Another delay for ‘The District’ Sale of Southbank site now might include the city. By David Cawton Staff Writer A proposed sale of JEA’s Downtown Southbank property now might include the city. Developer Peter Rummell has been negotiating for three years to buy the 30-acre site to develop The District, but JEA has granted extensions in completing the contract. On Tuesday, the JEA board of directors granted a third delay
but also will allow Elements Development of Jacksonville LLC, led by Rummell, to assign the contract to the city of Jacksonville and the Downtown Investment Authority. “Subsequently, the whole development agreement will be worked out between the city and us,” JEA CEO Paul McElroy told the board. It’s unclear what the city’s involvement would be. The board agreed to amend a
2015 purchase and sale agreement between it and Elements Development of Jacksonville LLC, giving the company another 90 days to close on the $18.5 million purchase of the 30-acre site. Picerne Real Estate Group of Altamonte Springs proposes to develop The Oasis at Town Center, a 328-apartment community south of Topgolf near St. Johns Town Center. Stephen Novacki, vice president of acquisitions and real estate, expects construction will start in April or May and be completed by the end of 2019. “It’s probably one of the best loca-
tions in Jacksonville,” Novacki said. The 15-acre site is visible from Interstate 295 and close to St. Johns Town Center, “which is an amenity in and of itself to our residents.” The address is listed on a city plan as 10595 Brightman Blvd. Novacki said Picerne wants to permit a pedestrian bridge across a stormwater pond owned by St. Johns Town Center to provide a direct connection to the shopping center. The eight four-story apartment buildings will comprise one-, two- and three-bedroom units. Novacki said each building will contain an elevator. Novacki said rents will average $1.30 a
square foot, which he said is commensurate with area rates. Units will average 1,075 square feet, equaling average rents of $1,400 a month. One-bedroom units will average 900 square feet at $1,170 a month; twobedroom units of 1,250 square feet will run $1,625; and the 1,400-square-foot three-bedroom units will run about $1,820. There will be surface parking for tenants. Florida Coastal School of Law Dean Scott DeVito on Tuesday described the story published Saturday in the Wall Street Journal stating Florida Coastal could be sold or transition from forprofit to nonprofit status as “old news and reactionary.” He said the law school is not for sale and there are no plans for it to leave JackDeVito sonville. In addition, InfiLaw, the holding company set up by Chicago-based Sterling Partners after the private equity firm purchased the school in 2004, began considering “transitioning” the school to nonprofit status through a partnership with another educational institution before DeVito became dean in June 2015, said Florida Coastal President Dennis Stone. “We’ve been talking about a transition since before 2015. We began in earnest in 2015 and we’ve talked to a number of partners, but we can’t divulge names,” Stone said. In a story published April 11 Coastal

Jacksonville LLC, and Michael Munz, an executive at the Dalton Agency, have been negotiating to buy the property to develop it as a health-focused, mixed-used development. Essentially, the land purchase will be tied to a separate economic development agreement being negotiated between Elements and the DIA. Details of the transaction, including any possible financial cost to the city, are still being worked out, McElroy said. He added that the city would need to answer any further questions about its involvement. “Any proposal on this property will be evaluated by the city if it passes through the DIA, which is the appropriate authority,” said city spokeswoman Marsha Oliver. “All inquiries should be directed to the DIA.” In a statement, DIA Executive Director Aundra Wallace said negotiations are ongoing. “No agreements have been
reached by the parties for the assignment of the contract to purchase the land nor have terms been agreed to for a redevelopment agreement,” Wallace said. Rummell did not return a call. JEA Board Chair Alan Howard said the board initially was concerned about approving another extension, but thought it was the best move to keep the deal alive. Howard declined to speculate about the city’s involvement. “We are not a party to those discussions at this point in time,” he said. “We’re not at the table with Elements, the city or the DIA.” The extension will result in Elements forfeiting a $250,000 deposit it paid the JEA when contract negotiations began. If the deal had been completed as originally scheduled, the money would have been credited toward the purchase price of the land. If the deal failed, Elements
