That’s based on their historic role in the profession. “When there’s a tough project the Bar needs to be done, when they need boots on the ground, they call us,” said Christian George, 201819 president of the Young Lawyers Division of The Florida Bar. The managing partner of the Akerman law firm’s Jacksonville office, George was president of the Jacksonville Bar Association’s Young Lawyers Section two years ago when he also was president-elect-designate of the statewide group. Membership in YLD is automatic for members of The Florida Bar who are under 36 years of age or who have been practicing for fewer than five years. There are more than 25,000 YLD members this year. George said one of the division’s primary responsibilities is helping law students transition from the classroom to the courtroom or the conference room. “Like other graduate degrees, law school doesn’t teach you everything you need to know for the real world,” George said. The division has launched a new resource, the “Legal Accelerator,” that’s available

With the property now in their possession, developers Michael Munz and Peter Rummell say there should be no skepticism their ambitious mixed-use development along the Downtown Southbank will break ground. “I’m over the naysayers, I’m over the doubters,” said Munz hours after the team announced it had closed on the 30-acre Munz site next to the Duval County School Board building for The District. Dallas-based Preston Hollow Capital LLC facilitated the $18.59 million payment to the group’s Elements Development of Jacksonville LLC to secure the land, formerly home of JEA’s Southside Generating Station. According to Duval County property records, Elements on July 13 secured a $20 million mortgage with Preston Hollow Capital, then closed on the property through a transaction with JEA. “Anybody who is doubting that we will move forward and get the development going as quickly as possible, is just being foolish,” Munz said. It’s a major step, nearly five years after the team began negotiations with the city, JEA and its financing partners.

Pastor says deal saves growing congregation “a ton of money and a ton of time.” Harvest Baptist Church was preparing to build a new campus on property it bought along the Arlington Expressway when the call came with another option. St. Matthew’s Lutheran Church along Merrill Road, 2 miles north of Harvest Baptist’s Arlington Road campus, offered to make a deal. “We were able to save a ton of money and a ton of time,” said Harvest Baptist Pastor Bryan Samms. Harvest Baptist Church now has a contract to buy the St. Matthew’s campus on about 6 acres at 6801 Merrill Road and invest $2.6 million for the land, buildings and renovations, he said. The deal should close Sept. 6 and the move follows that month. St. Matthew’s will rent space there temporarily for worship as it makes its next move, he said. The new space will provide seating for up to 500. “The Lord opened the door for us, without question. He knew we needed to save millions of dollars,” Samms said. “We could get so much more for so much less.” Harvest Baptist had been anticipating investing up to $12 million over three phases at the 18.5-acre Arlington Expressway property it bought in September for $1.75 million. Now, that site is under contract for $1.55 million to an investor that Samms understands is contemplating senior housing. He said the deal went to contract the last week of June and closing is set for August. “We were able to get rid of it and with minimal loss,” he said. And the Harvest Baptist property at 1051 Arlington Road N., at Lillian Road is listed for sale for $850,000. That 1.62-acre site comprises about 20,000 square feet of office, an auditorium and education space, Samms said. None of the interested buyers is under contract.

Samms said he came to Harvest Baptist and a congregation of 60-70 people in 2016. Sunday attendance of up to 250-300 has strained the 52 parking spaces and 200 auditorium seats. Harvest had drawn up plans and bought the expressway land when St. Matthew’s told him it was downsizing. It provides 50,000 square feet of buildings for the church, and the auditorium can seat up to 500. Harvest Baptist is remodeling the auditorium, removing pews to add chairs, redoing floors and adding new paint and lighting. The fellowship hall is repainted and the lobby already is redone. Upon the relocation, the 46-yearold Harvest will become River City Baptist Church. “It’s a fresh start,” Samms said. The federal court in Jacksonville granted in favor of North Florida Shipyards Inc. a final default judgment against the R/V Atlantis II and has ordered it auctioned. The 210-foot research vessel was built for the Woods Hole Oceanographic Institute with a $5 million grant from the National Science Foundation. U.S. District Judge Marcia Morales Howard signed the default judgment in the amount of $319,759.79 for dockage and services, interest, attorney’s fees, court costs and a fee for the U.S. Marshals Service, which will administrate the auction. What makes the case noteworthy is the vessel’s history. The 210-foot-long research vessel was state of the art when it went into service in 1963, designed to accommodate up

