ayor Sara Duterte-Carpio urged Dabawenyos to remember the victims and survivors of typhoon Odette this Christmas. In a video message, Mayor Sara expressed hopes that amid the grief, typhoon victims will gain strength in those who pray for them. “Let us not forget the victims and survivors of typhoon Odette who need our help and prayers as they face loss and despair. Together we can be their source of strength, joy, and hope,” the mayor said. The mayor is focused on helping the victims of typhoon Odette. She post-

poned her State of the City Address (SOCA), which was scheduled on December 20, 2021 to January next year to join the BBM-Sara UniTeam in the distribution of assistance to the typhoon victims. Meanwhile, the mayor wished Dabawenyos abundance, health, peace of mind, and love this Christmas. “The year has been very difficult but it should not dampen our spirit as the people call to share and

spread the love of Jesus with others. As we spend Christmas with our families, let it become a special moment to remember the hungry, in need, victims of abuses, children on the streets, the homeless and those who are away from their homes and family, our soldiers, OFWs, and our front liners,” Mayor Sara said. For the country, she wished Christmas will be a celebration of peace, healing, and unity. “Maligayang Pasko at nawa’y ang 2022 ay mas maging matatag, masaya, mapayapa at magdulot ng tunay na ginhawa sa ating

lahat. Mahalin natin ang Pilipinas!” she said. On the other hand, the city government of Davao reminded Dabawenyos to celebrate a happy and safe Christmas by following the minimum public health standards such as the proper wearing of facemasks, always using alcohol or sanitizer every time they go out of the house, staying away from other people, avoid crowded places or crowded places, and avoid taking children to malls or markets. The city also advised Dabawenyos to protect themselves and their loved ones by getting vaccinated.

added. Odette is the 15th tropical cyclone to hit the country this year. Around 20 form within or enter the Philippine Area of Responsibility each year, according to the weather bureau PAGASA. The typhoon brought strong winds and massive floods in the Visayas and Mindanao regions on December 16 that caused

thousands of people to flee their homes to seek shelter in evacuation centers. Authorities are still in the process of collating the total number of affected families and casualties and assessing the extent of damage to properties and infrastructure. Communications and power lines are mostly down in areas greatly affected by the devastation.

he Davao City Water District’s (DCWD’s) pipelines for the bulk water project’s expansion of services are underway with some to be completed in 2022 according to official. This is in line with the bulk water supply project wherein DCWD is working closely with its project partner, Aboitiz-controled Apo Agua Infrastructura, Inc., (AAII). DCWD is carrying out expansion work, with another 65 kilometers of pipelines being laid out to serve

more customers. “All the facilities needed to start accepting and distributing the bulk water are already in place,” Jovana Cresta T. Duhaylungsod, spokesperson of DCWD told Edge Davao. In July this year, Duhaylungsod announced that DCWD has completed the

rehabilitation and expansion of its distribution network in preparation for the bulk supply project that is expected to be online before yearend. She also said they have finished construction for storage facilities and ground reservoir as well as 108 kilometers of newly-laid pipelines. AAII, a joint venture between Aboitiz Equity Ventures, Inc. and JV Angeles Construction Corp., will provide the water district 300 million liters of water per day sourced from the

Tamugan River. Meanwhile, AAII operations head Shake A. Tuason in a text message said AAII will be providing a substantial report on the progress of the project early next year for updates on the testing and commissioning works as well as pipe-laying progress. It can be recalled that AAII is aiming to start operating the bulk supply facility by the end of the year, however, the original launch date of mid-2021 was delayed by coronavirus-related restrictions.

