By Max Marbut Associate Editor Don’t expect to see much participation by judicial candidates in the campaigning flurry that will lead up to the primary election in late August. In the 4th Judicial Circuit, Judges Don Lester, Steven Whittington, Thomas Beverly, Karen Cole, Katie Dearing, Kevin Blazs,
Robert Dees, Gary Wilkinson, Eric Roberson, Mark Jeffrey Borello, John Guy, Collins Cooper and Suzanne Bass are the sole candidates for their seats on the bench. All but Dearing and Cooper are incumbents. In the only circuit court election that will be on the ballot in Duval County, Maureen Horkan and Charles McBurney are the candidates for Seat 18 in the 4th Judicial Circuit. In the Duval County Court, two contested races will be on the ballot: Seat 3, Michael Bateh and Ger-
ald Wilkerson; and Seat 8, LaRae Hendrix and Kimberly Sadler. Duval County jurists who will be re-elected without opposition are Judges Roberto Arias, Pauline Drake, Emmet Ferguson III, James Ruth, Kelly Elizabeth Eckley, Michelle Kalil and Dawn Hudson. In the 1st District Court of Appeal, which includes Northeast Florida, Judges Harvey Jay, Stephanie Ray, Brad Thomas, Kemmerly Thomas and Allen Winsor all qualified for retention. With two candidates for each
of the three seats that will be on the local ballot, the judicial offices will be decided in the Aug. 28 primary election. The six candidates were invited to the Jacksonville Bar Association’s Judicial Forum that begins at 5:30 p.m. June 12 at the Wells Fargo Center auditorium. All plan to attend except Gerald Wilkerson, who declined the invitation, citing a conflict with a family matter. mmarbut@jaxdailyrecord.com (904) 356-2466

Moongate Kitchen renovating factory. The former Jerome Brown barbecue sauce plant in Northwest Jacksonville has been under new ownership for almost a year and has a new purpose and a new product. Jacksonville investor David Hicks Jr. bought the property in July and is converting it for his Moongate Kitchen venture to manufacture and sell hummus to natural-foods grocers. He had expected to start manufacturing by now, but said permitting took four months. He expects construction to start soon and take five months for completion. but it’s not for sale. “Plant trials have been hugely helpful,” Hicks said Thursday. “That involves making lots of trial product, making sure the equipment works and then getting formulae right.” Hicks, a Jacksonville native who lived and traveled internationally, spent years creating a premier hummus recipe and wants to make the product commercially. Through 5638 Commonwealth LLC, Hicks bought the building at auction. He paid $1.3 million for the property and the sauce equipment. He took title to it as BizCapital BidCo I LLC foreclosed on Cowealth LLC and Basic Products LLC, the entities that operated Jerome Brown Products. Hicks said in February he expects to invest at least $300,000 more into the 33-yearold structure at 5638 Commonwealth Ave., but he still is developing the final plan and budget. The 35,000-square-foot structure sits on 3.8 acres. Hicks bought it out of foreclosure. He also bought the unused barbecue sauce equipment that he likely will use to co-pack sauces for other companies after the hummus business is established. Moongate Kitchen applied for a permit to build-out 10,500 square feet of interior space and 1,200 square feet of exterior space at a cost of $280,000. That work primarily is connected to flooding from Hurricane Irma five weeks after he bought the structure. The building is being remediated as well as renovated. The new floor plan shows shipping and receiving, dry storage, a
mix and cook room, a filling room, space for vegetable prep, an open work area, five offices and an employee area. He is negotiating with a local builder on the project. Hicks said he needs about 5,000 square feet of the building and three to five employees to start. He said about 20,000 square feet of warehouse and offices could be leased to another tenant. He expects to focus on North Florida customers for the first six months to ensure the manufacturing and distribution processes are operating smoothly. Over time, he expects to distribute beyond the area with the limitation that the product is delivered in a timely manner for freshness. Having lived in London, he thought of his former England beach house called Moongate when it was time to name his venture. Hicks moved to London in 1997 with Security Capital Corp. and then formed his own self-storage group, which pioneered the concept across Britain. He sold it in 2007. He then traveled around Europe and Africa to immerse himself into international culinary cultures, and discovered the healthy attributes of hummus. The product is a natural plantbased food made from cooked and mashed chickpeas blended with tahini, olive oil, lemon juice, salt and garlic. Hicks decided to master it and refined his recipe. Hicks, his wife and three children returned to Jacksonville in 2013. Upon his return, “I had a lot of people interested in my hum-

