EECBG Background and Purpose • • • • • • • •

Established by the American Recovery and Reinvestment Act 2009 For Non-Formula Cities and Counties – Administered through the State Energy Offices Reduce Fossil Fuel Emissions Improve Energy Efficiency Promote Sustainability Creation and Retention of Jobs Funds must be obligated by States within 18 months Funds must expended by September 2012

National Environmental Policy Act (NEPA) • Activities 1-3, 5-10 have been categorically excluded (CX) From further NEPA review (Environmental Questionnaire still required). • *For categorical exclusion, eligible activity #4 is limited to: insulation, lighting, HVAC, shower and faucet upgrades, weather sealing, ENERGY STAR appliances, replacement of windows and doors.


Davis-Bacon Act • • • • •

Applies to all laborers and mechanics on federally funded projects over $2000. NO EXCEPTIONS. Wages and fringe benefits must be at or above local levels for projects of similar character Local prevailing wages are determined by the U.S. Secretary of Labor To be monitored by City or County EECBG award recipients. “Buy American” Clause • • • •

Applies to all construction, maintenance, repair or alteration of public buildings or public works funded by ARRA. Requires that iron, steel and manufactured goods must be produced in the United States Award recipients must monitor contracts for compliance. Exceptions: (must be approved) – Unreasonable cost of domestic good (25% differential) – Item not available domestically or quality/quantity required not available – To waive this requirement would be in the public interest Addendum to RFP on OER website

Selection Process 1. Associations and OER review applications for completion and accuracy 2. Selection Committee members review and force rank projects individually 3. Selection Committee convenes and comes to agreement on force ranking 4. OER certifies the selection process 5. Official notification, award offer (based on available funds) 6. OER negotiates contracts, posts award info on web 7. Contracts signed


Method of Payment • Advance payments will not be made • Payments will be made by reimbursement only – Regular progress intervals – Form W-9 required – Payment made within 21 business days – Payment deposited electronically – Form 1099 sent to recipient at year end


Reporting Requirements • • •

All grant recipients are required to meet reporting obligations to avoid suspension or termination of funding Reports must be submitted monthly, quarterly, annually, and as required Reports include, but are not limited to, the following: – Financial reports – AARA performance progress report – Property certification – Special status report (as required) Reporting format and tools to be developed by DOE