Escudero noted the presence of these marginalized segments of society continue to increase during the Christmas season, especially in Metro Manila, asking for help from motorists and the commuting public, which make them more vulnerable and at risk

of getting infected with the deadly virus. While the National Capital Region has already achieved herd immunity as more than 100 percent of Metro Manila’s target eligible population are now fully vaccinated against COVID-19 per the Metropolitan Manila Development Authority, Escudero said streets dwellers, mostly concentrated in the metropolis, should not be left out of the inoculation program. “Gusto kong malaman kung ang ating mga kababayan na nabubuhay sa

EDITORIAL Quick action laudable The Davao City Police Office (DCPO), indeed Davao City’s finest, ought to be lauded by grateful Dabawenyos for quickly identifying, arresting and filing an appropriate case in court against a suspect in the two bomb threats in Davao City very recently. DCPO chief Col. Kirby John Kraft told Edge Davao that the suspect, currently detained, has admitted to be the mastermind behind two letters containing bomb threats. The first letter was left in a vehicle in City Hall in September this year, while the second letter was placed December 20, 2021. “Yong naglagay ng sulat sa isa sa mga sasakyan sa City Hall, nakunan ng CCTV on December 20, 2021 at 1 p.m. Base sa footage nakita natin yong tao mismo na naglagay ng sulat. Kraft said his men are conducting a deeper probe and that they cannot as yet disclose to the public full details of the case or give the name of the suspect whose background is being thoroughly checked. For one thing, the suspect has still refused to reveal why he, a Davao City resident, did what he did.

It was also learned that the DCPO probers are also holding a 15-year-old who was asked by the suspect to write the threat letters. The minor also identified the letters as his when shown to him. The suspect, who has reportedly a Christian-sounding name, has allegedly admittedly that he directed the minor to write the letters. The investigators should take pains in uncovering the reason or reasons of the suspect in putting the bomb threat letters.

ATTY. DIMPNA D. BERMEJO-DULAY IBP DAVAO CORNERCORNER IBP DAVAO

THERE IS NOTHING EITHER GOOD OR BAD BUT THINKING MAKES IT SO (WILLIAM SHAKESPEARE) Dear IBP,

There is nothing either good or bad about “bakla”, only my thinking makes it so. Junjun

Dear Junjun,

Since your problem is about Facebook posts and Office Working Conditions, the following laws must be taken into consideration. First, as to Facebook posts, the law applicable to your predicament is the crime of cyber libel, as defined under Section 4(c)(4) of the Cybercrime Prevention Act of 2012; Libel. — The unlawful or prohibited acts of libel as defined in Article 355 of the Revised Penal Code, as amended, committed through a computer system or any other similar means which may be devised in the future. In reference to Article 355 of the Revised Penal Code, as amended, a libel committed by means of writing, printing, lithography, engraving, radio, phonograph, painting, theatrical exhibition, cinematographic exhibition, or any similar means are punishable acts. Primarily, Article 353 of the Revised Penal Code. A libel is a public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause the dishonor, discredit, or contempt of a natural or juridical person, or to blacken the memory of one who is

dead. Since your issue was whether or not calling you “Bakla” in Facebook Posts would fall as a libelous statement, it would be worthy to mention the recent 2020 case of Laguerre v. Maurice, 2020 WL. 7636435, 2020 N.Y. App . This a case in New York, where it was held that “Holding False Imputation of Homosexuality is not Defamatory Per se.” The decision also stated that “Thus, there is today no necessary presumption that falsely calling somebody homosexual will harm their reputation, and such a statement no longer falls within the sphere of cases in which reputational harm can be assumed on ground of criminality, professional disqualification or the imputation of a “loathsome illness.” A false statement that does demonstrably cause economic harm to the plaintiff could still be the basis of a defamation claim, but such harm would have to be alleged and factually supported in the complaint.” There is a similar case in the Philippines. In the case of DIONISIO LOPEZ y ABERASTURI vs. PEOPLE OF THE PHILIPPINES and SALVADOR G. ESCALANTE, JR., the Supreme Court stated that “the