mus.” He experimented and perfected his hummus recipe in his kitchen, adding flavorings inspired by his travels to enhance the creamy, nutty flavor. He calls his product a “nice, clean, premium hummus” made with “curated flavors from around the world.” To produce the hummus on an industrial scale, he assembled a team that includes a process engineer, a research and development chef and a food-safety expert. They created the protocols, including identifying the proper equipment and processes to produce his hummus recipe in a commercial quantity. That’s what the team is testing
now. “Shifting from a big pot in a kitchen to a steam cooker is a big change,” Hicks said. The Commonwealth Avenue building was the site of a plant for the Jerome Brown brand of barbecue sauce. The business was co-owned by District 8 City Council member Katrina Brown, the daughter of Jerome Brown. Brown and District 10 council member Reginald Brown were indicted Thursday by a federal grand jury on charges that include conspiracy to commit mail and wire fraud. The indictment is related to the use of a $2.65 million U.S. Small Business Administration loan that helped a company co-
owned by Katrina Brown finance the barbecue sauce manufacturing operation. Attorneys for Katrina Brown and Reggie Brown said nothing fraudulent occurred and all the money was put into the sauce manufacturing business. Louisiana-based BizCapital Bidco provided a $2.65 million loan for the plant. Cowealth LLC and Basic Products LLC, also received $590,000 from the city through a loan and grant. The sauce plant was supposed to create 56 jobs, but the city said it didn’t. kmathis@jaxdailyrecord.com @MathisKb (904) 356-2466

Program helps some traffic offenders obtain a valid driver’s license in Duval County. There’s a new criminal justice diversion opportunity designed to help certain traffic offenders to obtain a valid driver’s license. Based on the concept that “Knowledge Empowers Your Success” the KEYS 2 Drive program is a partnership among the State Attorney’s Office, Jacksonville Sheriff’s Office, the judiciary and the Duval County Clerk of Courts. A valid driver’s license can help break what for some people is a cycle of suspensions, fines, fees and repeated license-related infractions and also allow greater personal and economic success, according to a news release. “In a city as large as Jacksonville, a driver’s license can be an essential tool for greater prosperity. The KEYS 2 Drive program will put people back on the road legally and safely, all while reducing recidivism,” State Attorney Melissa Nelson said in the release. The program is available to people whose primary offense includes driving while their license is suspended or revoked and those who drive without a valid license.

State Attorney for the 4th Judicial Circuit Melissa Nelson said the new “KEYS 2 Drive” program can help people restore their driving privilege, which she said can be “an essential tool for greater prosperity.”
The clerk’s office is making payment plans available to settle fines and fees. “Initially, participants are eligible to have older fees that had been sent to collections agencies recalled on a one-time basis. As long as participants continue to make all agreed upon scheduled payments and fulfill all other requirements of the KEYS 2 Drive program, they are given a chance to restore their driving privileges while continuing to satisfy their financial obligations,” said clerk’s office spokesman Brian Corrigan.

illnesses such as epilepsy, cancer and Lou Gehrig’s Disease. Peebles said she began working with clients that were seeking the limited number of licenses allowed for cultivation and distribution to patients or caregivers. Her practice is focused on transactional law as opposed to litigation. “I’m a regulatory adviser for clients all over the state,” said Peebles. She points out that legalizing medical marijuana was a major change in state law that’s been in effect for only a few years. “This is an emerging area of law and it’s confusing. Because it’s illegal at the federal level, there’s no set of regulations, so each state is responsible for regulating the industry,” she said. That can affect myriad legal
issues, such as how investors might view the risks of getting into the industry and even landlord and tenant relationships. “The majority of what I’m doing now is drafting leases for dispensaries,” said Peebles. “A standard lease requires the tenant to abide by all local, state and federal laws. Obviously, that can’t apply for a dispensary.” She envisions that the state eventually will license more than 13 authorized producers and other areas of medical marijuana practice also will expand, such as intellectual property issues, as more brands of the product enter the market. “I think this is going to be a growth industry, and I’m in on the ground floor,” said Peebles.

