june September ended with the inexplicable operation performed against Herrira and the end of this month of October is marked by all the comings and goings around the ruling in Strasbourg on Decree 197/2006. A very mixed month of dierent feelings, to be sure. An intense month for the families of Basque political prisoners. During the early days of the month, Etxerat gave a press conference to denounce the operation against Herrira and the arrest of 18 of its members. We showed our indignation and denounced attempts by the Spanish state to criminalize the work done on behalf of human rights and Basque political prisoners and exiles. And wishing to discredit the legitimate work being done so openly and publicly to seek a social consensus for ending the violations, it took them to jail. Etxerat and Herrira also shared objectives: to end the prison policy, emergency measures, the systematic violation of the rights of our relatives. Therefore, on October 5th we met with other political and social agencies and trade unions in a demonstration in Bilbo to create drop by drop, a sea. And we showed our commitment to go on to create a great tide.

A few days later we begin to understand some of the reasons behind this operation. On 21st October, the European Court of Human Rights delivered their judgment: the 197/2006 Decree infringes human rights, both in the case of Ines del Rio as in that of Juan Manuel Piriz and also in the cases of 54 prisoners who remain in illegal detention. They have been long years of added suering, both for our imprisoned relatives and for us, the relatives and friends awaiting their return home, unable to forget that our loved ones have experienced the most extreme situations, in the toughest prison regimes, thousands of miles from their homes, sometimes even seriously ill, for over 20 years. After all this and just at the moment when they should be released after serving their full sentence, in the most cruel manner

and employing a measure that does not comply with the law, as has been shown, they were informed of the lengthening of their sentences, sometimes even on the very day that they were due to leave prison. The departure date of the prisoners would disappear and in passing once again our relatives were condemned. Although the Strasbourg ruling is clear, the State continue with the violation of rights of our family and friends. The prisoners who have served their sentence are in illegal detention. But in addition, they still apply many other emergency measures, which also violates their rights. Among these measures is the dispersal, a measure designed with us in mind. And its consequences (physical, psychological, economic, social, accidents, etc.) are suered both by the prisoners and by their relatives and friends. Therefore, we will continue to work for the end of all these measures. And especially for the end of the dispersal policy that aects us directly. We should not and we cannot rest, until each and every political prisoner should be in the Basque Country.

right to health Muret Seysses – Oier Gomez Oier Gomez, a prisoner from Gasteiz who is in prison in Meaux, in the French State, received the last session of treatment this month from the course he has been on since 18th January 12013, due to suffering from Hodgkin's Disease. Oier has spent many months going to and from hospitals for tests and to receive treatment. In July 2012 he was admitted for the first time to hospital because of the enlarged lymph nodes. No apparent cause was found in the tests performed at the Moulins Hospital. The size of the lymph nodes decreased again, so the study was discontinued. But in December of that same year, the lymph nodes increased in size again accompanied by a number of symptoms: generalized itching, night sweats, hot flushes, etc. Therefore, Oier was taken to the Pitie Salpetriere hospital, where he underwent a biopsy of the lymph and was diagnosed with a type of Hodgkin lymphoma. He began to receive chemotherapy in January 2013.

After four rounds of chemotherapy, in May he underwent a control study. And there was a good therapeutic response with regression of all nodes that were affected. Still, the doctors decided to continue the chemotherapy to complete the course. It is emphasized that up to this point he received adequate treatment. Nevertheless there have also been problems with the hospital treatment. For example, after the session he received in July, as is usual in such cases, he experienced a drop in white blood cells. On July 18th he had a fever and the jail nurse told him that would transfer him to the hospital. At 18:00 that day he was rushed to the hospital of Meaux where, after tests, they decided it would be best he were admitted. He had to be medicated to resolve the decrease in white blood cells. At all times he was handcuffed and so he refused to take the medication. Even though the nurses and doctors tried to resolve the issue with the officers, they were unsuccessful. Oier remained handcuffed and decided to request a change of hospital. Finally, on July 16th he was taken to hospital in Paris. As for his current situation, the treatment progress has been positive and he has had the final treatment session. To receive this, he was taken to hospital on October 10th, fifteen days later than should have been the case. monthly report october 2013

