The rancher was awarded $25 for a broken fence and the oil company was awarded $25,000 for having the
Certainly, restrictions on surface use may be included in the deed to limit the dominance of the mineral estate, but this needs to be done at the first severance of the property or it will not bind the mineral owner who first reserved. Absent a deed restriction on surface use, the common law will apply. Both parties to a transfer of property need to consider the mineral ownership in their evaluation and understand how the surface may be shared. In spite of being dominant, there are real limits to the use of the surface by the mineral owner. The doctrine of accommodation was established in a case called Getty v. Jones in Texas in 1971 in which it was held that the oil operator must reasonably accommodate other surface uses, particularly those uses already established. In Getty, Mr. Jones had a circular irrigation system. It seems that Getty’s pump jacks were so tall as to block the irrigation system from going in its circle. Getty said, “gosh we’re sorry but it’s not our problem.” The court disagreed and ordered Getty to go to each well site, remove and reinstall each pump jack after digging up enough dirt so that when it reinstalled the pump jacks in the newly created “cellar” they were low enough that the irrigation system could pass overhead freely. So the dominance of the mineral estate is not absolute.

If one chooses to acquire the surface with no minerals, he must be prepared to share his surface with the mineral owner as prescribed by the common law. Landowners, being pretty smart, soon learned that they could sell land reserving all or some of the minerals. So minerals began to be reserved a hundred years ago and still are today. The problem grows and grows – if you

As we consider the purchase or sale of any property today, we must consider severed minerals and how to best negotiate a deal satisfactory to the buyer and seller. We must think about owning less than 100% of the minerals (which is going to be the case most of the time) and understand the consequences thereof. In addition to lack of surface control (which remember happens anytime you get ownership of less than 100% of the minerals) you are giving up a proportionate part of future lease bonuses and royalty. In many cases today, since shale-gas and shale-oil drilling was perfected, the minerals are worth much more than the surface - multiples, in fact. Volume 74 Texas Farm&Ranch

He has been a TV analyst and co-host of Fox NFL Sunday. He played for 14 seasons with Pittsburgh, won four Super Bowl titles in a six-year period, becoming the first quarterback to win three and four Super Bowls, and led the Steelers to eight AFC Central championships. He was inducted into the Pro Football Hall of Fame in 1989. He is ranked #44 on the list of 100 of the Greatest Football Players ever, and in 1972 threw one of the most famous plays in NFL history, known as the “Immaculate Reception.”

What most people don’t know is that Terry, at heart and at home, is a rancher…a really good one… As the old saying goes, there is a time and place for everything. At my ranch in Thackerville, Oklahoma overlooking the Red River, I have devoted a lot of time over the last 14 years and a huge amount of money turning about 740 neglected acres into a place that I am proud to say I love. My wife, Tammy, tells me that being a Virgo, I have to have everything perfect. Of course, that is why I married her. She is right that I require perfection, whether it was on the football field when I was playing for the Pittsburgh Steelers, in the studio at FOX Sports Sunday or at the ranch. Everything about this ranch is perfect from my sprawling western-style lodge I built for my family and friends to the care I give my horses to the miles of pipe and cable fencing that surrounds the pastures to the eight bucolic lakes. On Building My Ranch I built it to satisfy my passion for being outdoors, working with animals, particularly horses and cattle, but also the hogs I raise to feed the hungry. This ranch meets all those needs. I raise a large herd of cattle and top quality horses on one of the finest spreads you will find anywhere. More important, in my hectic life of airplanes, television shows, speaking engagements and meetings, I have to have a spot on this Earth where I can walk out my front door and feel the peace, but get to anywhere in the country or the world in an hour’s drive to DFW airport. This ranch has been the perfect spot for me. It was not always that way. When I first laid eyes on this property, it was a mess. No one had taken care of it for years. There were a few head of cattle grazing on it, but mostly the acres were overgrown with brush and trees. The creek bottoms needed to be cleaned out. The fencing was

mostly gone. There was an old run-down barn and a worn-out, old school bus. There were no paved roads, just old tracks. Getting around the property required four-wheel drive. There was almost no surface water. The first time I saw the property, I walked away. I had looked for ranches all over Texas, and I didn’t think this one just across the river in Oklahoma was right for me either. Then on a whim, I drove up here in my jeep and spent hours driving over the old trails that Indians and stagecoaches once used, thinking about the potential the land offered. I pulled up on one of the hills, parked my jeep facing the setting sun. I stood on top of the jeep and looked back across the river. I decided then I could build a house on that spot. I did, and to this day, I find quiet peace and tranquility enjoying that setting sun from my back veranda. It took me two years to clear the trees and brush, clean out

The property also has fenced-in pastures and paddocks and eight ponds.

I built trails all over the property so my family, friends and I can enjoy viewing this fabulous place on four wheelers, on horses, or on foot. Once you needed a four-wheel drive just to get on the ranch—now you can drive a Ferrari from Highland Park, DFW Airport or Winstar Casino to my front door on sealed asphalt at any time of the year. So you are wondering why I would ever let go of a place I have put so much of myself into. This ranch is a part of me. I will miss it. But at 66 years old, it is time to downsize. I don’t have the time or the energy I once
