HE Supreme Court (SC) yesterday issued a temporary restraining order (TRO) stopping the enforcement of an order of a Davao City Regional Trial Court (RTC) in connection with the seizure of suspected smuggled rice. In effect, the SC stopped the enforcement an earlier TRO issued by Davao City RTC Branch 16 Judge Emmanuel Carpio on December 12, 2013. The Supreme Court’s TRO is effective immediately and until further orders from the high court. The Davao City RTC earlier restrained the District Collector of the Bureau of Customs (BOC) of the Port of Davao from seizing the
more than three metric tons (MT) of rice shipment of respondent Joseph Ngo. Ngo is allegedly not a registered rice importer who represented Stacraft International Trading, a company said to be owned by suspected rice smuggling ring leader Davidson Tan Bangayan. The higher court asked Carpio and Ngo to comment within 10 days on the TRO petition of department of agriculture Secretary Proscesso Alcala and BOC Commissioner John Philip Sevilla upon receipt of the order. HE committee on environment of the Davao City council will propose an ordinance banning metallic mining in the city and regulating quarrying operations. Councilor Danilo Dayanghirang, chairman of the committee, told reporters that metallic mining in the city would damage the Davao River due to harmful chemicals that will spill over into the water. “Experience will tell us the destruction of this mining industry operation is very wide just like what happened in Marinduque,” he said. But as for non-metallic or quarrying operations, it should be properly reg-
ulated but prohibited in areas like watersheds and protected areas under the zoning ordinance, according to him. “This should be definitely observed by quarry operators,” Dayanghirang said, adding that quarrying under bridges is also prohibited. During a hearing, quarry operators asked to be excluded from the mining ban in the city. “Sand and gravel are needed to empower industry for infrastructure,” said Dayanghirang. The proposal aims to ensure that quarry operators would comply with existing environmental laws in the country.

HE new Bureau of Customs (BOC) district collector in the port of Davao City said that he had earlier promised Mayor Rodrigo R. Duterte to coordinate with the local government regarding the agency’s operations. Speaking during the privilege hour in yesterday’s regular city council session, Ret. Gen. Ernesto Aradanas, new customs district collector, said that his administration has committed to mayor Duterte that it will closely coordinate with the city government to promote transparency in its operations. In a separate interview yesterday, Aradanas told
reporters that he is totally committed to support the programs of the city government. He said that transparency is one of the fundamental elements that would end corruption within the Customs. “We truly intend to initially somehow improve the working environment. Clean the surroundings as we keep on improving,” he said. Aradanas added that there is a need to develop more facilities as well as human resource development and management. “As what I have said, it is a broad and complicated system and it’s not good
to focus on just one aspect and judge the Bureau of Customs.” He said that in his administration he would propose the expansion of the port’s facilities. “Our facilities were setup about 40, 50 years ago. And we know that trade and the volume of shipments practically increased almost a thousand percent,” said Aradanas. HE Department of Environment and Natural Resources (DENR) in Region 11 will be allotting P1.8 million for the planting of mangrove trees along the coast this year. Lourdes Wagan, DENR 11 regional technical director for forestry said during the Kapehan sa Dabaw at SM City Annex last Monday that the agency will be targeting to plant mangrove trees on 53 hectares across the region. Mangrove tree planting is part of the government’s biggest environmental project, the National Greening Program (NGP). “We will be intensifying
reforestation in coastal areas because of the danger caused by storm surges,” Wagan said, adding that they will be prioritizing areas in Baganga, Davao Oriental badly hit by typhoon Pablo. Aside from Baganga, DENR 11 will also be planting mangrove trees in coastal areas of Island Garden City of Samal (IGACOS) and Tagum City. Mangrove forests can make coastal communities less vulnerable to storms and storm surges. They also serve as a breeding place for fish, crustaceans, and other marine organisms. In addition, the bark of
the tree can also be a good source of charcoal. Last year, the department was able to plant 100 hectares to mangrove. On the DENR 11 website, the agency together with other people’s organizations rehabilitated 12 hectares in Benoling, Samal Island; 15 hectares in Tambo, Samal Island; 20 hectares in San Isidro, Samal Island ; 15 hectares in Libuak, Samal Island ; and 5 hectares in Mabini, Davao province. Partner agencies for this year were Davao Light, Landbank, SM Supermalls, and a wood processing company based in the region, among others.

