Love’s planning second truck stop Site near Interstate 10 and U.S. 301 expected to open by 2020. Love’s Travel Stops & Country Stores is planning a second area store to open by early 2020 in the far Westside. The Oklahoma City-based company wants to build a travel center on 17.21 acres at northwest Interstate 10 and U.S. 301 near Baldwin. The chain opened a store in May 2015 at 400 Pecan Park Road off I-95 north of Jacksonville International Airport. The average investment for a new Love’s Travel Stop is $11 million. Spokeswoman Kealey Dorian said Monday the project would open after Florida Department of Transportation improvements are completed at the I-10 and U.S. 301 intersection. It’s not just the interstate that is attracting Love’s to the site. “Highway 301 is a major thoroughfare and our customers have frequently asked for services in that part of Jacksonville,” Dorian said by email. She said the highway connects Jacksonville to Gainesville. Dorian estimates that the development would create about 60 jobs between the restaurants, the Love’s Truck Tire Care Center and the travel stop. The count could vary depending on the number and brand of restaurants that will open. City Council is taking up

School owner InfiLaw seeking nonprofit for purchase or partnership, WSJ says. By Andrew Warfield Associate Editor Florida Coastal School of Law in Jacksonville is for sale or available for partnership, The Wall Street Journal reported Saturday. Naples-based InfiLaw, owner of Florida Coastal and its sister for-profit law school, Arizona Summit School of Law of Phoenix, is in discussions with nonprofit schools to take over or partner with it in ownership of the schools,
the Journal said. The report highlights lower-thanaverage pass rates of graduates of both schools in their respective Bar exams, lowered admissions standards, financial difficulties at both schools and high loan debt borne by students who either failed to pass the Bar, dropped out or were dismissed. Officials with InfiLaw did not respond to requests for comment. Florida Coastal

Southbank residential tower sent back to DDRB Agency is told to consider seven items before making a final decision. week to block an appeal of the project. GV-IP Jacksonville Owner LLC is appealing a decision by the Downtown Investment Authority upholding the Downtown Development Review Board’s approval of a proposed 13-story residential development along Prudential Drive. Jacksonville-based Ventures Development Group’s project includes a three-level parking garage to be built within the tower, along with 12 public surface-level spaces for access to the Riverwalk.

Other amenities include a private courtyard and pool along with 53,000 square feet of open space along the riverfront for the public. The DDRB voted 4-1 to approve the project June 1. The 2.9-acre property is owned by South Shore Riverpointe Holdings LLC and sits between the Acosta Bridge and the Aetna Building. Ventures originally was scheduled to purchase the land by Oct. 18. The closing date has been moved to Jan. 15, contingent on the result of the appeal.
GV-IP, a Chicago-based company, owns the neighboring 6.5 acres at 841 Prudential Drive, including the Aetna Building. The appeal is based on the argument that the DDRB failed to adhere to certain design criteria rules when approving Venture’s project, with five deviations from the zoning code, specifically guidelines on required parking and building height. Those deviations include a reduction in required parking from 559 spaces to a minimum of 337 spaces; altered landscaping along adjacent railroad tracks at

the east end of the development to provide a buffer; an increase in the allowed building height from 60 feet to 190 feet; and reduced setbacks from the riverfront bulkheads in certain areas from 50 feet to 25 feet. On Aug. 16, the DIA denied GV-IP’s initial appeal 4-1, with the lone dissenting vote coming from authority Chair Jim Bailey. Council members voted on two issues Nov. 21, including whether GV-IP and the surrounding property owners were Tower

