Hi all,

Oh my word .. it is APRIL ! someone stop the clock ! Hope everyone is well this month and enjoying the long weekends and school holidays. We really do love hearing from you and it is great getting such nice responses from the residents - Keep it coming ! We have alot of interesting residents in Seaward - both of the animal and human kind. This month we feature a few interesting stories, local news, local business, and even some local fury friends, all i’m pleased to say Seaward Residents. Lee Ann version II has settled in well and is already in the saddle at full gallop, she has managed to pick up extremely fast and is already being an asset to the Association. Lee Ann version I is happily ensconced in the land down under and says she is enjoying the new life. It is unfortunately a time to be a bit negative – my apology in advance. We are experiencing a small cash flow problem as levies and billings are not being paid as quickly as they should, in order to address this we have been instructed to take the following steps for any debtor who is more than 60 days outstanding: 1. Withhold the services of plan signing, levy clearances, occupation clearances and the associated administrative functions; 2. To withhold access rights to any contractors or workmen intending to work at the unit owned by the Debtor. 3. Disable the visitor intercom facilities and withhold the issue of visitors coins; 4. Our Collections Attorney has been instructed to immediately commence legal action and where a person falls in arrears on more than two occasions to immediately commence action against them after 30 days. Please ensure your account is up to date in order to avoid us having to implement the above. Some fairly major strides have taken place and SIZA water have agreed to start taking over the backbone reticulation in the Estate. It will unfortunately be sometime before they reach the point of taking over the Sub Development reticulations so unfortunately many of you will still be billed by the Association. The take over of the sub developments is the responsibility of the sub developer many of whom have been dragging their heels somewhat! We have been informed by Dolphin Coast Waste Management that the collection of garden refuse has been changed from a Tuesday to a Wednesday. Please DO NOT put out garden refuse on any day other than the official collection day. As the Aesthetics Committee has received complaints about garden refuse, we have instructed the garden services which carries out our non compliance cutting to do a drive through of the Estate and to collect garden refuse left out on any day other than a Wednesday. The errant owners will be charged R50.00 a bag for this service, the charge will be debited to the levy account – once again please assist us in this regard, we do not enjoy charging people more than we have to. That’s enough negativity for now……..

Leanne lives in the residential part of Seaward Estate with her

two daughters Chanique (16 years) and Nikita (3 ½ years) and her husband Marcris who is involved with IPSS. The family relocated from Johannesburg to Ballito in November 2006 to escape the rate race, although Leanne admits that she has actually been busier than ever since moving here. Leanne has always had a passion for making jewellery and when she arrived in Ballito she decided to turn this hobby into a business. Her shop Beaded Pink opened on spring day 1st September 2007 and is located in the Balvista Centre. Beaded Pink does not only stock beads but some truly different items such as imported Romanian pendants and beaded bra straps. Leanne says that she is the only person she knows who does these unique straps. They are made to fit the individual, are very reasonably priced and look fabulous under a strappy top or even a strapless number! Leanne also designs and makes pieces of jewellery for gifts, does jewellery repairs and stocks ready made jewellery. Another aspect of Beaded Pink is the beading workshops that Leanne offers. Ladies can choose between a morning, afternoon or evening workshop and are welcome to bring their own snacks and drinks along. THE SEMHOA RULES SALES and LETTING LEGAL ________________________________ Title Deed provisions The Title Deed in respect of every property registered within Seaward states has the following restrictive clause: (b) Home Owners Association Neither the lot, nor any further subdivision, nor any unit thereon, as defined in the Sectional Titles Act, No. 95 of 1986, shall be transferred to any person until he has bound himself to become and remain a member of the “Seaward Master Home Owners Association” for the duration of his ownership The clause goes on to give the Association the ability to with withhold a clearance certificate necessary for a registration to be effected, where it believes that the requirements of membership have NOT be fully met. and a clearance certificate has been issued by such association to the effect that its articles of association have been complied with. In addition to this the following clause empowers the Trustees to make rules and apply conditions and makes compliance of them obligatory. (c) General Right of Access The owner of the lot, any further subdivision, or any unit thereon shall have a general right of access over Erf 1823 Ballitoville subject to whatever rules, conditions and restrictions as are laid down from time to time by the “Seaward Master Home Owners Association” for the purpose of ensuring proper control and administration of the use and enjoyment thereof.” Constitutional provisions of ownership The constitution of the Association