Updating of local investment code urged to generate more revenues T
HE General Santos City local government is pushing for the revision and updating of the city’s investment code in a bid to enhance further the local government’s revenue generation initiatives. City Mayor Ronnel Rivera said Tuesday he has issued Executive Order 206 to facilitate the review and amendment within this year of the city’s Investment Code of 2004, which last underwent some minor revisions in 2010. He said the move will mainly focus on the updating of some provisions of the code to complement with the city’s current socio-economic condition and the continuing developments in the area. The mayor said the amendment of the code was among the strategies earlier adopted by the local government to achieve its goal of increasing local revenues this year by around P200 million. He noted that for this year, the city government has projected an income of around P300 million from local taxes and P900 million from its Internal Revenue Allotment share. “We’re continually finding additional resources
so we can invest on more sustainable projects that would reinforce the growth of the city’s economy,” Rivera said. In amending the investment code, the mayor said the local government will link up with the city’s business sector, specifically the General Santos City Chamber of Commerce and Industry, Inc. He said they also sought the business chamber’s help in the creation of the city’s investment promotion plan, investment promotion center and business promotion center. Rivera said these initiatives are aimed to further boost the city’s role as the business and trade hub of Region 12 and maximize the capacity of the city to consolidate future investment ventures. The mayor initiated last year a comprehensive study on the city’s trade and investment policies in a bid to sustain the area’s economic growth. It covered a review of the city’s ordinances and other local regulations involving business, investments and taxation. The city government, through the City Economic Management and Cooper-

He said appropriate steps are being undertaken inside the campus to help students avoid illegal drugs and illegal activities. “My appeal also goes to the parents of USM students,” Garcia said. “Help us save your children by monitoring their activities outside the campus,” he added. Garcia believed that an information campaign on the effect of prohibited drugs to humans should be
intensified, including how shabu is manufactured, distributed, marketed and sold in streets and areas known only to those engaged in illegal drug trade. Cops hunt down suspects in murder of DENR employee

OLICE are hunting down two men riding in tandem on a motorbike who shot dead an employee of the Department of Environment and Natural Resources (DENR)-Kidapawan City office at dawn Tuesday, police said. Supt. Leo Ajero, Kidap-
awan City police chief, said the victim, Agustin Abequebel of Women’s Subdivision, Barangay Singao this city, was heading for work at the Kidapawan City Environment Office on board a motorcycle when two men flagged him down. Citing witnesses, po-
lice investigators said the two suspects talked with Abequebel before he was shot at close range. The shooting occurred in Apo Sandawa Phase 2 subdivision, Kidapawan City at 5:45 a.m. Tuesday. Police said the shooting could have been triggered by a long-standing
feud with the suspects since the victim had no known enemy in the office. After he was shot, Abequebel managed to run away from the crime scene but later expired due to multiple gunshot wounds in the head and body. Police said they are following up a lead. [PNA]

NOTHER set of relocated residents from Garinan in Barangay Madaum, Tagum City have been awarded with deeds of donation in their respective lots in Iga Uy Village, one of the relocation sites by the city government. This after the city government through the efforts of the Local Housing Board chaired by Mayor Allan Rellon and co-chaired by Councilor Nicandro Suaybaguio, Jr. pushed for the speedy release of the documents to 11 beneficiaries certifying their ownership of the lot containing an area of 60 square meters. This is the second batch that the Local Housing Board was able to award the same documents. Under the said donation, the beneficiaries
and their heirs is not allowed to “dispose, mortgage or encumber the property during their lifetime, which condition shall be annotated in the title.” Most of the residents in Iga Uy Village are relocated from the shoreline of Garinan, which has been declared as a geo-hazard area by the Mines and Geo-Sciences Bureau of the Department of Environment and Natural Resources. Residents who agreed to be relocated have been awarded with free lots in the nearby Iga Uy Village, along with various materials needed to build a house. HE country’s import transaction in 2013 slightly decreased by 0.7 percent recording an import bill of USD 61.713 billion from 2012’s import value of USD 62.129 billion, the Philippine Statistics Authority-National Statistics Office (PSA-NSO) reported Tuesday. This is after importation of five out of top ten commodities declined from 0.71 percent up to 20.06 percent. Electronic products remained the country’s top imported commodity last year valued at USD 15.439 billion, a decrease of 4.72 percent from 2012’s import value of USD 16.203 billion. Mineral fuels, Lubricant and Related Materials was the country’s second most imported product which amounted to US 13.11 billion in 2013 from 2012’s value of USD 13.752 billion, a decline of 4.67 percent. This is followed by Transport Equipment at USD 5.899 billion in 2013 from USD 4.823
billion in 2012 which, on the other hand, grew by 22.3 percent. Fourth most imported products of the country last year was Industrial Machinery and Equipment with import bill amounted to USD 3.172 billion from 2012’s value of USD 3.194 billion, decreased by 0.71 percent. Other Food & Live Animals was the country’s fifth most outsourced commodity with import value of USD 1.804 billion in 2013 from 2012’s amount of USD 1.665 billon, increased by 8.36 percent The country’s top ten import partners in 2013 were China which was accounted for 13.01 percent of the total imports last year; followed by United States of America sharing 10.84 percent; Japan at 8.46 percent share; Taiwan at 7.90 percent share; South Korea at 7.72 percent share; Singapore at 6.82 percent share; Thailand at 5.48 percent share; Saudi Arabia at 4.58 percent share; Indonesia at

