undertaking,” said Jacksonville University President Tim Cost, who served as the overall chair to the committees’ efforts. “We looked at law enforcement through a different lens than we ever had before.” The task forces were led by business and civic leaders who reviewed topics of community engagement, transparency, resources and training. And they dealt with myriad issues ranging from suggestions for body cameras and citizen oversight and review boards to millage rates and additional hires.

A Downtown riverfront high-rise project that came to an abrupt halt nearly 10 years ago and is now being described as an “eyesore” might be entering a new chapter. The owner of the 18-story concrete shell at 500 W. Bay St. — Choate Construction Co. of Atlanta — is seeking to have the property rezoned from Planned Unit Development to Commercial Central Business District. Ordinance 2016-780 will be introduced to City Council today. The ordinance lists Indy Hotels LLC and Shan Pollachi as Choate’s agent. The company has an address in a shopping center on Old Baymeadows Road and was registered Oct. 24 with the state Division of Corporations. No other information is available about the company and the telephone number listed in the ordinance does not belong to Indy Hotels or Pollachi. Michael Hampton, Choate chief operating officer, did not respond to requests for comment. The rezoning is supported by the Planning and Development Department, the Planning Commission and the council Land Use & Zoning Committee. Originally intended to be the second phase of The Plaza at Berkman Condominiums and Marina, the project stopped Dec. 6, 2007, when the parking garage adjacent to the tower collapsed during construction, killing one worker. Developer’s plans resemble Sprouts A Tampa-based company is working on plans for a groceryanchored retail center in Southside whose initial design raises the possibility of a lease with Sprouts Farmers Market. It would be the first Sprouts Farmers Market in Jacksonville, although the developer and the supermarket company don’t confirm the site would be for the organic and natural foods store. Loop Pizza Grill to lease at Sadler Point Marina

Sadler Point Marina’s first signed tenant is Loop Pizza Grill, which is expected to open in early spring. Loop owners learned in the spring they would have to find a new location for the Avondale restaurant at 4000 St. Johns Ave. and landed about 2 miles south at the marina at 4619 Roosevelt Blvd. The Loop will lease 3,100 square feet in the 18,000-squarefoot building, according to Sadler Point Marina owner Brooks Busey in a news release. He owns the marina with his family. Busey renovated the former Pier 17 Marine building into a multiuse space for lease. He envisioned the building, which is in the marina at the Ortega River, for use by restaurants, retailers and community groups. It is called Sadler Point Marine Center. Loop co-founders Mike Schneider and Terry Schneider said the Sadler Point development is a perfect fit for the Loop. The restaurant’s design will draw from the St. Johns Town Center prototype but will be updated and modified. It will seat 116 guests inside and offer some patio seating. The Loop’s Avondale location also is on the waterfront of Fishweir Creek and Little Fishweir Creek, but the St. Johns Village site is being redeveloped as apart-

ments. The Loop operated there almost three decades. It is scheduled to close Dec. 11, according to the release.

