CSX could bring 550 workers Downtown

The company is consolidating its operations and seeking to shift at least 550 employees from its Southpoint facilities to a Southside or Downtown site.

The location would provide a “safe, comfortable accessible workplace that promotes collaboration in the best, most cost-effective facilities available,” said CSX spokeswoman Melanie Cost in a statement emailed late Monday. If “all else were equal,” she said, that would mean bringing those employees to about 120,000 square feet of vacant space on the Northbank of the St. Johns River. Cost said the employees work

in the company’s finance, technology, labor relations and corporate real estate organizations. According to a city report, the Downtown Investment Authority could offer a grant of more than $271,000 a year for five to seven years from its Northbank Tax Increment Financing Fund to the landlord CSX selects. The incentives would have a $1.9 million maximum indebtedness to the Northbank Commu-

nity Redevelopment Area, which operates the fund. Such a deal would be contingent on CSX relocating a minimum of 550 employees Downtown and the company would have to provide written notice that it wouldn’t seek other city incentives for the move. “They are sincere about looking Downtown,” DIA CEO Aundra Wallace said Tuesday morning. The Jacksonville Port Authority’s new 100-gauge cranes are now operating at Blount Island Marine Terminal. The state-of-theart electric cranes are equipped to service the wider, post-Panamax vessels calling on the port through the expanded Panama and Suez canals, according to a news release. Each of the three cranes can lift up to 65 tons and reach 22 containers across a ship’s deck. On Friday, stevedores used two of the three cranes to move containers from Maersk Line’s Sea-Land Comet. JaxPort spent $37.9 million on the purchase and installation of the cranes, the news release said, including a $15 million grant from the Florida Department of Transportation. The port wants 10 of the cranes within the next decade.

GEM Products buys land in Flagler Center Ownership of Orange Park-based GEM Products Inc. bought property Wednesday in Flagler Center, where the marine hardware supplier has submitted plans for a new facility. President and CEO Matthew Bridgewater said in late November that GEM would move its primary operations to the new facility, which it hopes to complete by the end of 2017. It also intends to keep its current facility for now. He had no comment Monday. Owners, through EmBee Industries LLC, paid almost $1.7 million for the property from FDG Flagler Center Land LLC. Compass Bank issued a $1.1 million loan. The address is 12770 Flagler Center Blvd. The company filed plans with the city in November for an almost 71,000-square-

If offering the Shipyards property on East Bay Street for redevelopment was a good idea in 2015, expanding the offer to include the city’s riverfront property from the west boundary of the Shipyards all the way to the west property line of WJCT may be an even better idea. The Downtown Investment Authority board of directors will consider Wednesday a resolution to do just that based on a request from the mayor’s office. The resolution also would close negotiations authorized in 2015 with Jacksonville Jaguars owner Shad Khan’s Iguana Investments Florida LLC. Khan’s firm won the right to negotiate redevelopment of the Shipyards property when its plan was selected best of three proposals submitted. Iguana’s proposal included up to 600 apartments and/or condominiums with a marina, a hotel, commercial office and retail space and community football fields. The project was an estimated private investment of $428 million to $663 million. Boylan Soon after Iguana was selected for the project, questions were raised about the city’s financial contribution to the plan, such as improvements to East Bay Street to accommodate the development, and the environmental mitigation that might be required before construction could begin. The Lexington Hotel & Conference Center on the Downtown Southbank continues its renovations, focusing next on more rooms and the main lobby and atrium along with the pre-function area, ballroom and meeting room finishes on the first floor. The city is reviewing a permit for that $890,000 fourth phase of work at the riverfront hotel at 1515 Prudential Drive. By early 2017, Vantage Hospitality Group has said it intends to complete the estimated $21 million renovation to the five-story, 323-room hotel that was built 35 years ago. Through LexDevCoJax LLC, Vantage bought the hotel in June 2015 for $9 million and started a top-to-bottom, inside-and-out upgrade. Brown Nester – Florida LLC, an affiliate of Coral Springs-based Vantage Hospitality, is the development and construction company for the renovations. Phoenix Building Corp. SE of Stuart is the contractor. The hotel remains open during the renovation. New décor is in greens, blues, grays and earth and wood tones and finishes, all tied into the hotel’s nautical theme. The structure was built in 1981 as a Sheraton and has operated as a Radisson and more recently, a Wyndham. It was foreclosed and bank-owned when Vantage Hospitality bought it. Adecco Group to lease in Deerwood South