P200M sought for upgrading of thriving fishing industry T
HE General Santos City local government is pushing for the release of a P200-million grant from the national government for the modernization of the city’s thriving fishing industry. City Mayor Ronnel Rivera said Monday the grant will mainly be utilized to fund the required upgrading and modernization of local fishing fleets and the implementation of various support programs for the industry. He said the local government is currently working with the office of Senator Cynthia Villar, who chairs the Senate committee on agriculture and food, for the release of the financial grant. “We will use this to develop further our fishing industry and eventually make the more than just the tuna capital of the Philippines,” he said in a statement. Rivera said they initially tasked local tuna industry stakeholders, specifically members of the Socsksargen Federation of Fishing and Allied Industries Inc. (SFFAAII), to come up with sustainable project proposals focusing on the advancement of the city’s fishing industry. He said they are specifically looking for proposals that will help local fishing fleets comply with the regulations set by the Western and Central Pacific Fisheries Commission (WCPFC). “We need to justify to the higher-ups that we need the auxiliary budget to improve our standing in

The WCPFC was established through the Convention for the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific Ocean, of which the Philippines was a signatory, that came into force in 2004. The commission, which is overseeing the management of the declining tuna stocks in the Pacific Ocean, required fishing vessels operating within the area to install
vessel monitoring systems, deploy an observer and use of appropriate net size to prevent catching of juvenile tuna. The WCPFC cited that “purse seine net shall have mesh sizes not less than 3.5 inches starting at the mid-body to the entire wing while ring nets shall have mesh sizes not less than 3.5 inches at both wings.” The Bureau of Fisheries and Aquatic Resources earlier acknowledged that most fishing companies in the area were facing difficulty in complying with the fish net requirement
due to their high costs. Aside from the upgrading of the tuna fishing fleets, Rivera said the city government has discussed a potential partnership with the Mindanao State University (MSU) campus here in terms of marine and fishery education. MSU General Santos Chancellor Abdurrahman Canacan earlier proposed to “revolutionize a new curriculum for marine and fishery courses” through the university’s College of Fisheries. Marking two years of addressing
climate pollutants
T
HE Climate and Clean Air Coalition to Reduce Short-Lived Climate Pollutants (CCAC) this week celebrated two years of rapid growth, during which dozens of governments and organizations have worked together to target swift reductions in atmospheric pollutants that threaten human health and the environment. The CCAC was originally launched as a partnership between six countries and the United Nations Environment Programme (UNEP), who all recognized that fast action to reduce short-lived climate poll u t a n t s - p a r t i c u l a r ly methane and black carbon (soot)-has the potential to slow down the global warming expected by 2050 by as much as 0.5°C. “The Coalition works on a triple-benefit agenda: better health, increased crop yields and food security, and near-term climate protection,” said Helena Molin Valdes, Head of the CCAC Secretariat. “Black carbon, methane, tropospheric ozone and hydrofluorocarbons (HFCs) are having an impact in all these fields, and we can have quick gains if we act now. And the solutions are all available-this is what the partners in the Coalition are focusing on.” “This year we will focus to a great degree on the health aspects of air quality and short-lived
climate pollutants, together with our partner the World Health Organization, and, increasingly, with the agriculture sector,” she added. “We have some very able partners to count on. As one of our founding ministers put it, ‘We are a Coalition of the Working.’ Anyone who is willing to act in that spirit is welcome to join us.” The coalition has gained momentum swiftly: 36 countries and 44 institutions and organizations are now lending their weight to tackling the issue, and a $50 million Trust Fund has been created to support and conduct emissions reduction work. Concrete actions range from working with more than 30 cities to assess the growing problem of methane and black carbon emissions from municipal landfills to promoting more stringent vehicle emissions standards, with initial successes in Asia and Latin America. “The Climate and Clean Air Coalition is a remarkable process of bringing science to policy, focusing on the multiple benefits of action, and creating initiatives that invite voluntary partnerships,” said UN Under-Secretary General and UNEP Executive Director Achim Steiner. “I hope that as policymakers and actors across the world look at the success story of the Climate and Clean Air Coalition, they will find
the courage and optimism that we are indeed able to take science, turn it into policy recommendations, and form coalitions that are willing and able to act.” Other accomplishments of the CCAC over the last two years include: Ten transformative initiatives, including work to reduce shortlived climate pollutants in municipal solid waste, oil and gas, diesel engines, brick production, HFCs, cookstoves and agriculture, with additional progress in finance, regional SLCP assessments and national planning; Giving grants to entrepreneurs to develop cleaner cook stoves, for which capital investments are lower than for other black carbon-reduction measures; Showcasing alternative technologies to replace high-global-warming-potential HFCs; Gathering oil and gas companies under the umbrella of the CCAC Oil and Gas Methane Partnership, to be launched officially in 2014; Making tools available to national governments to assess the benefits of emission reductions and national planning; Conducting the first region-wide review of short-lived climate pollutants in Latin America; Beginning a public health campaign with the World Health Organization to make clear the connection between pollution and health. More
than six million people die each year from indoor and outdoor air pollution, and many more are affected by non-communicable diseases from pollution; and Helping to shape the policies and investment portfolios of the World Bank and other development banks. CCAC partners welcomed the work of the coalition, and called on others to join and increase the momentum of a movement that offers much promise in protecting human health and mitigating climate change. “In the past two years the CCAC has grown into an action-oriented coalition, and I am pleased that so many countries and organizations have joined efforts with the coalition”, said Wilma Mansveld, Minister of Infrastructure and Environment for the Netherlands, one of CCAC’s partner countries. “In addressing shortlived climate pollutants, the CCAC has a lot to offer to the climate, health and food productivity,” she added. “In our view, governments, industry, NGOs and citizens must all be part of the solution. I am enthusiastic about the cooperation of countries and institutions in concrete initiatives, complementary to our efforts under the climate regime. Raps filed against smugglers of wildlife from Indonesia