is binding on every registered owner who automatically becomes a member of the Association on registration of a property within Seaward Estates, it is essential that every owner or prospective owner is aware of the contents of the Constitution. 5.4 When a member becomes the registered owner of an erf he shall ipso facto become a member of the association and when he ceases to be the owner of an erf, he shall ipso facto cease to be a member of the association. Many owners are under the mistaken impression that it is the duty of a property negotiator to inform prospective buyers or persons renting of the Constitution and rules, clause 5.5. of the Constitution clearly states; 5.5 No member shall let or otherwise part with occupation of his erf whether temporarily or otherwise, unless he has agreed with a proposed occupier of such erf as a stipulatio alteri in favour of the association that such occupier shall be bound by all the terms and conditions hereof. 5.6 A registered owner of any erf may not resign as a member of the association. Clause 5.7 clearly lays reinforces the obligations of owners. 5.7 All the rights and obligations of a member shall not be transferable and every member shall:5.7.1 further to the best of his ability the objects and interests of the association; 5.7.2 observe all rules made by the association or the trustees; provided that nothing contained in this constitution shall prevent a member from ceding his rights in terms of this constitution as security to the mortgage of that member’s erf. 1.

Property Sales

1.1. It shall be incumbent upon the owner of any property wishing to sell such property to advise the Association in writing through the Estate


Management that it is their intention to sell. 1.2. Upon receipt if such notification the Estate Management shall enter this into the Estate Property register and allocate such sale with a Property Register number and shall issue such owner with a Seaward Estate Sales Agreement the cost for which shall be debited to the owner. 1.2.1. The Association reserves it’s right to withhold “Levy Consent” where the sale of such property has not been duly registered with the Association and where a Seaward Estates Sales Agreement has NOT be used for such sale. 1.3. Should a registered Property Negotiator be used to effect the Sale of any property within Seaward Estates, such property negotiator shall require to have been accredited in terms of the rules applicable to Property Negotiators. 1.3.1. The Association reserves it’s right to withhold “Levy Consent” where the sale of such property has been made by a Property Negotiator who has NOT been accredited in terms of the rules. 1.4. It is incumbent upon the member [seller ] to ensure that the prospective buyer is given a copy of the Associations Constitution and Rules, irrespective of whether a Property Negotiator is used or not. 1.5. Signage placed to advertise the sale of any property shall require to comply with the rules relating to signage. . 2. Property Rentals 2.1. It shall be incumbent upon the owner of any property, wishing to rent out any property on Seaward Estates, to advise the Association in writing through the Estate Management of their intention to rent the property. 2.1.1. A mandate nominating and letting agent to rent the property shall be accepted as an application in terms of 2.1. above

2.2. Upon receipt of such notification the Estate Management shall enter this into the Estate Rental register and allocate such notification with a Rental Register number and shall issue such owner or his Agent with a Seaward Estate Rental Agreement Addendum. 2.2.1. The Association reserves it’s right to decline it’s consent to any rental, where the rental of such property has not been duly registered and where a Seaward Estates Rental Agreement Addendum has NOT be used for such rental. 2.3. Should a registered Property Negotiator be used to effect the Rental of any property within Seaward Estates, such property negotiator shall require to have been accredited in terms of the rules applicable to Property Negotiators. 2.4. Once a prospective renter has been selected by an owner or his appointed agent, it shall be incumbent upon them to: 2.4.1. Carry out a background check on the potential Lessee and shall make such information available to the Association if requested. 2.4.2. The SEMHOA Letting Addendum shall be completed and submitted with a copy of the signed Lease Agreement and copy of the first page of the Lessee’s identification document or other suitable identification 2.4.3. The Association reserves at its sole discretion and without having to give explanation therefore to decline any application made. 2.5. The Association shall at its sole discretion, have the right to demand that a lease agreement be revoked, in the following circumstances: 2.5.1. Where any lessee is found to be in contravention of the rules and after receiving written notice thereof the lessee continues to remain in non compliance; 2.5.2. Where the Association has


established that the actions of the lessee are of such significance that their continued presence on the Estate could be detrimental to the good name of the Association or a potential danger to the members of the Association. 2.5.3. Where a demand for the revocation of a lease has been received from the Association, the owner shall ensure that such lessee leaves the Estate within one calendar month of notice having been received, with the proviso that; if the Association believes it would not be in the best interest of the members for the leesee to remain on the Estate the lessee shall require to vacate the premises within seven days of receipt of such notice 2.5.4. Where an owner or lessee wishes to contest a notice served in terms of this section, they shall lodge within seven days of receipt of such notice a written objection thereto clearly substantiating the reasons for such appeal. The Appeal will within seven days be viewed by the Associations Legal Committee who shall give a finding on such appeal. Any finding given shall be final and binding. 2.5.5. The Association shall not be liable for any costs which may be incurred as a result of cancellation of the lease for reasonable cause. 3.

