THE CREAM OF THE CROP I never thought a cream could change my skin. Shedding light on counterfeit beauty By Kelli Russell Knockoff. Fake. Bootleg. Counterfeit. There is a part of the economy that thrives on products that look like the real thing, but are in fact fake or unauthorized versions. Counterfeit products are thought to exist only in dark alleys or on urban streets. However, with the rise in popularity of designer brands and the accessibility of the internet, the counterfeit economy is becoming part of the mainstream. Every industry has been affected by counterfeits, from entertainment, to the worlds of fashion, technology, automotive parts and 8 | Skin. The Epionce Magazine
even food. The dark side of counterfeit goods can be greater than corporations losing a little money. Counterfeit products can affect the consumer in a big way.
What is a knockoff?
Clues may be subtle, or quite obvious. Perhaps the product looks real, but the “normal” packaging is torn or the bottle is dented. The product’s logo is similar to the designer brand, but the name is slightly tweaked. The item is sold through an e-retailer, not the company’s web site or approved online channels. These are
The sale of counterfeit items sold throughout the world totals about $250 billion per year.1 In the United States, top counterfeit products include clothing, computers and personal care items. At the top of the list are wallets and purses, popular for many years on the streets of large metropolitan cities. Even food has been the subject of counterfeiting. Everything from jars of honey, ground coffee and spices has had their versions of knockoffs. Often, the ingredient list looks different than what the package might claim.2 Some items are sold on the “gray market”, an unauthorized way to buy and sell products. Another angle of this market is referred to as diverting—the act of selling an authentic product in an unauthorized channel. In the United States, there is currently no law against this trade, but it has companies scrambling to shut down unauthorized merchants and alert consumers of the shifty practice. The skin care industry is one example affected by diversion and counterfeit products. The line might be sold exclusively on a brand’s web site or through brick and mortar locations, but ends up on an unauthorized e-retailer at a deep
discount. These sellers may not allow returns, and the quality, authenticity and safety cannot be guaranteed. Several professional, salon-only hair care lines are found on grocery store shelves. These are sometimes purchased from private businesses that are liquidating inventory, often with middle men involved in the transaction.3 Recently, a major American hair care line launched a campaign to put the spotlight on counterfeit and diverted products bearing their brand and sold in unauthorized locations. The goal was to raise awareness about the controversial business practice so consumers could recognize counterfeits or diverted products.4 Discounted prices and more availability make it tempting for consumers to purchase, but buyer beware.

A Bad Deal
Consumers should consider the risks when purchasing diverted or counterfeit product so they don’t get scammed, or worse – purchase something hazardous to their health. For the customer, the draw of counterfeit items typically comes down to cost. Getting a discount on popular brands or a similar-looking version can be worth a gamble in hopes of finding a good buy. A handbag or technology device doesn’t usually pose a threat to consumers, but are often made with lower-quality material than a genuine article. For example, stitching and material may fall apart faster than an authentic version of the accessory. In 2013, the United States Federal Bureau of Investigation (FBI) raided the warehouse of a business selling auto parts to New York City cab drivers. Cab companies were paying much-higher prices for generic parts labeled as originals from the vehicle’s manufacturer. The parts were not faulty or dangerous, according to the FBI. However, higher cost for less quality trickled down to the cab companies and their customers.5 Some products do pose health risks. On the list of top counterfeits are personal care items– including pharmaceuticals. The food industry has also 10 | Skin. The Epionce Magazine
been charged with counterfeiting. In China, thousands of sick babies – including some fatally ill—led to the admission by the manufacturer that it used an ingredient that makes plastics as filler for a batch of powdered infant formula.6 The beauty industry is certainly not immune to shady practices. When sold to third-party or unauthorized distributors, the beauty consumer cannot know if a jar or bottle was opened and contaminated. They could even experience reactions if the contents have gone rancid. Often there is no return policy or guarantee of efficacy, or safety. The consumer is left with the short-end of the stick. Companies are also concerned that purchasing fake products encourages dishonest business practices. While it’s not illegal for grocery stores to sell a product like salon-only hair care, it can be against the manufacturer’s sales policy. Small businesses can be affected when goods are sold at a deep discount through unauthorized retailers and channels. When one business sells the same product at half the cost on a web site or nearby grocery store, sales at other nearby businesses may suffer due to the unfair pricing.

Shoppers should be cautious when purchasing merchandise sold outside of a product’s normal channel. If a line is professional-only or sold exclusively in medical offices, but is found elsewhere, this could possibly be a red flag that it is counterfeit or diverted. A little research can go a long way. If consumers are still unsure, they can usually contact the manufacturer directly. Ask if the web site or store is a legitimate merchant, and where to shop to get an authentic product.
