Sidewalks, drainage and raises Finance Committee sending budget proposal to full council By Max Marbut Staff Writer Citing “cooperation and collaboration,” the City Council Finance Committee and Mayor Lenny Curry’s administration wrapped up the fine-tuning of the city’s 2015-16 budget. The five-hour session Wednesday capped 60 hours of evaluation of the $1 billion, 512-page financial plan Curry submitted to council on July 20. “The process was right,” said committee Chair Bill Gulliford. “We worked together to do some-

thing good for the community.” The final session was devoted to wrapping up the last details in some departments’ spending plans and setting the course for the next phase of discussion that will begin when the budget is filed to the full council on Tuesday. City employees, who have lobbied council for months for the restoration of a 2 percent pay cut they accepted five years ago to help the city through the recession, got some good news. The committee allocated $737,000 to restore the 2010 pay levels for

1,275 city workers who are not union members. Curry’s proposed budget included $2.3 million to increase union workers’ pay, which will be part of collective bargaining as each union’s contract with the city is negotiated. Council member John Crescimbeni said the increase in pay should be effective Oct. 1, the date the decrease went into effect five years ago. “We taketh away, now we’re giving back,” he said. The news wasn’t as good for UF Health Jacksonville.
Over 43,500 public spaces available from city and private vendors
One of the most common misconceptions about Downtown is it’s difficult to find a place to park when you visit the neighborhood. According to Downtown Vision Inc., which keeps up with all of the urban core’s statistics, there are more than 43,500 public parking spaces along the streets at meters, in surface lots, parking garages and in peripheral lots adjacent to the sports complex and in LaVilla. With 3,196 spaces at four multilevel garages and three surface lots, plus about 1,600 parking meters, the city is the largest operator of public parking Downtown. Monthly rates vary by location, from $53.30 at the garage at the Yates Building and at the Water Street garage to $85.60 at the garage along Monroe Street at the Ed Ball Building and the city lot at 28 W. Forsyth St. The rates are structured to attract new business and to be competitive, but not too competitive with rates charged by private parking operators, said Public Parking Officer Jack Shad. “Each location is different and we try to be aware of what the private sector is charging,” he said. Like all parking operators, the city can be flexible on price when a Downtown business has specific parking needs for its employees. For example, the city negotiated with the owner of EverBank Center to meet the parking needs of about 1,000 Citizens Property Insurance Corp. employees who will soon be moving into the building. The Downtown Investment Authority approved an agreement to provide 850 spaces in the Water Street garage near EverBank Center for $45 per month per space. In order to better market the public spaces the city owns, a veteran parking department employee, Tina Moody, has served since March as the Office of Public Parking account coordinator. Moody joined the city in 2008, working as a parking operations analyst, where her job included budget management, financial analysis and forecasting and contract Parking

The committee made no addition to the $26 million allocation in Curry’s plan, which is the same amount in the 2014-15 budget. The committee and the administration agreed UF Health provides essential services for uninsured patients and trauma victims, but also agreed devoting another $1 million to the city contribution would not make a significant difference in the indigent-care facility’s bottom line. City Chief Administrative Office Sam Mousa said the administration will convene a Budget continued on Page A-2
Timoti’s plans Five Points location
Timoti’s Seafood Shak II is in the works for Five Points, branching out from the original in Fernandina Beach. Timoti’s Seafood Shak, which serves only wild caught seafood, operates at 21 N. Third St. in Fernandina Beach. It is owned by Theresa and Timothy Poynter, who also own Café Karibo at 27 N. Third St. Timoti’s Seafood Shak II is going into 1043 Park St. A pending building-permit shows a $275,000 build-out for Timoti’s next to Rain Dogs. Bryan Poynter, son of the founders, said he hopes for a November opening. “We’ve been working very hard to make the Jacksonville location a possibility,” he said. The Jacksonville permit application shows 1,735 square feet of enclosed space and 320 square feet of outside seating. The Fernandina Beach Timoti’s menu shows shrimp, oyster, clam strips, mahi and local catch baskets, as well as chicken strips. There also are shrimp, fish, chicken and tofu tacos along with wraps, burgers, po’boys, sandwiches and more. The Fernandina Beach fast-casual restaurant serves 11 a.m.-8 p.m. Monday-Saturday and is open 11 a.m.-3 p.m. on Sunday. Poynter said the Jacksonville restaurant will stay open a little later. He is trying to recruit a general manager. He said the plan is to “build something that is going to last for a long time.” “We are going to make sure we are following through and doing a good job at each step,” he said. Timothy Poynter is a Fernandina Beach city commissioner.