Signage Relating to Property Sales and Letting

3.2. Applications for the display of signage. 3.2.1. Application is respect of the erection of signage on a property, as described in 3.3.1. below, shall be automatic upon upon registration of the intended alienation of the property, in terms of rule 1.1. 3.2.2. Where it is intended to erect signage in terms of rule 3.3.2. application shall require to be made through the Estate Management offices, at least 24 hours prior to the intended erection of such signage. 3.3. Specifications in respect of signage 3.3.1. Applicants shall be entitled to display a maximum of one [1] sign placed directly in front of and within the survey boundaries the unit on sale; and 3.3.2. One sign per agency; (i) between the M4 provincial road and the entrance to the Estate adjacent to Alberlitto Hospital and; (ii) the Ballito Rocks Drive entrance to the Estate; subject to the following provisos 3.3.3. The agent, or agents house sitter or owner shall be in attendance on the property.

3.1. Prohibited Property Sales and Letting signage and advertisement.

3.3.4. No signage shall exceed 600mm x 500mm in area;

3.1.1. No signage or advertising relating to the sale or letting of property shall be permitted within Seaward Estates, save for those specifically indicated in clause 11.2 and 11.3 below, prohibited signage shall include but not be limited to:

3.3.5. All signage shall be removed by the applicant at sunset and may not be erected before sunrise.

(i) Signage advertising Property to Let or Rent, whether this be long or short terms rentals, (ii) Property “Sold” boards; (iii) Property “For Sale”; (iv) No bunting, flags, banners, balloons or A-frames shall be allowed.

3.3.6. No signage shall be attached to, suspended or displayed on any building or in the windows thereof. 3.3.7. Signage shall be fixed to the soil and supported by means of one or two poles driven into unpaved ground within the between a road frontage boundary and the nearest edge of a public footpath, or if there is no such footpath in a To advertise here call Hayley 072 104 9431


position not nearer than 1,5m from the edge of the roadway as defined in the Road Traffic Act, 1989 (Act 29 of 1989), and at such height that its lower edge does not exceed 400mm above the ground immediately beneath such lower edge; 3.3.8. Shall be at least 10,0m from any road intersection, traffic circle or entrance or exit to or from Seaward Estate. 3.3.9. Erected so as to obstruct the view from any portion of a roadway as defined in the said Road Traffic Act, of any road traffic sign or any street name sign; and 3.4. Penalties on house sales advertising and pointer boards 3.4.1. Any selling agent who, having displayed or caused to be displayed any pointer board in respect of which approval has been given under this subsection, fails to comply with the provisions of these rules he or she shall be deemed to be in contravention of the rules and the Association shall at it’s sole discretion be entitled to: (i) remove any such board or boards; provided that any board which has not been claimed within a period of 24 hours from the date of such removal may be destroyed by the Association, without giving notice to anyone. (ii) Should any agent be found to subsequently be in contravention of this rule the Association may at it’s sole discretion suspend the accreditation of such agent to operate on Seaward Estates. 4.

Information to Potential Buyers and Sellers.

4.1. Establish the survey beacons for the property, many buyers purchase assuming that where the fence runs is the boundary of the property, this seldom the case in reality. 4.2. Ensure that an occupation certificate issued by the Municipality has been issued and that the structure

