Ombudsman clears Dr. Ferrer, 10 PhilHealth officers in cases By ANTONIO M. AJERO

avao City-based diabetologist Dr. Roy B. Ferrer, former acting president and chief executive officer of Philippine Health Insurance Corporation (PhilHealth) and 10 other former high- ranking PhilHealth officials were cleared by the office of the Ombudsman in criminal and administrative charges filed by a group of seven PhilHealth employees. The OMB dismissed the criminal and administrative charges filed in 2019 against Dr. Ferrer, now an assistant secretary of the Department of Health; , former interim president Celestina Ma. Jude Dela Serna; chief operating officer Ruben John Basa; management services sector senior vice president (SVP) Dennis Mas; vice president for corporate affairs group Shirley Domingo; office of the senior vice president, legal sector SVP Rodolfo Del Rosario; chief of staff Raul Dominic I. Badilla; health finance policy sector SVP Israel Pargas; Angelito Grande; Laurence M. Mijares; and acting senior manager of operations audit department Leila

Tuazon. The complaints against them were filed by Miriam Grace G. Pamonag, Jelbert B. Galicto, Dennis B. Adre, William O. Chavez, Paolo Johann C. Perez, Khaliguzzman M. Macabato and Valerie Anne H. Hollero. The complainants alleged that the PhilHealth officials filed “baseless administrative cases” against them from Sept. 2017 to May 2019; thereby oppressing and harassing them. They claimed their preventive suspensions could have been simultaneously served instead of filing one formal charge after another in violation of Section 31 of the

Civil Service Commission rules. They likewise alleged there was “ unwarranted reassignments” made without their consent and that they were publicly humiliated in the PhilHealth internal communication system, casting doubt on their integrity. In dismissing the charges against Ferrer and the other PhilHealth officers; the Ombudsman said it finds neither probable cause to indict them nor substantial evidence to justify imposing sanctions against them. “It must be pointed out that the overt acts of respondents— recommending the filing of administrative charges as imposition of preventive suspension against complainants, acting as prosecutor in the administrative cases among others-- are part of their respective functions either in their capacity as officials of PhilHealth or by Board Resolution directing them to perform such duties”, the ruling stated. The OMB said “ thus, mere performance of the said acts, without more, should not be

Philippine retailers cite PNoy’s economic legacy

ormer President Benigno Aquino III will be remembered for his “good governance” leadership which led to relatively high growth rates during his term, the Philippine Retailers Association (PRA) said as the group mourned his untimely death. Aquino died of renal failure as a result of diabetes on June 24. “President Aquino’s transparency and good governance restored the confidence of both local & international investors, which made the Philippines one of the fastest growing economies in Asia during his administration,” the PRA said. In 2010, Aquino, riding on the mantra of “daang matuwid” (righteous path), succeeded President Gloria Macapagal-Arroyo, whose administration was hobbled by the 2004 electoral fraud and corruption allegations.

The PRA said Aquino was a “staunch supporter” of its programs, including the 17th Asia Pacific Retail Conference and Expo, the biggest retail event in the region, which it hosted in 2015. “For all these, we in the PRA will always be thankful for his service to the nation and to the Filipino people,” the group said. he city government will start rolling out “vaccination by the sea” for workers in the tourism sector beginning June 30 at the Garden Pavilion of the Waterfront Insular Hotel Davao, an official said.

