CSX looks on track with strong earnings Analysts praise company’s increase in efficiency; stock price surges.

After a year of big job cuts and service disruptions on the railroad as new management implemented its operating plan, CSX Corp. regained the confidence of Wall Street with strong first-quarter earnings. The Jacksonville-based company’s stock jumped as much as $4.60 to a record high $61.01 Wednesday after it reported earnings of 78 cents a share, 12 cents higher than the average analysts’ forecast,

according to Yahoo Finance. The s to c k reached $61.42 on Thursday. Analysts were particularly Foote impressed with the improvement in CSX’s operating ratio (operating expenses divided by revenue) from 64.8 percent in the fourth quarter to 63.7 percent in

this year’s first quarter. “After a challenging experience during 2017’s rapid implementation of the Precision Scheduled Railroading plan, first quarter’s beat reflects CSX’s strong execution and meaningful progress toward its 2020 OR target of 60 percent,” Robert W. Baird analyst Benjamin Hartford said in a research note. This was the first full quarter as CEO for James Foote, who took

over when Hunter Harrison died in December after just nine months on the job. The ceremony was not only procedural but also advisory with personal experience shared by attorneys who serve on the bench, the Bar and the classroom. “You have accomplished a tremendous goal. The legal profession is truly

a profession of great honor,” said U.S. District Judge Marcia Morales Howard, who presided over the ceremony and administerd the Oath of Attorney. “Lawyers are society’s professional problem solvers,” she added. Jacksonville Bar Association President Tad Delegal welcomed the new

Eight proposed changes to state constitution placed on ballot Florida Constitution Revision Commission adjourns after considering hundreds of changes.

By Max Marbut Associate Editor The Florida Constitution Revision Commission adjourned after more than a year of administrative and public hearings and deliberation on more 792 changes to the

state constitution proposed by the public and 123 submitted by commission members. Eight proposed revisions will be submitted by May 10 to the secretary of state for inclusion on the Nov. 6 general election ballot. In order to become law, a provision

must be approved by at least 60 percent of voters. Revision 1 would amend the constitution to establish additional rights for victims of crime; create a new section to require state courts and administrative law judges to interpret statutes

during litigation between the state and private parties rather than deferring to a state administrative agency’s interpretation; and create a new section to raise the mandatory retirement age for judges from Changes

1000 Degrees Pizza coming to Baymeadows Franchise owner opened first location in Fernandina Beach, one set for Gainesville. Another pizza place is on the way – 1000 Degrees Pizza. 1000 Degrees Pizza-SaladWings is coming to 9846 Old Baymeadows Road, the former Lemongrass Thai Bistro in Deerwood Village Mall. Lemongrass moved to Flagler Center. Prakash Patel, who owns the franchise with his brother Anil Patel, said he expects it will open by midsummer. A site plan for Deerwood Village Mall, represented by The Shopping Center Group, shows 1000 Degrees in 3,500 square feet of space. A pending building permit shows Trigon Construction LLC as the contractor for the $60,000 build-out. 1000 Degrees Pizza, founded in 2014 in Galloway, New Jersey, operates about 40 restaurants in 18 states, including Florida. The company says the gas-fired rotating deck in the oven cooks pizza in 2 minutes. The Patels opened their first area 1000 Degrees Pizza in August at 1480 Sadler Road in Fernandina Beach. Prakash Patel said a Gainesville location will open in a few weeks. “We’re being very cautious on locations. We want to be in the right markets and the timing is

based on what’s available, so in certain areas, we have to wait,” he said. The Patels are looking at the Downtown and Riverside area, Jacksonville Beach and St. Augustine. Their territory is Northeast Florida. The restaurant business is relatively new to them, but not customer service. The Patels worked in the hospitality industry, including owning two Wingate Inns in Jacksonville and a Holiday Inn Express and Best Western in Kingsland, Georgia. After selling the Wingate Inns in 2005, they managed hotels in Florida, Georgia and Alabama until 2015. They sold their Georgia hotels that year, too. A hotel they managed in Alabama had a restaurant and sports bar. They enjoyed it. “It was refreshing,” Patel said. “We thought it would be difficult but it’s very similar to hotels where you are dealing with guests and you have to have customer service skills.” Patel said that they understood customer service and hospitality. “Based on that, we started looking at the fast-casual pizza concept because that was the new style of restaurants,” Patel said. They decided to try a different concept and chose 1000 Degrees based on the quality, the Neapolitan style of pizza that specifies a type of dough and the 2-minute bake time, the fresh ingredients, the baked wings and the buildyour-own salads. The Patels also are installing a self-serve “Pour Your Own Beer and Wine” wall, which includes 18 or 24 taps of beer and four taps of wine, depending on the location. Beer and wine will be priced by