you are buying relates to the one for which the occupation certificate has been issued. Demand to see the signed off As Built Plans, if illegal alterations have been carried out the resubmission for these could become your liability. 4.2.1. In addition to 3.2. above demand to see the most recent rates account and ensure that the classification is ESR or RES, if it is still VAC it is an indication that the Municipality does NOT have an Occupation Certificate. 4.2.2. The valuation of the home for rates purposes is shown on the Rates Account along with the Rates Randage figure and rebate. The difference between VAC and RES in rates could be as much as R8,500,00 per annum on a R1 Million valuation. 4.2.3. The National Building Act and Regs makes it an offence to occupy or to be occupied a home for which an occupation certificate has not been issued. Although, to our knowledge it has not yet occurred, the occupier could be issued with an eviction notice and forced to vacate the premises. 4.3. Seaward Estates is a gated community and is a designated Private Township this requires you to accept certain responsibilities which are high lighted elsewhere in these rules. In addition to this, the majority of units on Seaward Estates are “Free Hold”, the Estate Management is NOT responsible for any problems which individual landowners have with regards to buildings, services and security within individually owned property boundaries, other than to ensure that the rules for the purpose of ensuring proper control and administration of the use and enjoyment of the Estate as a whole. 4.4. Please ensure that you use a registered property negotiator who is accredited to negotiate sales or rentals on Seaward Estates and please ensure that the Sales/ Rental Contract is SEMHOA approved. The Association has the right to reserve issuing a levy consent where the above has NOT been complied with which could nullify the sale.


LOCAL NEWS We recently got invited to attend an art exhibition down at Waterberry’s coffee shop. Breaking from the normal ‘school’ night we headed off down the hill to have a look at what was on exhibit. The team at Waterberry’s were on form, as usual, looking after their guests by making sure all were well catered for with a range of sushi and other great dishes. With cocktails in hand, and snacks close by, we took a walk around the deck to admire the art work on display. Haley warned us before hand that some of the art may be considered a little risqué, so all armed and ready we were pleasantly surprised by the diversity of work presented. With around 9 artists on display, which included local and international artists, there was definitely a variety of work to look at. It’s important to remember its not called art for nothing, and so whether it appealed or not to those attending, the creativity and skill on display had to be admired and respected. One specific work that caught our eye was of a Zulu tribesman, done with only a black ballpoint pen, which we were told was government issued. It took the artist a full month to complete the work of art and the end result was truly amazing. After the exhibition we got to chat to Haley about it and overall the evening was a success with potential for bigger and better ideas in future. Focusing on the next event, Haley wants to support more local artists through more exhibitions at Waterberry’s. Wanting to help artists get greater exposure with an emphasis on affordable art for visitors is definitely on the agenda, and perhaps moving the time of the exhibitions to a Saturday afternoon will see more people visiting the Waterberry’s art exhibitions and supporting local business and artists. Well done Haley for trying something new and different… We had a good time and enjoyed joining you and your team. We look forward to the next one !


Seaward animal families I, Nic Appelcryn and my wife Dale reside at 21 San Lorenzo. We have been here for nearly 5 years now and love the part of the estate that we live on. San Lorenzo was the first development (apart from Seaward Villas and a few single residential units) and we saw the growth of the Estate to what it is now. At the time the area was just one huge sugarcane field and we can still recall standing on our site trying to see what on earth we had purchased. At that time there was a very pleasant lady, called Sandy, who took pleasure in showing us around and pointed out certain areas zoned for recreational ‘spots’ (children’s playing areas) and the proposed ‘Otter dam’ down in the lower part of the Estate. Needless to say - none of that ever materialized. Where there was supposed to be ‘parks’ there are now homes - the proposed Otter dam’ now has a road through it. Like everything else happening in this area - proposed Airport, Power plant ,unsightly developments etc. we as humans just don’t seem to care as long as there is a ‘buck’ to be made. Apart from that we have settled down in our

retirement home and have adapted to ‘Estate living’. There are many differences to living in a city or town as most homes are on very small ‘footprints’ and in many cases families virtually live on each other’s doorsteps. From our observations, and others who have written to this Mag, it appears that quite a number of people find this transformation difficult. One just has to observe the driving habits and the very noticeable “ME SYNDROME” on the faces and actions of some residents when they drive around on the estate,and especially at the Ballito drive gate. As we live very close to the gate we hear some utterings that would make a sailor blush - (and sorry to say mostly from lady’s.) Enough of that now - the reason I am writing is to say that we enjoy the mag and in response to your article in March edition I would like to enclose some photo’s of a mongoos family that visit our garden nearly every day. This must be about the third ‘troop’ that we have seen growing up in and around us over the last two years or so. they have become somewhat tame and love to have a nap in the flower pots.
