The American Bar Association has filed a motion to dismiss the lawsuit brought against it in federal court by Florida Coastal School of Law. Florida Coastal, along with the two other law schools owned by Naples, Florida-based InfiLaw Corp., in May filed due process complaints in federal courts in response to the ABA finding that the schools are not in compliance with standards related to admissions and curriculum that have resulted in poor first-time Bar exam pass percentages for its graduates. The pass rate for Florida Coastal was 42.7 percent for the July 2017 Florida Bar exam; 62.1 percent in February, below the ABA minimum standard of 75 percent within two years of graduating. The February results for Florida Coastal’s graduates was the fourth-highest pass rate in the state among 11 law schools, according to the Florida Board of Bar Examiners. Arizona Summit School of Law, also owned by InfiLaw, reported a 20.1 percent pass rate in July 2017 and 19.8 percent in February. It was placed on probation by the ABA in March 2017. The other InfiLaw school, Charlotte School of Law in North Carolina, closed in August. Its graduates had a 34.1 percent Bar passage rate in July 2017. Florida Coastal was notified in October that the Accreditation Committee of the ABA Council of the Section of Legal Education

Chamblin plans Downtown apartments, restaurant

Ron Chamblin’s next chapter Downtown is developing the building at 225 N. Laura St., next to his bookstore, into apartments and a restaurant. “It’s going to be another building that will be occupied and renovated and used,” said Chamblin. Chamblin proposes to convert the three-story, 6,500-square-foot building just east of Hemming Park into four apartments on the upper two floors and a restaurant on the first floor. He bought the building in 2012. It housed the Gus and Co. shoe & and luggage repair shop until that business moved to 228 W. Adams St., near the Duval County Courthouse. Chamblin said the units facing Laura Street will feature balconies. The largest unit is three bedrooms and the others are two-bedroom. Rents will range from $900 to $1,995 a month. The street-level restaurant would provide breakfast and lunch and also feature evening events. It would serve beer and wine. “The entrance is going to be neat,” Chamblin said. It will feature a patiotype entry with tables and chairs. The city is reviewing a permit application for the $900,000 project.

Fred I. Podris is the architect. Chamblin said Breaking Ground Contracting is the general contractor. Chamblin expects construction to start “in earnest” in August and be completed in about nine months, about May. It’s adjacent to Chamblin’s Uptown at 215 N. Laura St. He said he bought that building for $930,000 in 2006, invested $630,000 into renovations and opened the bookstore in 2008. Both structures were built in 1904, property records show. The two-story bookstore building comprises 12,300 square feet. He said the 225 N. Laura St. building sat vacant for years. “It was quite deteriorated but we gutted everything. I’m just not intimidated about that kind of thing,” said Chamblin. “I bought it for $300,000 in 2012 because I felt like somebody ought to do something with it. So I’m doing it,” he said. Adding four more living units Downtown isn’t a lot, but it’s a step toward city goals to offer more housing in the urban core. Downtown Vision Inc. will report soon that there are almost 3,000 existing housing units Downtown with 4,450 residents, about half of the 10,000 residents considered necessary to be a critical mass for retail and services development. DVI CEO Jake Gordon said there is little residential vacancy Downtown. “That should be prime real estate for someone that is working Downtown or interested in Downtown living,” he said. Cavendish contributes to ‘Evidence in Florida’

Attorney spent more than 100 hours writing four chapters in 826-page book. Attorney Michael Cavendish wasn’t expecting a package to arrive the week before last at the Downtown office of Cavendish Partners. And he really wasn’t expecting it to contain two copies of an 826-page, $334 book, the 11th edition of “Evidence in Florida,” published by The Florida Bar in cooperation with LexisNexis. It’s the latest update of case law, statutes and regulations related to the civil and criminal practice rules of evidence in Florida. When he looked at the table of contents, Cavendish realized why the package was delivered to him. “I had forgotten I had written four of the 15 chapters,” he said. The author of the chapters covering privileges, impeachment and parol evidence as well as the introduction chapter, Cavendish said he devoted more than 100 hours over the course of a year, nights and weekends, to the project while he was an attorney in Gunster’s Jacksonville office before he opened his solo practice law firm in

