doption of Mayor Sara an opportunity to renew alliance with PDP-Laban: Lakas-CMD

Lakas-Christian Muslim Democrats (Lakas-CMD) sees an opportunity to renew partnership with the PDP-Laban faction backed by President Rodrigo Duterte following the latter’s announcement on January 21, 2022 that it is adopting Mayor Sara Duterte-Carpio as its vice-presidential bet in the upcoming May elections. In a statement, Lakas-CMD extended its deep gratitude to all leaders and members of PDP-Laban for

adopting its vice presidential bet, Mayor Sara, and welcomed this development as an opportunity to renew partnership with PDP-Laban, which has been a steady ally in pushing for social and economic reforms under the Duterte administration. “Mayor Inday Sara has been espousing unity and cohesion for a better Philippines under the BBM-Sara UniTeam alliance that includes Partido Federal ng Pilipinas (PFP) of presiden-

tial aspirant Bongbong Marcos, to which Lakas-CMD has been very supportive,” it said. Lakas-CMD also stated that it is always open to alliances and partnerships with other parties and political groups which share its ideals and vision for the common good of the country. “We hope that our efforts to forge unity with all parties supportive of President Rodrigo Roa Duterte would help realize our common dream of electing the team that would best serve the Filipino people,” it said. It can be recalled that

last year, there was a falling out between Mayor Sara and PDP-Laban when she sought an alliance with the administration’s party for a slate with presidential aspirant Ferdinand “Bongbong” Marcos Jr. According to the mayor, PDP-Laban refused. The PDP-Laban was fielding Senator Christopher “Bong” Go for president through an allied party and even President Rodrigo Duterte was backing Go, who withdrew his presidential bid last year also. The mayor also issued a statement that further inten-

How Campo Fuego brings people closer to nature in the pandemic

Nothing has brought us closer to nature than this pandemic has… We have discovered that there is a place we can run off to in our lowest times, breathe the freshest of air, the smell of the earth right after it rained, exhale away all our worries…. One of these kinds of places is at the heart of Baganihan in Buda (Bukidnon - Davao route). A wife and husband team has opened their place to the public. Their restaurant and camping grounds have been aptly named Campo Fuego, translated from Spanish to mean Campfire. Located about 7 to 10 minutes away from the Buda highway. Din, retired from the

EDITORIAL Quick action Governor Nelson Dayanghirang has requested the Department of Environment and Natural Resources (DENR) to cancel the permit of a mining company - RCMI/ANRI - accused of causing the massive siltation of the Mapagba and Pintatagan Rivers in Banaybanay, Davao Oriental last week.

thority (MinDA) has also stepped in to help the locals affected by the pollution.

He cited the violation of the company that left the rivers stained orange from nickel laterite following a heavy downpour last week.

Although mining companies have contributed immensely to the country’s income generation through tax revenues and providing jobs, the government and concerned groups say its environmental impacts outweigh any benefit.

In his letter to DENR Secretary Roy Cimatu, Governor Dayanghirang requested the agency not to allow the mining company to resume operations thereby seeking its permanent closure in the area. “This blatant disregard of the company to its environmental protection and enhancement commitments had caused immeasurable environmental damages, should be given corrective measures,” Dayanghirang said.

The mining company has already ceased its operation on Monday by order of the Mines and Geosciences Bureau (MGB). It has conducted massive desilting operations at the Mapagba River as part of its River clean-up. Aside from using heavy equipment, the company also resorted to manual desilting to remove suspended silts and sediments. The company has also done direct community service by giving food packs to the affected residents. It is also set to provide jobs for locals to work on the reforestation, rehabilitation, and repair works. An important government agency such as the Mindanao Development Au-

“For a while, it may provide benefits in terms of income for the local and the national government. But our people and our environment will suffer the longterm effects of irresponsible mining. We can still manage without it. Environment protection and conservation should be prioritized above everything else,” says Governor Dayanghirang. The ideal thing for such a disaster as the massive siltation of two important rivers in the province is for it not to be allowed to happen.