would have been refunded the money. “We thought it was a necessary step to protect the integrity of the bidding process,” Howard said. He said he believed this third extension would be the last the board would approve. “This contract terminates on March 30, and if they can’t conclude their transaction with the city at that time, we’ll go back to market and try to turn that asset into cash for the citizens of Jacksonville,” Howard said. City Council member Matt Schellenberg, who serves as the council liaison to the publicly owned utility, expressed his concerns to the board, saying “three years is long enough.” After the meeting, Schellenberg said he was not only unhappy with the latest extension, but “baffled” about the city’s involvement in the land sale. He said a conversation Monday night with McElroy did little
to answer his questions. “I respect Paul McElroy, but when I asked him about this, he had no term sheets or any idea of how it was going to work or if the city would pay for this land in cash,” he said. Schellenberg said the best move may be moving on from Elements altogether. “They’ve had three years, more than sufficient time for other developers with the financial resources to close on this deal,” he said. According to the last extension approved in October, Elements was to close on the deal by Dec. 29. “Since they apparently can’t close by the end of December, I think that we should give other people the opportunity to look at it,” Schellenberg said. The development would “inspire and promote a healthy lifestyle” for people wanting to live near Downtown with integrated outdoor activities and access to the riverfront. On Monday, Elements announced it had secured a hotel partner for the project, AC Hotel by Marriott. The proposed 200-room hotel is a midrise concept of about 70,000 square feet. It would be owned, managed and developed by Tampa-based Impact Properties, according to a news release. in the Daily Record, DeVito said Florida Coastal had two goals: to convert to a nonprofit entity and to “join with a nonprofit university that makes sense for our students.” “The real story is that we’re admitting a spring class with a 147 LSAT (Law School Admission Test) bottom quartile goal and a 150 median quartile goal,” he said, compared to the fall class that had a 146 bottom quartile goal. The minimum LSAT score required for admission to Florida Coastal in 2016 was 141. Referring to the spring class goal, based on the most recent survey by U.S. News & World Report, “that puts us at or above 50 other law schools,” DeVito said. “We’re doing the right things to get us where we need to be. We’re moving in the right direction in every possible way,” he added. DeVito on Tuesday again cited the Florida Bar exam in February, when just 25 percent of Florida Coastal graduates taking the test for the first time passed. He said he believes that prompted the American Bar Association to notify the school in October it’s being evaluated as to whether it’s meeting

Apartments will include full-size washers and dryers, smart-home technology, granite countertops, stainless steel appliances, hardwood floors, pendant lighting and walk-in closets. Community amenities include a 12,000-square-foot clubhouse and resort-style beach-entry pool along with dog parks. The clubhouse includes a cybercafé; fitness center with yoga, Pilates and fitness on demand virtual fitness classes; a clubroom and game room; a screened patio, pool cabana, barbecue grills and outdoor TVs. “It will be the newest and nicest project in the market when it’s complete,” Novacki said. Picerne Construction Corp. will be the contractor and Picerne Management Corp. will handle leasing and management. Novacki declined to provide an investment estimate. He expects Picerne will buy the land and close on the construction loan in April or May and break ground immediately after that. He said Picerne is working on architectural, civil engineering and landscape plans. K.T. Peter Ma, executive vice president of land development with England, Thims & Miller Inc., is the engineer. Novacki will buy the land from the Skinner family. He said Picerne is working with Tyler Nilsson, a director of ARA Newmark, in putting the deal together. The project also will contain a proposed 3.05-acre stormwater pond in the center. “We decided to centrally locate that and position the buildings around that pond so every building has water views,” Novacki said. It will feature a couple of fountains and will be lit at night, he said. Plans