Shoppers experiencing serious holiday traffic at the St. Johns Town Center should cherish the memory. Next year, there could be much more. Site work and some construction are underway at the Town Center Promenade and The Strand and The Crossing at Town Center, totaling 75 acres, for dozens of new stores and restaurants along with apartments and hotels. The target date for many to open is in time for next year’s holiday shopping season, which means more drivers will vie for space on the roads, especially at Gate and Town Center parkways. The new properties line Town Center Parkway across from The Markets at Town Center and St. Johns Town Center, which are north of Butler Boulevard and west of Interstate 295. To enter the new developments, drivers will take the main road system –– Gate and Town Center parkways –– although once they exit into the projects, they can use the internal network. But there is some help on the way. Preferred Growth Properties, the developer of The Strand and The Crossing, is making $2.5 million in traffic improvements at Gate and Town Center parkways, including adding turn lanes, access points and a trail for pedestrians, runners and bicyclists. District City Council member Scott Wilson said Wednesday those improvements are in design, plus construction on the roads can’t take place during the holiday season. By next year this time, Wilson hopes there will be improvements. “But they have serious problems with traffic there, no matter what,” he said, noting the number of retail stores in a small area. Wilson said it’s up to the city and state to address those issues.

Judge won’t reconsider tribe gambling ruling

A federal judge has refused a request from Gov. Rick Scott’s administration to reconsider a ruling that Florida violated a gambling agreement with the Seminole Tribe. U.S. District Judge Robert Hinkle issued an order Tuesday, less than a week after attorneys for Scott and the Department of Business and Professional Regulation submitted a 33-page document requesting changes in Hinkle’s Nov. 9 ruling in favor of the tribe. “This case was tried to the court. A written opinion set out the court’s findings of fact and conclusions of law. The defendant has moved to alter or amend the judgment,” Hinkle wrote in the order. “For the most part, the motion simply reargues the merits,” Hinkle continued. “The original opinion correctly analyzes the issues. This order denies the motion to alter or amend.” The November ruling and Tuesday’s order were part of a legal battle about blackjack and other

types of games at Seminole casinos and what are known as “designated player games” at pari-mutuel facilities regulated by the state. In siding with the tribe in November, Hinkle ruled designated-player games at pari-mutuels violate a 2010 agreement that gave the tribe exclusive rights to operate “banked” card games, such as blackjack, in exchange for paying $1 billion to the state. A five-year agreement dealing with the banked card games — part of a larger, 20-year deal called a “compact” — expired in 2015, prompting the Seminoles to file the lawsuit. The state, meanwhile, filed a separate lawsuit asking the judge to order the tribe to shut down blackjack and other banked games, which the Seminoles have continued to operate. Hinkle agreed with the Seminoles that the state-authorized designated player games, also known as “player-banked” games, triggered an exception to the fiveyear agreement. He ordered the tribe be allowed to continue to conduct the banked

games for the remainder of the overall compact’s 20-year term. In the request for reconsideration, attorneys for the state raised a series of issues about Hinkle’s November ruling, including disputing his conclusion that “designated player games” meet the definition of banked card games and, as a result, violate the 2010 compact. But attorneys for the tribe countered Friday by urging Hinkle to reject the state’s request for reconsideration. “The court found that the designated player games are ‘banked card games’ based upon reasonable interpretations of (federal and state laws), common understanding of the term in the gaming industry, testimony of both expert and lay witnesses, and legislative history,” the tribe’s attorneys wrote. “The state ignores virtually all of that evidence, disregards the court’s reasoning, and presents its argument as though there had been no comprehensive briefing on the relevant issues and no trial,” the attorneys added.