Outback Steakhouse closes Regency location

Outback Steakhouse said over the weekend it closed its restaurant at the Regency Park Shopping Center at 9400 Atlantic Blvd. Spokeswoman Elizabeth Watts said by email that its last day of business was Nov. 9. “The decision was made based solely on business circumstances,” she said. Watts said the majority of the about 50 employees transferred to its other Jacksonville area restaurants. She did not respond to a question about how long Outback has operated at Regency Park, although it has been there for more than 20 years. The Outback Steakhouse signs are down at Regency Park although the outline clearly identifies the name. A sign on the door of the closed Outback says: “With apologies we are now permanently Closed as of 11/10/2016.” It invites customers to visit the locations at Queen’s Harbour, 13245 Atlantic Blvd.; Baymeadows, 8145 Point Meadows Way; and North Jacksonville, 795 Skymarks Drive in River City Marketplace. Spokesman Diego Romero at Phoenix-based Sprouts said Monday the company has not announced plans to expand to Jacksonville. Sprouts is expanding into Florida next year, starting in Tampa. The company announced last week it would open a 27,000-square-foot store Feb. 22 in the Carrollwood Commons Shopping Center in the Tampa area. It will hire 100 full- and part-time employees. Tampabay.com reported Sprouts would open a 32,500-square-foot store at Palm Harbor Commons, near Tampa, and that other spots could be in Brandon and South Tampa. Sprouts opens stores from 28,000 to 30,000 square feet and wants locations with a population of more than 100,000 within a 10-minute drive. The store on the Wagner site plan is in that range and the location is in a densely populated area of town within minutes of San Marco, Beauclerc, Epping Forest Yacht & Country Club, San Jose, Baymeadows and other established neighborhoods. While Sprouts has not confirmed Jacksonville, its growth plans indicate Northeast Florida would likely be of interest. Founded in 2002, Sprouts has expanded to more than 250 stores in 13 states and projects the U.S. market could support about 1,200 of its stores. In September, it announced eight locations would open in the first quarter in six states, including the first Florida store in Carrollwood. Sprouts also said it wanted to open 36 stores next year in 15 states. It has been looking at the Jacksonville market for several years. In January 2014, a Regency Centers Corp. executive told an International Council of Shopping Centers North Florida group that Sprouts might be coming to the market. In March 2014, Jacksonvillebased retail developer Ben Hakimian said a Sprouts representative, scouting sites, had visited his Shoppes of San Jose retail center at University Boulevard West and St. Augustine Road. He said then the company decided to concentrate on other cities and would revisit Jacksonville in six to 12 months. Hakimian owns the almost 57,000-square-foot Shoppes

As he was formally nominated Monday by his Republican colleagues to be the next speaker of the Florida House, Rep. Richard Corcoran gave few indications of where he will take the chamber over the next two years. Corcoran, R-Land O’ Lakes, alluded briefly to changes to the House rules that are set to be approved by the full chamber Tuesday during an organizational session. But he spoke to the Republicans meeting Monday for less than five minutes, saying he would be more expansive when speaking to the entire House. Instead, he encouraged members to focus on their motivations for seeking office, something he said had helped him handle two defeats before finally winning his House seat in 2010. “And what guides me through those moments of adversity, what will guide me over the next two years, is I try very, very hard to do my best to remember, what’s my why,” Corcoran said. “ ... My why is truth, goodness and beauty.” Corcoran promoted aspects of the new rules intended to weaken ties between legislators and lobbyists. Among other changes set to

We hold it in a sacred trust with the people we have sworn to represent.” Corcoran’s nomination still has to be approved by the full House, but because of the overwhelming Republican majority in the chamber, that is essentially assured. House Republicans hailed Corcoran’s approach to the rules, even as one of them recognized they could face questions about how genuine the changes are. Rep. it’s real.” Republicans also nominated Rep. Jeanette Nunez, R-Miami, to serve as the No. 2 Republican in the House. If approved by the full House, she will become the highest-ranking Hispanic woman in the chamber’s history. Also, the GOP approved guidelines for its own caucus meant to slow down contests for future leadership spots. Speaking with reporters after the meeting, Corcoran discussed how the House would address one potentially ticklish area of budget negotiations under its rules. He reiterated the House would not accept any project during the budget process that has not been filed as a separate bill. The Senate does not have a similar provision in its new rules. But Corcoran said Senate members would still have to get a project filed with the House if they want it in the budget. That Senate project would not necessarily have to be approved by the House before negotiations to get into the final draft. “If they want that, then they have to come down, find one of the 120 members to file that earmark or project for them, and then it’s in play,” Corcoran said. “It’s in play all the way to the end of the session.”

The unfinished Berkman II is on the Northbank between the Plaza Condominiums and Marina at Berkman and the Shipyards property. Choate, the general contractor on the project, later received a $10.2 million judgment and lien on the property and in April 2014 secured clear title at auction for $100. Three months later, Choate was working with an Atlantabased apartment development and management firm and planned to finish the project to create more Downtown market rate rental residences, retail space and possibly workforce housing.