filed with the city show five 38-unit buildings and three 46-unit buildings. A total of 572 bedrooms are listed. Picerne is asking for an administrative deviation from the city’s zoning code to decrease the minimum number of bicycle parking spaces to 28 spaces from 286 spaces, which Picerne says is required under Ordinance 2017245-E. The ordinance, enacted June 27 by City Council, requires 0.5 off-street bicycle parking spaces for each bedroom of a multiplefamily dwelling. “We believe that having 286 bicycle spaces would be well in excess of demand and would reduce open space in the development,” says the application submitted by lawyer Thomas Ingram with the Akerman firm. Picerne says the proposal for 28 spaces is more than triple the nine that would have been required before the ordinance. The request states that the need for the deviation could be common to multiple sites. “Considering the cumulative effect of granting the deviation, the effect would be to allow for alternative uses of real estate that would otherwise have unused bicycle parking areas on them, whether it be for trees and landscaping, recreation, dwelling space or other uses,” it says. commercial and retail development in February. Called the Hanover Town Center Mixed Use Planned Unit Development, the PUD’s first phase is designed to comprise up to 400 multifamily residences — typically apartments — on about 19.4 acres at the southern end of the site. The Picerne project is proposed on the southernmost 15 acres, a survey shows. It is taking the property previously identified for an apartment project by Hanover R.S. Limited Partnership, part of The Hanover Co. in Houston. The second phase, immediately south of Topgolf, will consist of up to 150,000 square feet of retail commercial development and/or up to another 400 multifamily units on about 12.2 acres. That property contains the iFly indoor skydiving and Floor & Décor projects that are undergoing development reviews. The remaining acreage is for roads, drainage and a JEA easement. Novacki said the Oasis will be its first market-rate project in Jacksonville and Picerne is looking for additional sites. “We continue to work with our broker network and anticipate finding other sites in Jacksonville later this year and in the first quarter of next year,” he said. Picerne is seeking 12- to 15-acre sites that could accommodate another 300-unit project. Picerne’s website shows it also owns Rosaland Villas, a senior housing community in Northwest Jacksonville. The company owns and operates luxury, affordable, senior and other properties across the country.
n The city approved the permit for Haskew Company & Associates to build-out Benco Dental Supply Co.’s new Southeast distribution center at 13525 International Parkway at Jacksonville International Tradeport. The almost $1.8 million project involves the build-out of the 124,000-square-foot space. Benco will almost double in size as it moves its distribution center from 70,000 square feet in Westside Industrial Park. n Camel Car Wash applied for a Certificate of Use at 12472 San Jose Blvd. Camel Premium Express Car Wash posts on its website that it will open in the spring at that address and at 9200 Merrill Road, where site work is underway and a construction permits is in review. The San Jose Boulevard construction permit was issued Nov. 2. Camel is based in Marietta, Georgia. The Camel car wash is a 3-min-
ute express tunnel wash. A group led by developer Frank Bennett paid almost $1.7 million in January for the two vacant sites. n Badcock Home Furniture & More applied for a Certificate of Use for a 16,000-square-foot store at 5810-3 Normandy Blvd. in Westside Plaza. A building-permit application is in review. The retail center includes an Ollie’s Bargain Outlet. Badcock operates area stores on North Main Street and Beach Boulevard and in Orange Park. The company, based in Mulberry, operates more than 300 stores in eight states. n The city approved the $470,580 interior remodeling for Phoenix-based Dogtopia in the Avenues North Center at 9365 Philips Highway. Dogtopia offers pet day care, spa grooming services and boarding among more than 50 locations in U.S. and Canada.
Jay Hooper is the franchise owner-operator at the location. Emerald C’s Development Inc. is the contractor for the almost 6,700-square-foot space to comprise three playrooms, a spa and grooming area, five suites and an outdoor play area, along with reception and breakroom areas. Another Dogtopia is planned in San Marco, where franchisee Addie Kasraeian and her husband, urologist Ali Kasraeian, expect to open a 3,960-square-foot Dogtopia at 1075 Hendricks Ave., with a courtyard in back.
