo” are strong words that tend to dishonor or discredit him. These are defamatory statements that can naturally be understood by persons reading them to publicly ridicule you and your boyfriend. As to the presence of Malice, because you and your boyfriend are private individuals, the prosecution need not prove the presence of malice. The law explicitly presumes its existence.

However, as to your mother who is a public official and imputed with these words “pera daw ng bayan ng kinamkam at ninakaw ng Nanay ko sa pamahalaan”, even if these are defamatory words, the presence of malice is not presumed but must be proven. There is a stricter standard of “malice” to convict the author of defamatory Facebook posts if they refer to public officials. The Supreme Court stressed that for society’s interest and the maintenance of good government, a full discussion of public affairs is demanded. The third requisite of publication is present in your case because the Facebook posts are communicated to a third person. As you have stated, your relatives have read the libelous statement, which means your reputation is injured. As to the fourth element of identifiability, it must be shown that the readers of the posts were able to identify you as the object of the defamatory statement. Meaning, the description or the facts and circumstances in the Facebook posts allude or point to you as the object of ridicule. It should not be

a general statement like, “bato-bato sa langit ang tamaan ay huwag magalit.” Since in your case, you stated that you, your boyfriend and your mother were identified by the relatives, it is presumed that your names were mentioned. Finally, your case is referred to as online libel, as it is committed through a computer system. Again, it should be mentioned again that in libel, the affairs of private individuals and public officials are treated differently. In the case of RAFFY T. TULFO, VS. PEOPLE, GR. No. 187113, January 11, 2021, the Supreme Court stated that “consistent with the right to deliver information on public matters, journalists and members of the press may at times write inaccurate articles. Nonetheless, liability should attach only if it is proven that the article was written and published with knowledge that it was false or with reckless disregard for the truth.” Therefore, your course of action is different from that of your mother. Lastly, this bears reminder that one must be careful not only of his words but also of his posts.

HENRYLITO D. TACIO WHY CLIMATE CHANGE MATTERS When coronavirus disease 2019 (COVID-19) was reported all over the world, there were some reports that due to lockdowns, the world was recuperating from climate change as people were no longer traveling. But a new report, United in Science 2021, said the temporary reduction in carbon emissions caused by global lockdowns “did not slow the relentless advance of climate change.” As the report said, “Greenhouse gas concentrations are at record levels, and the planet is on path towards dangerous overheating.” After a temporary blip in 2020 due to COVID-19, carbon emissions “are rapidly accelerating” and “nowhere close to the targets set by the Paris Agreement,” the report observed. The Paris Agreement is a legally binding international treaty on climate change. It was adopted by 196 parties (including the Philippine government) at COP21 in Paris on December 12, 2015 and entered into force on November 4, 2016. “We have reached a tipping point on the need for climate action. The disruption to our climate and our planet is already worse than we thought, and it is moving faster than predicted,” said United Nations Secretary General António

Guterres in a statement. We are now just a month away from the most important global meeting of the year: The United Nations Climate Conference (COP26), which is scheduled to be held in the city of Glasgow, Scotland between October 31and November 12. There is a big choice to be made there, according to the UN Secretary-General. So, why should climate change be a concern to us, Filipinos? The Philippines, home to about 110 million people, is one of the most vulnerable countries to climate change, according to Dr. Rodel D. Lasco, a member of the International Panel on Climate Change (IPCC), the 2007 co-winner of the Nobel Peace Prize. For one, the country “has a long coastline where millions of people live including in urban centers such as Metro Manila, Cebu, and Davao.” In 2007, the IPCC estimated that sea levels might rise by between 18 centimeters and 59 centimeters in the coming century. The Philippines ranks fourth in the Global Climate Risk Index. Fifteen of the 16 regions of the Philippines are vulnerable to sea level rise. In a conference on strengthening river basin organizations in Davao City in 2015, Lorenzo Tan, executive director of Worldwide

Fund for Nature (WWF), declared: “If you see rising sea levels, Mindanao is at ground zero. Davao City is a case in point. It was among the 12 key cities in the country that was included in the Business Risk Assessment and the Management of Climate Change Impacts study done by WWF along with the Bank of the Philippine Islands (BPI) Foundation Inc. “The study was conducted to help city planners assess the impacts of climate change in their communities, identify opportunities and decide on a sustainability strategy, site-specific interventions that will allow the city to retain its economic viability,” Tan told Business World. Tan noted that Davao runs a close second to Cebu in terms of tonnage shopped through its ports. “Located along the relatively shallow channel between the city and Samal Island, these port facilities are a nerve center for Davao City’s economy, and serve a variety of ships handling both cargo and passengers,” the risk assessment said. But sea level rise may create some havoc in the near future. “Davao should take a close look at the city’s shipping fleet and port facilities and take the necessary steps to ensure that they are upgraded to deal with the impacts of