The system allows customers to pour their own selection and pay only for what they pour. “It’s a learning curve for the majority of the patrons but once they figure it out they have a really good time,” Patel said. The wine taps comprise two each of red and white. That allows customers to taste the beers or wines to see which they like before pouring more. Some mix their beers to create their own brew. The taps comprise four to five national beers and the remainder are local crafts and a few nationally known craft beers. The Fernandina Beach hours are 11 a.m.-9 p.m. daily. Jacksonville-area jobless rate unchanged in March By Mark Basch Contributing Writer Jacksonville’s unemployment rate remained low in March with continued strong job growth, particularly in sectors that benefit from spring break tourism. The jobless rate in the Jacksonville metropolitan area (Duval, Baker, Clay, Nassau and St. Johns counties) was unchanged last month at 3.5 percent, the Florida Department of Economic Opportunity said Friday. The state agency does not

adjust the data for seasonal factors but the University of North Florida’s Local Economic Indicators Project reported that on a seasonally adjusted basis, the unemployment rate ticked up from 3.47 percent in February to 3.59 percent in March. The number of jobs on nonfarm business payrolls in the Jacksonville area rose by 21,500 from March 2017 through March 2018, a 3.1 percent growth rate. UNF economist Albert Loh said March is a month where there is typically an increase in jobs.

“A lot of this increase is in sectors that are typically affected by seasonal patterns,” he said. For example, one of the biggest increases was in the leisure and hospitality sector, which gained a net total of 1,700 jobs just from February to March and was up by 4,500 jobs since March 2017, a 5.4 percent growth rate. Retail trade is another strong sector, adding 3,800 jobs in the past year, a 4.9 percent growth rate. The construction sector has the fastest growth rate in the past

year, at 8.9 percent. Jacksonville’s job growth rate was better than Florida’s statewide growth rate of 2 percent in the 12 months through March, and the area’s unemployment rate was better than Florida’s seasonally adjusted jobless rate of 3.9 percent in March, unchanged from February. Duval County’s unemployment rate edged down by 0.1 point to 3.6 percent in March without seasonal adjustment, the Department of Economic Opportunity said. Loh said when the rate is adjusted for

seasonal factors, it still shows a decline from 3.8 percent in February to 3.73 percent in March. Loh said other labor market data for the Jacksonville area shows people are working longer hours and increasing their income, but hourly wage rates are not rising. While he is waiting for signs that hourly wages will rise, Loh said Northeast Florida is off to a good start in 2018. “Overall our labor market continues to strengthen,” he said.

During the conference call, Sloan said the company is taking steps to improve employee compensation. Last month, Wells Fargo increased minimum pay for about 36,000 employees to $15 an hour, and increased base pay for another 50,000 employees. The company also granted restricted shares of stock to about 250,000 employees, he said. Wells Fargo announced firstquarter earnings $1.12 a share. But the company announced Friday that it was fined $1 billion, as expected, by federal regulators for matters related to fees for certain mortgage and auto loan customers. That reduced its first-quarter earnings to 96 cents a share.

CSX was widely criticized last summer for freight service disruptions as it implemented the new operating plan, but Credit Suisse analyst Allison Landry said it’s now the other major railroads that are having problems. “While service has broadly deteriorated amongst its peers, the operational turnaround at CSX is apparent in the form of improved service metrics, with train speed up 22 percent and terminal dwell down 10 percent despite a tough winter,” Landry said in her report. Terminal dwell is the average time a rail car sits at a terminal. CSX’s earnings benefited from unusual revenue items including real estate gains and charges to customers who didn’t meet certain contract obligations. But most analysts remained happy with the results. “While earnings benefitted from unusual items, even the most conservative definition of core earnings still exceeded our expectations by 5.5 percent as a result of stronger yield performance and robust execution on the cost side,” wrote BMO Capital Markets Fadi Chamoun in his note. However, Morgan analyst Stanley Ravi Shanker is maintaining some skepticism because of the revenue items. “Given the magnitude of change and the uncertain cadence of PSR implementation as well as the number of large lumpy items, it will be difficult to extrapolate the first-quarter result and say that the 2020 target of 60 percent OR is running ahead of plan,” Shanker said in his note.

As if Southeastern Grocers LLC isn’t dealing with enough in its Chapter 11 bankruptcy reorganization, the Jacksonville-based supermarket operator found itself needing a new customer rewards program. A year after Southeastern joined American Express Co.’s Plenti rewards program, American Express announced in a tweet last week that it was ending Plenti. American Express gave no explanation for its decision, but Plenti has been losing some highprofile retail participants. Macy’s and Chili’s both announced in January they were leaving the program. Southeastern, operator of Winn-Dixie and three other supermarket chains, wasted no time, announcing last Monday it will introduce a new loyalty program called SE Grocers rewards. That program will allow customers to redeem points at some fuel stations, including Shell. The Plenti program ends July 10. Southeastern, which filed its prepackaged Chapter 11 reorganization plan March 27, expects to be emerging from bankruptcy by that time.

