hose of you who had the opportunity to attend the 2017 Florida Pharmacists Legislative Days and Health Fair at the Florida State Capitol will know well, we rocked! With over 400 attendees this year, including meeting our goal of bringing 100 pharmacists and more than 300 student pharmacists to the Capitol, it was a huge success. Special thanks go to Dr. Angela Garcia and Jeanette Connolly, our Health Fair Co-Chairs, and Dr. Christina Laird and Preston McDonald, our Legislative Days co-chairs. Also a special thanks to Dr. Olga Wydner and Dr. Alexis Jurick, for coordinating the Health Fair booklets and advertisements. Thank you to all the local unit associations and individuals who sponsored an ad in this year’s Journal. Thank you also to Walgreens for donating all the diabetic testing supplies for the Health Fair. I recently remarked to a group of fellow pharmacists that I truly felt

the Florida Society of Health-Systems Pharmacists (FSHP). I want to especially extend my appreciation to 201617 FSHP President Kathy Baldwin, for all her hard work and dedication in getting those pharmacists to the State Capitol to meet our goal of 100. The feedback from the legislators and their aides was impressive, and showed the strong spirit of collaboration in getting our message out to them, in advancement of our profession and patient care in the state. There are several key bills of interest this year for which we have been hard at work advocating on your behalf. One of these is SB 670 sponsored by Senator Aaron Bean and HB 625 by Representative Fitzenhagen, which addresses the restricted pharmacy network access issues that have been felt across our state. If you are a constituent of either of these lawmakers, please be sure to thank them for fighting on behalf of our profession. Moving on in the calendar, we have a very active spring and summer ahead at the FPA, and many ways for you as MARCH 2017

What is the Adopt-A-Student program? The Adopt-A-Student program is a way to support the costs of a few select students from each of our seven Florida pharmacy schools to attend the FPA annual meeting and convention. Members attending the FPA annual meeting will have an opportunity to connect with students and then mentor their experience in our organization. Programs for students include educational sessions, poster presentation opportunities, an award and recognition event, educational game shows and a patient counseling competition. We want to thank our university faculty partners for assisting us with this project. DIR Fake News Repellant By Doug Hoey, Executive Vice President of the National Community Pharmacists Association There’s been an awful lot of talk about “fake news” in the political world over the last year. A September Gallup Poll reported that only 32 percent of Americans trusted the media, the lowest in the organization’s polling history. With so much information available online, it’s sometimes hard to know what’s real and what’s not. The demand for hard evidence is one of the reasons NCPA recently engaged one of the most recognized independent actuarial consulting firms in health care to look at the impact of pharmacy direct and indirect remuneration (DIR) fees on seniors, the government, plan sponsors/ PBMs and pharmacies. The report is in, and here’s some of what it found: Beneficiaries are impacted by pharmacy DIRs. A Part D plan/PBM that favors DIR may produce a slight reduction in premiums, but beneficiaries with Part D claims will also pay more out-of-pocket. Also as DIR amounts increase, cost-sharing for beneficiaries with Part D claims will be higher in all benefit phases (i.e., initial coverage limit, gap, etc.). The Centers for Medicare & Medicaid Services incurs higher costs because of pharmacy DIRs. CMS incurs these higher costs (reinsurance and low-income cost sharing subsidies) because of the increased use of retroactive or post claim adjudication pharmacy DIR fees. Plan sponsors/PBMs benefit from pharmacy DIRs. This is because they have significant financial incentives to use increased DIR in Part D bids and are in more favorable financial position as DIR amounts increase. Pharmacies are at a distinct disadvantage when DIR is taken or collected from pharmacies after the point of sale. There is a lack of transparency in the detail provided to pharmacies and the retroactive nature of these fees creates operational and cash flow challenges for pharmacies. So, in short, most seniors, the federal government and taxpayers all pay more with the current use of pharmacy DIR fees, while plan sponsors and PBMs reduce their risk and do better. What a deal. This report is groundbreaking information. You might be tempted to say that these findings are not a surprise to you. Certainly, not the part about pharmacies being at a distinct disadvantage because of pharmacy DIR fees. We couldn’t agree more. Since 2011, NCPA has been in contact with CMS repeatedly about the problems with retroactive pharmacy DIR fees and has doggedly taken our members’ concerns to Congress.
We knew what was happening to pharmacies. We suspected seniors and taxpayers were being hurt too, but we couldn’t quantify. That’s one reason we engaged the actuarial firm last year to show us exactly what was happening. Coincidentally, CMS released findings in January that are consistent with those of the actuarial firm. Now there are two well-respected entities—including the federal agency negatively impacted by DIR fees—that have weighed in on the problems with the way pharmacy DIR fees are being used. In addition, in January 2017 a commissioner with MedPAC, the independent agency that advises Congress on Medicare issues (the commissioner is also a principal in another wellknown actuarial firm), concluded that DIR fees may provide incentives for Part D plans to put higher priced drugs with large rebates on their formularies rather than lower priced drugs. This seems counterintuitive for entities that purport that DIR fees reduce drug costs. The NCPA-endorsed DIR legislation introduced in Congress last month is one step in the right direction to fix the problem. The Improving Transparency and Accuracy in Medicare Part D Spending Act (H.R.1038/S. 413) would prevent retroactive DIR fees charged to pharmacies in Medicare Part D. Moreover, it would be another step in creating full transparency in a highly opaque prescription drug payment system that allows PBMs to contribute to the rising costs of prescription drugs. FPA News & Notes Department of Health Webinar on ARNP and PA Prescribing On March 28, 2017 the Department of Health facilitated a webinar on House bill 423 passed during the 2016 legislative session that granted controlled substance prescribing authority to advanced registered nurse practitioners and physician assistants. The FPA office has fielded a number of questions on this issue and an article has been published in the December 2016 issue of Florida Pharmacy Today that is available on the FPA website. Questions continue on this issue such as limitations on prescribing, approved formulary and ARNP and PA credentialing. The FPA will be hosting a law and regulatory conference in Tampa the weekend of April 22 - 23, 2017. There is a session dedicated to ARNP and PA prescribing and also a panel discussion where experts in pharmacy regulations will be sharing additional information. You are encouraged to register for this meeting.