climate change,” Tan suggested. Sea level rise would also endanger the drinking water quality and agricultural productivity, according to the country’s weather bureau. This is due to possible salt intrusion in coastal soils and fresh water aquifers. Not only people are at risk of being displaced by sea level rise, but “important ecosystems such as mangrove forests could also be lost,” warned Dr. Lasco, who is the country’s coordinator for the World Agroforestry Center. Mangroves and coral reefs are at risk, too. Mangroves serve as sanctuaries and feeding grounds for fish. They also aid in natural land reclamation. More importantly, they act as buffer or coastal zone stabilizers by reducing typhoons and storm wind damage. The Philippines has about 27,000 square kilometers of coral reefs. Two-thirds of these are in Palawan and the Sulu Archipelago. An estimated 10-15 per cent of the total fisheries come from coral reefs. The Philippines is buffeted by typhoons every year, which kill scores of people and damage billions of pesos worth of properties. In recent years, stronger typhoons have become more frequent. “Climate change is expected to exacerbate this extreme event,” warned

Dr. Lasco. Rising temperatures will also spur changes in rainfall patterns. “Weather patterns (in the Philippines) may change with projections of higher rainfall and drier summers,” Dr. Lasco said. “These could adversely affect millions of hectares of farm lands. In the rainy season, there will be more frequent floods and in the dry season, there will be less water available for irrigation. Overall, it threatens the food security of our country.” The greenhouse effect is a natural warming process. During the Climate Change Media Workshop some years back in Davao City, Dr. Rosa Perez said that carbon dioxide and certain other gases are always present in the atmosphere. These gases create a warming effect that has some similarity to the warming inside a greenhouse, hence the name “greenhouse effect.” “Although the Earth’s climate has changed many times throughout its history, the rapid warming seen today cannot be explained by natural processes alone,” pointed out Dr. Perez who has a PhD in Meteorology from the University of the Philippines. Man’s tampering with the environment has made the temperature change faster, scientists believe

xempting small-scale miners from paying income and excise taxes resulted in around 1,000 percent jump in Bangko Sentral ng Pilipinas’ (BSP) gold purchases in 2020 and more refinements are still in the pipeline to support this. In a virtual briefing on Friday, BSP Mint and Refinery Operations Department Director Joseph Norbert S. David said Republic Act (RA) 11256, or the amendment in the National Internal Revenue Code, which was signed into law on March 29, 2019 “has a positive impact on our purchases”. “The BSP was able to buy a total volume of 115,800 troy ounces as compared to the 10,207 troy ounces in 2019. It is also worthy to mention that the current volume of the purchases this year has already exceeded that of last year’s purchases,” he said. He, however, declined to give the figures for their gold purchases so far this year, citing that there are

certain protocols before this can be disclosed to the public. In general, he said most of their gold purchases came from Baguio followed by those from Davao, both of which was due to the high resources in these areas. To further entice more small-scale miners to sell their gold to the central bank, David said they have submitted to the BSP’s policy-making Monetary Board (MB) proposed policy changes, some of which are seen to be implemented either this or next year. These programs include making rates attractive to small-scale miners, minimizing the processing cost, and fast-tracking the turnaround time for the assay of gold and the disbursement of final payment. David said the initial assay takes only a few minutes but the fire assay, or the more intricate assessment to determine the pureness of the gold, takes around 13 days.

axing people based on their consumption is better than taxing them based on their income, Bangko Sentral ng Pilipinas (BSP) Governor Benjamin Diokno said. In a Laging Handa briefing on Friday, Diokno reiterated his earlier stand on the issue, saying “it’s better to tax people on the basis of what they take away from society, consumption iyon (that’s consumption), rather than what you contribute to society which is your income.” “So maganda talaga ‘yung value-added tax,” he said, referring to the measures to tax digital transactions and the rich. Last month, the House of Representatives approved on final reading House Bill 7425, which slaps a 12 percent VAT on digital transactions to help boost government revenues. Diokno said lawmakers are now pushing for this measure but pointed out that it is better to exclude from this bid small value transactions to encourage

people to further use digital modes for their financial transactions. “In general, I think VAT is a good tax, pero iyong mga small transactions, let say, less than PHP500 ay i-exempt natin sa Value Added Tax (In general, I think VAT is a good tax but exclude the small transactions, say those less than PHP500),” he said. The BSP has been promoting the use of digital transactions, which got a boost during the pandemic due to movement restrictions imposed by the government. It targets to further increase the share of digital transactions to half of the total by 2023 from about 20 percent in 2020. This goal is backed by several programs such as the increase of payment operators that offer electronic financial services and the lowering of transaction fees. BSP has instituted two electronic payments facilities namely PESONet and InstaPay under its National Retail Payments System (NRPS).