Blackstone confirms Jacksonville purchases New York investment group buys three leased warehouses. By Karen Brune Mathis Editor Blackstone Real Estate Income Trust confirmed that it purchased three Jacksonville warehouses as part of a multistate $116 million acquisition. The New York-based investment group bought the properties, totaling more than 1 million square feet, as part of an almost 1.93 million-square-foot portfolio of industrial buildings in Jacksonville, Nashville, Tennessee, and Atlanta. An investment highlight from Blackstone about the “Southeast Industrial Portfolio” names Blackstone Advisory Partners L.P. as the dealer manager. Blackstone said the portfolio was 97 percent leased with tenants including United Parcel Service, Sumitomo, Volkswagen and Sub-Zero. The average remaining lease length was five years. Blackstone said fundamentals in the portfolio’s markets have been strong the past two years as rents increased 5 percent a year while vacancy
declined to 5.4 percent. Clarion Partners sold three North and Northwest Jacksonville properties to three Blackstone partnerships for $76.35 million. While one deed indicated vacant property was included, Blackstone’s acquisitions are listed only as the warehouses. The deeds were executed Nov. 10. The Jacksonville properties sold were: n A 399,664-square-foot mega warehouse at 12400 Presidents Court, leased by UPS, on 39.78 acres. It sold for $30.35 million to BREIT SE Logistics Westlake LLC. n A 364,560-square-foot distribution warehouse built in 2001 on 27.35 acres at 2855 Faye Road in North Jacksonville. Sub-Zero is a tenant. It sold for $24.38 million to BREIT SE Logistics Faye Road LLC. n A 260,122-square-foot mega warehouse built in 2008 on 15.26 acres at 4150 Perimeter Industrial Parkway W., used by Volkswagen Group of America Inc., in Northwest Jacksonville. It sold for $21.62 million to BREIT SE Logistics Perimeter LLC. kmathis@jaxdailyrecord.com @MathisKb (904) 356-2466

Ordinance 2017-801 to rezone the West Jacksonville property from Agriculture and Commercial Community/General 1 to a planned unit development for the Love’s Baldwin Travel Center and Truck Stop. The written description explains the project will comprise separate fueling areas for semitrucks and general gasoline and diesel pump stations as well as a convenience store and trucker service center, truck repair and maintenance facility and a truck weighing facility. The address is 17110 Brandy Branch Road between I-10 and U.S. 90. Structural site improvements include a convenience store and restaurant of 11,263 square feet, a 10,000-square-foot tire shop and canopies covering the pump stations. There would be 190 parking spaces for regular, handicap, RV, bobtail and trailers. Adkinson Engineering is the project architect, planner and engineer and the developer is Love’s Travel Stops & Country Stores. Construction would start within a year and completion would be within two years of the PUD approval. Dorian said the company customarily buys the land after obtaining development approvals from the city. Property records show the land is owned by Thomas E. and Terry Jo Braddock and includes a single-family home built in 1950. Love’s Travel Stops & Country Stores, founded in 1964, operates more than 430 locations in 41 states, including 14 in Florida. The Pecan Park Road store opened with Chester’s Chicken and Subway restaurants. The company said upon the opening the 24/7 travel stop also features seven showers, 82 truck parking
spaces, a Love’s Truck Tire Care center, cardless fueling and CAT Scales for weighing trucks. Dorian said the Pecan Park Road store’s general manager said that location always is busy. He sees traffic from residents and professional drivers, including those serving port-related companies. “Professional drivers will benefit greatly from another travel stop in Jacksonville,” Dorian said. The website shows there are 14 Love’s Travel Stops in Florida. In addition to the new one in Jacksonville, Dorian said a Love’s Travel Stop is planned to open in 2018 in Ellisville along I-75 south of Lake City. The Florida Department of Transportation began improvements in February 2016 at the I-10 and U.S. 301 intersection. The reconstruction is designed to accommodate increased truck traffic traveling north on U.S. 301 to eastbound I-10, according to the department’s website. Superior Construction of Jacksonville was awarded the $65 million project, which is targeted for a 2019 completion. The department’s site says the project includes ramps and bridges to correct existing deficiencies that cause truck traffic to back up waiting to make the northbound U.S. 301 to eastbound I-10 movement.