e claim that we live in a modern society, but gender inequality is still evident in many professions, including law. For many, the phrase “gender bias” is an abstract and illusive idea that women and men are treated differently solely because of their gender. Many attorneys have never been a victim of gender bias, many think it only occurs in other parts of the state or country and many operate under the misconception that it does not exist in the legal profession at all. I am here to dispel these myths.
For those who have never been a victim of gender inequality, good for you, but it is important to not remain ignorant of the issue, just because it has never personally affected you. For those who believe that it only occurs in other parts of the state, I can assure you that it is happening here in Jacksonville, right now, as I type this article. And finally, for those who believe that this discrimination is not actively and forcibly invading many aspects of our

FROM THE PRESIDENT
The JBA says goodbye and good riddance to Delegal
TAD DELEGAL JBA PRESIDENT
So, this is my last column as Jacksonville Bar Association president. I know that I’ve heard lots of former presidents
tell me how glad they were to give up this job, and I certainly want to have more time available for my practice and my golf game. But, in truth, I have really enjoyed serving as your president and working with the great group of lawyers and staff who make up the JBA. We’ve done a lot of good things in the past year and I am proud of our accomplishments. Geddes Anderson’s leadership in 2016-17 gave us a good platform from which we began the process of examining and strengthening the association. We went through a lot of gnashing of teeth before managing to land our executive director, Jim Bailey, but Jim and his
team have set us on the right course. (P.S., thanks to Tony Zebouni for helping to trick Jim into agreeing to accept the job). When I look at our events and our organization, I can see some real growth and improvement. The new website is great, the luncheons are improved, the events are improved and the JBA has developed new energy. We have done some great work with the D.W. Perkins Bar Association and the Jacksonville Women Lawyers Association and increased our commitment to diversity and inclusion. I have had the great fortune to have been able to work with President-elect Katie Dearing, Treasurer Elizabeth Ferguson and Secretary Michelle Barnett on our executive board, and we have made
a good team in forging directions for the organization. Our board of governors has been dynamic, and the board members have accepted new roles and responsibilities to help us move the organization in the right direction. All-in-all, I think that we have left the organization in good shape, and I can’t wait to see the great things that Katie and her team will bring next year. The JBA is on a great trajectory, but I do have fears for the profession. Attorneys, judges and the legal system rely upon a system of institutional respect, but we are seeing our country’s institutions continuously denigrated and SEE DELEGAL, PAGE 11

COMMITTEE MEETINGS
Law Day 2018: Civics education in action
JUNE 12 Judicial Relations Noon, Duval County Courthouse, Conference Room 6174
UPCOMING EVENTS
BY CIRCUIT JUDGE ERIC C. ROBERSON CIVICS EDUCATION COMMITTEE CHAIR
Law Day was established in 1958 to contrast with May Day, a holiday celebrated by many communist and socialist groups. Since then, Law Day has been proclaimed every year by the president regardless of his political party. In a joint resolution from the U.S. Congress, Law Day serves as a “rededication to the ideals of equality and justice under law” and “for the cultivation of the respect for law that is so vital to the democratic way of life.” I was shocked by recent polls indicating that there is a growing infatuation, especially among young, coming-ofage voters, with socialism. Socialism and communism have never worked — worse yet, they are responsible for millions of deaths and countless human suffering. Many Americans think the Bill of Rights is what sets us apart from these regimes. Not so. As one former U.S. Supreme Court justice oft-said, “Every Banana Republic has a Bill of Rights. Every presidentfor-life has a Bill of Rights. The Bill of Rights of the former evil empire, (the USSR) was much better than ours.” And he’s right. Reviewing the Soviet Constitution there are great ideals — every citizen has equal rights in all fields of economic, political, social and cultural life, guaranteed employment in their trade or profession of choice, a right to rest and leisure, health protection, housing and education. History shows these are hollow promises — but why? A key reason why America provides the greatest freedoms and opportunity in the world is the Rule of Law. The concept is hard to define; you’ve likely heard the saying that we are a country of laws, not men. To me, the Rule of Law has a few crucial components. First, our separate branches of government provide a check on the other branches that prevent the accumulation of too much power in any single branch. Second, every person — ruler and pauper alike — is accountable to the properly enacted laws and that there are consequences for not obeying the laws we all share. As stakeholders in the legal system, we see these concepts play out every day. But our youth have likely never been exposed to these concepts beyond the classroom. When I took over as chair of the Civics Education Committee almost a year ago, I had an ambitious goal. I wanted to reach students at every middle and high school in the county. With a lot of help and partnerships from those also sharing the passion for increasing civics education, we were able to achieve that