November 2017. “It seems like another lifetime ago,” Cavendish said. He’s been a contributor for The Florida Bar’s official legal publications for nearly 20 years, since he was a summer associate at McGuireWoods and one of the partners asked if he’d like to get involved in writing a chapter. Cavendish said writing for the publications gives him a different perspective on the law. “When you’re litigating, it’s easy to lose sight of the overall law you’re practicing. It’s nice to have an excuse to delve into the scholarly presentation of the law,” he said. Since he’s now focused on building his solo practice, this may be the final time “by Michael R. Cavendish”

Lopez, staff honored for work in Mexico City They helped investigate and prosecute members of the Los Zetas cartel who murdered a U.S. special agent. BY MAX MARBUT ASSOCIATE EDITOR

U.S. Attorney in the Middle District of Florida Maria Chapa Lopez and three members of her staff were among the 162 employees of the Department of Justice recognized June 15 at the 34th Director’s Awards Ceremony in Washington, D.C. Chapa Lopez accepted the award for Superior Performance by a Litigative Team for her work while detailed to the U.S. Embassy in Mexico City. She and her colleagues investigated and prosecuted members of the Los Zetas cartel who murdered Immigration and Customs Enforcement Special Agent Jaime Zapata and wounded ICE Special Agent Victor Avila in February 2011 during an attempted carjacking in Mexico. Assigned immediately after the attack, the team soon began filing charges against the assailants. Over the next 6½ years, seven defendants were extradited to the U.S., five of whom pleaded guilty and agreed to cooperate with the investigation. In July 2017, the final two defendants were prosecuted and convicted. Administrative Officer Jeff Hahn, Office Manager and IT Specialist Joey Chigro and Assistant U.S. Attorney Ilianys Rivera Miranda received the award for Superior Performance by an Administrative Team for their work in coordinating and implementing emergency response efforts to the District of Puerto Rico and the District of the Virgin Islands in the aftermath of hurricanes Irma and Maria. Working with employees from the District of Puerto Rico and the Southern District of Florida, they analyzed policies to find the best ways to handle emergency relief efforts which could serve as best practices for other U.S. Attorney’s offices responding to similar emergencies.

Jacksonville men sent to prison for conspiracy

U.S. District Judge Brian Davis on July 2 sentenced professional bodybuilder Donald McCloud Long, 51, of Jacksonville, to 18 months in federal prison for conspiracy to illegally distribute anabolic steroids. Gregory Allen Baker, 30, also of Jacksonville, was sentenced to three years in federal prison for the same offense and for money laundering. Long’s wife, 35-year-old Sarah Long, was sentenced to 42 months of probation, including 12 months of home confinement. The investigation determined that from January 2015 through September 2017, the Longs distributed anabolic steroids and human growth hormone as part of their “Team Long” training regimen.

The couple provided dosage directions and instruction to athletes on how to consume steroids and HGH to prepare for bodybuilding and other athletic competitions, according to court documents. Baker was the primary source of supply for the drugs and imported raw anabolic steroids and HGH from China. He manufactured the steroids into consumable form, branded it “AxioLabs” and provided it to the Longs and others. The court also ordered the Longs to forfeit $250,000, traceable proceeds of the offense. Baker was ordered to forfeit three motor vehicles, a motorcycle, an electric golf cart, jewelry and proceeds in the amount of $124,418. He also consented to forfeit $37,800 in additional proceeds. The cases were part of “Operation Total Package,” led by the Drug Enforcement Administration. The investigation also involved U.S. Immigration and Customs Enforcement’s Homeland Security Investigations, the U.S. Postal Inspection Service, U.S. Customs and Border Patrol, the Jacksonville Sheriff’s Office, the Jacksonville Beach Police Department, the Green Cove Springs Police Department, Internal Revenue Service and the U.S. Anti-Doping Agency.