ARITIME police authorities in General Santos City filed charges on Monday for illegal transport of wildlife against five persons who allegedly tried to smuggle to this city over the weekend some 79 exotic birds and animals from Indonesia. Chief Insp. Jemifer Gamido, chief of the 1201st maritime police station, identified the suspects as Leonilo and Leonel Lumokso, Uswaldo Mamasanta, Benson Karil and Alvin Alihan, all residents of Barangay Calumpang here. He said they arrested the suspects after intercepting a wildlife shipment early Saturday aboard a motorized banca that reportedly originated from North Sulawesi province in Indonesia off the coasts of Glan town in Sarangani. Gamido said they found inside the motorboat a number of cages containing assorted wildlife species, including cockatoos, echidnas and wallabies. “We earlier received a tip that a shipment of exotic wildlife is on its way to this city so we immediately conducted patrols in portions of the Sarangani Bay to intercept them,” he said. The official said their initial investigation showed that the suspects were scheduled to deliver the exotic birds and animals this week to an un-
identified buyer based in the city. He said they received information that the suspects are also in contact with some buyers in various areas outside the city. Gamido said they immediately turned over the seized wildlife to the Wildlife Protection Conservation Center of the Department of Environment and Natural Resources (DENR) in Region 12 for proper handling. Ali Hadjinasser, chief of the DENR-12’s protected areas and wildlife division, said the illegal wildlife shipment included species that are considered critically-endangered by the International Union for the Conservation of Nature. He said the shipment specifically comprised 31 rainbow lorikeets, 24 dusky lories, five green lizards, four live and two dead sugar gliders, three Indonesian snakes, three pesquet’s parrots, two red-necked wallabies, two white cockatoos, two palm cockatoos and one long-beaked echidna. Hadjinasser said the seized wildlife species are currently being quarantined at the Wildlife Protection Conservation Center here. “Right now, we’re considering repatriating or returning these birds and animals back to their origin in Indonesia or turn them over to our rescue centers,” he said. AVAO City Mayor Rodrigo R. Duterte has issued yet another executive order, this time one that is aimed at regulating the sale of second hand or surplus vehicles in the city. Duterte signed Executive Order No. 14 of 2014, “An Order Directing All Importers, Distributors, Sellers and Agents of Sellers of Second Hand And or Surplus Vehicles within the Territory of Davao City to Strictly Comply with and Adhere to, the Provisions Of RA 6539 (An Act Preventing and Penalizing Carnapping), PD 1612 (Anti-Fencing) and Other Pertinent Laws on the Matter and Imposing Administrative Sanctions Against Violators.” The EO was issued due to numerous complaints reaching the mayor’s office that there has been a proliferation in the sale of stolen vehicles, including those with dubious registration documents, by unscrupulous establishments dealing in second hand motor vehicles in the city. The remaining provisions are quite clear about the EO’s other reasons for being. “This illegal activity should be suppressed, because