goal on May 1. Duval County Public Schools could not have been more welcoming — from Dr. Patricia Willis, our superintendent, and Kim Bays, the executive director of Natural and Social Sciences, to each and every teacher and administrator at the individual high schools. This year’s program, developed in collaboration with Circuit Judge Adrian Soud and professor Joanmarie Davoli from Florida Coastal School of Law, was titled “A More Perfect Union.” It references the Preamble to the Constitution and the goals for “We the People” to (among other things) “establish Justice” and “secure the Blessings of Liberty.” The program recognizes that our government is not perfect, but it is more perfect than its predecessors of Colonial British rule and the Articles of Confederation. The setup of our government and the U.S. Constitution should not be taken for granted. It was the result of compromise — including the “Great Compromise” that led to a bicameral legislature with the number of representatives determined by population and the Senate having equal representation. It was

also the product of debate — not the rancor that dominates our televisions today, but thoughtful debate — both in the state house in Philadelphia and the public debates for ratification between the Federalists and Anti-Federalists. Our young country saw the dangers of too much power being held by any one person or institution. Accordingly, our Constitution provides that the legislature has the power of the purse (controlling the budget) and the sole responsibility to enact laws, the executive wields the sword (enforcement of laws) as well as the power to veto laws enacted by the legislature, and the judiciary has judicial review to determine if a branch has exceeded its constitutional authority. We ended the presentation, as I will end this article, with two quotes that are as true today as when they were first made. George Washington, in his 1796 farewell speech, said, “It is substantially true that virtue or morality is a necessary spring of popular government.” A century later, Frederick Douglass reiterated this point by saying, “The Life of the Nation is secure only while the Nation is honest, truthful and virtuous.”

Noon in June: A 4th Circuit welcome to new members of the legal community
ASHLEA EDWARDS NOON IN JUNE COMMITTEE CHAIR
As the clock strikes noon on June 21, eager and enthusiastic law clerks, interns and young lawyers will continue the tradition of learning about the Jacksonville legal community. For the past several years, it has been a priority for the Young Lawyers Section of the Jacksonville Bar Association to welcome new members of our legal community with a program called Noon in June. It is an immersive program that teaches prospective and new attorneys the ins and outs of the 4th Judicial Circuit. The day begins with a lunch and introduction to local Bar leaders, including leaders of the JBA, the Young Lawyers Section, the D.W. Perkins Bar Association and the Jacksonville Women Lawyers Association. Noon in June attendees also will hear from a special speaker, Megha Parekh, the senior vice president and chief legal officer for the Jacksonville Jaguars. Parekh will share her legal journey and her experience as the Jaguars’ in-house counsel. After inspirational words from our Bar leaders, the Noon in June group will take some time to visit U.S. District Judge Timothy Corrigan, who will introduce himself and the world of federal law. The group then will make their way to the ceremonial courtroom in the State Attorney’s Office to hear from the Circuit Judge John Guy, Mac D. Heavener III, the chief assistant state attorney, and Lewis H. Buzzell III, the chief assistant public defender, as they describe their roles. As an inherent part of Jacksonville’s legal landscape, the Noon in June attendees will tour Jacksonville Area Legal Aid or JALA. Kathy Para and her exceptional team will show our attendees the importance of giving back to the community through pro bono work and services.

This year, the Young Lawyers Section and Duval County Judge Gary P. Flower have a new, special event planned for the Noon in June attendees. Judge Flower has been hard at work gathering attorneys from all around the 4th Circuit to act as mentors for a speed networking event at Bellwether immediately following the Noon in June program. This is the first time that a speed networking event has been incorporated into the Noon in June program. Attendees will speed network with attorneys to learn about practice areas and the do’s and
don’ts of being a law clerk or new attorney. Through this, we hope the Noon in June attendees form long-lasting mentoring relationships. Also at Bellwether, all attendees are encouraged to attend the Young Lawyers Section Annual Meeting for food and drinks to continue the welcoming and mentoring into the evening. On behalf of the Young Lawyers Section, I would like to welcome all law clerks, interns and young lawyers to Jacksonville and the 4th Judicial Circuit. Regardless of whether you are with us for the summer or
for the beginning of your legal career, we would be honored for you to join us. To register, contact Ashlea Edwards at (904) 598-9929 or ashlea.edwards@grayrobinson.com. We are looking forward to hearing from you. ASHLEA EDWARDS IS AN ASSOCIATE WITH GRAYROBINSON P.A. FOCUSING ON COMMERCIAL LITIGATION, BANKRUPTCY, AND CORPORATE TRANSACTIONS.