to 25 scientists and a crew of 33 who could stay at sea up to 45 days. Before it was decommissioned in 1996, the Atlantis II sailed more than 1 million miles during 458 research expeditions. It logged more than 8,100 days at sea in every ocean of the world, according to Woods Hole historical records. Perhaps its most newsworthy mission was to support the exploration of the wreckage of the RMS Titanic. In July 1986, the Atlantis II transported the submersible Alvin to the site to capture the first photographs and video of the ocean liner, which sank after hitting an iceberg in 1912. The vessel has been in Jacksonville for several years, as far back as 1998 when it was at a shipyard in Mayport for a proposed reclassification. It eventually was moved to a dock under the Mathews Bridge, where it remained until September 2017 when Hurricane Irma threatened Northeast Florida. The U.S. Coast Guard declared the dock unfit for the

vessel to ride out the storm, so it was moved to North Florida Shipyards at Commodore’s Point near the Hart Bridge. After the storm, the ship’s agent, who was given power of attorney about a year earlier by the vessel’s owners when they decided they weren’t going to continue to invest in the ship’s upkeep, couldn’t pay the dock bill, so the Atlantis II remained at the shipyard. In November 2017, it was seized by federal marshals after the shipyard filed suit to recover its dockage bill. No date for the public auction has been set, but in the meantime, a Facebook page, Save the Research Vessel M/V Atlantis II, was established in February. That was two months after a gofundme account, save Atlantis II the ship, was opened with the goal to raise $600,000

that would, according to the site, clear the vessel’s debts for dockage and crew expenses that also are in arrears. As of Friday, there were no

Liberty Ambulance agrees to $1.2 million settlement Whistleblower to receive nearly $1.5 million for initiating lawsuit. BY MAX MARBUT ASSOCIATE EDITOR

Jacksonville-based Liberty Ambulance Service Inc. last week agreed to a $1.2 million settlement of allegations that it fraudulently billed federal health benefits providers for transportation of patients. Liberty was the final defendant to settle after nine hospitals and another ambulance

company settled with the government related to similar allegations that were resolved in 2015 for more than $7 million. The first settlement agreements comprised Baptist Health, which operated four hospitals in Jacksonville, $2.89 million; Memorial Hospital, Specialty Hospital, Lake City Medical Center and Orange Park Medical Center, combined settlement of $2.37 million; UF Health Jacksonville, $1 million; and Century Ambulance Service, $1.25 million. The government and defendants resolved allegations that from January 2009 until April

2014, the hospitals provided Certificates of Medical Necessity indicating the need for basic life support non-emergency transports even when the service was not medically necessary. Century was alleged to have up-coded claims from “basic” to “advanced” life support and transported patients to the hospitals or to their homes when that service was not medically necessary. The settlements were related to false claims submitted to Medicare; Medicaid; the TRICARE Department of Defense health care program; and the Federal Employees Health Benefits Pro-

gram managed by the Office of Personnel Management. A former Century Ambulance employee, who filed the original lawsuit that was later joined by the government, will receive about $264,000 from the most recent settlement under the whistleblower provisions of the federal False Claims Act. The employee was awarded more than $1.2 million after the 2015 settlements were completed. The settlement last week with Liberty is the result of allegations that between June 2005 and January 2016, the ambulance company knowingly up-coded claims for life support services that

were reimbursed from “basic” to “advanced” without justification and also unnecessarily transported patients. Both investigations were conducted by the FBI, the Office of Personnel Management, the Defense Criminal Investigative Service, U.S. Department of Health and Human Services, the Florida Medicaid Fraud Control Unit and the Defense Health Agency Program Integrity Office and the U.S. Attorney’s Office. Court-aided intervention available for addicts