City Tourism Office head Generose Tecson said on Friday that the local government listed around 7,000 workers who need to be vaccinated in the tourism industry. My husband and I got married in Hong Kong because we were both working there before. I lost my job in 2018 so I came back to Davao City while my husband stayed in Hong Kong. Things are not going well between us and we would like to file an annulment of our marriage. We plan to file a divorce in Hong Kong. Will our Hong Kong divorce be recognized here in the Philippines? Thank you. May-Ann

Dear May-Ann, The answer would depend whether you and your husband are both Filipino or one is a foreigner at the time the divorce is

filed. If both of you are Filipinos at the time of the filing of divorce, then filing a divorce before Hong Kong courts cannot be recognized here in the Philippines. You need to file an annulment of marriage following the provisions of the Family Code of the Philippines. On the other hand, if one of you is a foreigner at the time the divorce is filed, then a divorce granted by the Hong Kong courts can be recognized here in the Philippines. The above difference was due to Article 26(2) of the Family Code which states that: “where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained

abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall likewise have capacity to remarry under Philippine law.” Before, it is required that the divorce should be filed by the foreign spouse to be valid. But recent Supreme Court decisions overturned the requirement that the divorce decree should have been obtained by the foreign spouse. As ruled in Juego-Sakai vs. Republic (G.R. No. 224015. July 23, 2018), “We observed that to interpret the word “obtained” to mean that the divorce proceeding must actually be initiated by the alien spouse would depart from the true intent of the legislature and would otherwise yield conclusions inconsistent

with the general purpose of Paragraph 2 of Article 26, which is, specifically, to avoid the absurd situation where the Filipino spouse remains married to the alien spouse who, after a foreign divorce decree that is effective in the country where it was rendered, is no longer married to the Filipino spouse. The subject provision, therefore, should not make a distinction for a Filipino who initiated a foreign divorce proceeding is in the same place and in like circumstance as a Filipino who is at the receiving end of an alien initiated proceeding.” Why is there difference in rules when one spouse is foreign against a marriage where both spouses are Filipinos? This is due to Article 15 of our Civil

Code which states that, “Laws relating to family rights and duties, or to the status, condition and legal capacity of persons are binding upon citizens of the Philippines, even though living abroad.” As such, if both spouses are Filipinos, the Philippine laws apply even though the marriage was celebrated abroad. GETTING READY FOR POSSIBLE VOLCANO ERUPTION Sitting in what scientists call the “Pacific Ring of Fire” – a halo of seismic hotspots around the Pacific Ocean – the Philippines is home to about 200 volcanoes. The Philippines is home to more than 7,100 islands. However, most of these islands are of volcanic origin. Fortunately, of the many volcanoes found in the country, only 21 volcanoes are considered active. A volcano is considered active if it has erupted sometime within the last 600 years. If a volcano has not erupted in 600 years, it is regarded as inactive (dormant). There are also volcanoes which are considered extinct. “It is difficult to distinguish an extinct volcano from a dormant one,” an American volcano expert says. Extinct volcanoes are those that scientists consider unlikely to erupt again, because the volcano no longer has a lava supply. Examples of extinct volcanoes are many volcanoes on the Hawaiian. Edinburgh Castle in Scotland is famously located atop an extinct volcano. In the Philippines, the government agency in-charge with anything related to volcano is the Philippine Institute of Volcanology and Seismology (PHIVOLCS). It is dedicated to provide information on the activities of volcanoes, earthquakes, and tsunamis, as well as other spe-

cialized information and services primarily for the protection of life and property and in support of economic, productivity, and sustainable development. It is one of the service agencies of the Department of Science and Technology (DOST). Currently, the Philippines has a total of 65 seismic stations, 29 of which are manned, 30 are unmanned, and 6 volcano stations. The central operating station is located at PHIVOLCS main office in Diliman, Quezon City. The eruption of Mount Pina-

tubo is perhaps the most popular around the world. But among Filipinos, Taal Volcano is more common as it erupts every now and then. The worst recorded eruption of Taal Volcano happened in 1754 and lasted from May 15 to December 1. “(The said eruption) can be repeated,” DOST undersecretary and concurrent Officer-In-Charge of PHIVOLCS Dr. Renato U. Solidum Jr. was quoted as saying by Rappler. Last year, Taal volcano literally started the year with a bang. It resulted in the suspension of school classes and work and suspended local flights in the area above as PHIVOLCS issued Alert Level 4 on the afternoon of 12 January 2020. The scenario indicated “possible hazardous explosive eruption within hours to days.” After 42 years of silence, Taal volcano showed renewed activities that fateful day, spewing ash that affected residents and tourists in Batangas, Cavite, Laguna and even in Metro Manila and other neighboring cities. Fortunately, the recent disaster has prompted scientists from PHIVOLCS to develop VolcanoPH, a volcano advisory application that will help the public better understand similar geohazard warnings in the future so they can be better prepared. “This innovation is a real-time volcano advisory applica-