controversial phrase ‘CADIZ FOREVER, BADING AND SAGAY NEVER’ imputes derogatory remarks on private respondent’s character, reputation and integrity. In this light, any discussion on the issue of malice is rendered moot.” Also, it was mentioned, “an allegation is considered defamatory if it ascribes to a person the commission of a crime, the possession of a vice or defect, real or imaginary or any act, omission, condition, status or circumstance which tends to dishonor or discredit or put him in contempt or which tends to blacken the memory of one who is dead”, and “Tested under these established standards, we cannot subscribe to the appellate court’s finding that the phrase “CADIZ FOREVER, BADING AND SAGAY NEVER” tends to induce suspicion on private respondent’s character, integrity and reputation as mayor of Cadiz City. There are no derogatory imputations of a crime, vice or defect or any act, omission, condition, status or circumstance tending, directly or indirectly, to cause his dishonor. Neither does the phrase in its entirety, employ any unpleasant language or somewhat harsh and uncalled for that would reflect on private

respondent’s integrity.” But if you are discriminated because of your gender, the applicable law is Section 3 of Republic Act 9710 otherwise known as the Magna Carta of Women (MCW) provides that “All individuals are equal as human beings by virtue of the inherent dignity of each human person. No one should therefore suffer discrimination on the basis of ethnicity, gender, age, language, sexual orientation, race, color, religion, political or other opinion, national, social or geographical origin, disability, property, birth, or other status as established by human rights standards. In the case of Ang Ladlad Party List vs. Commission on Election (G.R. No. 190582), the Supreme Court ruled in favor of the Ang Ladlad Partylist, declaring that the LGBT sector deserves to participate in the party-list system on the same basis as other marginalized and under-represented sectors. Here, the battle for gender equality was upheld. But if your working conditions were not hampered, it seems that your HR Chief was correct in saying that since you were an open gay, calling you as “bakla” was no longer derogatory. Be proud.

HENRYLITO D. TACIO THINK ON THESE!

ANGELS ARE STILL IN BUSINESS DO you believe in angels? “We not only live among men, but there are airy hosts, blessed spectators, sympathetic lookers-on, that see and know and appreciate our thoughts and feelings and acts,” admits Henry Ward Beecher. “The angels,” explains John Calvin, “are the dispensers and administrators of the Divine beneficence toward us; they regard our safety, undertake our defense, direct our ways and exercise a constant solicitude that no evil befall us.” Saint Francis de Sales says, “Make yourself familiar with the angels, and behold them frequently in spirit; for without being seen, they are present with you.” And Saint Thomas Aquinas believes, “An angel can illuminate the thought and mind of man by strengthening the power of vision.” There is no definite number of angels recorded in the Holy Bible. Eileen Elias Freeman, in ‘The Angels’ Little Instruction Book,” pointed out: “Angels are all around us, all the time, in the very air we breathe.” George Bernard Shaw commented, “In heaven, an angel is nobody in particular.” Perhaps, the number of angels might be compared with the number of stars in the universe, which means the number would run into the billions. Apostle John saw in

a vision “ten thousand times ten thousand, and thousands of thousands” -- that equals 100 million and untold thousands besides. The book of Daniel (7:10) recorded: “A fiery stream issued and came forth from before Him. A thousand thousands ministered to Him; ten thousand times ten thousand stood before Him.” And Revelation 5:11 stated: “Then I looked, and heard the voice of many angels around the throne, the living creatures, and the elders; and the number of them was ten thousand times ten thousand, and thousands of thousands.” Interestingly, of all of the angels, Michael and Gabriel are given places of importance among angels in the ministry of God. Both Michael and Gabriel are mentioned in both the Old Testament and the New Testament. Michael, whose name means “who is like God,” has the rank of archangel and is the defender of Israel, God’s chosen people. Gabriel, whose name means “mighty one of God,” is a special messenger of God. Satan, a fallen - evil angel, is also mentioned by name. Unknowingly, we can all be angels to one another. Joan Wester Anderson explains: “We can choose to obey the still small stirring within, the little whisper that says go: ‘ask, and reach out.’ Be