it undermines the flourishing local trade and economic boom brought about by the sound and effective fiscal incentives and policies of the local government,” the EO stated. It may be said that Mayor Rody’s executive order will further strengthens the enforcement of existing national laws earlier mentioned. This should be welcome development to national agencies whose enforcers, for whatever reasons, are unable to perform their tasks of imposing laws satisfactorily. This new EO will directly affect those in the business of dealing in second-hand cars in Davao City and is expected to lessen the chances of the city being made a haven for dealers of stolen vehicles. If strictly implemented, this would be another positive step in Mayor Rody’s passion, if not obsession, of achieving law and order at least on his turf. Indeed, the city mayor ought to be supported by all Dabawenyos who desire to live in a community enjoying the benefits of law and order.

A new good reason for coming to Davao ?
IGHT MARKETS in all its forms, whether you like it or not, will always be with us, anywhere you are. All the jobless out there with no wages to look forward to, if they have the mind to survive, will find a way to earn money. Although as a pedestrian, I know my right to use those cemented sidewalks along San Pedro street and Magsaysay street near NCCC, I won’t mind walking on the street alongside those jeepneys and multicabs even at the risk of being bumped by these vehicles. Perhaps like other pedestrians, I really don’t mind the risk and the inconvenience of losing the sidewalk to vendors who have no better place to go to display their variety of things to sell that are much cheaper than the established stores and shopping malls whose airconditioned “ambiance” is probably the only reason why their prices are much higher than the ones you find from sidewalk vendors. To most pedestrians like me, it was such a pleasant surprise that city officials here finally got the political will to come up with a local ordinance to force all sidewalk vendors all over the city— most specially those at San Pedro and Sta Ana--- to occupy only one-fourth of the sidewalk to display their wares, thus