February 22nd 2006: the Criminal Chamber of the Supreme Court of Spain in response to an appeal filed by Unai Parot, states that the remission should apply to each of the separate sentences and not, as had been the case, on an aggregate of 30 years. The judgment, a legal precedent, was approved by 12 votes in favor to three against.
From then until now, Decree 197/2006 has been applied, retroactively, to 93 Basque political prisoners. 28th March 2012: The Constitutional Court, with the dissenting vote of 5 of the 11 judges, endorsed the application of the “Parot doctrine” with the exception of those prisoners who had received confirmation in writing that their remission would be calculated as before and had been given a leaving date. July 10th 2012: Chamber of the European Court of Human Rights judges the first appeal to this court by Ines del Rio, whose sentence should have been completed on July 5th 2008 but which the application of Decree197/2006 had extended until 2017. In its judgment, the Court finds that the Spanish Supreme Court decree violates Articles 7 and 5.1 of the European Convention on Human Rights "with respect to establishing the non-retroactivity of criminal laws with result unfavorable to the apellant", urging the Spanish Government to release Inés del Río. The Spanish Government refuses to release her, announcing an appeal to the Grand Chamber of the Supreme Court and is willing to resort to legal engineering to maintain the extensions of sentences. October 4th 2012: Delaying to the time limit of three months, the Spanish government enters its appeal. October 21st 2013: The Grand Chamber of the European Court of Human Rights composed of 17 judges presents its findings, condemning Spain for violating Articles 7

(“no punishment without law”) and 5.1 (“right to liberty and security”) of the European Convention on Human Rights and orders Ines del Rio be released and to be given financial compensation. The European Court notes that this legal precedent decision is binding and one which the Spanish State, as a party to the Convention of the Court itself, must abide by and comply with. October 22nd 2013: Ines del Rio is released five years after serving her original sentence. The rest of the prisoners affected by the 197/2006 doctrine remain imprisoned. The Spanish Government leaves the management of the Strasbourg Court judgment to the National Court. October 25th 2013: Juan Manuel Piriz is released a few months shy of completion of the extension of his sentence imposed by the Parot Doctrine. He was jailed in 1984 and prior to the application of the Doctrine his sentence would have been completed during March 2009. October 28th 2013: The Full Chamber of the Criminal Division of the Spanish National Court considers that the Strasbourg Court's ruling requires compliance by the State, leaves no room for avoidance and is general in application with regard to all prisoners in same situation as Ines del Rio. It sets up a schedule to assess cases. Etxerat, in common with the great majority of Basque society, saw in the judgment of the Strasbourg Court the triumph of human rights over political interests. As family and friends of political prisoners, we are filled with joy at knowing that an important crack has opened in the wall of the violations of rights that encloses us. However, the government will delay the releases thereby continuing the extension of sentences, which is reflected by the decision of the National Court: although as the trial and sentencing court, reviewing cases would correspond to itself, the National Court leaves its outstanding appeals to the Constitutional Court to resolve, others to the Supreme Court and, as for those which it will examine, will assess every Friday from November 8th. This means that at very least long months may pass until the 71 * prisoners to which the violating rights doctrine has been applied and who meanwhile remain incarcerated, see their cases reviewed. Meanwhile, 54 of them continue serving sentences which expired already, in some cases years ago:

Thus, not even the judgment of the highest court of human rights has prevented our relatives, with their time already served, from remaining in prison. But the desire for revenge and political interests that dominate the Spanish Government are visible to all, as are the long years of suffering caused by this emergency measure, for the prisoners and for us, their family and friends, also subject to the harsh consequences of prison policy.

inviolation theofjails rights other incidents Isolation Isolation or the separation of comrades, preventing all contact between them, is part of the specific regime applied to Basque political prisoners. Although in legislation and in penitentiary norms isolation is a measure applied to very concrete situations and for a restricted period, it is applied to our relatives as a way of life, in addition to other sanctions which they may intend to use as punishment. The Basque political prisoners are dispersed in different jails and in addition to different blocks. In other cases, without being in isolation as such, they are kept apart from their comrades, which we must assume creates a difficult lonely situation.