an answer to someone’s plea. You have a part to play. Have faith. We can decide to risk that He is indeed there, watching, caring, cherishing us as we love and accept love. The world will be a better place for it. And wherever they are, the angels will dance.” As a friend, you can be an angel, too. Do you know the reasons why? According to one poem, friends brighten our days “in all kinds of wonderful, magical ways.” Their thoughtfulness comes, “as a gift from above” and we feel we’re surrounded, “by warm, caring love.” Friends fill our lonesome moments “with their laughter and fun.” They are considered angels “without any wings” for they bring blessing to our lives “with the most precious things.” James Russell Lowell once penned, “All God’s angels come to us disguised.” I am reminded of this quote after reading a story circulated on the internet. It goes this way: Two traveling angels stopped to spend the night in the home of a wealthy family. The family was rude and refused to let the angels stay in the mansion’s guest room. Instead, the angels were given a small space in the cold basement. As they made their bed on the hard floor, the older angel saw a hole in the wall and repaired it.

When the younger angel asked why, the older angel replied, “Things aren’t always what they seem.” The next night the two angels came to rest at the house of a very poor, but very hospitable farmer and his wife. After sharing what little food they had the couple let the angels sleep in their bed where they could have a good night’s rest. When the sun came up the next morning, the angels found the farmer and his wife in tears. Their only cow, whose milk had been their sole income, lay dead in the field. The younger angel was infuriated and asked the older angel how could you have let this happen? “The first man had everything, yet you helped him,” she accused. “The second family had little but was willing to share everything, and you let the cow die.” “Things aren’t always what they seem,” the older angel replied. “When we stayed in the basement of the mansion, I noticed there was gold stored in that hole in the wall. Since the owner was so obsessed with greed and unwilling to share his good fortune, I sealed the wall so he wouldn’t find it. The older angel continued, “Then, last night as we slept in the farmer’s bed, the angel of death came for his wife. I gave him the cow instead. Things aren’t always

what they seem.” Sometimes that is exactly what happens when things don’t turn out the way they should. If you have faith, you just need to trust that every outcome is always to your advantage. You just might not know it until sometime later. After all, things aren’t always what they seem. Have you ever seen an angel? One night, the king of Syria sent his army under cover of darkness with lots of chariots and horses and horsemen to surround the city and cut off all escape routes. When the prophet and his servant got up early the next morning and checked around outside, they discovered troops, horses, and chariots everywhere! The servant, obviously frightened, asked, “Now, what are we going to do?” The prophet Elisha answered in so many words, “Don’t be afraid because our army is larger than theirs!” Then Elisha prayed, “Lord, open his eyes and let him see.” And when the Lord had opened the young man’s eyes he saw horses of fire and chariots of fire everywhere on the mountains surrounding the army which had surrounded them! Have you ever seen an angel? Maybe you just need your eyes to be opened!

Privacy watchdog to summon BDO, UnionBank over hacking incident

T

he Philippines’ privacy watchdog on Wednesday said it has ordered BDO and Unionbank to a meeting on Jan. 4 next year on the BDO hacking incident which affected hundreds of depositors. The National Privacy Commission said it is investigating the possible personal data breach and processing of data from the incident. Privacy Commissioner

John Henry Naga said the agency is also looking into “the relevance of BDO’s 10year old system to the alleged security incident.” The NPC said it wants to know if “sufficient tech-

nical, organizational, and physical safeguards were in place to prevent unauthorized disclosure of personal information that may have been contained in the system.” The agency earlier said it has already launched a sua ponte or voluntary investigation into the incident, and is coordinating with other government

agencies on the issue. BDO has said that it is reimbursing around 700 depositors for money lost due to what it called “sophisticated fraud technique.” More than 30 BDO depositors who claim to have also been victimized but were denied refunds, meanwhile said the bank also owes them.