Government should have this above mindset as DENR prepares to allow mining operations in many areas of the country as a strategy to recover our economy devastated by the ongoing pandemic. ANTONIO M. AJERO Editor in Chief

BETRAYAL OF TRUST Dear IBP Davao,

To help his friend who is an engineer, Engr. X, my husband took a loan for P2 Million and invested it on the project of Engr. X with a promise that they will divide the profit. Initial plans say that there will be a return after 3-6 months when the project is finished. 3 months after giving the P2M to Engr X, my husband found out that Engr. X left the project unfinished, put up a new company, and took Purchase Orders worth P3.9M for himself. My husband does not know a thing about construction and Engr. X was even present when my husband took out the loan. Although Engr. X was able to pay us P1.9M, it is still P100,000 short of the loan, not including interest. Can we sue Engr. X? -Working Wife

Dear Working Wife,

Betrayal of trust is one of the worst things that can happen to us. Of course, filing a case is a right of every citizen, but it is important to look at the evidence you have in your possession to know identify the best remedy. You may share your story to a lawyer, bringing any evidence you have, so that the lawyer can assess what case or cases to file. One remedy is to file a criminal case for estafa, provided all the elements of the crime are present. You may visit the Office of the Prosecutor’s Office as they can assist you in drafting the complaint for this remedy. Another remedy is to file a civil case for collection of money. You may even be eligible to file your claim under the Small Claims Court as this covers money claims of less than

P400,000. You may visit the Office of the Branch Clerk of Court of the Metropolitan Trial Court at Hall of Justice, Ecoland, Davao City to get the pro-forma copy for filing a complaint before the Small Claims Court. After filling-up the forms, you would need a lawyer to notarize the documents, but lawyers are not allowed to appear before the hearing. Only one hearing will be scheduled by the Small Claims Court, after which, the judge will already render a decision. Of course, as a professional governed by the Professional Regulation Commission (PRC), you likewise have the option to file an administrative case against Engr. X. All professionals are mandated to follow their respective profession’s Code of Ethics and there is a penalty for any violation of the Code. For

grave abuse of the Code, Engr. X might even have his license revoked. There might be other remedies available for you which your lawyer can advise you after examining your evidence. I hope by then, your trust will not be betrayed anymore. Nevertheless, in the event of violation by lawyers of our Code of Ethics, you may also file an administrative case before the Integrated Bar of the Philippines-Davao City Chapter for Davao City based lawyers. Our office is likewise located at Hall of Justice Compound. Maintaining one’s peace through these trials is important though as there is a long road ahead of you. As Master Choa Kok Sui, the founder of Pranic Healing wrote, “Forgiveness is not a matter of who is right or wrong. It is a matter of

doing the right thing. Compassion means to forgive. There is both Inner Forgiveness and Outer Forgiveness. Inner Forgiveness is for all people, but Outer Forgiveness should be done on a case-to-case basis. If the mistake or crime is serious, the offender cannot be forgiven externally. There has to be justice and order, without which there will be chaos.” IBP Davao Corner is a weekly column of Integrated Bar of the Philippines- Davao Chapter, giving legal advice as part of its legal aid program. The above legal opinion is based solely on the appreciation of the facts and problem given and stated above. The opinion may vary when other facts, circumstances, and situations are stated. DEBUNKING URDUJA’S MYTH If you look at the four names of personages honored in Davao’s city streets, a hiker can discover that four of them are related to history, but no one is associated with Mindanao. Lakandula was the paramount ruler of precolonial Tondo when the Spaniards landed. Lapu-lapu, on the other hand, is the chief-tain of Mactan who was credited for the death of Portuguese ex-plorer Ferdinand Magellan when he was in his sixties. Soliman (Sulayman), meanwhile, was a Moro rajah of Manila on the other side of Pasig River when the colonists arrived. Among the four rulers, only Urduja, supposedly a princess, rep-resents the distaff side. According to Dr. Jose Rizal, citing surviv-ing accounts in his time, she ruled a land known as Tawalisi which, in 1916, was placed by American biographer

and histori-an Austin Craig, at Pangasinan. Like the fictitious Kalantiaw Code and the 10 Bornean datus of Panay, Princess Urduja’s rule of a Pangasinan polity is considered mythical. The biographies around this figure have been a focus of review but nothing definite has come out why her kingdom was situated in the north. Ibn Battuta (1304-69), A Moroccan scholar-explorer who toured widely the Afro-Eurasia lands, does not agree with Rizal and Craig. In his travelogue, Urduja ruled Kaylukari in Tawalisi land, which is along the way to China from Java, and she led the Ki-nalakian, a tribe she controlled. Tawalisi, named after Princess Urduja’s father, owned a navy that rivaled China’s maritime force. To argue against Craig’s hy-pothesis, Batuta wrote that it took him seven-