tion, initially for Android devices, that provides infographic information on the latest updates of Philippine active volcanoes monitored by PHIVOLCS,” wrote Joy M. Lazcano, of the Science and Technology Information Institute (STII). The app will help users understand the present volcano status along with its alert level warnings through the 24-hour real-time observation data gathered from the Volcano Monitoring Network records and actual field survey data analyzed by experts from PHIVOLCS. Lazcano said that App users can also select and click from a list of active volcanoes with alert levels on its homepage and be provided with the 24-hour summary containing its alert level warning status, monitoring parameters, and recommendations in Filipino language. The push notification feature will inform the users of the latest volcano advisory before the updates are posted on social media platforms. “The system will enable the user to see the updates first on the app after we have posted it to the PHIVOLCS website and have disseminated the information to the proper authorities,” said Dr. Solidum. The information that the users can access include the following: seismicity or the number of

volcanic earthquakes monitored, acidity level and temperature of the main crater lake, the level of sulfur dioxide being spewed by the volcano, volcanic plume level or the gas and particles produced by the volcano. Moreover, the app can provide other important information to help users determine the risks like the following: ground deformation or the presence of cracks, sinking, or swelling of the ground that can be caused by gas, magma, or fluids moving underneath or the movements of the earth’s crust due to the motion along the faults. The VolcanoPh app also provides recommendations and comments written also in Filipino. According to Ma. Antonia V. Bornas, head of the Volcano Monitoring and Eruption Prediction Division of PHIVOLCS, currently her team is planning to include advisories on different languages as warnings can be contextualized using local languages. “Like in (province) Bicol, there are three languages used in the province,” explains Bornas. However, this is still being studied thoroughly to ensure that the app will be more effective. To make the app more effective, Dr. Solidum also shared that the Agency is planning on developing the app for IOS users as well.

he Northern Davao Electric Cooperative (Nordeco), Inc., formerly Davao del Norte Electric Cooperative (Daneco), aired its side on the recent allegations of Mayor Al David Uy of the Island Garden City of Samal (IGaCoS) with regards to the capital expenditures of the Submarine Cable and Station Project in Samal. Uy posted on his Facebook account on June 26, 2021, asking former officials of Daneco and the National Electrification Administration (NEA) from 2013 to 2018 regarding the P200 million capex for the submarine cable project. “Gi-loan naman diay na ninyo, asa naman karon? t takes a grizzled veteran in international play to know what’s in store for this young Gilas Pilipinas team.

No less than former national basketball playmaker LA Tenorio admitted he was impressed with the young Gilas Pilipinas’ 3-game sweep of the third window of the FIBA Asia Cup Qualifiers. “I’m a bit surprised (Dwight Ramos) played like that in the bubble in the na-

tional team,” said Tenorio in an interview on “The Game”. “Another surprise for me are the two point guards, SJ Belangel and (RJ) Abarrientos. The future of Philippine basketball is seeing those young players, like Kai Sotto, Carl Tamayo, (Justine) Baltazar and a lot of players. The future

of Philippine basketball is in good hands if they play that way.” Gilas scored two huge victories against bitter rival South Korea and one against Indonesia in the Philippine-hosted qualifiers. Tenorio said the real test now is the Olympic qualifying tournament in Belgrade, where coach Tab Baldwin and co. will face basketball heavyweights Serbia and the Do-

minican Republic. Tenorio said big men such as Kai Sotto, Ange Kouame and Justine Baltazar will be important because of their height.
