On the 14th of January, the parliamentary Secretary announced the launch of a white paper aiming to introduce the regulation of estate agents. During the press conference an astounding number of people were present, which goes to show how many people this

regulation will directly affect, the agencies, the agents and all the full time employees who form part of the industry. Real Estate can be regarded by some as business which does not require much education but this is very much the contrary. Real Estate agents must be dynamic, outgoing professional individuals with extensive knowledge about property law, bank loans, and construction costs, and so on. Agents are critical to the real estate transaction process. The list sellers’ homes, show homes to buyers and negotiate on behalf of their clients. They advise clients on market conditions, property and location information. They have a responsibility to their clients to always act in their clients’ best interest. Regulating the Real Estate Industry On the 14th of January 2016, Parliamentary Secretary, Hon. Jose Herrera announced the launch of a White Paper aiming to introduce in Malta its first legal framework for the regulation of estate agencies, agents and property managers. The implementation of such framework is a direct reaction to the lack of supervision, recognition and regulation of a flourishing profession which evidently carries a considerable degree of responsibility. This proposal is not only evidence of the Maltese Government's awareness to the interests of consumers, but through an authoritative regime of administration it also aims to reinstill the public’s confidence in the exercise of estate agency work. Addressing the shortcomings found in the industry today, the White Paper proposes several monumental changes in the local real estate business, among which is the set-up of an Act to regulate
real estate agencies, agents, and other entities carrying out a similar business. Through its enactment, the Act will not only give this profession legislative recognition, but also establish an authority responsible for the supervision of estate agencies and other related entities. Aside from being the administrator for the licensing of all such agents and agencies, it is also vested with an investigatory role in the acts of misconduct from licensees and may initiate proceedings in such respect. Malta may finally also be able to count itself as one of several other European Union member States to implement specific educational requirements which an estate agent must satisfy in order to be licenced by the said authority, and thus warranted to perform such work. The course material will range from law to business management and economics, providing agents operating in Malta with the necessary tools to
perform a higher quality and standard of work fit for such profession. Furthermore, aside from being subject to training and licencing, the White Paper also introduces rules of conduct which every estate agent is obliged to respect in the exercise of his work. This code crystallises the values, standards, and principles which the agent himself must embody in order to ensure fair and responsible trade involved in the transfer of property. The proposals laid out in the White Paper shall undoubtedly inspire the consumers' faith in the capacity and ability of estate agents operating in Malta as qualified professionals, whilst also giving this business the relevance it is deservedly due.