teen days to reach China from Tawilisi, a place that scholars nearly unanimously ap-prove of Champa (Vietnam). Urduja, as was depicted in accounts, was ‘a tall and beautiful lady having golden bronze skin, straight shiny luscious dark hair, and deep, dark-colored eyes. Clad in gold and is adept in sword fighting and horseback riding… a brave, smart and kind-hearted lady… [and] multi-dialect.’ She was also described in some narra-tives as a fluent Arabic speaker. As warrior princess, she joined in actual combats; she was a generous host to visitors, providing them with provisions and gifts before leaving port. She did not marry unless her condition for tying the knot was satisfied: ‘I will marry no man except him who shall conquer me, and all the eligible suitors in this vicinity are afraid to try for fear of being beaten by a

girl.’ Interestingly, there are placenames in Batuta’s Arabic narratives with Malay provenances such as Tawalisi (tantalizingly rhymes with tawilis, the world’s only freshwater sardine in Taal Lake) and Kinalakian (sounds like the Tagalog kinalakihan and the root word laki). Pangasinan’s entry in the Urduja myth is tenuous. When the princess ruled, China, situated 17 days away from Tawalisi, was led by the Mongols, who drove the Muslims to Java, supposedly the precolonial Tawalisi. Ibn Batuta describes Urduja’s land as fol-lows: ‘Thereafter, we reached the land of Tawalisi, it being their king who is called by that name. It is a vast country and its king is a ri-val of the king of China. He possesses many junks, with which he makes war on the Chinese until they

come to terms with him on certain conditions. The inhabitants of this land are idolaters; they are handsome men and closely resemble the Turks in figure. Their skin is commonly of a reddish hue, and they are brave and war-like. Their women ride on horseback and are skillful archers, and fight exactly like men.’ Based on Ibn Batuta’s 14th-century accounts, Urduja and her turf, which hosted elephants, have absolutely no historical refer-ence to Pangasinan (and the country as a whole) whatsoever! Meanwhile, there are no extant documents to identify those who proposed the naming of city streets, formerly swamplands that once hosted houses on stilts, after these Moro characters. What is indisputable is that many of the city’s thoroughfare names were chosen at random.

Meanwhile, Center Head of the Mental Wellness Center for Homeless Building, Dr. Annaliza Malubay also said that the establishment of the Center is an achievement for the City Government of Davao because this is the first of its kind in the country. “This facility was created because our local government saw the need for a shelter that caters to those psychotic vagrants

We have to provide holistic care.” She added that being assigned to the facility is an eye-opener for mental illness as the most neglected health problem. “Hopefully, in the near future, we will be able to establish livelihood programs and other services both medical and non-medical that can benefit not only admitted clients but also outpatients,” Malubay said. Pag-IBIG releases record P1-B housing loans in ‘21

T

he Home Development Mutual Fund (Pag-IBIG Fund) last year financed PHP100.8 billion worth of housing loans, the highest ever released by the agency in a year despite the continuing Covid-19 pandemic.

Department of Human Settlements and Urban Development (DHSUD) Secretary Eduardo del Rosario, who also heads the 10-member Pag-IBIG Fund Board of Trustees, said the in-home loan disbursements contributed to the economic recovery efforts

of the government. “While the country is still facing challenges caused by the pandemic, I am happy to report that Pag-IBIG released more than PHP100 billion in home loans in 2021, surpassing its best-ever figure which it achieved in 2019, before the health crisis started,” del

Rosario said in a statement on Friday. Data released by PagIBIG Fund showed it released PHP97.28 billion worth of home loans, with interim releases for loans for house construction and renovation amounting to PHP3.5 billion. The amount disbursed in 2021 significantly grew to 58 percent compared to PHP63.75 billion in 2020. The agency’s previous record-high of PHP86.74 billion released in 2019 was also surpassed by 16 per-

GCash said it has worked closely with the agents of the National Bureau of Investigations and the PNP Anti-Cybercrime Group “to deliver an above-and-beyond customer experience and identify fraudsters abusing its platform.”

“In cooperation with the elements of the NBI CCD, we were able to identify and apprehend these unscrupulous individuals who have been taking advantage of Filipinos through fraudulent methods, mainly through phishing and misrepresentation,” GCash chief risk officer Ingrid Berona said. “May this serve as a warning to other fraudsters: We do not tolerate the use of GCash for illegal and unlawful activities,,” Berona added.