giving back to pedestrians the threefourth walking space on the sidewalk they rightfully deserve. From the looks of it, this Davao ordinance seems to be working well since I could feel the wider space on all the sidewalks along Sta Ana district leading to the NCCC shopping mall. If there are people who should be congratulated for this wider space for pedestrians, it’s not so much those implementing this local law, but the sidewalk vendors who are voluntarily obeying this law and respecting the rights of pedestrians to walk freely on the sidewalks, making sure that no obstacles are blocking the way. If the sidewalk vendors felt shortchanged by this “one-third, two-thirds” law on our city streets, the recently opened “Night Market” along Roxas Avenue was one good idea that should have been done a long time ago. With all the “ukay-ukay” flooding this city, along with
the proliferation of so many kinds of food stalls selling things to eat ---like ice buko, kwek-kwek eggs, fried chicken intestines, lechon manok, fruit shakes, fresh pineapple, etc--- it was just right that someone thought of putting all these vendors together in one place to sell at nighttime. Regular ukay-ukay hunters and scavengers amongst us, may not like to admit it, but they tend to find the best shirts, the best pants, the best shorts, the best shoes, best bags, etc, ---all high-quality imported brands--- at ukay-ukay stores at Lizada street at Chinatown in Sta Ana district. Whether they were smuggled or imported legally, doesn’t really matter to people who buy them, as long as they’re unbelievably dirt-cheap. Can you ever imagine finding a P1,200 long sleeved executive shirt with an Italian label costing only P20 because no one is buying it at the ukay-ukay ? Or an imported P4,500 French bag with a Christian Dior brand costing only P200 at the ukay-ukay ? So, don’t be surprised to know that the “Night Market” here in Davao has started to become one of the city’s attractions that local and foreign visitors coming to this southern city are making it one of their special reasons for coming here. thority – and to no one else. And this is the reason people probably recognize the concern about the rising threat of nepotism and cronyism that eventually lead to widespread corruption. There is also an urgency of involving both the elderly and the young among our countrymen to assert their rights and constitutional duty. In a word, it is an agenda serious and determine in its intent and wide-ranging in its concept. People have to work on it to divulge corruption in its worst form. Today’s question therefore is no longer whether people should cooperate and unite with one another but how far cooperation and unity among them should go. This lack of public accountability is made worse by the way high-level officials are chosen and the way voters elect political leaders. Most of our government managers come from the backgrounds in big businesses or the elite professions. They are educated in a small number of elite schools. Like the reputation of the old Chinese empire, they are socially distant from the masses of our people. And, naturally, they tend to serve and protect not the masses of their countrymen but their own kind. The same goes true with elective officials. They don’t want to give up their prerogatives, perks and absolute power despite being embroiled in enormous financial scandals. They will cling on to power for dear life like hungry leeches. This kind of elitist rule and the voters’ method of electing people who cannot give good gov-
ernment promote the needs and wants of the vast minority over the broad and larger complicated concerns of the larger society. Interest-groups like the professionals, academe, farmers, workers and student groups not to mention militant and left-leaning organizations have no other resort except mass protest action which oftentimes ended up in trouble with authorities to express their grievances and demands. Clearly, government must find a mechanism to institutionalize and civilize these often violent and destructive schemes for expressing sectoral gripes and requests. There is much to be said for the constitutional wisdom that reminds us the Constitution seems to recognize the need when it prescribes that Congress should respect the role of independent people’s organizations and the rights of these groups to effective and reasonable participation at all levels of social, political and economic decision-making. While officials notably legislators do hold every now and then “consultations with the people,” these conferences actually are more form than substance. Unless people’s organizations are on the verge of disrupting the social order, public officials elective or otherwise pay them no attention. The P10 billion pork barrel fund scam proved to be a test case for the Aquino administration. One answer to this problem of imposing public accountability on both elective and appointive officials lies in the setting up of, say, people’s commission or oversight committee appointed by the President which can act like directors of government departments – setting policies, performance target and operating guidelines. Most importantly, it can review and monitor budgetary requirements of every departments to avoid misuse and abuse of funds thereby eliminating corruption.
Larger complicated concerns
ANDID SPURT – Everywhere in the world the problem of government under any administration is always to deliver at the grassroots, to the countryside. To drive their point political observers and detractors alleged that the Aquino leadership has been unresponsive and has not delivered on that level. Persistent critics likewise noted that the present dispensation’s policies and regulations failed to change the country’s political, economic and societal concerns. The transformation of the socio-economic landscape of our ailing and blighted country from a sickly to healthy economy; from a weak to vigorous society is all hype and hyperbole. MORE FORM THAN SUBSTANCE– Having recently experienced political disorder sparked by the multi-billion pork barrel fund controversy and other equally high-level financial scandals I suppose the Aquino administration really cannot afford to institute meaningful reforms while the country is under such a tumultuous situation. Non-ending probes and senseless debates are leading us nowhere. Political infighting is not the best strategy for long-term development. Reform no matter how arduous must be a continuing; an endless process. It must constantly present a spectrum of the people’s interests to the urgent attention of government. The Constitution as many of our people know defines public office as a public trust and demands that officials be accountable, at all times, to the people. But this idealist concept seldom materializes in real life – a glaring example is the pork barrel fund scandal enmeshing some members of Congress. The way people look at it there are no fangs to this constitutional provision. Furthermore, Cabinet secretaries and other high officials appointed by the President owe allegiance only to the appointing au-