A measure that would expand how and where Florida’s more than 1.67 million concealed weapons license holders can carry handguns may have an easier path through the Senate in 2017 than in the past. Senate President Joe Negron, R-Stuart, this week sent the bill (SB 140) to three committees, two of which are led by prominent gun-rights supporters. The bill would need to make it through the committees before it could be considered by the full Senate during the 2017 legislative session, which starts in March. “I’ve always been a strong proponent of the Second Amendment rights of law-abiding citizens,” Negron said Tuesday before he assigned the bill to committees. The bill, sponsored by Senate Judiciary Chairman Greg Steube, R-Sarasota, would allow people with concealed weapons licenses to openly carry handguns in public and to be armed on college and

university campuses. They also could carry guns at airport passenger terminals, in elementary and secondary schools and at legislative and local government meetings. Negron assigned the measure to the Steube-led Judiciary Committee and to the Governmental Oversight and Accountability Committee, which is chaired by Ocala Republican Dennis Baxley, who in 2005 sponsored the House version of the state’s “stand-yourground” self-defense law. The Senate president Tuesday also assigned the bill to the Rules Committee, which is led by Fort Myers Republican Lizbeth Benacquisto. While not as prominent as Steube and Baxley on gun-related issues, Benacquisto in 2016 voted during a Higher Education Committee meeting in favor of allowing concealed weapons license holders to carry guns on college and university campuses. National Rifle Association lobbyist Marion Hammer praised Negron when asked about the

committee assignments for the bill. “It is my hope that Senate members will have an opportunity to vote on this bill,” Hammer said Wednesday in an email. During the 2016 session, opencarry and campus-carry measures failed to advance through the Senate Judiciary Committee, which was chaired by former Sen. Miguel Diaz de la Portilla, R-Miami. Diaz de la Portilla lost a re-election bid in November. Parts of Steube’s proposal appear in separate measures that have been filed in the House for the 2017 session. Rep. Scott Plakon, R-Longwood, introduced a House version of the campus-carry measure (HB 6005). Also, Rep. Jake Raburn, R-Lithia, has proposed a bill (HB 6001) that would allow people with concealed weapons licenses to bring guns into the passenger terminals of airports. The House overwhelmingly approved campus-carry and open-carry bills during the 2016 session.

Major emergence

The Crossing, Strand and Promenade emerged this year as members of the Skinner family sold property. The family also owned the St. Johns Town Center property and land around it. Core Property Capital of Atlanta bought 69 acres along Town Center Parkway in January, across from St. Johns Town Center. Its northern end is at Brightman Boulevard. About 30 acres are being developed as Town Center Promenade. Preferred Growth Properties, the real estate subsidiary of Birmingham, Ala.-based Books-AMillion, bought about 61 acres in March at Gate and Town Center parkways, just south of the Promenade land. About 45 acres can be developed. The main tract, The Strand, is east of Gate Parkway and runs north and west along Town Center Parkway.

A smaller tract, The Crossing, is west of Gate Parkway. While two of the retail tenants will be relocating from the Town Center area, many of the names are new to the area while some are additional locations. And more are coming. For example, about 20 smaller tenant spaces are available at The Strand. Here’s what has been revealed at this point.

Crossing at Town Center

So far, the Crossing includes plans for a Wawa gas station and convenience store, Goo-Goo 3 Minute Express Wash, ABC Fine Wine & Spirits and PDQ, a restaurant that sells chicken tenders, sandwiches and salads. ABC and PDQ have a Jacksonville presence, while Wawa and Goo-Goo are new. There is land for more projects.

Strand at Town Center

The Strand will feature two retailers that are relocating across the street. Best Buy is moving from The Markets at Town Center while Chase Bank is relocating from the St. Johns Town Center. New there to the market will be four restaurants: Fogo de Chao Brazilian Steakhouse, Chuy’s, Cheddar’s Scratch Kitchen and Firebirds Wood Fired Grill. Moe’s Southwest Grill, with a local presence already, also will open there. PGA Tour Superstore and 2nd & Charles, a Books-A-Million company, will be new to the market. Hobby Lobby and TD Ameritrade are already in the market but plan locations there. The 160-room Hyatt Place hotel and the 306-unit Ravella at Town Center Apartment Homes also will join The Strand. Lots more retail space is available.

