Amendment made to Correct Error relating to Biomethane On 4 March 2015, a new Amendment was enacted into Regulation 2015 to address the confusion in biomethane calculations under the Renewable Heat Incentive Scheme.
Background to the Renewable Heat Incentive Scheme (RHI) The Renewable Heat Incentive Scheme (RHI) was introduced through the Energy Act of 2008, and in the first phase starting in November 2011, owners of non-domestic buildings became eligible for cash payments when they install renewable heat generating equipment. The incentives for commercial buildings depend on the scale of energy generation and the payment could be up to 10p/kWh for hot water and up to 8.7p/kWh for heat. Eligible technologies include solar thermal (hot water) panels, ground source heat pumps, water-source heat pumps, biomass boilers, and biomethane.
Amendment (No.2) Regulations 2015 The Amendment came into force on 4 March 2015, and it aims to correct a technical error in regulation 42 of the Renewable Heat Incentive Scheme Regulation 2011. The correction concerns what input to disregard in composing the total amount of the eligible biomethane by which commercial sites with renewable energy generation could claim cash payment. The confusion regarding the calculation mechanism previously illustrated should be overcome at this point and it will apply to the biomethane plants currently in the process of obtaining non-domestic RHI accreditation.

Other notable Amendments: The Renewable Heat Incentive (Amendment) Regulations 2015 (S.I. 2015/197) introduced apportioning to CHP to add additional flexibility, as well as simplification to the requirements of underground piping and manufacturer’s instructions. Changes also clarified when Ofgem can apply sanctions. The Renewable Heat Incentive (Amendment) Regulations 2015 and introduced Biomass sustainability criteria, including setting up of a Biomass Suppliers List.
Next Steps: Commercial building owners need to consider new calculation mechanism Commercial building owners who are seeking accreditation or currently reporting their biomethane generation for cash payment shall be aware of the new calculations now in effect according to the latest regulation.

List of Environmental Legislative Proposals Withdrawn from European Commission On 7 March 2015, some key environmental proposals were withdrawn from a draft Directive aimed at amending six waste directives, including the Waste Framework Directive 2008. The Commission expressed intentions to replace the draft Directive with a more comprehensive and ambitious package to address the circular economy later on in 2015.
Withdrawn Proposals: • Waste: the draft Directive formed a part of the Commission’s wider package measures encourage a circular economy adopted in 2014. • Chemicals: proposals addressed the classification, packaging and labelling of dangerous preparations. • Water: establishment of a fund for the compensation of oil pollution damage in European waters and related measures.