PRO BONO
Pilot program can help boost stable housing The Florida Bar Foundation Pro Bono Innovation Grant to Jacksonville Area Legal Aid will fund the Eviction Defense Self Help Clinic. BY KATHY PARA THE JBA PRO BONO COMMITTEE CHAIR
Studies show that stable housing is the foundation for economic autonomy, educational achievement, employment and good mental and physical health. It follows that working to ensure stable housing is a high priority in helping families move out of poverty and into financial health. In March, The Florida Bar Foundation awarded a Pro Bono Innovation Grant to Jacksonville Area Legal Aid to pilot a new service to tenants. The grant will fund the Eviction Defense Self Help Clinic for one year. Smith, Gambrell & Russell helped lay the groundwork for this project. Read the description of the project later in this article, but first read this description of one of their successful cases. James Cummings and Nicole Kalkines accepted this case for full representation. Their efforts resulted in both housing stability and choice for this family. Cummings and Kalkines describe the case: What were the basic facts of your case? Our client was a single father with several young children, living in a rental unit with uninhabitable conditions. Initially, at our intake meeting at JALA, we showed him how to prepare the appropriate statutory notice to the landlord to require the landlord to remedy the conditions. Unfortunately, after the landlord received our client’s notice, the landlord commenced wrongful and retaliatory eviction proceedings without any notification to the client. As a result, the landlord wrongfully obtained a default and a final judgment of eviction against the client. At that point, we immediately filed an appearance in the case on the client’s behalf. What were you able to accomplish for your client? We filed multiple motions (including to set aside the default and final judgment of eviction, and asserting our intentions to pursue counterclaims for retaliatory eviction), and we set a hearing with the court. Before the date of the hearing, the landlord contacted us and we negotiated a favorable global settlement which included the landlord agreeing to vacate the default and final judgment of eviction. Why was the outcome important to your client? Our client was understandably concerned with the possibility of having a wrongful eviction on file against him in the public record, including the detrimental effect this would have on his credit rating and his ability to find housing in the future.
Special to the Daily Record
Smith, Gambrell & Russell attorneys James Cummings and Nicole Kalkines helped a single father fight an eviction.
Why was the experience important to you? That is, what did you gain from the experience? There is a deep satisfaction in preventing, and in many cases such as this, reversing a clear injustice. The disparity in power between certain landlords and tenants in our community is real, particularly in low-income housing. Wherever a disparity of power exists, there will always be the potential for abuse. Each of the attorneys in our firm who have participated in the JALA Landlord/Tenant Pro Bono Initiative have reported that it not only fulfilled their duty as lawyers to perform pro bono legal services, but furthermore, it provided a satisfying and rewarding experience. What is the name of your firm? In what areas do you practice? Smith, Gambrell & Russell LLP. James Cummings is a partner in our litigation group and Nicole Kalkines is one of the firm’s newest litigation associates. What advice do you have for other attorneys considering
pro bono involvement? Get involved. Not only is it a rewarding experience, but it’s also a fantastic opportunity for newer attorneys to get their feet wet with client interaction, case management from beginning to end and courtroom experience. The pro bono project funded by The Florida Bar Foundation will help tenants defend against wrongful evictions and maintain stability. The Eviction Defense Self Help Project is a resource available from 1 p.m. to 5 p.m. every Wednesday afternoon on the 7th floor of Jacksonville Area Legal Aid, 126 West Adams St. Tenants of private landlords who receive an eviction summons and who may have defenses will complete their answers using the Florida Justice Technology Center’s new Pro Se Eviction Defense Answer form. Pro bono attorneys will be there to assist with the answer and to provide guidance. Tenants will be directed where and how to file their answers that day. The project needs a few good law firms and willing pro bono attorneys. The law firm commitment: The goal is to have four law firms commit to staffing the project once a month. The law
firm will supply two or three attorneys one Wednesday afternoon per month to assist pro se tenants in private rental properties and create answers to their eviction summons or rental conditions letters. Attorneys are encouraged to consider representing clients in either a full or limited capacity, especially those that may be harder hit by eviction, such as people with disabilities, single parents and senior citizens. Benefit to the law firm: Through participation in the project, new associates get excellent client interviewing, representation and litigation experience with short-term matters. The participating firm attorneys will build a core of expertise and have the opportunity to collaborate on short-term cases. Support for pro bono attorneys: Training webinars by attorneys Jeff Haynie and Katherine Hanson with CLE credit will be provided. In addition, Suzanne Garrow, the project coordinator, will be on-site to assist, as needed, and guide the process. This project has been piloted
for the past two years by Smith, Gambrell & Russell, which will continue to participate on the second Wednesday of every month. The logos of all participating law firms will be included on project information. Landlord/tenant cases move quickly, making it difficult to provide meaningful assistance to tenants facing eviction. Because the Eviction Defense Self Help Clinic will be offered weekly, qualifying tenants will have greater opportunity to file effective answers and defend against wrongful evictions. Stable housing means children don’t have to change schools, parents can keep steady employment and families have a much better chance to work toward economic health. LAW FIRMS AND ATTORNEYS ARE ENCOURAGED TO CONTACT KATHY PARA, CHAIR OF THE JBA PRO BONO COMMITTEE FOR MORE INFORMATION ON THE EVICTION DEFENSE SELF HELP PROJECT AND OTHER OPPORTUNITIES FOR PRO BONO INVOLVEMENT THROUGHOUT THE 4TH JUDICIAL CIRCUIT. Bias: Women have made uneven progress CONTINUED FROM PAGE 6