$2 million for a former General Electric facility in Imeson Industrial Park and invest $5.6 million in renovations and equipment to make quartz slabs used for counter tops. The legislation’s documents contained a few more insights. For example, a draft economic development agreement states and facility also would serve as a regional headquarters. USA Quartz would import and export goods through Jacksonville’s port. The jobs would include IT and finance positions and generate an annual payroll of $3.49 million in what the project summary defines as a “state-designated high crime area.” A performance schedule calls for USA Quartz LLC to create 30 jobs by year-end 2018, another 20 by year-end 2019 and the remaining 20 by year-end 2020. As previously reported, USA Quartz seeks up to $210,000, or $3,000 per job, from the city and state through the Qualified Target Industry Tax Refund program, payable over four years starting in 2019. The city would repay $42,000, or 20 percent, and the state would be responsible for $168,000, or 80 percent. The bill is Resolution 2017800. USA Quartz said the incentives are a material factor in its decision to locate the new manufacturing operation in Jacksonville as opposed to another Southeastern port city. The summary said the building has sat idle for several years. General Electric Co. owns an almost 62,000-square-foot manufacturing structure built at 10 Van Dyck Road in 1972. kmathis@jaxdailyrecord.com @MathisKb (904) 356-2466

given due process and proper notice to weigh in on the project during the DDRB review. “The thing that I think is pretty simple to dispose of, and what I was recommending we make a finding on right now, is due process,” said Land Use and Zoning Committee Vice Chair Lori Boyer. “I don’t see anything in the record before us that disputes that,” she said. The committee voted unanimously to approve that finding. The other issue is whether the DDRB made the right choice in approving the deviations, especially one that allows the project to exceed the 60-foot height limit. Holland & Knight attorney Daniel Bean, representing GVIP, told council members the project is “motivated by profits,” saying Ventures has been unwilling to compromise on the building’s proposed 190-foot height or residential density despite it causing a possible hardship on neighboring properties. “This doesn’t have to be 190 feet,” said Bean. “That’s a decision they’re making.” Attorney Paul Harden, who represented Baptist Health during the DIA hearing, argued the building’s height would harm future office rental rates because the new structure would block views of the river and the Northbank for tenants in the Aetna Building. Both attorneys emphasized the project’s potential impact on traffic conditions, too, saying it would increase the current congestion during peak hours. “We believe the DDRB made the correct decision based on the applicable law and criteria,” said Steve Diebenow, the Driv-