Marchman Act can help people addicted to drugs or alcohol, but challenge in Duval County is a lack of beds for treatment. Established in 1993, the Hal S. Marchman Alcohol and Other Drug Services Act provides for emergency assistance and temporary detention for people who need substance abuse evaluation or treatment. When judiciously applied, it can help someone overcome addiction and its social side effects through a courtordered framework that supports recovery. Duval County Magistrate Dianne Misiak, who conducts Marchman Act hearings each Thursday at the Duval County Courthouse, said the process could be described as “courtaided intervention.” Similar to the Baker Act that addresses mental health issues, a Marchman Act proceeding begins when someone familiar with the impaired person files a petition in county court for involuntary assessment. That’s usually a family member or close friend who believes the impaired person has lost the power of self-control and may inflict harm upon themselves or others. After hearing the relevant testimony, the court may enter an order for involuntary assessment for a period of up to five days. Following assessment and review, the court may then order involuntary treatment for a period up to 60 days. That’s where the challenge arises in Duval County. “Our biggest issue is lack of beds for residential treatment,” Misiak said.

The city of Jacksonville funds 23 beds at Gateway Community Services for court-ordered residential substance abuse treatment, but that’s only about half the number of beds needed, Misiak said. The other option is a private rehabilitation facility, but that’s rarely an option. “Most people in Marchman court don’t have insurance,” Misiak said. “That’s the frustrating part. People come to court and ask for help, but there’s no place to put them.” The sole other resource funded by the city is a program conducted at the jail, but most of the people who appear in Marchman court haven’t been apprehended for a crime, Misiak said. About three months ago, the nonprofit City Rescue Mission got involved and is offering its LifeBuilders Residential Recovery Program as a resource.

It’s an individualized rehabilitation program that includes counseling, medical care and workforce development skills training over a period of up to 18 months. City Rescue Mission Executive Director Penny Kievet said there are about 140 people currently enrolled in the program, including three who were referred by the Marchman court. “They added it to their menu. Those judges want to see people’s lives change,” she said. While the partnership is in its early stage, it may prove to be a valuable option. “So far, we have been able to accommodate everyone the court has sent to us,” Kievet said. Hyperbaric oxygen therapy provider Healogics Inc. agreed to pay up to $22.51 million to settle allegations that it violated the federal False Claims Act by knowingly causing wound care centers to bill Medicare for unnecessary and unreasonable treatments. The company, based in Jacksonville, manages more than 700 hospital-based wound care centers in the U.S., including at Baptist Medical Center. Cindy Hamilton, spokeswoman for Baptist Health, said Baptist Medical Center Beaches and Baptist Medical Center Jacksonville contract with Healogics for outpatient wound care services. According to the U.S. Attorney’s Office Middle District of Florida, Healogics agreed to pay $17.5 million, plus an additional $5.01 million if certain financial contingencies occur within the next five years, for a total possible settlement of $22.51 million. The company agreed to a five-year corporate integrity agreement with the Department of Health and Human Services Office of Inspector General that includes claims and

systems reviews to be conducted by an independent review organization. The settlement resolves allegations that for five years beginning in 2010, the company knowingly submitted or caused to be submitted false claims to Medicare for unnecessary treatments. Medicare covers the therapy for wounds that will not heal when treated with traditional means, during which a patient’s entire body is exposed to oxygen under increased atmospheric pressure. The allegations related to the settlement began with a lawsuit filed by former Healogics Director of Research and Quality for Medical Affairs James Wilcox, and a separate lawsuit filed by Dr. Benjamin Van Raalte, Dr. Michael Cascio and John Murtaugh, two physicians and a former program director who worked at Healogic’s wound care centers. The suits were filed under the qui tam, or whistleblower, provisions of the False Claims Act. Private citizens with knowledge of fraud against the government can bring action on behalf of the United States and are eligible to share in any recovery. The settlement provides for the four plaintiffs to share up to $4.28 million. In a news release, the U.S. Attorney’s Office stated that the claims settled by the agreement are allegations only and there has been no determination of liability. to all members of The Florida Bar. George describes it as a “virtual mentor.” It’s a comprehensive series of short videos available online that cover a range of subjects and practice areas. The concept is to provide a basic overview of a specific subject related to a practice area in about three minutes. Another program developed by YLD can help an attorney set up a law practice from incorporation to marketing and business practices. “The reality is that a lot of young lawyers are hanging their shingles, and a lot of attorneys are leaving law firms to start their own practice,” George said. The division will continue to advocate for initiatives it helped identify and develop in the past several years, such as gender equality in the profession and the importance of lawyers adopting a healthy lifestyle including work-life balance. George cited the survey conducted a few years ago by YLD that identified discrimination experienced by many women lawyers in terms of equal compensation and professional advancement opportunity when practicing alongside men in a law firm.