Adecco Group North America is leaving the CIT building in Deerwood Park, where its lease expires in the first quarter, for the entire third floor at Building 400 in the Deerwood South office park at 10151 Deerwood Park Blvd. It’s a half-mile relocation. Senior Vice President Tyra Tutor said Adecco Group will expand from 23,000 square feet in the CIT building into 29,000 square feet in Deerwood South. She said 140 employees will move. The new lease brings more Adecco Group associates into Deerwood South, where it already leases about 103,000 square feet in Building 200. That’s where most of the headquarters staff operates. The city is reviewing a permit application for Dav-Lin Interior Contractors to renovate more than 25,000 square feet in Building 400 for Adecco Group at a cost of $450,000. Blo Blow Dry Bar to open in Hurst Plaza

The Blo Blow Dry Bar chain plans to open a salon in Hurst Plaza at 9210 San Jose Blvd., No. 4. It will occupy 1,161 square feet, according to plans filed with a building permit application. The website says the location is coming soon. The salon doesn’t cut or color — it washes and styles hair “into runway ready locks in no time,” says the blomedry.com site. The Downtown Investment Authority is considering recommending that riverfront property owned by the city from Catherine Street on the west to WJCT’s building on the east be offered for proposals from developers. been approved by the state, so no final determination of environmental issues or a plan for mitigation is available. Assuming the board approves the resolution, a notice of disposition for city-owned riverfront property would be advertised for at least 30 days by the Procurement Department. Responses will be evaluated by a committee comprising a DIA board member and representatives of the mayor’s office. The committee will select one proposal, based on the respondent’s vision for future use of the site; conceptual design; financial offer, capacity and strategy; and experience and expertise of the development team. At that point, the board will consider a resolution to select the winning bidder and again authorize Wallace to negotiate an agreement. The board will then approve the terms of the agreement before the Office of General Counsel drafts a redevelopment agreement and legislation for the project to be sent to City Council. Beyond the west edge of the property is the Berkman Plaza II condominium project that was abandoned in December 2007 when the parking garage under construction collapsed, killing one worker. The property was later purchased at a foreclosure auction by the general contractor on the project. It is under consideration for rezoning from Planned Unit Development to Commercial General, possibly to make way for its completion as a riverfront hotel. Beyond the east edge of the property proposed for redevelopment is the building where the WJCT offices and studios are located. In between is Kids Kampus and Metropolitan Park. Michael Boylan, WJCT President and CEO, said Monday that when Daily’s Place opens, he expects events there will generate more parking revenue for the station than events at Metropolitan Park.

That’s because the city limits ticketed events at Metropolitan Park to no more than 12 each year, but no limitation will be in effect for the amphitheater adjacent to the stadium. “Our parking is closer to Daily’s Place than Metropolitan Park,” he said. Workers’ comp rate hike continues

Next step over Sunshine Law issues set for February hearing By Jim Saunders The News Service of Florida A state appeals court Monday said an increase in workers’ compensation insurance rates will continue amid a legal battle about whether Florida’s Sunshine Law was violated during the ratemaking process. The 1st District Court of Appeal approved a stay of a Nov. 23 ruling in which Leon County Circuit Judge Karen Gievers said the 14.5 percent rate increase should be rejected because of Sunshine Law violations. The stay will remain in place while the appeals court considers appeals of Gievers’ Sunshine Law ruling. With businesses gradually getting hit with the rate hikes starting Dec. 1, the appeals court said it will consider the appeal on an “expedited” basis. But it appears a ruling on the appeal will not come until February at the earliest, as the court set a Feb. 2 deadline for filing

final briefs. The state Office of Insurance Regulation and the National Council on Compensation Insurance, an organization that files rate proposals for workers’ compensation insurers, appealed Gievers’ ruling. The appeals court approved a temporary stay that allowed the rate hikes to take effect Dec. 1 and then followed up in Monday’s order to keep the stay in place. A three-judge panel, made up of Chief Judge Clay Roberts and judges Brad Thomas and Lori Rowe, did not explain their reasoning for approving the stay. In the Nov. 23 ruling, Gievers said, in part, that the National Council on Compensation Insurance, commonly known as NCCI, did not comply with legal requirements about holding public meetings during its deliberations on the hike. Also, she wrote the organization held improper closed-door meetings with staff members of the Florida Office of Insurance Regulation.