“They have a great plan if they can pull it off,” said council member Bill Gulliford in July 2014 after a meeting with Choate, the management firm and city economic development officials. Gulliford said Monday after learning about the rezoning legislation that he hasn’t had contact with Choate for six months. “Choate’s got a tough situation. CONTINUED FROM FRONT PAGE achieved through strengthening existing community programs, developing stronger partnerships, improving measurements and evaluations, and enhancing opportunities for citizen involvement. For example, one of the subject areas was African-American males and males of color. A suggestion is the sheriff’s office should convene meetings twice annually of existing programs that serve and mentor those populations and address questions and concerns. An expanded liaison program for a host of citizen-related boards was consistent throughout the report. And it was suggested there should be a revision to the Sheriff’s Advisory Council, commonly known as ShAdCo, and Citizen Planning Advisory Committee. No specific suggestions were provided. Another idea was there shouldn’t be any new programs created. Instead, the ones in place needed to be measured and evaluated because the group said it wasn’t clear how they all worked together and benefited the public.

Transparency

The group dealt with some of the more hot-button issues of the day like body cameras, public records and citizen review boards. As for body cameras, the task force recommends implementing them “as soon as possible.” If widespread use isn’t financially possible, a pilot program for up to 10 percent of officers should be considered and officers phased in and out of training. Williams has been working on a pilot program and said Monday the plan is still on track for spring. How public records are handled needs tweaking, the task force said. Better communication was needed with media and individuals, as well as officers who are having their files pulled. When it came to process, it was suggested the office begin charging for records at 20 minutes of time spent, rather than 30 minutes, and that a majority of the cost be collected up front.

Oversight boards were addressed, but there is a wide range of options that could be pursued. In all, 146 communities are part of the National Association of Civilian Oversight for Law Enforcement. Each has a different level of oversight — some are voluntary, some are done legislatively, some don’t cost anything, some are funded. Wayne Young, JEA government affairs director and transparency task force chair, said it would need to be determined which model fit Jacksonville. Yet, as the report noted, one is needed as “the exclusion of citizen involvement can give rise to the perception of bias and lack of accountability, real or imagined,” that erodes trust and cooperation.

Resources

The task force dealing with resources determined the agency needed to hire 400 officers — bringing the force up to about 2,000 — to cover a city the size of Jacksonville. Pay and benefits for existing members also should be increased along with steps taken to have a competitive, reliable pension plan. All that would cost an unknown amount, but the task force does have a possible funding source: A “reasonable” millage increase that would bring Jacksonville more in line with other Florida cities for funding city services. What a “reasonable” increase would be wasn’t suggested. The idea that Jacksonville “has been a city trying to get by on the cheap for a long time was mostly true,” the task force opined. And while Mayor Lenny Curry, Gov. Rick Scott and the Legislature are addressing the pensions, “more needed to be done, especially on the millage issue.” Curry has pushed back on increasing the city’s property tax levels since he campaigned for the post. The task force, led by Jim Casey, Stein Mart security director and retired special agent in charge of the FBI Jacksonville field office, also suggested more needed to be done on a salary standpoint. Starting officers in Jacksonville

made $36,240, the report said, well below peers like Tampa ($47,320), Orlando ($46,631) and Miami ($50,490). Additionally, the required education level of a bachelor’s degree for Jacksonville officers was high, leading the group to suggest officers in the city are among the highest educated but lowest paid.

Training

The task force led by Daniel Bean, Holland & Knight law firm managing partner, reviewed training in an effort to reduce injuries and fatalities on the job. It was suggested the office continue to participate in national leadership practices, where it could be part of discussions of best practices and improved awareness tactics. One tangible idea was to update the officer physical fitness course, basing it more on the types of obstacles officers face in the field. It also was suggested the office encourage additional physical fitness and wellness programs that officers could pursue in their free time. When it came to security threats, the task force said the office has an impressive track record and should continue on a path to consolidating programs and areas into one strategic oversight unit. Such an effort might require a slight increase in personnel.

What’s next?