Online sex offender arrested in St. Johns The U.S. Attorney’s Office for the Middle District of Florida has charged St. Augustine resident Kenneth B. Hanger, 46, with soliciting child pornography using the internet. According to the criminal complaint, on May 22 a detective with the St. Johns County

Sheriff’s Office reviewed sexual offender registration information provided by Hanger. The defendant disclosed use of a Facebook account that did not list his true name. Posing as a minor child, the detective sent a “friend request” to the account, which was accepted by Hanger, who then made online contact with the “child.” Between May 24 and June 5, Hanger engaged in online texting conversations after he was advised and acknowledged that the “child” was only 13 years old. On June 1, Hanger raised the topic of sexual activity. Three days later, he sent a photo of his genitals and solicited the “child” to send him a graphic video depicting “her” genitals. Hanger was arrested by St. Johns County police June 6 at his home in St. Augustine. He admitted during an interview that he had engaged in the conversations, had sent the photo and that he had stated his intention to engage in sex with the “child.” Hanger was required to register as a sexual offender in 1994 after he was convicted of aggravated indecent assault in Bradford County, Pennsylvania. Because of his prior sex offense conviction, Hanger faces a mandatory minimum sentence of 25 years, and up to 50 years, in federal prison and a potential life term of supervision.

Bombing attempt yields 10-year sentence

Ending an investigation that began three years ago, Joshua Ryne Goldberg, 23, of Orange

Park, was sentenced June 25 by U.S. District Judge Brian Davis to 10 years in federal prison, to be followed by a lifetime of supervised release, for attempted malicious damage and destruction by an explosive of a building. He pleaded guilty on Dec. 20. According to the plea agreement, in the summer of 2015, the FBI and law enforcement officers from Australia began investigating the online name “AusWitness” and determined that it was Goldberg. He had come to the attention of law enforcement due in part to his social media postings concerning the May 3, 2015, attack by two gunmen at the Muhammad Art Exhibit and Contest in Garland, Texas. Prior to the attack, Goldberg posted a map of the location of the contest and urged anyone in the area to attack the event. His posting was copied by gunman Elton Simpson, one of the two people killed during the attack. The FBI later located an online posting in which Goldberg took responsibility for inspiring the Garland attack, as well as two other planned attacks. In July 2015, an FBI confidential human source began exchanging messages with Goldberg as “AusWitness” on social media. Between July and mid-August 2015, Goldberg discussed getting someone in Melbourne, Australia, to carry out a terrorist attack and to have the confidential source commit a bombing in the United States. Goldberg sent website links to the source containing instructions for making an explosive device, including pipe bombs and other incendiary devices.

On Aug. 20, 2015, Goldberg stated that he was thinking of pipe bombs at a large public event and later said that a pressure-cooker bomb may be better. Later that month, Goldberg told the source that he had found the “perfect place” to target on Sept. 13, 2015, and sent a link to a Kansas City, Missouri, firefighter’s event that memorialized first responders that had been killed in the September 11 attacks. On Aug. 27, 2015, Goldberg instructed the CHS to place the bomb near the crowd at the memorial event and to ensure it was very well hidden. The following day, Goldberg provided the CHS with a list of items to use in the pressurecooker bomb. He instructed the CHS to dip screws and other shrapnel in rat poison before putting them in the pressurecooker bomb in order to inflict more casualties. A forensic analysis of the bomb-making information determined that it could have been used to make explosives that would cause property damage, personal injury and/or death. This case was investigated by the FBI’s Joint Terrorism Task Force and the Clay County Sheriff’s Office. The Jacksonville JTTF comprises the FBI, the Naval Criminal Investigative Service, U.S. Immigration and Customs Enforcement’s Homeland Security Investigations, U.S. Customs and Border Protection, U.S. Border Patrol, the Florida Department of Law Enforcement, Florida Highway Patrol, St. Johns County Sheriff’s Office and Jacksonville Sheriff’s Office. and Admissions to the Bar found the school to be out of compliance with:  Standard 301(a), which requires law schools to have a “rigorous program” to prepare students to pass a Bar exam and practice law.  Standard 309(b), related to academic support standards to give students a “reasonable opportunity” to complete their studies and become lawyers.  Standard 501, sections (a) and (b), which directs that accredited law schools have sound admissions policies and mandates that potential students who don’t appear capable of graduating from law school or passing a Bar exam should not be allowed to enroll.  Interpretation 501-1, which discusses factors to consider in admissions. In March, the Accreditation Committee found that Florida Coastal had come into compliance with Standard 501(a). For the other standards in question, the committee instructed the school to develop a plan, including admissions data and methodology, to achieve full compliance with the standards. Florida Coastal has not been placed on