James F. Fee Jr., a Miami attorney who represents injured workers, filed the lawsuit Aug. 10, as insurance regulators were considering an NCCI proposal to raise rates by 19.6 percent. The Office of Insurance Regulation later required the proposal be scaled back and the 14.5 percent hike was approved in October. NCCI issued a statement late Monday saying it was pleased with the appeals court’s decision to extend the stay while considering the Sunshine Law issues. “We continue to believe that NCCI, (Insurance Commissioner David) Altmaier, and the Office of Insurance Regulation have fully complied with the law,” NCCI said in the statement. “NCCI looks forward to presenting its case to the appellate court.” The rate hike stems largely from two Florida Supreme Court rulings this year that found parts of the workers’ compensation system unconstitutional. The most-prominent ruling rejected strict

limits on fees that can be paid to attorneys who represent injured workers. The rulings and the rate hike are expected to lead to workers’ compensation insurance being one of the biggest issues of the 2017 legislative session. A key battleground will be attorneys’ fees, with business groups arguing that fees drive up insurance costs. Meanwhile, attorneys for injured workers blame the insurance industry for higher rates. Bill Herrle, executive director of the small-business group NFIB/Florida, said in a text Monday night that the appeals court’s decision on the stay clears the way for the broader legislative debate on the workers’ compensation system. “Now we can get on with fixing the workers’ compensation crisis, and it looks like the trial lawyers can’t keep hidden from legislators the data from OIR and NCCI that shows just how outrageous attorneys’ fees are,” Herrle said.

Although Florida’s production of graduate degrees has stalled in the past few years, Senate President Joe Negron said Monday he wants to enhance the state’s graduate and professional schools as part of a plan to improve the quality of the state’s higher-education system. Negron, R-Stuart, who wants to boost university system funding by $1 billion over the next two years, said one of the quickest ways to elevate the system is to enhance “our graduate programs, particularly law, business and medicine.” “I would expect that we want to set aside some money specifically designed to make those schools even more prominent than they already are,” he said. “And the good news is we’ve got a lot of great law schools, medical schools and business schools in Florida.” As Negron made his remarks, Marshall Criser III, chancellor of Florida’s state university system, told the Senate Education Committee the production of master’s degrees, research doctorates and professional degrees has been “flat” across the 12 state universities. Graduate degrees rose from 22,136 degrees in the 2012-13 academic year to 22,654 degrees in 2014-15, an increase of less than 2.5 percent, according to data from the university system’s Board of Governors. Medical degrees rose by 39 percent to 581 degrees while law degrees dropped 13 percent to 864 in that time frame. Florida’s graduate degree production was third in the nation

In the longer term, Florida’s graduate programs have grown based on enrollment. Over the last decade, students enrolled in research doctoral programs or professional programs were up by 41 percent, while master’s degree programs were up by 21 percent. “Some of that may have been the function of the recession, when some people decided to stay in (school) and go for that next degree,” Criser said. “We’ve seen a fairly flat level of graduate degree production in the last three years.” Criser said his staff was “diving deeper” to understand those trends. In fact, 60 percent of the graduate degrees awarded in 2014-15 were in the emphasized programs, including 5,195 STEM degrees and 4,816 in health fields. “These are the areas where we believe Florida needs more graduates to fill the workforce demands that we have,” Criser said. He said the growth in those degrees has been “significant” as universities have emphasized that message and students have responded. “They have in turn gotten the bug to pursue some of these things,” he said. Over the last decade, healthcare graduate and professional degrees are up 87 percent, business management and marketing is up 41 percent and engineering is up 48 percent, according to Criser’s report.

The U.S. Supreme Court on Monday refused to take up a Death Row inmate’s appeal in the 4-decade-old murder of an Orlando car salesman — but Justice Stephen Breyer used the case to raise broader questions about the death penalty. Breyer, who wrote a dissenting opinion in the case of Death Row inmate Henry Sireci, has called in the past for reconsidering the constitutionality of the death penalty. But his pointed comments Monday came as Florida’s death penalty has been on hold for nearly a year because court rulings found parts of state law unconstitutional. Breyer focused his dissent, in part, on the length of time since Sireci was first sentenced to death in 1976 and whether that violates the constitutional ban on cruel and unusual punishment. “He has lived in prison under threat of execution for 40 years,” Breyer wrote. “When he was first sentenced to death, the Berlin Wall stood firmly in place. Saigon had just fallen. Few Americans knew of the personal computer or the internet. And over half of all Americans now alive had not yet been born.” Sireci, now 68, was sentenced to death in the murder of usedcar dealer Howard Poteet, who suffered 55 stab wounds, according to a brief filed by Attorney General Pam Bondi’s office. A death warrant was issued for Sireci’s execution in 1986, but an

Breyer appeal led to a new sentencing hearing. Sireci was again sentenced to death, but a series of state and federal appeals have played out over more than two decades. In the appeal before the Supreme Court on Monday, the issues focused on a crime-lab analyst’s testimony about a hair that was found on one of the victim’s socks and linked to Sireci. His attorneys challenged the testimony and argued that DNA testing should be conducted. But Bondi’s office asked the Supreme Court to turn down the appeal, arguing that “upon any reasonable interpretation of the facts of this case, the result of the trial would not be different absent the challenged forensic testimony.” The Supreme Court, as is common, did not detail its reasons Monday for declining to take up Sireci’s appeal.