Hunger strike Seville: Basque political prisoners in Seville jail began a protest on October 28th to denounce their living conditions in this prison. Of the thirteen political prisoners there, eleven (Iker Agirre, Gurutz Agirresarobe, Koldo Aparicio, Asier Arzalluz, Juan Mari Etxebarri, Garikoitz Etxeberria, Jesus Goikoetxea, Manuel Gonzalez, Juan Lorenzo, Roberto Lebrero and Urtzi Paul) began an indefinite hunger strike, while two (Javi IĂąaki and Agirre Arakama) did not start the hunger strike for several reasons but also joined the protest, carrying out other protest actions. The situation is one of great tension, with harsh living conditions: always kept in the isolation module, not being permitted activities, when they leave their cells for the exercise yard they first pass through a metal detector and then are searched probing throughout the body, sometimes even going so far as to touch the testicles or penis, creating moments of high tension. Basque prisoner Arkaitz Bellon was assaulted; after a face-to-face visit they carry out comprehensive body searches (stripping him naked); relatives also tend to be searched before entering a face-to-face visit or even before entering the booths (divided by glass from the visitor) and, when they have refused, have lost visits, and so on. At the conclusion of this monthly report, the prisoners were continuing their hunger strike. Fleury: Basque political prisoners Javier Arruabarren , Asier Bengoa, Joanes Larretxea, Igor Suberbiola and Gorka Azpitarte, who are in French prison Fleury, Module D1, began a hunger strike on October 1st. Inmates who are in the D1 module are categorised as prisoners requiring "special surveillance" and the living conditions of this module have deteriorated sharply over the summer: frequent and very aggressive cell changes, complete body searches, turning their belongings in their cells upside down, etc. The last time they were again required to change cells, the Basque political prisoners requested to meet the prison administration but were told that there was an order “from above" and that nothing would change. In response to this situation the prisoners carred out several protests. On September 16th they met again with oďŹƒcials but it was reconfirmed to them that the situation would remain the same. Thus, on October 1st the Basque political prisoners who are in that module decided to start a hunger strike. After 10 days on hunger strike, on October 9th they met with the General Director to inform him about their monthly report october 2013

demands. So, it seems that agreement has been reached to change the frequency of cell changes to once every four months. The prisoners therefore decided to end the hunger strike. Prisoners who are in the D2 module also joined the protest in solidarity and ended it when they learned that the D1's had finished .
Assaults Fleury: October 9th, Gorka Azpitarte was in the waiting room to the nursing station. Then the time for the exercise yard arrived but there were still prisoners waiting to enter the nursing station (himself included). Realising that because of the queue he was unlikely to get seen at the nursing station, but also would have no time for the exercise yard, he called to a prison officer with a shout to let him out to the yard. He tried to talk to this officer by the door, but he refused and closed the door, hitting Gorka in the face. Tension rose and there were shouts. The officer opened the door and hit Gorka on the nose, from which he began to bleed. After all this, Gorka was told he would face a disciplinary charge. Lyon Corbas: Urko Labaka from Donostia and Xabier Aranburu from Ondarru were seriously assaulted by prison officials at Corbas Lyon, France. Although these events occurred on 10th October, Basque political prisoners in this prison have spent several months fighting for their rights. In September, for example, using all kinds of excuses, the prisoners were denied access to activities (soccer and gym). The three political prisoners in Lyon Corbas, male block, decided to hold pickets, as the activities are their only opportunity to get out of the cells, in addition to the two exercise yard periods of an hour and a half. The first picket held caused some concern among officials and at the second, an officer lost his temper and attempted to strike one of the Basque political prisoners -- another officer had to protect the prisoner. On October 9th, they were punished for the actions and sentenced to eight days of solitary confinement. Both before imposing the punishment and after, the three Basque political prisoners booked an appointment with the principal officer but he did not respond. The following day, October 10th, at 10:00 am, officials with officers in riot gear entered the prison cells of Xabier Urko and Labaka Aranburu. They were carried bodily to the punishment cells in the air, then drag-

ged, kicked, their heads and knees being banged against the stairs, very aggressively. In addition, the distance to the punishment cells is very long and they got there bleeding from the mouth, almost naked and with scraped backs and wrists. Totally destroyed. Which is to say that in addition to receiving the punishment of solitary confinement they received a substantial beating. Saint Martin de Ré: On October 15th in addition to handcuffs, they wanted to blindfold Juan Ramón Karasatorre and to place soundproof headphones on him when he was to be taken for trial. When he resisted, he was bashed against the wall three times.
Worsening general situation in the jails Algeciras: Prisoners have to endure frequent cell changes. Curtis: Both the quantity and quality of the food are much reduced. Prisoners are losing weight. Soto del Real: Garikoitz Aspiazu has had problems during the time he was in Soto del Real: the newspaper did not arrive, he was given problems trying to phone his lawyers ... On 22nd September, for example, he asked to go out on the exercise yard with his comrade, because it was his birthday, but he was refused. Minutes later five or six officers came to search him in his cell, including giving him a full body search. They left everything upside down. Garikoitz sent a letter to the Director of the jail and to the monitoring judge and received a disciplinary charge as a response. Fresnes: Iñigo Vallejo was taken to Fresnes in order to be extradited. Basque political prisoners in this prison are in Block 3 but Inigo was transferred to Block 1. The prisoners in Block 3 protested to have Iñigo in with them, so they were taken to the mitard (French prison solitary confinement cell). The female prisoners also joined the protest, doing sit-ins. On October 17th Iñigo Vallejo was extradited to Spain. On October 13th, Alberto Matxain had been in the mitard (punishment cell). As he was leaving the exercise yard, he was frisked with probing and squeezing. Upon reaching his cell he found another two officers waiting; one told him to open the zipper of the top he was wearing, which Alberto refused because he had been searched a few seconds earlier. The officer replied saying that he