erage is particularly limited,” it said. To date, foreign ownership in public utilities in the country is only allowed up to 40 percent. The commentary noted that “downside risks to foreign investment and improvements to fixed networks include the Philippines’ proximity to escalating tensions between China and Taiwan, as well as the appeal of mobile broadband.” It said the government has been enticing foreign investors through continued liberalization of FDI policies. Citing Bangko Sentral ng Pilipinas (BSP) data, it said FDIs have slipped for the third consecutive year in 2020, by nearly 25 per-

cent. With favorable demographics for having a large number of young population, the report said: “the Philippines is largely held back by underdeveloped digital infrastructure.” “Liberalising the environment for foreign investors is likely to encourage greater investment into maturing the country’s digital infrastructure, a requirement for tech-players looking to successfully capitalize on the Philippines’ conducive demographics,” it said. Allowing greater foreign investors’ participation in the domestic telco industry is seen to boost the country’s capacity to be among the fastest-growing cloud market

in the region over the medium to around USD1.36 billion market size by 2024. The commentary said that “despite the rapid increase in investment, the Philippines will remain one of APAC’s smallest cloud computing markets, with recent activity insufficient to significantly improve the country’s scarce terrestrial digital infrastructure.’ “That said, liberalizing the market should see an influx of international tech-players looking to monetize the Philippines’ long-term growth opportunity and we could see the country’s cloud computing market forecasts revised upwards,” it added. Online application for construction permits, licenses to be implemented

O

nline application and processing of construction permits and licenses will soon be implemented with the amendments of the Joint Memorandum Circular (JMC) No. 1 Series of 2018 or the Guidelines in Processing of Construction-Related Permits. The JMC, which was signed Tuesday, is in line with the implementation of the National Effort for the Harmonization of Efficiency Measures of Interrelated Agencies (NEHEMIA), a streamlining program led

by the Anti-Red Tape Authority (ARTA). The guidelines involve setting up one-stop shops— online and physical—for the processing of construction-related permits. Agri damage, losses due to Odette rises to P2.6B SoCot visitors urged to bring documents for pork items

T

he provincial government here reminded excursionists and sightseers from nearby General Santos City and Sarangani province to secure the necessary documents when bringing pork and pork by-products to this area due to the threat of the African swine fever (ASF). Dr. Flora Bigot, head of the provincial veterinary office (PVET), said Wednesday the local government

units (LGUs) of General Santos and Sarangani are likewise restricting the bringing of pork products in their area without any documents due to the threats of the ASF. “Please comply with the needed document. For example, for lechon (roast pig) you have to get a meat inspection certificate from the slaughterhouse to justify that the animal is healthy,” Bigot said.

T

he damage and losses to the agriculture sector caused by Typhoon Odette has so far reached P2.6 billion, according to the latest data released by the Department of Agriculture (DA). As of 12 noon, December 22, the DA said the agricultural damage and losses brought by the calamity stood at P2.6 billion. This is higher than the P2.2-billion worth of damage reported as of 5 p.m., December 21. The amount covers volume of production loss at 87,640 metric tons (MT) and 60,451 hectares of agricultural areas in Cala-

barzon, Mimaropa, Bicol, Western Visayas, Central Visayas, Eastern Visayas, Zamboanga Peninsula, Northern Mindanao, Davao, and Caraga. The typhoon affected 34,747 farmers and fishers. Affected commodities include rice, corn, high value crops, livestock, and fisheries. Damage has also been incurred in agricultural in-

Janssen vaccine. Last week, Concepcion and the OCTA Research Group called on the government to shorten the interval between the last dose and the booster shot to four months. This, as data suggest that the efficacy of Covid-19 jabs “significantly decreases at around five months” or sooner depending on the vaccine brand, OCTA Research Fellow Fr. Nicanor Austriaco said.