fabrication shop. The West Virginia-based company paid almost $1.15 million for the 40,000-square-foot building on almost 6.7 acres at 1737 Jessie St. The deed was signed Monday and recorded Tuesday with the Duval County Clerk of Court. Raleigh Mine bought the property from Conex Forest Products Inc. Fifth Third Bank issued a $1.01 million mortgage to Raleigh Mine on Aug. 28. It was recorded Tuesday. Raleigh Mine CFO Donna Zandlo said SteelCon, a subsidiary, has leased the building for three years with a right to purchase it. SteelCon maintains a rebar fabrication shop there. Zandlo said the business has done well and the building is in a good location. She said SteelCon has six fulltime employees and usually has six temporary workers. Zandlo said SteelCon makes rust-resistant rebar used in bridges, seawalls and any projects exposed to the elements. SteelCon is a wholesale distributor of steel and supplies for the industrial, construction and mining industry.
Zaxby’s to develop next door in Regency
The owner of the Zaxby’s in Regency filed site plans with the city for a proposed restaurant next door on the site of a former buffet restaurant. Jasz Group LLC owns and built the existing Zaxby’s at 9575 Regency Square Blvd. N. The 3,048-square-foot structure was built in 2001 on almost an acre. Site plans show that Jasz Group Inc. proposes a 90-seat restaurant on the 1.83 acres where the closed buffet restaurant stands at 9569 Regency Square Blvd. N. The size of the proposed Zaxby’s is shown as 4,378 square feet in a city concurrency application. The 11,300-square-foot buffet restaurant also was built in 2001 and plans show it will be demolished. It has served under several names, including Ryan’s Grill, Buffet & Bakery and then Whistle Junction. It also has housed sushi and grill buffets. The two Jasz Group organizations comprise the same owners. A spokeswoman said she would provide information from the corporate office about the

Since becoming account coordinator, Moody said she’s added another important skill when it comes to Downtown parking — education. “People call all the time and ask where they can park. The concept is to reach out to people and let them know the number of options we have available,” Moody said. There’s also quite a bit of problem-solving involved in parking management, such as when the
city caps monthly parking before a garage is full in order to leave some spaces for hourly parking. An example is the garage at 33 W. Duval St. About a block from the Main Library, the city offers one hour of free parking in the garage when a customer has the entry ticket validated at the library. “We have short-term and longterm options. We can find the fit for all types of needs,” Moody said. “It sounds dull, but it can be challenging.”
Asked if anything about Downtown parking has come as a surprise since she started working daily with customers, Moody said there is one aspect she wasn’t anticipating. “I am always surprised how many people don’t know that parking at a meter after 6 p.m. Monday-Friday and on weekends is free,” she said. mmarbut@jaxdailyrecord.com @drmaxdowntown (904) 356-2466
Court ponders malpractice in patient’s 2008 suicide
By Jim Saunders The News Service of Florida In a medical-malpractice lawsuit stemming from the death of a woman who hanged herself, the Florida Supreme Court on Wednesday weighed whether her doctor could be found negligent in the suicide. The case, brought by the husband of Sarasota County woman Jacqueline Granicz after her 2008 death, raises issues about physician Joseph Chirillo’s “duty” of care. The 2nd District Court of Appeal ruled last year that the lawsuit against Chirillo could move forward, overturning a circuit judge’s ruling in the doctor’s favor. Scott Cole, an attorney for Chirillo, told the Supreme Court that Granicz, 55, had never indicated she might commit suicide and that the hanging death was “not foreseeable.” “In this particular case, this was a suicide,’’ he said. “This was not a standard medical-negligence case.” But Justice R. Fred Lewis pointed to scientific advances that have led to greater knowledge about the human mind and psychiatric conditions. He questioned the idea that a suicide cannot be foreseeable. “Why is that (suicide) such a reserved area?” Lewis asked. Granicz suffered from depression and called the doctor’s office on Oct. 8, 2008, reporting that she was under mental strain, crying easily and having other

The Florida Supreme Court will decide whether the doctor of a Sarasota County woman could be found negligent in her suicide. problems, according to last year’s appeals-court ruling. After learning about the call from an assistant, Chirillo decided to change Granicz’s medication and refer her to a gastroenterologist for gastrointestinal issues. The woman’s body was found the next day. The lawsuit alleged that Chirillo breached a duty of care, but a circuit judge granted summary judgment in favor of the doctor. The appeals court reversed that decision, allowing the lawsuit to move forward and prompting Chirillo to take the issue to the Supreme Court. After hearing oral arguments, justices typically take months to
rule in such cases. Lewis and other justices repeatedly questioned Cole about distinctions he drew related to the ability of doctors to predict suicides. James Tilghman, an attorney for Granicz’s husband, Robert, argued the lawsuit against Chirillo should be allowed to move forward. “This is a, ‘You’ve got to treat your patient according to the standard of care’ (case),’’ Tilghman said. But Cole said Chirillo could not have predicted the suicide. “There was never an indication that this patient had anything other than distress and stomach issues,’’ he said.