GCash said it employs up-to-date security technologies and global best practices are applied on its app to keep consumers and transactions safe. “GCash would also like to clarify that it is not party to incidents from other financial institutions,” it added. PH economic growth seen at 5% in 2021; 7.5% in 2022

T

he Philippine economy is seen to have expanded by 5 percent in 2021 and is forecast to grow by 7.5 percent this year, an economist of Standard Chartered Bank said Friday. Both gross domestic product (GDP) projections are within the inter-agency Development Budget and Coordination Committee’s (DBCC) assumption of a 5 percent to 5.5 percent expansion for last year and a 7 percent to 9 percent assumption for 2022. In a virtual briefing, Jonathan Kho, Standard Chartered Bank economist for Asia and the Philippines, said the projected quarter-on-quarter output for the last quarter of 2021 is 6.5 percent, higher than 3.8 percent from July to September that year. Kho said their growth projection for the domestic economy this year is higher than the previous forecast of 6.5 percent, attributing it to base effects, continued economic re-opening that boosts employment growth, fiscal consolidation, and accommodative monetary policy. He said they expected

stronger economic recovery last year but the Delta variant of the coronavirus disease 2019 (Covid-19) greatly affected the region. “(The) Philippines was also hit, especially in Q2. But after that, we saw (a) pretty strong recovery in Q3. So just on the basis of that, I think, on the back of lower base effect in 2021, as well as, I think, the pretty strong recovery we saw in Q3 and probably going forward, our growth forecast was revised higher to 7.5 percent,” he said. The domestic economy snapped from a five-quarter contraction starting in the second quarter of 2021 when it posted a growth of 12 percent, followed by a 7.1 percent expansion in the next three months. Kho noted that the employment situation in the country is improving, calling it a plus for the economic recovery. Philippine Statistics Authority data show that the unemployment rate declined to 6.5 percent in November 2021 from 7.4 percent in the previous months and 8.7 percent at the start of the year.

DTI provides facilities worth P2.5M to 3 groups in D de Oro PH, Russia reaffirm efforts on potential use of small reactors

T

he Philippine Department of Energy (DOE) and the Russian State Atomic Energy Corporation (ROSATOM) on Thursday reaffirmed their collaborative efforts to explore the potential utilization of small modular reactor (SMR) technology in the Philippines during the Small Modular Reactors’ Day. This event formed part of ROSATOM’s Breakthrough Technologies for Sustainable Future Week, which was held at the sidelines of the World EXPO 2020. Under the definition of the International Atomic Energy Agency (IAEA), SMRs “are advanced nuclear reactors that have a power capacity of up to 300 MW(e) per unit, which is about onethird of the generating capacity of traditional nuclear power reactors”. Because of their size, and the capability of pre-assembling most SMRs in factories, they are considered ideal for industrial utilization, as well as for use in remote areas with limited grid access. In a pre-recorded video message, Energy Secretary

Alfonso Cusi stated that SMRs are a “game-changer in the global energy landscape”, especially since they could be utilized in locations that are not suitable for large nuclear power plants (NPPs). “It is an attractive, viable, and doable option for the Philippines given that SMRs provide non-intermittent power supply for calamity-prone countries, their low-carbon footprint, predictable supply costs, and are tailored-fit for our country’s archipelagic setting,” Secretary Cusi emphasized. He expressed strong interest in Russian nuclear energy technology and its potential application in the Philippines after an official visit to Saint Petersburg, Russia, in 2017, where he witnessed the assembly and processing of the 70-megawatt Akademik Lomonosov floating co-generation plant in the Kamchatka region. In 2019, the DOE and ROSATOM signed a memorandum of intent in Moscow, Russia, on the conduct of a pre-feasibility study on SMR technology’s applicability in the Philippine setting.