Assistance to Restart Enterprises), which makes PhP8.08 billion available for micro, small, and medium enterprises (MSMEs), cooperatives, hospitals, tourism businesses, and repatriated or displaced Overseas Filipino Workers (OFWs) affected by COVID-19 pandemic. Under the program, qualified loan applicants can apply for loans ranging from PhP10.0 thousand up to PhP5.0 million, depend-

ing on their pre-pandemic sales and business assets figures, if applicable. These loans are payable up to a maximum of four (4) years, inclusive of a maximum grace period of 12 months for Non-Tourism MSMEs, or a maximum grace period of 24 months for Tourism MSMEs accredited by the Department of Tourism (DOT) or registered as Barangay Micro Business Enterprise (BMBEs). Successful loan applicants will only need to pay a one-time service fee, set at a maximum of eight (8) percent for a four-year loan term. Lower service fees apply to shorter loan terms. SBCorp also enhanced

its requirements to enable more MSMEs to benefit from the highly concessional loan terms under the program. For instance, MSMEs that have been operational for at least one (1) year as of their date of application may now qualify for the loan. SBCorp’s previous requirement was for MSMEs to be operational for at least one (1) year before 16 March 2020 when the community quarantine was imposed in the country. This is in recognition of the fact while most MSMEs chose to adapt to the new operating environment, some have chosen to pivot to or establish entirely new businesses.

“The BSP upheld the cease-and-desist order issued against Digital Spring on 23 July 2021, reiterating that Lyka/TIL and not Digital Spring should register as OPS with the BSP,” it added. The CDO for both Lyka and Digital Spring “shall remain effective until Lyka/ TIL properly registers as an OPS in accordance with law and regulations,” the central bank said. Lyka allows users to use gift cards in electronic modes or GEMs as payment

EW YORK — The Brooklyn Nets listed Kyrie Irving as ineligible to play in their home exhibition game Friday (Saturday, Manila time), another strong indication he has not met New York’s vaccination requirement.

Kyrie Irving still unvaccinated? Irving has not been with the Nets for any of

their practices in New York, where professional athletes are required to be vaccinated against

COVID-19 to practice or play. The Nets are prevented by law from revealing whether he has been vaccinated, but listed him as “ineligible to play” in the injury report for their preseason game Friday against Milwaukee. Unless Irving is vaccinated, he would have to

miss the Nets’ 41 home games and their two road games against the New York Knicks. The NBA has said he wouldn’t be paid for any of those games. He practiced with the Nets last week when they held training camp in San Diego, but hasn’t been with the team since it returned home.

Gumabao, who won three UAAP volleyball titles with the De La Salle University, was named the second nominee of the Mocha Uson-led Mothers For Change (MOCHA) party-list for the upcoming 2022 elections. Gumabao accompanied Uson in filing their certificates of nomination and acceptance on Friday. Uson’s hand was even raised by President Rodrigo Duterte after filing her bid at the Sofitel Philippine Plaza. She is the first nominee of the MOCHA party-list. The Creamline Cool Smasher hitter was recently tapped as ambassadress of National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) which made headlines numerous

times for allegedly red-tagging personalities. Gumabao first rose to fame when she suited up for the Lady Archers, winning three UAAP titles. She then continued her playing career in several club teams such as the AirAsia Flying Spikers and Pocari Sweat Lady Warriors before joining the Cool Smashers. Gumabao also tried her luck in beauty pageants, joining Binibining Pilipinas in 2018 where she won the Binibining Pilipinas Globe title. She represented the country in the Miss Globe pageant and finished as part of the top 15. The athlete then joined the inaugural Miss Universe Philippines pageant in 2020 where she placed second runner-up. Rabiya Mateo of Iloilo took home the crown. Gumabao also appeared on “Pinoy Big Brother: All-In” in 2014.

PH club Rebisco drops opener in Asian Volleyball Championships

hilippine club Rebisco suffered a straight-sets defeat against the Iranian Super League champion Sirjan Foulad, 25-15, 25-22, 255, to open its campaign at the 2021 Asian Men’s Club Volleyball Championships in Thailand Friday. After losing the opening set, Philippines showed more grit in the second frame, thanks to back-to-back hits by Jao Umandal and Mark Alfafara to put Rebisco within two points, 20-22. Rebisco moved a point closer in the set after Umandal’s two consecutive attacks made it 22-23, but the Filipinos committed errors down

the stretch to give the set to Iran. The Philippines, however, totally collapsed in the third set, falling 9-0 early on as the Iranians displayed strong net defense that denied Rebisco’s attacks almost instantly. Nico Almendras put the team on the scoreboard with a crosscourt hit. However, the team did not find the spark for a possible run, dropping to a 2-16 deficit. Iran scored back-toback aces for an overwhelming 24-4 advantage. The Philippines will face the AGMK of Uzbekistan on Saturday.
