Title Tip: How to Reference Surveys

When it comes to reflecting survey matters and encroachments in the Schedule B-II of the title commitment and Schedule B-I of the title policy, we encourage the use of the following language:

Matters and notes depicted, referenced or shown on that certain survey entitled [name of survey], recorded at Map Slide ___ of the ___ Land records, including but not limited to the following specific matters: 

(a) [EXAMPLE] encroachment of building show on northeasterly corner of Land

(b) [EXAMPLE] apparent setback encroachment of walkway across Land

(c) [EXAMPLE] 15’ foot sewer line passing under garage.

By taking exception in the policy for the survey as a whole and any matters that are found on the plan, as well as taking exception for specific items found in the survey, it provides an extra level of comfort knowing that you directly carved out coverage for specific matters that the title insurance policy is not going to cover.