Pingris named Pilipinas Super League Commissioner

M

arc Pingris is going from the hardcourt to the boardroom as the ninetime PBA champion has been named as the commissioner of the upcoming Pilipinas Super League. The league bared the

news on Saturday as it seeks to formally open shop by March 2022. This is the latest career move for the Pozorrubio, Pangasinan native who hung his sneakers for good last year and had his jersey retired by the Purefoods franchise

on Christmas Day 2021. Pingris was expected to play for the Nueva Ecija Rice Vanguards in the Maharlika Pilipinas Basketball League (MPBL) Invitational late last year, but those plans did not push through. Pingris is also linked to

the Davao Pilipinas team which is set to see action in the rebooted Asean Basketball League (ABL). But with this development, the playing days of the former Gilas Pilipinas stalwart might as well be done for good. Eleven teams have

commited to join the inaugural Pilipinas Super League season led by MPBL champion Davao Occidental Dumper Tigers - Cocolife and Pilipinas VisMin Super Cup titlist Basilan BRT. Also joining the fray are Cagayan Valley Gold-

en Eagles, Kapatagan Buffalos, Pagadian Explorers, Bicol Express Uragons, Cooly El Nido Fruit Masters FSD-Makati Auto Insurance Services, MJAS/Zenith Danao City, Lapu-Lapu City, Tsada Kagayan, and a club from Boracay.

SPORTS SNAFU Snafu is an American slang that is short for “situation normal all fouled up.” It means “a confused or chaotic state, a mess.” This is exactly what is going on at PATAFA, PSC and the POC which all got embroiled with the mess created by allegations of fund mis-appropriation against pole vaulter EJ Obiena. I wrote then that the Philippine Sports Commission should handle the matter exclusively. This is because the money involved in the controversy comes from government coffers directly from the taxpayers. Since this is government

money, PATAFA which threatened to file criminal charges against Obiena, dId not have the juridical prerogative to do so. The PSC, being the government agency that released the money, is legally the entity that should conduct the probe and prosecute Obiena, if it were necessary. PATAFA could have only recommended that Obiena be probed for the mishandling of funds meant for the payment of his foreign coach’ monthly salary.. If proven guilty by the PSC Investigation, then PATAFA can effectively proceed to de-list and drop EJ from the roster of the na-

tional athletics team. If this procedure had been initially observed, then the Philippine Olympic Committee, in its effort to assist and protect EJ, would not have gone to the extent of declaring PATAFA president Philip Juico “persona non grata.” The above procedure would have also prevented some uninvolved third parties from issuing statements that tended to cast aspersions and add more fuel to the fire. What about the Athletes’ Commission? Why did it not raise a howl or a hoot? The AC is supposed to represent the athletes in the umbrella organization that is the POC.

The PSC should make everybody understand that the matter involves government money. Ergo, it is sufficient to assume that from hereon, only PSC Chair Butch Ramirez or his authorized representative can issue oficial statements regarding the status and progress of the EJ Obiena probe. It is good that the Tokyo Olympian has submitted to the polite request of Ramirez. I would have kept my peace since writing my first reaction about a month ago. I thought the PSC’s message to PATAFA to settle the misunderstanding surrounding the financial circumstances amicably already helped subside

the fire. Amusingly, PATAFA is chaired by a congressman, Rep. Rufus Rodriguez (Cagayan de Oro) while POC is likewise chaired by another member of the House of Representatives, Rep. Bambol Tolentino (Tagaytay City) who is head honcho of the cycling association. BREAKTHROUGH WIN Pinay booters stun Thailand to open WAC campaign

I

n what could be the first big good news for Philippine sports in 2022, the country’s women’s football team finally solved the mystery that is Thailand.

The Filipina booters beat their Thai counterparts for the first time in their head-to-head meetings through a 1-0 win at the start of their campaigns in the AFC Women’s Asian Cup (WAC) at the DY Patil Stadium in Navi Mumbai, India on Friday night. All it took for the squad, formerly known by the moniker Malditas, to slay the perennial Southeast Asian football giant was some luck. Chandler McDaniel found an opening from the right elbow and went for the 81st-minute attempt. Waraporn Boonsing appeared to have saved the ball from going in, but she fumbled it and it rolled into the goalmouth. Her tap-out came too late as it was already way inside the goal line. While it was more of a lucky strike, the goal put into fruition a solid performance by the Philippine squad that saw their supposed

opening goal disallowed due to the offside infraction and another attempt that hit the crossbar before sailing out. Thailand stepped on the gas in the final minutes looking to at least salvage a draw, but the Philippine defense held fort. The win was the first time the Philippines edged Thailand in 13 tries overall. “That’s a massive win,” Coach Alen Stajcic said after the match. Up next for the Philippine team is a huge showdown against Australia at the Mumbai Football Arena on Monday, which, by the looks of it, might decide which team will finish on top of Group B after the group stages. Australia sent a strong message to the entire AFC WAC field with an 18-0 bludgeoning of Indonesia earlier Friday. (PNA)
