AllianceFlorida at Cecil Commerce Center master developer Hillwood is proposing another speculative warehouse. Dallas-based Hillwood proposes the 450,000-square-foot Building A-2 in the 13000 block of 103rd Street in the Westside business park owned by the city. The building site is next to the Wayfair distribution center under development. A site plan shows the structure backs up to the General Electric Oil & Gas valve manufacturing plant. Hillwood Senior Vice President Dan Tatsch said construction of the spec building will depend on how quickly other warehouses lease up around Northeast Florida. He said the building might or might not be its next spec building, but is the one “furthest along in concept.” Site plans show about 400 auto parking spaces and about 140 trailer park positions. pants May 14 that Junior Achievement is a game changer, “not just for the individuals, but for our community.” Junior Achievement provides volunteers to help teach elementary, middle- and high-school students about workforce readiness, entrepreneurship and financial literacy. “For those children will one day spend money, buy homes, and lead. We have more diversity in our state than ever before. We need to take care of our diverse children to compete,” Smith said. “Not only is it the right thing to do, but the long-term impact will be felt by industry and business and ultimately our economy,” he said. Smith said the program benefits the schools, students and volunteers. “JA expands our idea of what education is. The lesson plans are intricate and exciting, and truly engage both students and volunteers,” he said. Smith said there is demand for volunteers. “We leave 3,000 students behind each year whose teachers have requested programs but for which we do not have the volunteers. “If you don’t already volunteer, I hope you will consider it, and consider it today,” he said. Students who participate in JA programs served as masters of ceremonies: Ariana Cobb, an eighthgrade student from James Weldon Johnson College Preparatory Middle School; Dekari Long, a second grader from Richard Lewis Brown Elementary Gifted and Academically Talented Academy; and Christian Savin, a 10th-grade student from Douglas Anderson School of the Arts. FIRST INSERTION petitioner wishes the Department to take with respect to the Department’s proposed action. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Department’s final action may be different from the position taken by it in this notice. Persons whose substantial interests will be affected by any such final decision of the Department have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above. In addition to requesting an administrative hearing, any petitioner may elect to pursue mediation. The election may be accomplished by filing with the Department a mediation agreement with all parties to the proceeding (i.e., the applicant, the Department, and any person who has filed a timely and sufficient petition for a hearing). The agreement must contain all the information required by Rule 28-106.404, Florida Administrative Code. The agreement must be received by the Clerk in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, within ten days after the deadline for filing a petition, as set forth above. Choosing mediation will not adversely affect the right to a hearing if mediation does not result in a settlement. As provided in Section 120.573, Florida Statutes, the timely agreement of all parties to mediate will toll the time limitations imposed by Sections 120.569 and 120.57, Florida Statutes, for holding an administrative hearing and issuing a final order. Unless otherwise agreed by the parties, the mediation must be concluded within sixty days of the execution of the agreement. If mediation results in settlement of the administrative dispute, the Department must enter a final order incorporating the agreement of the parties. Persons seeking to protect their substantial interests that would be affected by such a modified final decision must file their petitions within fourteen days of receipt of this notice, or they shall be deemed to have waived their right to a proceeding under Sections 120.569 and 120.57, Florida Statutes. If mediation terminates without settlement of the dispute, the Department shall notify all parties in writing that the administrative hearing processes under Sections 120.569 and 120.57, Florida Statutes, remain available for disposition of the dispute, and the notice will specify the deadlines that then will apply for challenging the agency action and electing remedies under those two statutes. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE TOLOMATO COMMUNITY DEVELOPMENT DISTRICT: SECTION 1. The Series 2019 Assessments shall be levied to defray the cost of the Improvements described the previously adopted improvement plans and the Series 2019 Revised Improvement Plan. SECTION 2. SECTION 3. The total cost of the Improvements is $513,233,755 (“Estimated Cost”). SECTION 4. The Series 2019 Assessments will collectively defray approximately $106,075,000 which includes a portion of the Estimated Cost plus financing related costs, capitalized interest, debt service reserve and contingency, as applicable. SECTION 5. The manner in which the Series 2019 Assessments shall be apportioned and paid is set forth in Exhibit B. The Series 2019 Assessments shall be levied, within the District, on certain lots and lands adjoining and contiguous or bounding and abutting upon such improvements or specially benefitted thereby and further designated by the assessment plat hereinafter provided for; provided, however, that the lots for which debt assessments securing the Prior Bonds have been prepaid in full shall not be subject to the Series 2019 Assessments. SECTION 6. There is on file, at the Districts Record Office, an assessment plat showing the areas to be assessed, with certain plans and specification describing the Improvements and the Estimated Cost of the Improvements, all of which shall be open to inspection by the public. SECTION 7. Commencing with the year in which the Series 2019 Assessments are certified for collection, the Series 2019 Assessments shall be paid in not more than the maximum period of time permitted by law then in effect. The Series 2019 Assessments may be payable at the same time and in the same manner as are ad valorem taxes and collected pursuant to Chapter 197, Florida Statutes (“Uniform Method”); provided, however, that in the event the Uniform Method is not available to the District in any year, or if determined by the District to be in its best interest, the Series 2019 Assessments, or any portion thereof, may be collected as is otherwise permitted by law. The decision to collect special assessments by any particular method – e.g., by direct bill or on the tax roll – does not mean that such a method will be used to collect special assessments in future years, and the District reserves the right in its sole discretion to select collection methods in any given year, regardless of past practices. SECTION 8. The District Manager has caused to be made a preliminary assessment roll, in accordance with the Series 2019 Methodology, attached as Exhibit B hereto, which shows the lands assessed, the amount of benefit to and the assessment against each parcel of land and the number of annual installments into which the assessment may be divided, which is hereby adopted and approved as the District’s preliminary assessment roll. As such, the previously-adopted assessment methodologies, assessments and assessment liens remain in full force and effect. SECTION 12. TOLOMATO COMMUNITY DEVELOPMENT DISTRICT NOTICE OF PUBLIC HEARING TO CONSIDER IMPOSITION OF SPECIAL ASSESSMENTS PURSUANT TO SECTION 170.07, FLORIDA STATUTES, TO CONSIDER ADOPTION OF ASSESSMENT ROLL PURSUANT TO SECTION 197.3632(4)(b), FLORIDA STATUTES, AND NOTICE OF REGULAR MEETING The Tolomato Community Development District (“District”) intends to levy special assessments (i) to secure repayment of bonds issued by the District to refinance its $91,020,000 Tolomato Community Development District Special Assessment Bonds, Series 2006, $2,545,000 Tolomato Community Development District Special Assessment Bonds, Series 2007-1, $7,115,000 Tolomato Community Development District Special Assessment Bonds, Series 2007A-1 and $30,250,000 Tolomato Community Development District Special Assessment Refunding Bonds, Series 2012A-3 (together, “Existing Bonds”) and (ii) to fund certain infrastructure improvements, including but not limited to, additional recreation and transportation improvements. The District will hold a public hearing and regular board meeting on Tuesday, June 11, 2019 at the Nocatee Crosswater Hall, 245 Nocatee Center Way, Ponte Vedra, Florida 32081 at 3:00 p.m. to consider the adoption of an assessment roll, the imposition of non-ad valorem special assessments on benefited lands within the District, a depiction which is shown below, and to provide for the levy, collection and enforcement of the assessments. The public hearing is being conducted pursuant to Chapters 170, 190, and 197, Florida Statutes. The purpose of the public hearing is to receive opinions from the general public and answer questions on the proposed special assessments prior to taking final action. The District may amend or alter the proposed special assessments at the public hearing. At the conclusion of the public hearings, the Board will, by resolution, levy assessments as finally approved by the Board. The Board will also hold a public meeting to consider any other business that may lawfully be considered by the District. A description of the property to be assessed and the amount to be assessed to each piece or parcel of property may be obtained at the District’s Record Office located at Nocatee Amenity Center, 245 Nocatee Center Way, Ponte Vedra, Florida 32081, during normal business hours. By way of background, the District previously issued the