probation by the ABA. The ABA’s motion to dismiss, filed June 1 with the U.S. District Court Middle District of Florida, points out that the ABA has not ruled on Florida’s Coastal’s appeal of its findings. The ABA states in the motion that courts have previously held that judicial review of such actions are not ripe until due processes are complete. “The court cannot evaluate whether Coastal was denied due process if Coastal has not yet actually availed itself of the processes still available to it.” The motion also requests that if the court disagrees with the motion to dismiss, it should alternatively grant a stay of proceedings pending the conclusion of Florida Coastal’s appeal of the committee’s findings. According to the ABA, the council is expected to rule on the appeal at its Aug. 2 meeting. In addition, the ABA is seeking to consolidate pretrial proceedings related to Florida Coastal’s lawsuit and the similar actions filed in other federal jurisdictions by Arizona Summit Law School and Charlotte School of Law. Arguments are scheduled to be heard July 26 before the U.S. Judicial Panel on Multidistrict Litigation when it convenes in Santa Fe, New Mexico.

Of the four incumbent constitutional officers, only Jacksonville Sheriff Mike Williams doesn’t have the council or the Legislature on his resume. “Serving on the council gives you kind of a kickstart because you learn how the offices work,” said Duval County Supervisor of Elections Mike Hogan. Hogan He was a council member from 1991-99 and a state representative from 2000-03, when he was elected tax collector and then served two four-year terms. He was elected in 2015 to run the elections office. He said serving in the local legislative branch is a way to establish a relationship with the public, but just as important, council experience gives a constitutional officer insight into how rules and laws are made and how the annual budget process works. The race for tax collector is a special election because Michael Corrigan resigned the post effective June 1 to become CEO of Visit Jacksonville, the convention and visitor’s bureau for Jacksonville and the Beaches. Corrigan is a former two-term council member. If one of the four candidates gets the majority of the vote in the Aug. 28 primary election, he or she will be the next tax collector. Otherwise, the two candidates receiving the most votes in the primary will face each other in a runoff election Nov. 6. The winner will serve the remainder of Corrigan’s term, until June 30, 2019, and will need to qualify for election and campaign for the office again in 2019. Jessica Mathis is the 2018-19 president of the Jacksonville Bar Association Young Lawyers Section. She joined the Dawson | Orr law firm in June as senior associate attorney. Who or what inspired you to become a lawyer? When I was attending Florida State University, I took a class on the Supreme Court. My professor pulled me aside after class one day and asked if I ever thought about pursuing a career in the law as he saw great potential in me. I had not considered it, but after speaking with him I signed up to take the Law School Admission Test. Without that professor’s encouragement, I would not be a lawyer today. How do you relate your undergraduate degree to your practice of law? My undergraduate degree is in political science and I minored in international affairs. I believe that my undergraduate degree provided me with a foundation of understanding the political process and key issues in politics, which is undoubtedly intertwined with the law. How did you decide your practice area? And why have you chosen that? In law school I had the great fortune of clerking every summer. I tried to gain experience in various areas of the law. Civil defense litigation seemed to be what best fit my personality. I enjoy the practice and being in the courtroom. Litigation provides me with that opportunity. What has been the biggest change in your practice area since you passed the Bar? E-discovery. With everyone communicating via email, text messages and on Facebook and other social media, it has broadened the

If I could change anything in the legal system, I would: Ensure that cases are resolved in a more expeditious fashion. There are many times that cases go on for years and clients are left with large legal bills and no end in sight. In some cases, this dissuades people from bringing their grievances to the legal system. I think we can do a better job of case management to keep cases moving and on track for resolution.

information that we need to gather when investigating cases. Much of the e-discovery necessarily includes hiring an expert or outside firm to assist in this process, as the method by which we collect these forms of data is challenging.

What community service have you pursued and why that? The majority of my community service is through the Young Lawyers Section of the Jacksonville Bar Association. We put on several events for local charities each year. The golf tournament, poker tournament and chili cook-off are the three charitable events that the YLS hosts. We have donated thousands of dollars to the HEAL Foundation, the Ribault High School mentoring program, K9s for Warriors, Rethreaded and many other organizations. We try to include a variety of charities that have unique missions. I look forward to continuing to donate to local charities this year.

While work is important, no matter how long you’ve been practicing, finding a balance is important for longevity in your career and for stress management. Sometimes we allow our stress to take over, and having something outside of work to assist in this is critical.