The Florida Fish and Wildlife Conservation Commission approved the quota for October’s black bear hunt.
‘Harvest’ numbers approved for October black bear hunt
By Jim Turner The News Service of Florida
A target was placed on at least 320 black bears Wednesday as the once-threatened species will be hunted across Florida next month for the first time in more than two decades. A split Florida Fish and Wildlife Conservation Commission approved quota numbers that represent about 10 percent of the bear population in four regions of the state — there are seven regions — where the hunt will be allowed. Commission staff called the regional and overall quota numbers “conservative.” Commissioners, meeting in Fort Lauderdale, also gave support Wednesday to a position paper on the Florida panther population. Some panther advocates argued the commission’s move is a step toward allowing the endangered animals to eventually be hunted like bears. The bear hunt, approved by the commission in June and set to start Oct. 24, will last two to seven days. While the hunt is supposed to end in each region once the preset quotas are reached, hunters are guaranteed a minimum of two days of pursuing bears. Commissioner Robert Spottswood said he’d like to give the agency’s executive director authority to close the hunt after
the first day if the quotas are reached, but he failed to get support from the full commission. “Why not manage the program so you can’t exceed the objective?” Spottswood said. Commissioner Ron Bergeron, a hunter who cast the lone vote against the hunt in June because of what he said was a need to gather more data on the number of bears, also voted against approving the quotas. Diane Eggeman, director of the commission’s Division of Hunting and Game Management, said that while the number of bears killed could exceed the quota numbers in each of the four regions, there will not be an “over-harvesting,” based on examples from others states that allow bear hunts. Opponents said the commission was mismanaging the hunt, with an unlimited hunt for the first two days, and warned of a pending bear “blood bath.” Lee Cook, a wetlands biologist, questioned assurances that there won’t be over-harvesting, as the state has sold 1,948 bear hunting permits — as of Tuesday — at a cost of $100 for Floridians and $300 for non-Floridians. “You have put us on track to go over the quota in the first two days,” Cook said. “That, combined with the nuisance bear kills and the car kills, could put

us right back on the endangered species list, which we all worked so hard to get them off.” Black bears were placed on the state’s threatened list in 1974, when there were between 300 and 500 across Florida. At the time, hunting black bears was limited to three counties. In 1994, the hunting season was closed. This year’s hunt is intended to help the state achieve a 20 percent reduction in the bear population in each region. The 20 percent figure includes the number of bears that die naturally, are hit and killed by cars and are captured and killed by wildlife officers due to conflicts. According to the latest figures, there are an estimated 1,300 bears in the Central region, which includes the St. Johns River watershed to the Ocala National Forest, and 550 bears in the North region, which goes from Jacksonville west to Hamilton and Suwannee counties. In each region, the harvest target is 100 bears. The bear quota is 40 in an eastern Panhandle region, which includes the northwestern Big Bend area to west of Apalachicola Bay. In a South region, which includes Broward, Collier, Hendry, Lee, Miami-Dade, Monroe, and Palm Beach counties, the quota number is 80. The South region excludes the Big Cypress National Preserve.

Millions of Floridians could find it a little cheaper to run the air conditioning in 2016. The state’s four major investorowned utilities — stretching from Miami to Pensacola — say they expect residents’ monthly electric bills to drop by a few bucks next year. Regulators still need to finalize the numbers for Florida Power & Light, Duke Energy Florida, Tampa Electric and Gulf Power. But the utilities said this week that relatively low prices for natural gas and coal are helping hold down the costs of generating power. Low natural-gas prices are particularly important as utilities increasingly move away from dirtier-burning coal. “We’ve worked very hard to manage our fuel mix to provide affordable, reliable electric service for our customers,” Jeff Rogers, a spokesman for Pensacolabased Gulf Power, said in a prepared statement. “In the end it means lower electricity bills, and that’s great news for Gulf Power customers.” Utilities released the monthly bill numbers as they filed projections of fuel costs and other expenses with the Florida Public Service Commission. Regulators will use the projections this fall in finalizing the amounts that will be passed along to customers in 2016. As a benchmark, utilities offer bill estimates based on a residen-
tial customer who uses 1,000 kilowatt hours of electricity a month. While companies describe that as a typical or average customer, actual electricity usage can vary widely among residents. Also, bills for commercial customers are calculated differently. Nevertheless, Florida Power & Light, the state’s largest utility, will continue to have the lowest residential bills next year, according to the projections. An FPL customer who uses 1,000 kilowatt hours a month currently pays $96.72. That number is projected to drop to $93.24 in January before going to $94.86 in June as a new Port Everglades plant starts generating power. Tampa Electric, which is expected to have the next-lowest residential bills, currently collects $108.47 a month for 1,000 kilowatt hours. That number will go up 45 cents in November as part of a 2013 rate settlement and then is projected to drop to $106.22 in January, according to the company. Meanwhile, Duke Energy expects to see monthly bills for typical residential customers drop by slightly more than $4. Duke currently collects $121.59 from those 1,000-kilowatt hour customers and projects that the number will go to $117.41 early next year. Gulf, which does business in eight Northwest Florida counties, said it expects typical residential customers to pay $135.58 a month in January, a drop of $3.71.