Journal Correction In the December 2016 Florida Pharmacy Journal, the article Deciphering Florida’s New Laws on ARNP and PA Controlled Substance Prescribing by Martin R. Dix, requires a clarifying statement: Existing statutory language addressing PAs states that if the prescription contains the PA’s prescriber number, it creates a presumption that the prescription is valid.

FPA Elects New Officers President-elect and Treasurer to be Installed at FPA Annual Convention Meet Incoming President-elect Angela Garcia Angela Garcia, Pharm.D., is an assistant professor at the University of South Florida College of Pharmacy Department of Pharmacy Practice. She graduated from Nova Southeastern University College of Pharmacy, completed a Drug Information Residency and then earned her Master of Public Health degree. Her academic experiences include graduate education programs in physical therapy at Florida Gulf Coast University as well as several pharmacy programs including NSU College of Pharmacy, University of North Texas and the University of Florida. Prior to her arrival at the University of South Florida College of Pharmacy, she was an assistant professor at the Nova Southeastern University College of Osteopathic Medicine and Public Health Program. Garcia served as the co-coordinator for an international medical mission outreach program through Women of HOPE and the College of Osteopathic Medicine, working in an interprofessional capacity in Jamaica, West Indies, since 2008. In addition, she has worked in community pharmacy and spent her time building relationships that fostered initiatives resulting in improved outcomes for patients. Currently, Garcia is serving as the Member-At-Large for the Florida Public Health Association. She previously served as a member of the organization’s Board of Directors. In addition, Garcia has supported the pharmacy profession through local unit leadership as a former member of the Board of Directors with Broward County Pharmacy Association and currently with the Pinellas County Pharmacy Association. Her leadership experiences within the FPA include serving as a chair for both Public Affairs and Educational Affairs Councils, as well as the Ad Hoc Health Fair Committee chair for seven years. She has been active in advocacy and legislation to support the Florida Pharmacists’ Health Fair and Legislative Days, a program designed to support public health and awareness. Meet Treasurer-elect Ashley Huff Ashley Huff is a newly graduated pharmacist, earning her Pharm.D. from the University of Florida in 2015. She is currently a pharmacy manager with Walgreens Pharmacy in Tampa and is an active participant with FPA. Ashley is also active in her community, where she
works with the Pasco Alliance for Substance Abuse and Prevention (ASAP), an organization focused on decreasing prescription drug abuse. She is a native Floridian and lives with her husband of four years in her hometown of Land O’Lakes. Through the association, she has served on the membership council for two years as both student and pharmacist chair of the Student Affairs Council. She has also held a student liaison position on the Florida Pharmacist Political Committee and worked closely with all the schools of pharmacy in the state to run multiple programs focusing on increasing student involvement and membership. In addition, she has attended and helped coordinate the FPA Legislative Days and Health Fair from the school level for many years. As a pharmacist, she continues to devote her time and efforts to advancing the profession of pharmacy through the FPA.