Town Center Promenade

At least three new restaurants are planning locations at Promenade –– Red Robin Gourmet Burgers and Brews, Texas de Brazil Churrascaria Brazilian Steakhouse and Piada Italian Street Food. Texas Roadhouse, Newk’s Eatery, Freddy’s Frozen Custard & Steakburgers, Taco Bell and Starbucks will expand their market presence there. Aldi will open a grocery store in the Promenade, right across the street from Publix at the Town Center, while Mattress Firm and Aspen Dental also will lease space. “We won’t be able to hold the Town Center or the others accountable for that. That’s something we have to fix on our own,” he said. More relief might be down the road. Wilson said some state funds will be freed up as the city uses $7 million in Jacksonville International Airport Community Redevelopment Area funds for traffic improvements at the I-95 and Airport Road interchange. That would mean five other projects would be fully funded in the Florida Department of Transportation’s five-year work plan, including improvements to the Butler Boulevard and Gate Parkway interchange. That interchange now sometimes suffers major backups from St. Johns Town Center traffic. Wilson also said at the request of the city, the North Florida Transportation Planning Organization is funding a study to suggest improvements in the Town Center area. The TPO’s Unified Planning Work Program for 2016-17 through 2017-18 shows a traffic study for the St. Johns Town Center, Deerwood Park and Belfort Road areas. Tasks include recommending short-, mid- and long-term improvements, such as transportation demand management strategies and intersection improvements. The report is due for completion in June. Still, it likely will be a busier time next year on the roads, especially since visitors might want to try out many of the newto-town stores, restaurants and hotels at The Strand, Crossing and Promenade. More residents will be using the roads, too, from the two planned apartment communities that total almost 600 units.

TrailMark, a new community near World Golf Village in St. Johns County, is offering a full slate of amenities, including a welcome center and amenities center. were prior to the economic downturn in 2008, “buyers today are more discerning,” Parker said in a later interview. In a buildup to the bust, many buyers didn’t even care so much where a community was located, “the market was so hot, people were just buying and flipping,” he said. Now people are looking for a place where they can connect with their neighbors and with nature, said TrailMark developer Ed Burr, president and CEO of GreenPointe Holdings. His company offers homes there in five price points to appeal to a broad market. “One of the attractions of Florida is its healthy outdoor environment,” he said, adding people at all financial levels “demand that lifestyle.” ICI Homes, the developer and sole builder of Tamaya, is closing out the first phase of the gated community on Beach Boulevard, not far from Mayo Clinic. It is attracting medical and other professionals who are looking to live “literally between the city and the sea,” said Rosy Messina, vice president of marketing and online sales. Most are families and the huge Residents Club — slated to be completed early next year — is designed to give every member of the family what they are looking for. With a ballroom, outdoor cafe, tennis courts, basketball, and a giant pool slide, “it’s like a theme

park,” Messina said. “The second phase is selling very fast.” ICI Homes has developed many communities in the past, and is creating one in Nassau County: Amelia National in Fernandina Beach. It has about 900 lots, of which about 40 percent are sold. About half the buyers are coming from outside Florida, so it has more of a resort-style feel. Tamaya, however, is mostly attracting buyers who live in the area, Messina said. With an Old World European, Tuscan-inspired design, it features smaller lots than the company has offered in the past, ranging from 50 to 85 feet. The homes are customized, “because when people come to us they know exactly what they want,” Messina said. They expect hardwood floors, kitchen islands, open designs, great rooms and digital wiring, “so we give it to them,” she added. The smaller lot sizes help keep costs down, because land has become more expensive. Now, as the economy and real estate market continue to recover, “people are more careful with their finances,” Messina said. They want to do other things with their money besides spend it on a house. And they want to spend more time outdoors, which is why many of the homes come with backyard fire pits, waterfalls and summer kitchens. Outdoor living is built into the 630 acres of Beacon Lake,