legal profession, I respectfully request that you kindly remove your blinders and educate yourself on this issue so that you do not end up a victim, or worse yet, a perpetrator. Recently published surveys have painted a discouraging picture of the prospects for women in the legal profession. It is an unfortunate reality that gender bias exists in many aspects and many practice areas. Simply put, women have made uneven progress as compared with their male counterparts, and this is true whether we are discussing salary, partnership track, case assignments or, my own personal favorite, trial work. A young, female litigation associate, at a midsize firm in town, became pregnant with her first child. She ultimately discovered that, per her physician’s recommendation, the baby would be delivered via cesarean section at 39 weeks. Her delivery date fell on the Wednesday of the first week of
a two-week jury trial, which had been set the previous year. Although this young, female attorney had planned to try this complicated case with her senior partner, this was her case. She had handled the pre-suit, she had handled the discovery, the depos, the experts and, most importantly, the client. She attempted to obtain consent to reset the trial from the opposing party’s attorney, but she was denied. She was forced to file her motion to continue and set it for hearing. At the hearing, the opposing attorney argued that this young associate’s cesarean section was purposefully scheduled for the week of trial in order to secure a continuance and gain some kind of unfair advantage. Fortunately, the judge presiding over the case was horrified by the obtusely absurd argument and she not only granted the motion, but gave the opposing attorney a lecture on professionalism and civility. Two weeks ago, I was contact-
ed by a fellow trial lawyer and mom who is currently pregnant with her second child. She filed a motion to continue in one of her trials, which is set when she is scheduled to deliver. Opposing counsel filed a response. In this response, the attorney cited a case which discusses how the trial court should handle a continuance when one attorney has an “illness.” That’s right, an illness. This attorney actually filed a pleading, in the public record, with his name on it, which compares the birth of a baby to an illness. The point here is that these two female lawyer-moms are not alone and their stories are not isolated incidents. Many times gender bias is not as blatant as a female attorney, walking into a hearing and being mistaken for the court reporter or an opposing counsel referring to a young attorney as “sweetheart” or “honey,” although I have been involved in both of those situations. The good news is that gender
bias is becoming a topic of conversation in the legal profession and raising awareness is quickly rising to the forefront of business here in our city and state. Last May, The Florida Bar board of governors considered the proposed Rule of Judicial Administration 2.570, which governs parental leave. The proposed rule provides, “A motion for continuance based on parental leave of the lead attorney in the case shall be granted if made within a reasonable time after learning the basis for the continuance unless substantial prejudice to the opposing party is shown. Three months shall be the presumptive length of a continuance granted for parental leave absent good cause for a longer time. If the court denies the requested continuance, the court shall state on the record the specific grounds for denial.” The commentary to this proposed rule discusses that the legal profession is committed to the importance of work-life bal-
ance, and allowing trial lawyers, both mothers and fathers, time to enjoy their new additions without the fear that the trial, of a case they have worked so hard on, will be taken away from them and given to another attorney, simply because they dared to start a family. Baby steps are being taken in the right direction, but there is more work to be done. Education and awareness on this issue are of the utmost importance. Kofi Annan said, “Gender equality is more than a goal in itself. It is a precondition for meeting the challenge of reducing poverty, promoting sustainable development and building good governance.” This is what we should all strive for. LINDSAY L. degraded. Our society is becoming numb to daily attacks on the concepts of honesty, decency, the rule of law and respect for institutions – the very concepts and principles upon which our profession is built. I have become increasingly concerned as a parade of respected figures, including conservative statesmen and persons
who have left the administration, who have warned about the danger that the president poses to the continued viability of our nation, only to see their warnings seemingly lost in a news cycle that features the next day’s new presidential outrage. We shrug off constant stories of conduct and statements that would have brought down
past administrations, seemingly oblivious to the growing number of the president’s inner circle who are under indictment. I cannot help but think that the pattern we are seeing is probably similar to that observed by the legal profession in societies destroyed by strongmen or cults-of-the-individual, and I profoundly hope that we don’t
find ourselves longing a decade from now for the good old days of the rule of law. I am hopeful, though. I have had the chance to work with some extremely dedicated and competent persons during my tenure with the JBA, and I know that those people are dedicated to preserving the values of the American system of government.
As JBA president, I witnessed how our members give their time and energy to the community and to the continuation and improvement of our justicebased society. It has been an honor to serve as your president, and I thank you very much for the opportunity.