would conduct a full body search and Alberto refused again. They grabbed him and threw him to the ground, stripped him and searched his clothing. They had him naked on the floor with a foot on his neck and arms tied behind his back. Poitiers Vivonne: Oihana Garmendia has had notes and material of the last five years wiped from her computer, all of which were needed for the course of study she is following. They also wiped her music. Reaú Sud Francilien: In March there was an escape attempt by a social prisoner from this prison, since which prison conditions have tightened significantly, including several measures in the regulations: prisoners have to pass more often through the metal detector, more control is exercised over their movements, they have toughened communication rules, etc. Therefore, Basque political prisoners have been in several protests jointly with social prisoners throughout the summer. During one of the protests an official assaulted a social prisoner and all prisoners have been punished and had to appear before the disciplinary committee. Villepinte: On October 7th, Mikel Karrera was transferred to Reaú Sud Francilien prison. He was in the cell after an officer gave him his trousers and began talking with comrades but was then told he had to go back to Villepinte. When he asked why, he was told that he had a court appearance due on the 23rd. Arriving at Villepinte he was obliged to go through the whole admission procedure again (a new inmate number, etc). In his amazement, he asked an officer why he had been moved twice and the answer he received was that he had no right to ask. Given this response Mikel refused to cooperate further. He was thrown to the floor, handcuffed and taken to the mitard (solitary confinement). Upon returning to his cell later he saw that all his things were in a mess, that he was missing some and that some others had been broken. His comrades told Mikel that they had heard noises in his cell, and asked to witness but they were not permitted to do so.

Under normal circumstances, prison guards are not supposed to search a prisoner's cell in his absence. As Mikel was in the punishment block, his comrades asked to witness the cell search on his behalf but were refused.

Right to communication and visits Ávila: Idoia Mendizabal (Ávila) y Jon Gonzalez (Estremera), as they are a couple, have the right to communicate with one another. The Prosecutor appealed this right but during the summer the couple won a decision denying the appeal. Idoia Mendizabal was transferred to Estremera in accordance with the court order but after being in communication with her partner was again returned to Ávila.
Granada: The prisoner's partner is not permitted to go unaccompanied to visit the prisoner on “open visits” (another relative must attend also). And in the “open visits” they are only permitted to bring in water (but, for example, they are not permitted to bring toys even though children attend the visits). With regard to telephone calls, while previously they could make them mornings and afternoons, now they are only permitted to make them in the mornings. Soria: On 26th October, Iñaki Loizaga was scheduled a family “open visit” as well as an intimate relationhip visit. There was no problem with the family visit but when his partner returned for the intimate visit, they told her that she would have to be searched. She refused and lost her visit. In July they lost another one for the same reason. Valdemoro: On 7th October, the 17 month-old nephew of Joseba Lerin was not permitted to be carried through the metal detector by his parents; they forced him to pass through on his own.

relatives and friends New accident due to the dispersal On their way to the Muret Seysses jail to visit Basque political prisoner Julen Mujika on 25th October, his partner and son were in an accident. On the motorway five minutes away from Seysses, the tyre of a lorry in front burst. A part of that tyre got stuck under their car and they had to pull over to the side and stop. Their own tyre was punctured and the radiator holed. They had to remain there for two hours and go afterwards to the Gendarmerie office, to make a statement, accompanied by the occupants of another vehicle which had also been involved in the accident. They were not injured but were unable to visit the prisoner and had to leave their cars in Toulouse.
Hounding of a relative Nahia Zuriarrain, partner of Asier Arzalluz, imprisoned in Seville II jail, experienced harassment and threats on 29th and 30th September. Nahia was alone in Seville to carry out the visit. There she was approached by three people who used her relationship status to threaten and try to talk to her. Unfortunately the families have to suffer situations of harassment by officials in prisons when we make visits but this is the third attack on a relative by the police in a year. Arkaitz Rodriguez 's sister, Enara, on September 28th 2012 suffered a serious assault and harassment while returning from a visit. And Gari Arruarte's sister and partner of Ugaitz Errazkin, from Izaro, suffered another harassment 15 days later, on October 9th. We still do not know who are those responsible for these attacks and we have received no responses to the complaints filed but in the meantime already there has been yet another attack, at least. What should we do about this situation? This is the testimony of Nahia Zuriarrain and what she experienced during those two days:

“Sunday, September 29th I had a visit booked in Sevilla II prison at 18:00, through glass. Driving a rented car I went to a hostel in La Puebla de Cazalla, a town near the prison. After dropping my stuff off at the hostel, I went to get some dinner. I parked in a public parking area in the centre of town. I went to dinner and was back about 15 minutes later. When I was in the car and about to start, a woman tapped my window and told me I had puncture in the front wheel of the car. I got out and saw that the front left tire was totally flat. The woman was very "friendly" and offered to help, saying that her brother had also had a puncture two weeks earlier. I felt at a loss. In order not to pay additional insurance, I had not purchased the "Roadside Assistance". And I told this woman that. She said she also was driving a rented car and she noticed mine when she was looking for hers. She suggested that we ask some man for help. I replied that there were several young men nearby and I would ask for help from one of them but she insisted that in these cases it was better to seek help from older people. Meanwhile she introduced herself as María and I told her my name. She was about 35-40 years old and did not have an Andalusian accent. She referred to my belly -- I'm five months' pregnant. She told me that she would help me because I could not lift heavy things. Then, by "by coincidence", two men arrived and María asked them if they could help; they replied that they could. They changed the wheel quickly. I thanked the men for their help and they left. María stayed with me for a while and helped me arrange things in the boot; she told me she had recently had a miscarriage and became pregnant through a course of treatment. I had been through the same situation a few months before, so I encouraged her, saying that I had a hard time but I was able to endure it, that I was pregnant again and this time all went well. At one point I commented on her accent and she said that she wasn't from around there but next day had to work there. In the end I thanked her for her help and we parted. Monday, 30th September I had an “open” visit booked for 11:00am. I left the prison by car around 13:00pm. Since my flight back was not due until that evening, I went to a large shopping centre called Los Alcores which is on my route to the airport, one hour away from the prison, in Alcala de Guadaira. I went into the restaurant to eat. When I had finished the starter, "María" suddenly appeared. At that point I started to worry -- this could hardly be a coincidence. She asked if she

could join me and I answered yes. She began to tell me she'd had a bad day and I asked her directly what her job was. She said she was a psychotherapist and I told her I already had an idea about where (in the prison), considering where we met the day before, and she confirmed it. She told me that day she had to work with a Colombian but things did not go as she wanted and that she also had ups and downs with hormones, so that she was not well. Soon, a man approached. "María" greeted him, said he was her friend and would sit with us. Before I had time to say anything, he approached the table and sat next to "María". The man was 35-40 years of age and he didn't have an accent either. He said he knew who I was and said my name and both surnames 3. I asked him who he was, if he was police. He said he worked for a commission (I forget the name but I think he used a word like conflict or peace) and for the Ministry of the Interior. He wanted to talk to me and to know my opinion. He told the woman that she could leave now. At that point I told "María" that she should stay, that I was leaving as I did not want to be there. Those were moments of great tension. I did not know what could happen. I was alone in Seville and did not know how to get out of that situation. He threatened me saying that I would not move, I was going to stay there and I was going to listen for 20 minutes. I asked what they were going to do, whether they were going to arrest me. He said no but that if I did not stay there, then Asier (my partner who is in Sevilla II) would be transferred to Ceuta 4, that it was in his power. Immediatly I got up and told him I did not want to talk and was going to call the lawyers right away. I got up, paid for the food and left. They stayed at the table. I called the lawyers, told them everything that had happened and went to the airport.”
Valencia III Four relatives of political prisoners who are in that jail went in a car to their visit booked for the end of October. When they got to the jail they noticed a person photographing them from another car. The person noticed them had seen him, bent down and hid. And when they were they were inside awaiting to be called to the visit, they noticed a man sitting near them was taking notes while he looked at them 5.

EPPK (Basque Political Prisoners) actions in the jails The Basque political prisoners continue with their campaign “Euskal Presoak Euskal Herrira” 6 and in each prison carry out different means of protest; in the majority they refuse prison food or carry out fasts. On the second-to-last Friday of each month they also demand the abolition of decree 197/2006.