The case against a Chinese financial crisis COMMENTARY BY ANATOLE KALETSKY

SEVERE slowdown in China is viewed as among the greatest risks facing the world economy this year, and the recent dismal news on Chinese manufacturing output exacerbated these fears. But the really important news from Beijing pointed in the opposite direction: Bank lending in China, instead of slowing dramatically as many economists had expected, accelerated in January to its fastest growth in four years. This means China is unlikely to act as a brake on the global economy in the months ahead — despite the recent weak manufacturing figures. It also suggests that predictions of a credit crunch or financial crisis in China will likely prove wrong — or at least premature. To welcome stronger bank lending in China is not to deny that credit growing at double the gross domestic product growth is unsustainable and will ultimately have to be curbed. The Chinese authorities themselves clearly believe this. The government and the central bank want to reduce credit growth and to replace the unregulated, opaque “shadow lending” system with properly supervised, well-capitalized modern banks. The government has two other economic objectives, however, that it sees as equally or more important. The three priorities were clearly set out at the Communist Party Third Plenum last November. First, the Chinese economy must be restructured away from over-dependence on infrastructure investment and exports, toward private businesses that increase the quantity and quality of consumer goods and services. The second priority — though many observers would argue that this is the overriding objective — is to ensure that restructuring occurs in an orderly manner, without risking a severe slowdown that might threaten the Communist Party’s monopoly of power. In practice, the government has quantified this objective in “target” of 7.5 percent GDP growth. China’s third major economic objective is reforming financing and restraining excessive credit growth. The problem, which Chinese leaders and economists were long reluctant to acknowledge, is what happens if these three objectives clash. What if restraining credit growth causes a severe economic slowdown? Or if clamping down on shadow banking starves private enterprises of the working capital for growth? Or if aggressive industrial restructuring becomes incompatible with financial stability? In the past few months, the answers to such questions have become clearer. While Chinese leadership remain genuinely committed to all three major economic objectives — industrial restructuring, economic stability and financial reform — they now acknowledge that progress may not be possible simultaneously on all three fronts. Policy will therefore have to be prioritized. And the financial reform objective is proving a less important priority than industrial restructuring and maintaining an acceptable rate of growth. Whenever possible, China will likely try to move ahead on all three objectives. But if there is a serious conflict, maintaining an adequate growth rate will trump credit restraint and financial reform. This is a sensible ordering of priorities — both for China and for the world economy still desperately short of growth. Yet even if China is determined to keep its economy expanding and avoid a credit crunch, is it capable of doing this?

Carpio issued an order to release the seized shipments on Dec. 12, 2013 after Ngo filed a petition against the BOC. Ngo alleged having an agreement with Starcraft International Trading for the rice shipment. The local BOC told EDGE Davao in a telephone interview that they could not comment yet on the SC decision while their office waits for a copy of the TRO issued by the higher court. In an earlier report, Port of Davao still has 85 container vans on hold awaiting the decision of the court on the motion for clarification filed on the Writ of Preliminary Injunction issued by the Court.
The BOC also has 100 containers under warrant of seizure and detention issued by the District Collector Aradanas. The port also has other items which were recently issued notice of abandonment by the new district collector. During the hearing of the Senate committee on agriculture last Feb. 3, senator Cynthia Villar, chairperson of the committee, found out that Ngo is connected with the alleged rice smuggler Davidson Tan Bangayan. Villar uncovered it when she asked about Bangayan’s connection with a certain Julius Mangupag and Bangayan confirmed that the latter is his nominee director of some of his companies. Filipinos not being targeted in Malaysia-- Ambassador P
HILIPPINE Ambassador to Malaysia Edgardo Malaya said Filipinos are not being targeted here as the Malaysian government carries out a crackdown on illegal immigrants. Although there are crackdowns happening here in Malaysia not only in areas with high concentration of Filipinos like Sabah, Malaya said, other nationalities who entered the country illegally are being rounded up. At the same time, Malaya said in an interview Monday with Radio TV Malacanang that there is no truth to reports say-
ing there were 100,000 Filipinos deported from Malaysia. He said that while there are deportations, it’s only around 500 Filipinos being sent home. They are part of a regular deportation process happening here for the past few months, he explained. Malaya also said that while there are illegal Filipino immigrants in peninsular Malaysia, their number is not significant. He also advised Filipinos here to avoid areas being frequented by illegal immigrants to avoid being detained by authorities. Malaya also asked
them to always bring their passports, work permits and other documents that will prove the legality of their stay in Malaysia. There are around 90,000 Filipinos working or staying in peninsular Malaysia, Malaya said. In Sabah, where there’s a large number of concentration of Filipinos, Malaya admitted that quite a number of Filipinos enter the territory illegally, especially the new entrants. Indonesians, not only Filipinos, are being rounded up by Malaysian authorities, he said. But he also made an
assurance that the Philippine government is doing enough to service them by sending consular personnel regularly. The consular team, composed of around seven members, stays in Sabah for a week or two to provide services to Filipinos, he said. Art and about Dadai Joaquin ART imitates life and every painting tells a story. It conveys a narrative - any event that happened in time or in a dream — in just one, static image. In between success, controversies and tragedies, we find comfort in any work of art --- whether it reminds us of a happy memory or a defining moment wherein we surfaced with a braver heart and a soothed soul. Over the last few years, the works of Lovella “Dadai” Joaquin, Davao-based mother and homemaker, has captured the hearts and attention of many. Self-taught and sustained by passion, her talent in art became a means of communicating life as she sees it. She is someone who we can call a modern and female version of Fernando Amorsolo. Several notable individuals in the society see Dadai’s works as depictions of the simplicity of life sans the comforts of technology and luxury. Quoting Mr. Noel Saavedra, a busy Manila-based consultant for special projects for the Dr A.B. Moñozca Foundation and Parmon Group and a part-time project manager at IBM, “Dadai’s pieces are a refreshing reminder of how we can still be happy in spite of the mediocrity around us.” How do artists create a story that provides a message or provokes emotions in that single frame? “I’m an impressionist and