IN THE LAW . . .
CYNDY TRIMMER By Max Marbut • Associate Editor
CYNDY TRIMMER
In addition to her career as a land use and zoning attorney, Cyndy Trimmer has been a member of the

governors, Trimmer is stepping away from her editing duties, but will consult with the new chair who will be appointed by 2018-19 board President Katie Dearing. Who or what inspired you to become a lawyer? I’ve wanted to be a lawyer for as long as anyone can remember. My mother tells stories about the time I had to draw what I wanted to be in nursery school, and I drew myself with a little briefcase. To be fair, I also drew a ballerina, but that one was not in the cards. How do you relate your undergraduate degree to your practice of law? My undergrad degrees are in psychology and law. The psych background really impacted my level of empathy and appreciation for the motivations behind action and decisions. They are invaluable qualities in a job that constantly requires building consensus and resolving disputes. How did you decide your practice area? And why have you chosen that? My practice area is commercial real estate development focusing on land use and zoning. The job was recommended to me by a colleague I met through the Bar. I knew nothing about the area of law at the time, but once she started describing it to me, it sounded like a great fit for my personality and skill set. My job is the perfect mix of lawyering and lobbying and I love it. I get to help people make their dreams a reality while working with brilliant development professionals to bring new projects to the city.
Hometown: Hyde Park, Pennsylvania
What has been the biggest change in your practice area since you passed the Bar? My first office had a single computer with dial-up internet in a back room and PalmPilots were all the rage. The vast majority of correspondence was handled by thoughtfully crafted letter and reaching someone when they were away from the desk was near impossible. Now we all squeeze as much work as possible into the few minutes we are stuck at a red light and are still handling texts and emails from our phones as we lay in bed at night.
One person (other than my spouse or partner) who inspires me: City Council member Lori Boyer Favorite book: “The Song of Ice and Fire” series by George R.R. Martin (since before it was an HBO series and cool) Books I’m reading now: Whatever my book club says I should be reading, which currently is “The Nightingale” by Kristin Hannah
If I could change anything in the legal system, I would: Provide more certainty in outcomes. I know it is maddening to anyone who does not practice law, but most of the time, the answer really is “it depends.” What community service have you pursued and why that? Outside of my Bar service, I am an active member of the Junior League of Jacksonville. I originally joined to meet people when I moved here. I have stayed active over the years because the league truly lives up to its motto: Women Building Better Communities. Junior League provides me the opportunity for personal growth through placement on a new committee each year, as well as a venue for giving back to the community through direct service with our countless community partners.

and do not stop looking until you find it. If you are feeling perpetually burnt out, stressed or dissatisfied, do not assume that’s just part of being a lawyer. Also, take steps to improve your quality of life like getting involved in voluntary Bar organizations or civic groups. Having a network of like-minded people outside the office is vital to personal and professional satisfaction.
Some of my favorite volunteer experiences have been with Daniel Kids, Cathedral Arts Project, White Harvest Farms, Feeding Northeast Florida and the Jacksonville Symphony Instrument Zoo. What’s your advice for new lawyers? Find the practice area and office that are the right fit for you,