Williams on Monday said he hadn’t seen the report, but had heard bits and pieces that had been discussed. He said his hope is the litany of recommendations would feature items the office had not thought of before. He plans in the coming weeks to “digest” the report and address “each and every single” recommendation, although he didn’t have a timetable for how long that could take. Court backs dismissal of FAMU hazing lawsuit

An appellate court Monday upheld a decision to dismiss a lawsuit stemming from an alleged hazing incident at Florida A&M University. Former student Aisha Sylvain filed the lawsuit after being suspended for involvement in an alleged sorority hazing incident in 2013, according to a 2014 news release from a law firm represent-

ing Sylvain. She was initially dismissed from the university for five years, but the penalty was later reduced to a two-semester suspension, said the ruling Monday from the 1st District Court of Appeal. A Leon County circuit judge dismissed the lawsuit, finding Sylvain failed to “exhaust her administrative remedies” before filing the case, Monday’s ruling said. A three-judge panel of the

appellate court backed the circuit judge’s decision. Hazing became a major issue at Florida A&M after the 2011 death of drum major Robert Champion during a hazing ritual involving university band members on a bus. Monday’s ruling in the Sylvain case came three days after the 5th District Court of Appeal upheld convictions of a former band member in Champion’s death.

While pointing out increases in state funding over the past halfdozen years, Scott called on the trustees to improve performance on issues like graduation rates and job placement, while emphasizing universities can do a better job of controlling costs. “Here’s my attitude, I don’t understand why we’re not No. 1,” Scott told the trustees during the meeting at the governor’s mansion. “I was never in a business where I said I’m fine with being No. 10, No. 15. Why wouldn’t we be No 1?” Echoing comments he made to university trustees at a Florida Board of Governors’ meeting in Boca Raton this month, Scott said he will evaluate how the schools meet some of the initiatives he has outlined, including graduating more students in four years, placing students in higher-paying jobs and keeping tuition low. Scott, a former health-care company executive, also re-emphasized the need to reduce costs at the 12 universities. “I really believe the cost is ridiculous,” Scott said. “The money these schools have been getting is skyrocketing. It’s not a little bit. It’s a lot of money.” Among other issues, Scott said he will scrutinize how Florida State University and the University of Florida, which received $25 million each in “pre-eminence” money in the new academic year, are using that funding to rise in the ranking of national public universities. All of the universities have a large portion of their new funding tied to a performance-measurement system, which ranks the schools on metrics like job placement, wages of graduates, retention rates and whether students are taking “excess” classes. In the current academic year, the state distributed $500 million in performance funding to the 12 schools, with three schools — the University of North Florida, the University of West Florida and New College of Florida — missing out on some of the funding because they finished at the bottom of the rankings. improvements could be made. Tom Kuntz, chairman of the Florida Board of Governors, which oversees the entire system, said the meeting was a unique opportunity for the trustees to “sit down and do some work” with the governor on the higher education improvements. Many of the chairs said they are using and incorporating the performance standards in various areas of their schools, including evaluations of the university presidents. Ed Burr, chairman of Florida State University’s board, said over time the performance standards have “created a culture” at the schools based on metrics and other performance standards. “That is becoming pervasive throughout our schools,” Burr said, saying it has been embraced by administrators and “more slowly by faculty.” Kuntz said he expects the metrics to constantly evolve, noting the Board of Governors has just revised a metric designed to evaluate the “cost” of obtaining a degree at each school. He said some schools like the revision and others have concerns. “If these (measurements) ever just stop and never change, I think we will have a failed system,” Kuntz said. He said the measurements should not be changed radically on a year-to-year basis but that ongoing revisions are expected. “What should we change? What’s a better way to do it? And then adopt those over time,” he said. “Twenty years from now I would suggest it will look nothing like it does today.” But Kuntz also said there is still some resistance among the universities to using the measurement system to punish schools based on their performances. “I would say at this point one of the biggest obstacles to overcome still is I hear a lot of conversation of, ‘Yeah, but why is there going to be somebody at the bottom who gets less than somebody else?’ “ Kuntz said. Kuntz said some critics argue the schools should be measured against the performance standards but not be financially penalized. But Kuntz, a former banking executive, said “that’s just the way the world works.” “Somebody who has performed the best should get more, whether you are measuring against each other or measuring against a different group,” Kuntz said. Burr said the universities are adjusting to the system. “Hold us accountable and reward us if we do well,” he said.