Existing Bonds to fund a portion of the infrastructure improvements (“Improvements”) identified in the District’s Improvement Plan, dated November 29, 2004, as supplemented by the 2006 Supplemental Engineer’s Report, dated January 18, 2006, Split Pine Improvement Plan dated November 29, 2004, as supplemented by the Split Pine 2007 Supplemental Engineer’s Report dated April 5, 2007 and 2007 Supplemental Engineer’s Report, dated July 19, 2007 (together, “Improvement Plans”). The streets and areas that are subject to the Improvements are depicted below and in the Improvement plan. The Existing Bonds are secured by non-ad valorem assessments levied on certain property within the District (“Existing Assessments”). In general, the District intends to refinance the outstanding Existing Bonds to take advantage of interest rate savings and to raise additional proceeds through the issuance of new bonds, in one or more series (“Refinanced Bonds”). The proceeds of the Refinanced Bonds will fund certain infrastructure improvements as described more fully in the Preliminary 2019 Supplemental Engineer’s Report for Master Infrastructure Improvements dated May 8, 2019. As part of the refinancing, the District plans to levy special assessments to secure the Refinanced Bonds (“Refinanced Assessments”). Annual assessment payments will decrease and the term of the bonds will not be extended. However, the Refinanced Assessments will be made up of a higher principal amount and a lower interest amount. The assessments may be prepaid in whole at any time, or in some instances in part. The proposed schedule of assessments includes no more than thirty annual installments from the initial collection date of the respective Existing Assessments which the Refinanced Assessments are replacing. The manner in which the District proposes to consider the levy of the Refinanced Assessments is more fully described in the District’s Supplemental Assessment Methodology Report - Series 2019A, 2019B, and 2019C Bonds, dated May 8, 2019 (“Series 2019 Assessment Report”), a copy of which is on file in the District Records Office. The total assessment amount to be levied against each parcel and the unit of measurement to be applied against each parcel to determine the assessment is set forth in the Series 2019 Assessment Report. The following neighborhoods/commercial areas are subject to the Refinanced Assessments: Dell Webb Ponte Vedra Daniel Park Amsdell Self Storage Coastal Oaks Timberland Ridge Chadbourne Apartments Tidewater Oakwood Planet Swim Austin Park Pyrotek Planet Swim - Tennis Willowcove K-9s For Warriors Wheelhouse Storage The Palms - Townhomes Starling Assisted Living TCC North The Palms at Nocatee - Single Starling Senior Independent CRP/Pollack Ponte Vedra Family Living Unassigned Area Twenty Mile Communities Primrose Daycare All assessments described herein may be collected directly by the District in accordance with Florida law, or may be collected by the St. Johns or Duval County Tax Collector, as applicable, on the property tax notice. The decision to collect special assessments by any particular method – e.g., by direct bill or on the tax roll – does not mean that such a method will be used to collect special assessments in future years, and the District reserves the right in its sole discretion to select collection methods in any given year, regardless of past practices. Please be advised that failure to pay any assessments will cause a tax certificate to be issued against your property within the District that may result in a loss of title, or, if the assessments are directly collected, will cause a foreclosure action to be filed against your property within the District that may result in a loss of title. The public hearings and meeting are open to the public and will be conducted in accordance with the provisions of Florida law for community development districts. The public hearings and meeting may be continued to a date, time and place to be specified on the record at the hearings. Any person requiring special accommodations at the public hearings and/or meeting because of a disability or physical impairment should contact the District Manager’s Office at (904) 940-5850 at least forty-eight (48) hours prior to the hearings or meeting. If you are hearing or speech impaired, please contact the Florida Relay Service at 1-800-955-8770 for aid in contacting the District office. All affected property owners have the right to appear at the public hearing and meeting and the right to file written objections with the District within twenty (20) days of the publication of this notice. A person who decides to appeal any decision made by the Board of Supervisors of the District with respect to any matter considered at the hearing or meeting will need a record of the proceedings. Such person may need to ensure that a verbatim record of the proceedings is made, including a record of the testimony and evidence upon which the appeal is to be based.