According to the New York Times, Morgan said last week he and CNN president Jeff Zucker had discussed Piers Morgan Live’s failure to connect to the network’s audience and had decided to cancel it, more than likely in March. For me, the hardest part is simply preparing canvas. Stretching a canvas takes a lot of work. The painting part itself is the most fun and exciting.” “Discipline is integral to my work. Like I said, I don’t wait for inspiration. If you’re a working artist, it’s something you do every day. I was inspired by the artist Malang who told me that he would wake up every day at 4 am to paint. It’s a discipline. Then he would have his daily devotions and talk to people.” “I discipline myself to work daily. I consider it work and not a hobby, so I don’t wait for inspiration. I work at home, specifically in our kitchen. We live in a small apartment and I have to make do with what space is available. I literally paint where our lives move around as a family. FTER a long wait, Floyd Mayweather has finally named his next opponent. Mayweather tweeted a selfie while saying that he will fight Marcos Maidana of Argentina on May 3 (May 4, PHL time). Weeks ago, Mayweather started a poll to ask the fans to vote for his next opponent. British fighter Amir Khan won the poll but it proved to be nothing else but a marketing ploy as Mayweather selected the puncher from Argentina who’s fresh off a win against Adrien Broner. The fight will be a unification for Mayweather’s WBC title and Maidana’s WBA belt. Mayweather, whose record stands at 46 wins without a loss or a draw, will be fighting after seven months of inactivity. He last defeated Saul Alvarez by majority decision. Maidana on the other hand defeated Broner via unanimous decision last December. Back in December, Khan announced that he already signed a contract to fight Mayweather and that he was only waiting for the undefeated American to sign his part of the contract. ENERAL SANTOS - The Bureau of Internal Revenue in region had given recognition to boxing legend and Sarangani Rep. Manny Pacquiao as one of the district’s 2012 top taxpayers in individual category - both income and value added tax. The recognition was bestowed during the kickoff ceremony of the BIR’s tax campaign held at Phela Grande convention center here. “I thanked the BIR for such recognition. Even without this, we do pay our taxes religiously because that is part of our duty as citizen of this country,” Pacquiao told reporters here. Shortly after his fight in November last year, Pacquiao got embroiled in controversy when the BIR ordered a freeze on all of his banks accounts pending settlement of his tax dues. Pacquiao, however, maintained that he is not remiss
in paying his tax obligations with the government. The controversy was further hyped when news about his tax woes with the United States’ Internal Revenue Service (IRS) came out. In December, Pacquiao and BIR commissioner Kim Henares met through the intercession of President Aquino. BIR heeded the appeal of Pacquiao to lift the freeze order on all his bank accounts. Just last month, Pacquiao paid P32 million in VAT alone with the BIR. The boxing icon claimed his lawyers are now ironing out his tax problems both here and in the US. “As a couple with clear intention, we did not allow them to divert our attention from our compelling vision. We are here to serve the people with utmost dignity and integrity,” Pacquiao stated in his speech. According to Pacquiao, they viewed the tax contro-
versy as part of life’s trials and challenges. In one of his readings, Pacquiao said, he came across an online article on tax fairness which outlined 10 big reasons to feel good about paying taxes. “One of which is: Taxes put out fires, keep our streets safe, provide our children with education, provide our families with health care, ensure our food and water are safe, create legal safeguards for businesses and employees, provide parks - in other words, taxes provide us benefits every hour of the day, every day of the year,” Pacquiao said, quoting an excerpt of such article. He noted that some people are not serious in paying taxes due to corruption in government. He assured the BIR he and his wife, Jinkee, will continue paying their taxes religiously. “As for me and my wife,
we have made a decision. We have a biblical mandate to do what is right. When Jesus was asked whether it is right to pay taxes, he responded saying give to Cesar what is due to Cesar and give God what is his,” he said. He urged the public, above all the businessmen, to pay correct taxes to the BIR. As for him, giving what is due to BIR is giving what is due to our country. “When we give what is due to our country, that is glorifying God. That is an honorable thing to do,” he said.