Gubbins Scholarship Award Presented to NOVA Pharmacy Student Farima Raof is the recipient of the 2017 FPA Terry Gubbins Student Leadership Scholarship. This prestigious award recognizes Raof’s involvement in FPA, involvement in school and community activities, and her demonstrated sense of passion to the profession. Raof is in her fourth year at the Nova Southeastern University College of Pharmacy (NSU COP), and currently serves as the APhA-ASP NSU Chapter immediate past president. She is also as the chair of the Florida Pharmacy Association’s Student Affairs Council. Raof has been extensively involved with the Florida Pharmacy Association, organizing and participating in multiple association events including FPA Legislative Days, presidential debates, annual meetings, and Council leadership duties. In celebration of her significant efforts to promote FPA membership, Roaf was recognized by the FPA’s prestigious #1 Club for her support of member recruitment programs. Executive Summary
Chapter 2016-240, Laws of Florida, was passed during the state’s regular 2016 Legislative Session, and was signed by Governor Rick Scott becoming effective on July 1, 2016. The law directs the state’s Agency for Health Care Administration (AHCA), the Department of Health (DOH), and the Office of Insurance Regulation (OIR) to collaboratively survey the Florida licensed health care facilities, professionals, and payers of health care services in an effort to determine and document: •
The types of health care services provided via telehealth in the state
•
The extent to which telehealth is used by health care practitioners and health care facilities nationally and in the state
•
The estimated costs and cost savings to health care entities, health care practitioners, and the state associated with using telehealth to provide health care services
•
Which health care insurers, health maintenance organizations, and managed care organizations cover health care services provided to patients in Florida via telehealth, whether the coverage is restricted or limited, and how such coverage compares to that insurer’s coverage for services provided in person
The law directs AHCA to compile the survey and research findings and submit a report of such findings to the Governor, the President of the Senate, and the Speaker of the House of Representatives on or before December 31, 2016. This report is submitted by the Agency to meet the requirements of Chapter 2016-240; and represents the collaborative efforts across AHCA, DOH, and OIR. The new telehealth law also creates a Telehealth Advisory Council for the purpose of making recommendations to the Governor and the Legislature. The law designates the Secretary of AHCA as the Council’s Chair, and designates the State Surgeon General (or designee) as a member. The Agency’s Secretary and the Surgeon General appointed 13 Council members representing specific stakeholder groups. The Council is charged to review the survey and research findings included in this report, and to employ that information to inform recommendations to increase the use and accessibility of services provided via telehealth, including the identification of any barriers to implementing or accessing services provided via telehealth. A report of the Council’s recommendations must be submitted to the Governor, the President of the Senate, and the Speaker of the House of Representatives on or before October 31, 2017. 3 16

Highlighted findings contained within this initial report include: •
Utilization of telehealth is expanding in Florida and nationally, both in terms of the variety of applications and use cases as well as patient volume and demand.
•
Nearly half (44.8%) of Florida hospitals responding to AHCA’s telehealth survey indicated that telehealth services are available through their facilities.
•
The most frequent use cases of telehealth reported by licensed health care facilities in Florida include: neurology (including stroke care), home health/patient monitoring, primary care, behavioral health, and radiology.
•
Nearly half (44%) of home health agencies responding to the Agency’s survey indicated using telehealth to assist with remote patient monitoring.
•
Benefits reported from health care facilities and professionals offering telehealth services include improved convenience for both patients and providers, improved efficiencies, and improved patient care outcomes.
•
Financial barriers are the most frequently reported obstacles among health care facilities and providers during both implementation and ongoing operations of telehealth programs.
•
Due to multiple and often conflicting definitions of telehealth at every level (Federal, State, and among private payers and policymakers), there is significant uncertainty across stakeholder groups regarding types of services and activities that may qualify as telehealth for the purposes of coverage and reimbursement.
•
Despite great technological advances over time in the field of Health Information Technology, including Electronic Health Records (EHR) systems and Health Information Exchange (HIE) networks, there remain significant challenges with interoperability between providers across the state and nationally, making it difficult for health care professionals to obtain adequate medical history and clinical information at the time they are treating a patient. These gaps in interoperability were cited by survey respondents as a common barrier to the development and implementation of telehealth programs.
•
Research and survey findings indicate that few providers have achieved a financial Return on Investment (ROI) attributable to the implementation of telehealth services; although some examples do exist.
•
Many providers reported a lack of detailed knowledge about telehealth services, and indicated interest in gaining access to evidence-based best practices, educational resources, or training opportunities associated with telehealth.