Marcato plug helps Rayonier AM Rayonier Advanced Materials Inc. gave a seat on its board of directors to Marcato Capital Management in February after the activist hedge fund seemed to take aim at the Jacksonville-based company. Marcato returned the favor last week when a plug from one of its fund managers sent the maker of

However, the San Franciscobased banking giant is cutting the size of its network as part of an ongoing restructuring of its operations. Wells Fargo had 5,805 nationwide branches after closing 58 in the first quarter and is planning on closing a total of 300 this year, with a goal of reducing the network to 5,000 by the end of 2020. “Branches continue to play an important part in serving our customers and we will have as many branches for our customers to use for as long as they want to use them,” CEO Tim Sloan said in the company’s quarterly conference call with analysts. “However, our customers are increasingly using our digital

Howard advised the group that opportunities to serve are plentiful and pro bono service need not be formal. “Help a next-door neighbor with a will or help a nonprofit with a legal matter,” she said. Flower advised that the most important concepts to realize as

a young attorney is “absolute rigorous adherence to honesty will secure your place in the profession” and “do the right thing for the right reason.” “Always remember that no one case, client or opportunity is worth sacrificing your integrity or your name,” Howard said. “Never put yourself first. Serve and uphold the law and make sure justice is never subverted.”

MICHELLE BEDOYA BARNETT If I could change anything in the legal system, I would: Lawyer mental health. Despite the fact my job is tough, I happen to love what I do. However, almost daily I talk to lawyers who feel overworked, overstressed and are having difficulty finding happiness and fulfillment in their careers. If I could wave a magic wand I would empower lawyers to make changes in their careers and to seek resources when necessary.

Who or what inspired you to become a lawyer? I grew up in a small town where there were only a handful of lawyers. I remember them all being involved citizens and community leaders and always being willing to help others. There was one teacher, Roger Lizotte (a former police officer turned teacher), and one lawyer in particular (now the Honorable Leandra Johnson), who especially had an impact on my decision and encouraged me along the way. Judge Johnson gave me my first internship at the state attorney’s office and was one of my mock trial coaches. Mr. Lizotte was my criminal justice teacher in high school and provided me my first lessons on the justice system. He was also instrumental in my participation in teen court as well as a mock trial, which I continued through law school. While I have told them what an impact they had on me over the years, I’m not sure they recognize the tremendous role they played in me pursuing my very fulfilling career in law. One person (other than your spouse or partner) who inspires me: Mary Jarrett just retired after a long and successful career as a labor and employment lawyer.

She was one of the first females in Jacksonville in this field. I reached out to her even before I started working full-time and I will never forget that she promptly responded to my e-mail then and each and every time I have reached out to her for advice over the years. She’s a great lawyer and an even better person. How do you relate your undergraduate degree to your practice of law? I was a finance major. Almost every case we touch has a damage component and I am very comfortable with numbers. My degree has been especially helpful in opening the firm, buying a building and ultimately constructing a new office. How did you decide your practice area? And why have you chosen that? My partner and mentor, Mark Alexander, often reminds me of a John Lennon song that says “Life is what happens while you’re busy making other plans.” I never imagined being anything other than a small-town lawyer who does a little bit of everything. In fact, it was my dream to have a law office in a historic house in Lake City. One could say I stumbled upon employment law. I was initially drawn to it during

I was so right about my decision that two of them are now my law partners and have become dear friends. What has been the biggest change in your practice area since you passed the Bar? It depends on which president is in office. Before President Trump was elected, I would have said it was the increase in salary qualifications for a salaried-exempt employee. However, that has all changed. Now I am finding that the crackdown on the use of illegal workers has dramatically risen and I find myself working with Immigration and Customs Enforcement and The Department of Homeland Security on a regular basis.

What community service have you pursued and why that? I have been involved in the Jacksonville Bar since I started practicing law. Some of my best friends have come from my Jacksonville Bar involvement. Outside of the Bar, I volunteer at my kids’ school and have been involved in the March of Dimes, Girl Scouts, The Performer’s Academy and am now serving on the city Ethics Commission. We as lawyers are trained to research and make good decisions. I believe we have a duty to give back. I have learned more about myself and become a better wife, mother and lawyer because of my community involvement.

Websites or apps I can’t live without: Allowancebot – it tracks my kids’ allowance. Favorite nonwork activities: I love traveling with my husband and kids. I’ve recently gotten into cooking. I also love to hit up estate sales and yard sales.

What’s your advice for new lawyers? Slow down. Don’t feel the need to be involved in anything and everything when you first start practicing. Take time to focus on your trade. There will always be lots of opportunities to get involved. My mentor told me this on my first day of work and it still holds true today.