er, McAfee, Peek & Hawthorne attorney representing Ventures. “Our position is there is no need to remand this at all,” he said in response Bean’s comments. Boyer disagreed with Diebenow. She said she believed the DDRB failed to take into consideration how the new tower would impact the river views of the existing office building, and called into question some of the experts who gave testimony at the DIA appeal in August. The committee voted to send the appeal back to the DDRB, outlining seven items to consider before making a final decision: DDRB needs to discuss each deviation independently, taking into consideration the actual statute outlining each deviation; evaluate any evidence presented during the appeal for competency and substantiality; review and consider the total regulation from which the deviations are requested; determine, based on the evidence, whether cri-
teria enumerated in the zoning code have been satisfied; make findings describing the evidence relied upon with respect to criteria for each deviation; authorize a deviation only if a positive finding has been made on criteria set forth in the Downtown district regulations; and that any consideration of the DDRB should be based on all evidence presented, including the full record on appeal and any new evidence presented. The DDRB will have 10 business days to schedule a special meeting to re-review the appeal and make a final decision on behalf of the city. If the DDRB is unable to meet, the DIA will hear the issue. In either case, that decision will be the city’s final word on the appeal. Should either side disagree with that decision, the issue could land in Circuit Court in the form of a lawsuit. dcawton@jaxdailyrecord.com @DavidCawton (904) 356-2466
Florida Coastal Continued from front page
Officials with Florida Coastal said they are willing to discuss the WSJ story, but could not do so on Monday. The Daily Record reported in October that the American Bar Association notified Florida Coastal that it may be significantly out of compliance with the ABA standards for approved law schools because of the performance of its graduates on their first sitting for the bar exam. The school received a letter on Oct. 12, noting not only the Bar results, but also stating that Florida Coastal is not in compliance with admission standards, specifically that a law school shall not admit applicants who do not appear capable of satisfactorily completing its program and being admitted to the Bar. Florida Coastal Dean Scott DeVito responded that he believes the ABA Accreditation Committee was reacting to results of the February Florida Bar exam, in which 25 percent of Florida Coastal graduates who took the exam for the first time passed. The Florida average was 56.1 percent for graduates of all instate law schools. Five months later, 47.7 percent of Florida Coastal graduates sitting for the first time at the July exam passed, compared to 68.4 percent for all Florida law school graduates. DeVito added the “ultimate pass rate” for Florida
Coastal graduates is in the high 90s. The ABA asked Florida Coastal to submit a report on its compliance with the standards and to appear before its Accreditation Committee when it convenes March 15-17 in Williamsburg, Virginia. This isn’t the first time the ABA expressed concerns with an InfiLaw school’s admissions standards and bar exam results. The ABA put the Charlotte School of Law on probation for similar results in November 2016. That school closed in August. The ABA also put the Arizona Summit Law School in Phoenix on probation in March based on the school’s 25 percent Bar exam passage rate. Florida Coastal School of Law was founded in 1996 by law professor Don Lively with a goal of providing more minority students a pathway to a legal career even if their academic record fell short of law school admissions standards, the WSJ reported. After some initial success — the Journal reports there were about 4,000 students enrolled at the three InfiLaw schools combined in 2012 — enrollment has since declined sharply. Thousands of students have dropped out, transferred or failed Bar exams and they cannot pay down more than $1 billion in federal student loans. According to information
provided by the ABA, a change in ownership of Florida Coastal could affect the timing of any disciplinary action, adding that all such situations are considered on a case-by-case basis. However, any change in ownership must be approved by the Accreditation Committee Council, as defined in Section 105 of the ABA Standards and Rules of Procedure for Approval of Law Schools. It reads, “Before a law school makes a major change in its program of legal education or organizational structure, it shall obtain the acquiescence of Council for the change.” The standard applies to a law school being either acquired or merged with another university. Meanwhile, Florida Coastal earlier this month submitted a 70-page report to the ABA Accreditation Committee in response to noncompliance allegations. “We are fully compliant, based on our data, and all of our projections indicate we will stay in compliance,” DeVito said at the time. However, if the committee disputes the data in the response, DeVito and Florida Coastal President Dennis Stone will appear before the ABA Accreditation Committee. awarfield@jaxdailyrecord.com @andrewfwarfield (904) 356-2466
A neighborhood of 276 homes will soon be under development near Cecil Commerce Center. Liberty Square Jacksonville LLC has received a renewal of its mobility certificate of $638,012 to develop Liberty Square northwest of West Meadows Drive North and Chaffee Road South. Greg Matovina, principal of Matovina & Company, is the manager of the development entity. Lots will be a mix of 50 and 75 feet wide. Builders will be Dream Finders Homes, New Atlantic Builders and Advantage Home Builders. Matovina said he expects prices to start around $210,000 and exceed $300,000. The engineer is J. Lucas and Associates. The development subcontractor is PetticoatSchmitt Civil Contractors. The
entire development comprises 108.2 acres. The neighborhood will be near the new Amazon facility and other businesses. “This development is what I would characterize as a ‘brand new area,’ and the reason I call it that is because it is on a brand new connection that runs from Cecil Commerce Center Parkway north of Normandy Boulevard over to Chaffee Road,” said Matovina. “The main road when you come off Normandy is New World Avenue, which used to dead end a little way past the Amazon facility. The city is now extending it and it will be open shortly to connect to Chaffee Road. We are located in that area,” he said. Primary entrances will be off New World Avenue, which will border the northern side of the neighborhood. The first phase is planned to include 115 lots. Infrastructure is expected to be completed in February and model homes opened by midsummer. awarfield@jaxdailyrecord.com

“ Difference We Make a
“One of the main reasons I love my job is it gives me the opportunity to be out in the community and constantly meet new people. I thrive on that. I would go crazy sitting at a desk all day. “After I call on potential customers or talk to my existing customers, I always feel like I’m in the know. I’m always learning about business and what’s going on in the community. “Those are great things that make it exciting to be part of a local news media company. You really feel like you’re involved and working to make your community a better place. “We make a difference. That’s a great feeling.” Beth Jacobson Multimedia Advertising Executive Longboat Observer