F

frastructures, machineries and equipment, the DA said. “These values are subject to validation. Additional damage and losses are expected in areas affected by Odette,” it added. The Agriculture department, however, said 11,454 hectares of rice have been harvested from Regions Mimaropa, VI, VIII, IX, XI, and XIII with an equivalent production of 34,433 metric tons amounting to P615.53 million. “As for corn, a total of 2,452 hectares have been harvested from Region IVA, Mimaropa, VIII, IX, XI, and XIII with an equivalent

production of 6,965 metric tons amounting to P82.55 million,” the DA said. The agency said its regional field offices are conducting assessment of damage and losses brought by disaster in the agri-fisheries sector. “The DA continuously coordinates with concerned NGAs (national government agencies), LGUs (local government units) and other DRRM(disaster risk reduction and management)-related offices for the impact of Odette, as well as available resources for interventions and assistance,” it said.

the solar plant joint venture. “We are preparing an initial 1,000 hectares for a joint venture with a partner who can help turn this plan into a reality,” he said. He added that the projects of Solar Philippines are in response to the Department of Energy’s (DOE) target to increase the share of renewable energy in the country to 35 percent by 2030, translating to building over 20,000 megawatts of solar power projects.

Last Friday, SPNEC’s IPO was oversubscribed at PHP5.3 billion from its PHP2.7 billion offering. The company plans to use the fund raised through the stock market to construct the first 50 MW out of the 500 MW projects and to acquire land for future expansions. SPNEC will be building a solar ranch in Nueva Ecija, which is eyed to be the largest solar project in Southeast Asia.

residential Adviser for Entrepreneurship and Go Negosyo founder Joey Concepcion has lauded the Department of Health (DOH) for heeding the private sector’s call to shorten the interval time between the second dose of Covid-19 vaccine and booster shot. “We need to act fast by getting ahead before the immunity from the first two doses wane. We are in a good position to increase our protection and keep

our ‘Bakuna Bubble’ intact now that cases are low and vaccine supply is stable,” Concepcion said in a statement Wednesday. On Tuesday, the DOH approved to give a single-dose booster as early as three months after the second dose for individuals that completed their AstraZeneca, Moderna, Pfizer, Sinovac, or Sputnik jabs, and as early as two months for those that received the single-dose

ollowing its initial public offering (IPO), Solar Philippines Nueva Ecija Corp. (SPNEC) has vowed to support government’s goal to increase renewable energy in the country. Breach of security in banks a serious issue that needs BSP intervention: Chiz

T

he increasing incidents of online fraud affecting Philippine banks is a serious threat that needs to be addressed by the Bangko Sentral ng Pilipinas (BSP), senatorial candidate and incumbent Sorsogon Gov. Chiz Escudero said. Escudero, who used to chair the Senate Committee on Banks, Financial Institutions and Currencies, said the BSP needs to go beyond the occasional fraud investigation and establish policies that will ensure all commercial, rural, thrift and digital banks have the infrastructure to protect their clients. “As institutions imbued with public trust, banks have the responsibility to protect their clients’ data and resources. But the breach of banks’ security systems, which we have

repeatedly seen for several years now, shows that the digital infrastructure needed to do that is grossly lacking,” Escudero said. “The BSP needs to put in place policies that will address this weakness in banking systems if it wants to promote financial inclusion through digital banking and digital payments. How can you expect people to try online banking and digital payments when they are not confident of the banks’ ability to protect them?” he said. Some 700 clients of

Your last chance:

BDO Unibank Inc. have lost money in a massive breach of its 10-year-old web service—supposedly due for phaseout—that allowed hackers to move BDO depositors’ money to the UnionBank account of a certain “Mark Nagoyo”. BDO is processing the return of funds to the affected accounts. In 2019, Metrobank— among other banks—fell victim to a sophisticated cyberattack that was able to intercept codes sent to customers via SMS to verify transactions. In 2017, the Bank of the Philippine Islands blamed technical glitches that wrongly debited funds from its depositors’ accounts. Security Bank, Land Bank of the Philippines and BDO have reported similar cases.

“The way we do banking has evolved, and the challenges have evolved as well. The BSP can and must look at long-term interventions, including incentives and penalties, that will push banks to strengthen their security and information systems. This should be a priority as we transition to digital platforms,” Escudero said. He said the BSP is mandated by law to establish standards for operations of banks according to what it deems to be sound practices and necessary interventions. “Now would be a good time for the BSP to examine how to make banking work in a digitally driven era that comes with as many risks as there are benefits,” Escudero said.