After the issue was brought into the open, The Florida Bar developed a plan of action to begin the process to improve opportunities for all attorneys. “The YLD survey led to a Florida Bar committee and this year, we’ll be rolling out programs,” George said. The division also will be working with groups within local voluntary Bar associations to strengthen the statewide network of young lawyers. “I know this is going to be a very busy year, but I enjoy it. “I actually have the first email from Peter from December 2013 where he shared with me thoughts and ideas about creating what we, at that time, were still calling ‘Healthy Town,’” he said. The estimated $600 million project would transform the Southbank with 1,170 residential units for sale and lease; 200,000 square feet of office space; more than 200,000 square feet of retail; riverfront restaurants and bars; a 3.5-acre riverfront park and an extension of the Southbank Riverwalk; a 125-slip marina and a 200-room AC hotel by Marriott. The sale, tied to a 2014 purchase agreement with JEA, also marks the start of a new phase of the project, establishing the Community Development District which Elements will use to finance the horizontal construction, or infrastructure. “We will be filing the petition as required by state law with the city early next week,” said Munz. The Community Development District could then issue up to $30 million in bonds to help Elements fund the horizontal development, which includes new roads, sidewalks and other infrastructure. The city has no obligation for that debt. After the Community Development District bonds are secured, Elements must convey about 4.5 acres of unencumbered land to the city for the public space. “We’re not letting any time slip away between the work we had to close and to forming the CDD,” he

said. On June 12, City Council approved an economic development incentives package for the project worth up to $82 million. The city pledged up to $26.4 million to build public infrastructure. The Downtown Investment Authority plans to build three riverfront parks totaling 3.5 acres, another 1-acre pocket park, a 1,900-foot expansion of the Southbank Riverwalk and

bulkhead construction, a walking trail around the development, a 100-space parking lot and the expansion of three roads for public access. Elements also can receive up to $56 million through a Recapture Enhanced Value Grant through 2040. The final encumbrance is based on the actual construction and the property value when the project is completed. Elements will use the money saved from paying property taxes to repay

the bonds. “We’re really fortunate that our capital partners stuck with us through this process and watched patiently on the approval process that we went through with the city,” Munz said. Munz said that in the short time following the property sale, buzz from outside investors already is starting to grow. “That tells you right there that when somebody steps up to the plate and closes on a parcel of dirt

that people are going to start paying attention,” he said. JEA interim CEO Aaron Zahn said through a Friday news release that he commends Elements for “bringing a forward-thinking concept to the Southbank.” “This project is important for Downtown development and the community,” he said. “It also demonstrates JEA’s commitment and value by ensuring the property and the proceeds are used to benefit the community.” Zahn wants sale proceeds to go toward Jacksonville’s ongoing septic tank phase-out, a plan the JEA board will consider at its July 30 meeting. In March, Elements announced Kitson & Partners would execute the development plan for the site, beginning with horizontal construction. The Palm Beach Gardens group plans to oversee all phases of the construction process. Rummell serves on the advisory board of Kitson & Partners. Munz said there was no update on when Elements could apply for permits, or when they would announce additional agreements with potential tenants.
