As we move into 2008, the number of plans being submitted is on the increase, with 9 plans being scrutinized at the most recent meeting of the Design Review Committee. This is a positive sign on the perception of the Estate, also bearing in mind the building and other cost increases. The number of owners coming for orientation meetings prior to commencing with their plans has also increased. As in the past, the main reasons for coming to Simbithi are security, open living, a good place to bring up children, and the eco-ambience. Not many live insects have arrived to feed our chameleons, but the few children who have come have had their dip into the sweetie jar, so the incentive still stands. Please encourage your youngsters to come with their offerings, and see if they can find the chameleons in the bushes At the recent Board meeting when the budget for 2008/2009 was discussed, the Estate levies came under consideration, with the result being they are to increase as follows with effect from1st April 2008: The levy on each and every housing unit, freehold or sectional title, will be R975.00 (including VAT) per month, regardless of the size of the dwelling There will be no discount for payment by debit order. A R50.00 penalty will be added for every levy not paid monthly by debit order. This increase has been necessitated by the sharp rise in all costs in running the Estate during the year, and also takes into consideration the levy includes VAT, i.e. the actual levy being received by the Association is R855.00 per month. Another point to be remembered is when the Association was first formed in 2004, VAT was not payable, and the full levy came into the coffers. However in 2006 we became vatable, and 14% of the income was lost to this expense from then on. These levies are still very competitive and less than a number of equivalent Estates of the same standing. Great care is taken to ensure your money is spent wisely and productively. A large percentage is spent on Security which accounts for 34% of the budget. An Estate such as Simbithi, with 13 km of perimeter fencing and just under 1900 residences on completion, becomes an attractive target to would-be thieves and intruders, and our intention is to be continuously pro-active in the sphere of potential crime and illegal access to the Estate. As I have said to many of you, security may seem to be a hindrance at times which is, in fact, a sure sign it is working.

As you are well aware by now WBHO has become the 100% developer of Simbithi, and are engaged in completing various outstanding projects. One of these is the construction of the Simbithi Country Club. The design is well advanced, and I have included the basic layout and views of the building for your information. The design is not cast in stone at this stage, but is a very good indication of the overall product, which will be a great asset to the Estate. An article from Mike Simpson is included in this magazine. I am glad to see more activities are starting up on the Estate, such as karate training and, aqua-aerobics. Time and space are made available for these at the community centres, as they are viewed as beneficial to residents. However, I assure you they will not be allowed to grow to such a degree as to occupy the centres to the detriment of owners who wish to use them. There is no such thing as “exclusive use� of a community centre, and this needs to be recognized. I am still looking forward to seeing the startup of birding and garden groups within the Estate. You have probably heard by now Craig Kember is leaving us to move to Zimbali, where he will be working for the hotel group as their SHE officer. Craig has been with us for 2 years, before which he was with Real Landscapes, responsible for the rehabilitation of Phase one from cane to indigenous planting. Craig has done a very good job while he has been here, and will be missed. Yours sincerely,

News from the Developers As most of our homeowners will know, Simbithi Eco Estate was the brainchild of Mark Taylor, the Managing Director of the eLan Group. Before the development started, he sold a 50% interest in the development company to WBHO Construction.

WBHO Construction is one of the four largest construction companies in South Africa. Some of the projects that they have completed include: The Gateway shopping centre, The Durban ICC extension. Current contracts include: The new King Shaka airport at La Mercy, The new soccer stadiums in Durban, Cape Town and Polokwane. The company has assets of R5 billion and an order book of over R15 billion.

The main clubhouse

At the end of 2007, Mark Taylor and WBHO came to an agreement where WBHO would purchase the balance of Mark’s shareholding in Simbithi Eco Estate. For those of you who know Mark, he is an ‘ideas’ man, with great vision. Once the project is established, his mind moves on to new horizons. The purchase of the 50% shareholding was subject to Competitions Board approval. This was received in January 2008, and the transaction has now been concluded. The only change in the structure of the company is the shareholding. There is no change in the directors of the company, however, Mike Wylie, the chairman of Wilson Bayly Holmes Ovcon Limited, the listed company has been appointed as Chairman of Simbithi Eco Estate (Pty) Ltd in Mark’s stead. Mike Simpson, the Managing Director of WBHO Property Developments (Pty) Ltd is responsible for WBHO’s interests in Simbithi. Both ‘Mike’s’ have been involved in Simbithi’s development from the inception. Mark and Peter Taylor will continue as directors, and eLan is still totally involved in the marketing the development and the administration of the development company. The re-arrangement of the shareholding has cleared the way for the balance of the facilities at Simbithi to be completed. These include:

The equestrian centre 14 stables and the associated tackroom and other facilities will be commenced shortly. The plans are in council for approval. The stables should be completed by the end of 2008. We had hoped to complete the clubhouse by December 2008, but this will simply not be possible. Charles Taylor has been appointed as the architect. We are going through the detailed design stage at present. Construction should commence in July 2008, with completion in April 2009. There is a model of the proposed clubhouse in reception at the Administration building. Plans will also be made available for view.

Guinea Fowl / Sportsfield Community Centre We will commence building this facility in July 2008, to complete it before December. The intention is to build a fairly open structure, with braai facilities, toilets and a small swimming pool. This facility will mainly be used by those people using the sports field. The sports field is envisaged as a multi purpose field.

Paula gave us a brief background on herself and how she had to learn the hard way, how amazing we as women really are . Paula is very involved with body fitness and real estate. Her latest interesting import is the fitvibexcel, it is an extremely effective method of training with sessions of only 15 mins you will see results and feel great ... even a very busy woman can fit that into her schedule. “Simbithi Country Club comes out tops” In a recent article in the Complete Golfer, John Botha perfectly sums up the experience of Simbithi Country Club

“The Simbithi course has a par 60, with an outward nine consisting of seven par threes and a pair of par fours, and a homeward loop of six par threes, two par fours and a par five. From the championship tees the course measures 3 902 meters and judging it on paper one might be tempted to dismiss it as an excuse for a real course. Forget it - this course is a revelation; an honest-to-goodness, flat-out, brilliant test of golf that is an absolute joy to play! We have often pointed out that the three main factors governing the quality of any course are design, location and condition, and this magnificent facility earns highest marks in all three of these categories”

Build-by date penalties

T

here seems to be a lot of confusion as to the Build-by date penalties, and I thought I would write a brief explanation. Clause 6.2 of the SEEHOA sales agreement states if you do not have plans approved by the Association within two years of the ORIGINAL DATE of transfer (date the property was sold by the developer to the first owner) you will be liable for a penalty of 20% of the levy. Clause 6.3 states should you have not completed building your house (issue of practical completion certificate) within three years of ORIGINAL DATE of transfer (date the property was sold by the developer to the first owner), you will be liable for 100 % of the levy as a penalty. As a resale purchaser (you did not buy directly from the developer) you need to be aware of the date the property was first sold by the developer, as this will indicate when these penalties will pertain to you. Other points I would like to bring to your attention when selling your property are: • • • • •

Estate levies must be fully paid up by the seller at the time of sale for a levy clearance certificate to be issued, at a cost of R456, payable to SEEHOA The new owner must sign a debit order form for SEEHOA levies. R5,000 is payable by the purchaser to SEEHOA for the Levy Stabilisation Fund (LSF) into SEEHOA’s LSF account. A Debenture of R10,000 is payable to the Simbithi Golf Estate. 1% of the total selling price is payable as a Marketing Fee, payable to the Developer via SEEHOA.
